SUBJECT: Adopt Resolution No 2015-57 adopting an amended Uniform Bail Schedule
for Parking Violations, Adopt Resolution No 2015-58 revising and restating
the charges for Civil Fines for Municipal Code Violations, and, Approve for
Introduction Ordinance No 4071 amending Chapter 10 of the Huntington
Beach Municipal Code (HBMC) relating to Meter Zones
Statement of Issue
At the September 8, 2015, Public Hearing on the Fiscal Year 2015/16 Proposed Budget, the City
Council directed staff to finalize recommendations to increase General Fund revenue for the fiscal
year starting October 1, 2015
Financial Impact
It is estimated that the proposed amendments to parking meter charges, Municipal Code violations
and certain parking fines will generate approximately $747,000 in General Fund revenue each year
starting with the FY 2015/16 Adopted Budget
Recommended Action
A) Adopt Resolution No 2015-57, "A Resolution of the City Council of the City of Huntington
Beach, California, Adopting an Amended Uniform Bail Schedule for Parking Violations," and,
B) Adopt Resolution No 2015-58, "A Resolution of the City Council of the City of Huntington Beach
Revising and Restating the Fee Schedule for Municipal Code Violations," and,
C) Approve for introduction Ordinance No 4071, "An Ordinance of the City of Huntington Beach
Amending Sections 10 60 010, 10 60 020 and 10 60 030 of the Huntington Beach Municipal Code
Relating to Meter Zones"

Analysis
At the Strategic Planning Retreat held July 13, 2015, the City Council created a working group with
the objective of evaluating options on how to generate additional General Fund revenue Under the
leadership of Mayor Pro Tern Katapodis, the City Manager, Police Chief, and Director of Finance
were tasked to identify potential new General Fund revenue sources Based upon City Council
direction, the working group met with Mayor Pro Tern Katapodis and presented options at the
September 8, 2015, Public Hearing to adopt the Fiscal Year 2015/16 Proposed Budget

The following revenue options and proposals were Introduced
Parking Meter Revenue — Staff conducted a review of surrounding beach cities, Including Redondo
Beach, Long Beach, Seal Beach, Newport Beach, Laguna Beach, and San Clemente and proposed
a modest Increase to the hourly parking meter charge during the summer months for meters in the
downtown business zone, downtown residential zone, bluff top parking lots, Pacific Coast Highway,
Beach Boulevard, and metered lots at Pier Plaza The proposed Increase of 25 cents per hour for
the months of May through August would Increase the hourly rate from $1 50 per hour to $1 75 per
hour and generate approximately $380,000 per year The current parking meter rates are within
the range of rates charged by other coastal communities, and the proposed summer charge of
$1 75 per hour is in keeping with rates in neighboring Newport Beach and Laguna Beach which
similar to Huntington Beach, generally have a higher concentration of visitors during the summer
months and a greater draw on City staff and resources
Parking Citation Violations — While the Uniform Ball Schedule consists of many types of violations
and fines, Staff proposes changes in two areas that relate to the fines for expired meters
(Huntington Beach Municipal Code) and parking in a handicap ramp (California Vehicle Code) The
proposed changes would Increase the expired meter fine from $48 00 to $58 00 per violation and
from $55 00 to $356 00 for parking Illegally in a handicap ramp These changes to the Uniform Ball
Schedule will generate approximately $282,000 annually Please be advised that the State
recommends a handicap ramp fine of at least $250 00 These Increased fines are also generally in-
line with neighboring cities
Civil Fines for Municipal Code Violations —The final proposed source of revenue relates to changes
in the Civil Fines for Municipal Code violations such as public Intoxication and using glass
containers on the beach The proposed general Increase for Administrative Citations will generate
approximately $85,000 in revenue per year
Staff is requesting City Council approval for these amendments to existing parking meter charges,
parking violations, and Municipal Code violations, to Increase General Fund revenue effective in
Fiscal Year 2015/16

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH, CALIFORNIA,
ADOPTING AN AMENDED UNIFORM BAIL SCHEDULE
FOR PARKING VIOLATIONS
WHEREAS, Vehicle Code section 40203.5 requires local governing bodies to establish a
schedule of parking penalties for parking violations
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
resolve as follows: Pursuant to the aforesaid authority, does hereby rescind Resolution 2011-13
and adopts the Uniform Bail Schedule for parking violations, attached hereto as Exhibit A.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH REVISING AND RESTATING THE FEE
SCHEDULE FOR CIVIL FINES FOR MUNICIPAL CODE VIOLATIONS
WHEREAS, City Council adopted a Resolution setting the civil fines, interest, and
penalties to persons who are issued Administrative Citations pursuant to Chapter 1.18 of the
Huntington Beach Municipal Code; and
Section 1 18 070 of the Municipal Code provides that the fines, interest, and penalties
shall be set by the City Council by Resolution; and
The City Council has considered this matter and has detennined to increase and set for
the specific fines, interest, and penalties for various Code violations,
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
resolve as follows:
1. The civil fines, interest and penalties and implementing provisions for violations
of the Municipal Code pursuant to Chapter 1.18 shall be those as specified in
Schedule 1, attached hereto and incorporated herein,

subject to the fines shown below. A subsequent violation is any violation where the
citee was cited one or more times in the preceding 12 months for the same violation.

2 Interest on Fines. Interest shall accrue upon all delinquent fines and penalties at the
annual late of 18 per cent This interest will be imposed and collected!according to
the discretion of the City Treasurer upon considering such factors bearing on
practicability as to the cost to compute the interest owed, the amount of interest due,
and its collectability. The purpose of granting this discretion to the Treasurer is to
not require collection of interest when it would not be cost effective.
3 Late Payment Penalties. A $25 late payment penalty shall be owed for fines not paid
within 30 days of their due date. The Treasurer shall have the same discretion over

AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING SECTIONS 10 60.010, 10.60.020 AND 10.60.030 OF THE
HUNTINGTON BEACH MUNICIPAL CODE RELATING TO METER ZONES
The City Council of the City of Huntington Beach does hereby ordain as follows:
SECTION 1. Section 10.60.010 of the Huntington Beach Municipal Code is hereby
amended to read as follows:
10.60.010 Establishment
Pursuant to Section 22508 of the California Vehicle Code,parking meter zones may be
established and determined by ordinance of the City Council and parking of vehicles within any
such zone shall be as follows:
A. Business Zones. The boundaries of the business zones shall be as follows:
1. Within Main Street right-of-way from Pacific Coast Highway to Palm Avenue,
excluding the west side of Main Street from Acacia to Palm Avenues.
2. Within Walnut Avenue right-of-way from Third to Fifth Streets.
3. Within Olive Avenue right-of-way from Third to Fifth Streets.
4. On the inland side(north side) of Pacific Coast Highway right-of-way fiom Third
to Sixth Streets.
B. Residential Zones. The boundaries of the residential zones shall be as follows
1. Within First Street right-of-way from Pacific Coast Highway to Atlanta Avenue.
2. Within Second Street right-of-way from Pacific Coast Highway to Orange
Avenue.
3 Within Third Street right-of-way from Walnut to Orange Avenues.
4 Within Walnut Avenue right-of-way from First to Third Streets
5. Within Olive Avenue right-of-way from First to Third Streets.
6. Within Fifth Street right-of-way from Pacific Coast Highway to Orange Avenue.
7. Within 22nd Street right-of-way from Pacific Coast Highway to Walnut Avenue
8. Within Walnut Avenue right-of-way from 22nd to Goldenwest Streets.
C. Recreational Zones. The boundaries of the recreational zones shall be as follows:
1. ZONE A: On the ocean side of Pacific Coast Highway right-of-way from Beach
Boulevard to Goldenwest Street.
2. ZONE B- On the inland (north) side of Pacific Coast Highway right-of-way from
Beach Boulevard to Third Street and from Sixth to Goldenwest Streets.

3 ZONE C: On the ocean side of Pacific Coast Highway, the parking lots from
Goldenwest Street to a point which is 6,100 feet north-westerly of said
Goldenwest Street.
4. ZONE D: Within the boundaries of Huntington Central Park between Gothard
and Goldenwest Streets at Huntington Central Library
5 ZONE E: Within the parking lots of the public launching ramps on Warner
Avenue.
6. ZONE F- Within Beach Boulevard right-of-way from Pacific Coast Highway to
Sunrise Street, including the Huntington Breakers complex frontage road.
7 ZONE G: Within the parking lots on the ocean side of Pacific Coast Highway
between First and Seventh Streets, commonly known as the Pier Plaza Parking
Lots
8. ZONE H: Within the boundaries of the Huntington Central Park Sports Complex
including the parking lot.
SECTION 2. Section 10.60.020 of the Huntington Beach Municipal Code is hereby
amended to read as follows:
10.60.020 Times and Coins or Payment Deposited Prescribed
The parking time allowed following deposit of such coins or payment as provided in this chapter,
the hours during which such payments are required, and the directions which shall appear on the
parking meters, shall be as follows:
A. Business Zones.
1 Within the business zone, City parking meters shall be installed to show legal
parking for a maximum of two hours. The fee for parking for one hour shall be
$1.50 from the Tuesday following Labor Day weekend through April 30", and
$1.75 per hour from May lst through Labor Day weekend with a one-week
overlap between seasons to allow for recalibration of meters as necessary.
2. Twenty-four-minute meters shall be placed within this zone in specific locations
to be determined by the Director of Community Services. Coins or payment shall
be placed in such meters from 6.00 a m. to 12.00 a.m. daily, including Saturdays,
Sundays, and holidays
B. Residential Zones.
1. Within the residential zone, 60-minute, 120-minute and 12-hour meters shall be
installed to show legal parking. The fee f61 parking for one hour shall be $1.50
fiom the Tuesday following Labor Day weekend through April 30th, and $1.75
per hour from May lst through Labor Day weekend with a one-week overlap
between seasons to allow for recalibration of meters as necessary.
2. Sixty-minute, 120-minute, and 12-hour meters shall be placed within this zone in
specific locations to be determined by the Director of Community Services.
Coins or payment shall be placed in such meters from 6.00 a m. through 12:00
a in. daily, including Saturdays, Sundays, and holidays. A fee of five dollars shall

be charged for annual visitor permits to park in residential metered zones
(maximum two permits per household).
C. Recreational Zones.
1. Within Zones A, B, C, E, and F, 12-hour meters shall be installed to show legal
parking for a period of one hour after payment of$1.50 from the Tuesday
following Labor Day weekend through April 30"', and$1.75 per hour from May
1st through Labor Day weekend with a one-week overlap between seasons to
allow for recalibration of meters as necessary
2. Within Zone D, 12-hour meters shall be installed to show legal parking for a
period of one hour after payment of$1.50.
3 Within Zone G, a Park and Pay system shall be installed to show legal parking for
a period of one hour after payment of$1.50.
4. Thirty-minute, 60-minute, 120-minute, and 12-hour meters shall be placed within
recreational zones in other specific locations to be determined by the Director of
Community Services. Coins or payment shall be placed in such meters from 6 00
a m through 12.00 a in daily, including Saturdays, Sundays, and holidays The
Director may determine that certain recreational zone parking lots may require an
earlier or later curfew for safety or other purposes.
5. Within Zone H, a Park and Pay System shall be installed to show legal packing
between the hours of 6:00 a.m. and 12:00 a.m. daily after payment of a sum set by
resolution of the City Council.
SECTION 3. Section 10 60 030 of the Huntington Beach Municipal Code is hereby
amended to read as follows:
10.60.30 Varied Meter Times
When the City Council designates the parking times allowed following payment as provided in
this chapter and more than one parking time is so designated, the Director of Community
Services cnay place the meters in such locations within the zone as he or she shall deem proper
and consistent with the intention of the City Council

10.60.010 Establishment
Pursuant to Section 22508 of the California Vehicle Code,parking meter zones may be
established and determined by ordinance of the City Council and parking of vehicles within any
such zone shall be as follows
A.Business Zones. The boundaries of the business zones shall be as follows:
1 Within Main Street right-of-way from Pacific Coast Highway to Palm Avenue,
excluding the west side of Main Street from Acacia to Palm Avenues.
2 Within Walnut Avenue right-of-way from Third to Fifth Streets.
3 Within Olive Avenue right-of-way from Third to Fifth Streets.
4 On the inland side(north side) of Pacific Coast Highway right-of-way from Third
to Sixth Streets.
5 Withinthe City a par-king 1e4 bordered by> t f4 et.eet to the west 1
B Residential Zones The boundaries of the residential zones shall be as follows:
1 Within First Street right-of-way from Pacific Coast Highway to Atlanta Avenue

10.60.020 Times and Coins Deposited Prescribed
The parking time allowed following deposit of such coins as provided in this chapter,the hours
during which such deposits are required, and the directions which shall appear on the parking
meters, shall be as follows
A Business Zones.
1. Within the business zone, City parking meters shall be installed to show legal
parking for a maximum of two hours.The fee for parking for one hour shall be+s
$1.50 from the Tuesday following Labor Day weekend through April 3e and $1 75
per hour from May 1�`through Labor Dav weekend with a one-week overlap between
seasons to allow for recalibration of meters as necessary.
2. Twenty-four-mmute meters shall be placed within this zone in specific locations
to be determined by the Director of Community Services. Coins or Payment shall be
placed in such meters from 6 00 a in.to 12.00 a in daily, including Saturdays,
Sundays,and holidays.
B Residential Zones.
1 Within the residential zone, -min to 120-minute and 12-hour meters shall be
installed to show legal parking
eeins The fee for parking for one hour shall be$1 50 from the Tuesday following

annual visitor permits to park in residential metered zones(maximum two permits per
household)
C Recreational Zones.
1. Within Zones A,B, C,E F-,and GE, 12-hour meters shall be installed to show
legal parking for a period of one hour after depesrtpaymen of sw 25 een4 eetfis $ 50
from the Tuesday following Labor Day weekend through Apnl 30d' and$1 75 per

may determine that certain recreational zone parking lots may require an earlier or
later curfew for safety or other purposes
65 Within Zone 411, a Park and Pay System shall be installed to show legal parking
between the hours of 6.00 am. and fni"t a m. daily, after depest a n of

10A0,030 Varied Meter Times
When the City Council designates the parking times allowed following depesit payment ef sue
