The Public Works Department and City Clerk's Office request fee updates. As development related fees are effective 60 days after adoption, and miscellaneous fees are effective immediately, two resolutions have been prepared. Funding Source: No funding is required. Minor adjustments to General Fund revenue are possible and discussed in the analysis. Recommended Action: Motion to- 1. This action will result in retaining the existing fee schedule. -7 REQUEST FOR ACTION MEETING DATE: 8/7/2006 DEPARTMENT ID NUMBER:PW 06-052 Analysis: The citywide fee schedule was adopted on November 21, 2005. At that time, the utility companies objected to the proposed utility encroachment fee. Direction was given for staff to negotiate an appropriate fee with the utility companies. A revised encroachment fee of $140 has been agreed upon. The fee does not include inspection time, but fully recovers the costs of permit issuance, record keeping and billing. An annual permit is also available at the utility company's option. The annual permit covers all emergency repairs and maintenance work during a one-year period. New service installations will continue to require individual encroachment permits. The fee for working in the public right-of-way without a permit has been increased to fully recover costs, however, at this time does not assess punitive charges. The rate for stockpiling of construction materials in the public right-of-way corrects a previous typographical error. Adjustments are proposed for non-development related fees for both the Public Works Department and the City Clerk's Office. Public Works fees include modifications to storage bin and recycling bin fees. The cost of temporary parking permits in residential permit districts has been calculated per sign, rather than a flat fee. Transportation permits are regulated by the State of California and the City imposes the State fee. This relationship is documented in the resolution. The Public Works overhead rate of 60% was established through the PRM, Inc. Cost Recovery Study, July 2005, but was not included in the previous fee resolution. All cost recovery fees were calculated per the PRM methodology. Revenue estimates for the utility encroachment permits are difficult due to the variable nature of the work. The new rate is approximately $36 less than current, however, offers full cost recovery due to the reduction in overhead cost percentage. Annual revenue from this source is generally $150,000. A revenue decrease of approximately $5,000 is possible. Other proposed fees are infrequent occurrences and will have a minimal impact on revenue, $1,000 or less annually. The City Clerk is proposing a reduction in fees for duplicating electronic media in video and audio tape form in accordance with California Public Records Act guidelines that direct "copy costs are limited to statutory fees set by the Legislature (not by local ordinance) or the direct cost of duplication," and is adding new fees for the cost to duplicate electronic media in the form of digital versatile disk (DVD) or compact disk (CD). The City Clerk also proposes a new, optional fee for passport photograph services offered for convenience purposes to patrons who visit the Passport Acceptance Facility. Revenue estimates for this service are undetermined, as competitive services are readily available.
