This included a program to charge for response to vehicle fires and vehicle accidents involving non-residents. Since the date that the City Council voted on the cost recovery program, I have received input from a variety of community stakeholders, including members of our local business community, tourism interests, major employers, and residents. In evaluating the comments I have received, the potential impacts that implementing the program could have on our local community and business interests and recognizing that the actual revenue received could be influenced by several variables, I would like the City Council to reconsider implementation of this program. RECOMMENDED ACTION: Reconsider the establishment of the cost recovery program for various emergency response activities involving non-residents. xc: Fred Wilson, City Administrator Paul Emery, Deputy City Administrator Bob Hall, Deputy City Administrator Joan Flynn, City Clerk Jennifer McGrath, City Attorney Patrick McIntosh, Fire Chief ld'o /d Huntington Beach fndependent his been adjudged a newspaper of general circulation in Huntington Beach ind Orange County by Deciee of the Superior Court of Orange County State of California under date of Aug 24 1994 case A50479 PROOF OF PUBLICATION STATE OF CALIFORNIA ) ) SS CITY OF COUNTY OF ORANGE ) HUNTINGTON BEACH LEGAL NOTICE ORDINANCE NO 3888 by the I am the Citizen of the United States and a Adopte Crty C oounciluncil i resident of the County aforesaid I am over on AUGUST EOF AN ORDINAA NCE OF OF the age of eighteen years and not a party T B HUNTINGTON NGTO BEACH TERS 43 to or interested in the below entitled matter ADDITHEMUNG MUNICIPAL OF THE MUNICIPAL CODE RELATING TO I am a principal clerk of the HUNTINGTON COSTS OF EMERGENCY BEACH INDEPENDENT a newspaper of RESPONSE SYNOPSIS THE ADDED CHAPTER general circulation, printed and published in 843 OF THE MUNICIPAL CODE CONCERNS FEES ) the City of Huntington Beach, County of AND COSTS FOR SER I VICES PROVIDED BY Orange, State of California, and the THE BEACH HUN HUNTINGTON attached Notice is a true and complete copy MENT T PFO TIDES STRUCTU REIM as was printed and published on the BURSEMENT F DE PARTMENT EO following date(s) T U R E S F O R EMERGENCY SERVICES THROUGH COST RECOV ERY IT ALSO ALLOWS THE DEPARTMENT TO INITIATE COST RECOV EERY CLAIMS AND PRO VIDES THAT ADDITIONAL FEES MAY BEMPLE MENTED FROM TIME TO Au ust 26 2010 TIME AS APPROVED BY g THE CITY COUNCIL (PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular' 1eeting held August 16 10 by the foilowmgi roil call vote AYES Carchio Coerper Hard I declare under penalty of perjury that the Hansen Green Bohr fore goingis true ana correct NOES None ABSTAIN None ABSENT Dwyer THE FULL TEXT OF THE ORDINANCE IS AVAIL ABLE IN THE CITY Executed on August 27 2010 CLERK rOFFICE g This ordinance is of at Costa Mesa, California adop T on o days after P CITY OF HUNTINGTOI BEACH 2000 MAIN STREET zw HUNTINGTON BEACH CA 92648 714 536 5227 111J;MZ1OAN I. FOR COUNCIL ACTION MEETING DATE 8/2/2010 DEPARTMENT ID NUMBER FD10 009 Analysis The attached ordinance (Attachment 1) would add Section 8 43 to the City of Huntington Beach Municipal Code This section concerns fees and costs for services provided by the Huntington Beach Fire Department It provides a structure for reimbursement of department expenditures for emergency services through cost recovery The ordinance will allow the department to initiate cost recovery claims In addition the attached resolution (Attachment 3) establishes motor vehicle accident vehicle fire pipeline and power line incident fees for cost recovery claims that are to be charged by the department These fees are based on customary and reasonable rates recognized by the insurance industry The ordinance also provides that additional fees may be implemented from time to time as approved by the City Council Over 16 million people visit Huntington Beach each year, and this impacts the emergency services provided to the community The service demand by non-residents stresses the system and requires additional staffing to support the increased call volume Residents pay property taxes which partially fund the emergency medical service provided by the Huntington Beach Fire Department However non-residents do not pay property taxes yet compel the department to maintain an emergency services system that is available and quick to respond A growing number of fire departments have recognized that a significant number of their emergency responses to vehicle accidents involve an at-fault driver that is not a resident of their community In response they have established fee structures to recover expenditures for a portion of the cost of their emergency responses These emergency response fees are recognized by automobile insurance policies All persons operating motor vehicles are required to maintain insurance coverage Therefore it is reasonable to believe that most cost recovery claims will be paid through the at-fault drivers automobile insurance coverage Huntington Beach has a major interstate freeway and several major roads that increase the number of non-resident drivers traveling through the area Annually it is estimated that there are over 300 motor vehicle accidents in Huntington Beach caused by non-residents In addition to vehicle accidents many California cities and fire districts are also setting fees to recover costs for other emergency responses such as pipeline and power line incidents These jurisdictions have used the cost recovery process to obtain reimbursement from pipeline and power companies for such emergency responses Based on past experience it is estimated that such incidents occur over 60 times per year in Huntington Beach Fire departments have experienced a prompt payment of cost recovery claims from the insurance industry Accordingly a number of Orange County cities are currently evaluating this type of cost recovery for fire department emergency responses The city of Garden Grove has implemented a similar structure and obtained third party billing services to process reimbursement claims The city of Santa Ana has completed the Request for Proposal process and is preparing a contract for City Council approval The proposed cost recovery system is estimated to annually generate over $100 000 in additional general fund revenue for the City of Huntington Beach Item 18 - Page 2 -432- REQUEST FOR COUNCIL ACTION MEETING DATE 8/2/2010 DEPARTMENT ID NUMBED FD10 009 Analyses (continued) The proposed fees can be charged upon the
