Statement of Issue:
The Police Department has received notification of the Fisc
$291,597 from the County of Orange for the Supplemental La
(SLESF). This funding is a pass through grant from the State
for Public Safety (COPS) funding program. In order to comp

related equipment as described, and
5. Appropriate $291,597, plus any accrued interest to be expended on patrol related
equipment.
Alternative Action(s):
Do not approve the grant and reject the grant funding from the County of Orange and
direct staff accordingly.
Analysis:
In 1996, State Assembly Bill AB 3229 was signed into law. The bill created Citizens Option
for Public Safety Program (COPS), which provided $100 million statewide to be used
exclusively for front line law enforcement services. The program has been ongoing, however
it requires a budget appropriation each fiscal year for continued funding. Each law
enforcement agency is guaranteed $100,000 minimum. The total allocation to an agency is
determined by a formula derived from the base amount and population figures provided by
the Department of Finance. Based on our population, we received an award of $291,597 for
fiscal year 2005-2006. This funding is provided by October of each year.
This is the tenth (10t") year of funding for this grant. The grant requires that the funds be
spent on front-line police service. The SLESF Oversight Committee, which is comprised of
members of Orange County Sheriff's Department and involved citizens throughout Orange
County, has requested that we define the intended use for the funds before acceptance of
this grant. At this time, the intended project for this grant is to fund front line patrol equipment
as follows:
To purchase and provide funding to maintain specialized equipment for front line
officers to utilize for SWAT and Weapons of Mass Destruction (WMD) response and
to maintain said equipment at the ready.
Changing the planned expenditure for the funds is allowed and at the discretion of the police
agency. No funds will be expended until the funding is received. Once funding is received, a
defined plan for it will be developed according to the needs in the Police Department. When
a defined plan for the funding is completed, any other city departments that could be affected
by the purchase will be consulted for their opinion regarding the purchase.

As adopted by the City Council in March 1998, all requests for appropriation of funds must
meet one of the following criteria; 1) The request is for an unanticipated emergency, 2) the
request is required to implement labor negotiations, or 3) The request will be offset by related
new revenues.
This request meets criteria #3 and will be fully offset by grant funds.

effect on the General Fund balance because the amount is funded entirely from amounts
not shown in the budget adoption for 2005-2006.
