Small, Chief of Police SUBJECT: Conduct a public hearing, approve and accept expenditure of the County of Orange Supplemental Law Enforcement Services (SLESF) Grant in the amount of $200,000 for Fiscal Year 2011-2012 Statement of Issue: In compliance with State Assembly Bill 3229, chapter 6.7, the City Council is requested to conduct a public hearing and approve acceptance of the Supplemental Law Enforcement Services Fund (SLESF) Grant. This grant will provide funding for the purchase of a laser scanning system which will be used for crime scenes and traffic accidents. Financial Impact: Grant funds estimated to be $200,000 will be fully reimbursed by the grant from the State of California, Citizens Option for Public Safety (COPS) funding program. No other matching or in-kind city funds are required for this grant. A new fund will be established for this funding. Recommended Action: Motion to: A) Conduct a public hearing; and, B) Approve the acceptance of SLESF grant for funding fiscal year 2011-12; and, C) Authorize the Chief of Police to expend $200,000, plus any accrued interest; and, D) Appropriate $200,000 plus any accrued interest to purchase the new laser scanning system and new Motorola radios; and, E) Approve the change proposal for the FY2010-11 SLESF funding to purchase the new laser scanning system. Alternative Action(s): Do not approve the recommended action and direct staff accordingly. HB -167- Item 9. - I REQUEST FOR COUNCIL ACTION MEETING DATE: 2/6/2012 DEPARTMENT ID NUMBER: PD-12-001 Analysis: The Police Department previously obtained approval from City Council for the spending plan for the Fiscal Year 2011-12 award of $200,000 from the County of Orange for the Supplemental Law Enforcement Service Fund (SLESF) at the August 15th 2011 Council meeting. The City Attorney has since advised the Police Department of the State Assembly Bill 3229, Chapter 6.7 which required the City Council to conduct a public hearing and approve acceptance of the SLESF grant. In 1996, State Assembly Bill AB 3229 was signed into law. This bill created the Citizens Option for Public Safety Program (COPS), which provided $100 million statewide to be used exclusively for front line law enforcement services. This program has been ongoing, but required a budget appropriation each fiscal year for continued funding. Each California law enforcement agency is guaranteed $100,000 minimum. The total allocation to an agency is determined by a formula derived from the base amount and population figures provided by the Department of Finance. Based on City of Huntington Beach population, we received an award of $200,000 for fiscal year 2010-2011. This funding is provided in four installment payments. The grant requires that the funds be spent on front-line police service. The SLESF Oversight Committee, which is comprised of members of Orange County Sheriff's Department and involved citizens throughout Orange County, has requested that we define the intended use for the funds before acceptance of this grant. At this time, the intended project for this grant is to fund front line patrol equipment as follows: For FY2011-12 funding, the Huntington Beach Police Department proposes to purchase a new Leica ScanStation C10. The Leica ScanStation C10 is an easy-to-use 3D laser scanning system, which enables personnel to first panoramically photograph and then laser scan [measure] crime scenes and traffic accidents. The system instantly captures the entire scene with an extraordinary level of speed, accuracy, and completeness. The ScanStation easily assists front-line personnel in preserving crime scenes, traffic accidents, fire scenes, industrial accidents, vulnerability and threat assessments, and shooting reconstructions. Currently at major crime scenes, patrol officers and crime scene investigators are saddled with hours of photographing, measuring, and diagramming duties at their scene[s]. With the ScanStation, the crime scene investigation would require a fraction of the current time to complete the thorough investigation. During fatal traffic accident reconstructions, officers frequently spend several days of labor time to complete the lengthy and cumbersome reports. ScanStation is able to capture the entire scene instantly and precisely, which will drastically shorten the amount of workload the current traffic officers spend on their important investigations. The ScanStation quickly preserves the scene exactly the way the first responding officer discovered it. Due to the ScanStation's speed and accuracy, patrol officers will experience reduced time at the scene, freeing them to perform additional tasks at the scene or move on to other patrol duties. To date, the Police Department has not spent any dollar amount in FY10-11. The Police Department originally proposed to purchase a new SIRE Document Management System. Item 9. - 2 HB -168- REQUEST FOR COUNCIL ACTION MEETING DATE: 2/6/2012 DEPARTMENT ID NUMBER: PD-12-001 The Department would like to request to change the proposal from the SIRE system to the Leica ScanStation C10. Fiscal Year 2010-11 funding balance is $131,580. However, the total cost of the ScanStation is $170,106. Therefore, the Department requests to pay for the new ScanStation's remaining balance of$38,526 from fiscal year 2011-12 funding. Depending on the total distribution of approved funding in FY2011-12, the Police Department will use the remaining balance of FY2011-12 funding for Motorola Astro Digital XTS-5000 700/800MHz radios. These radios are superior to the existing radios used by police officers in the field because of their ability to access radio frequencies in the 700 MHz bandwidth. The additional access is critical in providing interoperable communication with federal agencies in the event of a major emergency, something that is not possible with the current 800 MHz radios. These radios will also provide encrypted communications, which adds an additional layer of security to radio transmissions. The Orange County Supplemental Law Enforcement Oversight Committee(SLEOC)is responsible for meeting annually to review and approve actual and proposed future SLESF expenditures by all Orange County recipients and to facilitate required state reports regarding all expended funds. The Orange County SLEOC includes the Sheriff(Chair), County Executive Officer,District Attorney, Police Chief, and City Mainager. The SLEOC will convene in early October,2011 to approve the SLESF expenditures for FY10/11,complete and submit the standardized reporting form to the State Controller's Office, and approve the proposed SLESF expenditures for FYI 1/12 to authorize the release of fluids by ` the county Auditor-Controller to each city agency. To ensure that all new development within the BECSP complies with the Development Code, including applicable Town Center Neighborhood development standards, all development, including the proposed project, is subject to site plan review. Inconsistencies between the design of the proposed project and the BECSP Development Code would be resolved during the site plan review process, and may require revisions to the design of the proposed project or submittal of a request for a variance or minor deviation from the development standards. The project proposes the development of a maximum six-story mixed-use building that would include market and retail uses on the ground floor fronting Ellis Avenue and Beach Boulevard, respectively, and residential uses on the upper levels. Refer to Figure 3-3 (Proposed Project Site Plan) for an illustration of the proposed project's building configuration. Implementation of the proposed project would change the visual character of the site from a low-scale, auto-oriented commercial development to a contemporary, highly-designed, mixed use development consistent with the BECSP vision for the Town Center Neighborhood. Development standards of the BECSP that relate to the visual quality and character of proposed development include regulations for building scale; frontage and building placement; streets; open space; architecture; and signage. Compliance with these development standards would ensure that implementation of the proposed project would not degrade the existing visual character and quality of the project site and surrounding area, and serve to actualize the BECSP vision for the Town Center Boulevard segment. BECSP Section 2.3.1 (Building Height) permits buildings to be a minimum of two stories and a maximum of six stories in height on the project site. Further, BECSP Section 2.3.2 (Special Building Height Limits) establishes special building height limits for development along Beach Boulevard or located adjacent to, or across from, housing such as the project site. As such, site plan review approval would ensure that the proposed project would�co�nflict with the BECSP. Street and Open Space Design Existing streets would include public frontage improvements, as required by BECSP Section 2.5.1(1)(c). Along Beach Boulevard, the Palm Tree Boulevard typical configuration would be implemented. The proposed project would also be consistent with BECSP Section 2.6 (Open Space Regulations), which requires the provision of public open space at a rate of 50 sf per 1,000 sf of retail uses.and per dwelling unit to be provided on the project site. If public open space cannot be provided on the project site, the payment of an in-lieu fee to construct the required amount of usable open space offsite is permitted by BECSP Section 2.6.1(2). The project proposes a total of 1,850 sf of public open space in the form of a plaza at the corner of Beach Boulevard and Ellis Avenue. The remaining open space requirement would be satisfied through the payment of an in-lieu fee to provide the open space off site. Additionally, 10,500 sf of open space for residential use would be provided on Level six of the proposed building. 4.8-4 City of Huntington Beach, Beach and Ellis Mixed-Use Project EIR • • - • - e - • e -• e -Li e - As is the case with the proposed project, there are no scenic vistas available from the proposed project site as most are located along the coast As such, Alternative 3 would have a less than significant impact on scenic vistas, similar to the proposed project. As the project site is located approximately 3 miles from the ocean, no views of the coast currently exist. Building heights would not exceed six stories under Alternative 3, consistent with the proposed project, and therefore would not impact views to a greater extent than what was analyzed for the proposed project Development occurring under Alternative 3 would be designed in compliance with Town Center Neighborhood development standards included in BECSP Section 2.1.4 (Town Center Neighborhood). Development standards relating to the visual quality and character of Alternative 3 would include regulations for building scale, frontage and building placement, streets, open space, architecture and signage. Under Alternative 3, development along Beach Boulevard would be four stories in height, while the remainder of development on the site would be six stories in height. Building heights under Alternative 3 would be consistent with BECSP Section 2.3.1 (Building Height), which establishes a minimum building height of two stories and maximum building height of six stories on the site, but would be inconsistent with BECSP Section 2.3.2 (Special Building Height Limits), which establishes special building height limits for development along Ellis Avenue , as defified . As shown in Figure 6-2, the height of the building would not be limited for a distance of 65 feet from the back of sidewalk where development is located across from housing on Ellis Avenue wag. Consequently, Alternative 3 is not consistent with BECSP development standards for building height that directly relate to the visual quality of the site. However, Alternative 3 has been designed with building breaks along Ellis Avenue, which minimizes the building mass and limits the area of nonconformity. Nonetheless, Alternative 3 would result in a greater, less than significant impact relating to the visual quality and character of the project site and surrounding area. All buildings would be built to the sidewalk with uses along Beach Boulevard and Ellis Avenue fronting these roadways, as required by BECSP Section 2.4 (Frontage and Building Placement Regulations) and building frontages would be designed in compliance with BECSP Section 2.4.2 (Private Frontage Types). Compliance with BECSP Section 2.5 (Street Regulations) would ensure that adjacent streets are improved to enhance the connectivity of the community and create a safe and attractive streetscape environment. Compliance with these development standards would ensure that Alternative 3 would be visually consistent with the BECSP's vision for the Five Points District and would be visually compatible with adjacent residential and commercial uses. Although inconsistencies between the height of buildings and the BECSP Development Code have been identified, during the site plan review process, revisions to the design of Alternative 3 would likely be required in an effort to achieve consistency with the BECSP, as is the case for all development occurring in the BECSP area. As such, site plan review approval would ensure that Alternative 3 would not degrade the existing visual character and quality of the site and surrounding area, similar to the proposed project Therefore, Alternative 3 would result in a less than significant impact, similar to,but slightly greater than, the proposed project due to the increased massing.
