Wilson, City Manager PREPARED BY: Patrick McIntosh, Fire Chief SUBJECT: Adopt Resolution No. 2015-09 Reauthorizing Establishment of a Used Oil and Used Oil Filter Collection Proqram Statement of Issue: The City Council is requested to adopt a resolution reauthorizing the establishment of a used oil and used oil filter collection program. Financial Impact: If approved, approximately $55,000 in annual funding would be provided by the California Department of Resources, Recycling and Recovery (CalRecycle) Used Oil Payment Program. The funding level is determined on a per capita basis using State Department of Finance population estimates. Recommended Action: Adopt Resolution No. 2015-09, "A Resolution of the City Council of the City of Huntington Beach Authorizing Submittal of a Used Oil Payment Program Application and Related Authorizations." Alternative Action(s): Do not approve the attached resolution and direct staff to pursue an alternate strategy for the establishment of a used oil collection program. Analysis: The City of Huntington Beach, through the Fire Department, has operated a grant -funded used oil and used oil filter recycling program for over 18 years. The Used Oil Payment Program (UOPP) authorized in Senate Bill 546 (Lowenthal) provides up to $11 million annually in payment to municipal governments for implementation of a local used oil and used oil filter recycling programs. Applicants are required to have a used oil and used oil filter collection program including at least one certified collection center per 100,000 residents or a curbside program that includes collection at least monthly; and a public education program that informs the public of locally available used oil recycling opportunities. The City currently uses eight used oil collection centers, a curbside program that meets State requirements, and a public education program that has been in existence for many years. The attached resolution reauthorizes City staff to submit a UOPP application to CalRecycle and authorizes the Fire Chief or his designee to execute all documents necessary to implement and secure payment under this program. HB -23- Item 3. - 2 RESOLUTION NO. 2015-09 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING SUBMITTAL OF A USED OIL PAYMENT PROGRAM APPLICATION AND RELATED AUTHORIZATIONS WHEREAS, pursuant to Public Resources Code § 48690, the Department of Resources Recycling and Recovery (CalRecycle), formerly known as the California Integrated Waste Management Board, has established the Used Oil Payment Program ("UOPP") to make payments to qualifying jurisdictions for implementation of their used oil programs; and In furtherance of this authority, CalRecycle is required to establish procedures governing the administration of the UOPP; and CalRecycle's procedures for administering the UOPP require, among other things, an Applicant's governing body to declare by resolution certain authorizations related to the administration of the UOPP, NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: 1. The City of Huntington Beach is authorized to submit a UOPP Application to CalRecycle. 2. The City's Fire Chief or his/her designee is hereby authorized to execute all documents necessary to implement and secure payment under the UOPP. 3. This authorization is effective until rescinded by signature authority of this governing body.
