The amendment proposes a reduction of six fee categories, deletion of one fee, and addition of one fee. As development related fees are effective 60 days after adoption, and miscellaneous fees are effective immediately, two resolutions have been prepared. Funding Source: No funding is required. Based on historical averages of the types of applications received, a reduction of $25,000 in the fiscal year 2007/2008 revenue forecast is anticipated. Recommended Action: Motion to: 1. Adopt Resolution No. 2008-17 A Resolution of the City Council of the City of Huntington Beach Amending Resolution No. 2007-58 Entitled "A Resolution of the City Council of the City of Huntington Beach establishing a Citywide User Fees Schedule and repealing resolution No. 2005-74 and all supplemental resolutions thereto" and establishing a new user fee for the Planning Department Service of a Zoning Letter— Simple (Supplemental User Fee Resolution No. 1 ); and 2. Adopt Resolution No. 2008-18 A Resolution of the City Council of the City of Huntington Beach Amending Resolution No. 2007-59 Entitled "A Resolution of the City Council of the City of Huntington Beach establishing a Citywide Development Fees schedule and repealing resolution No. 2005-75; and all supplemental resolutions thereto" and establishing new Development Fees for various services provided by the Planning Department (Supplemental Development Fee Resolution No. 2 ). Alternative Action(s): Do not adopt one or both of the resolutions. This action will result in retaining the existing fee schedule. REQUEST FOR CITY COUNCIL ACTION MEETING DATE: 3/3/2008 DEPARTMENT ID NUMBER: PL08-02 Analysis: In 2003, the City Council established a cost recovery goal of 100 percent for all City Department's development fees, essentially composed of staff's fully burdened time, plus a share of Department overhead and Citywide overhead. The Planning Department's fees consist of all zoning entitlements (i.e., Administrative Permits, Conditional Use Permits, Coastal Development Permits, and Zoning Map Amendments). These fees include not only the planner's time but also the staff time of other departments involved in the development review process such as Public Works, Building and Safety, and Fire. Subsequently, the citywide fee schedule was updated on November 21, 2005, using the same methodology. At the time of adoption, fees for all Planning Department services were frozen, with the exception of certain services where a fee reduction was recommended. In those instances, fees were reduced as recommended. The 2005 Fee Study only analyzed cost recovery for existing applications. The 2005 study did not analyze all uses covered under individual permits or which uses require fewer staff resources. Since that time, the Planning Department has undertaken a Department wide review of organizational practices. As a result, the Planning Department has been able to realize efficiencies in some permit processing activities and has identified certain uses where a new permit and associated fee could be created. These improvements result in lower costs, which should therefore be reflected in lower fees to the applicants. On October 15, 2007, the City Council held a Study Session on Planning Department fees. Planning staff highlighted specific common entitlement applications that encompassed a broad range of uses that could be reduced for those uses whose review requires measurably fewer resources than the average time for that application as a whole. These reductions are based on average time savings. Currently, a Conditional Use Permit for a commercial, industrial, or mixed use development or use requiring Planning Commission approval has a fee of $6,668. Conditional Use Permits are one of the most common applications received by the Department and this fee applies to all such type uses and development. For example, applications for alcohol sales, dance floors, or live entertainment at an existing restaurant in the Downtown Specific Plan pay the same fee as a new hotel or retail building. However, the former involves less staff review time (both by the Planning Department as well the need to circulate to all departments in the internal development review process) than would be needed for the hotel application, and the level of review focuses on fewer issues than need be analyzed for hotels. This type of minor CUP process would be similar to other cities in the region that have a minor CUP application for similar uses that are significantly less than the regular CUP. Staff is recommending a 50% reduction in the processing fee for these types of CUP's. • Creation of a no-fee Administrative Permit for Personal Enrichment Uses. This permit applies to personal enrichment uses such as photography studios, diet centers, yoga studios, martial arts and others up to 5,000 square feet in building floor area and the cost is $530. In evaluating staff time involved for these types of uses based on our current code requirements, it was determined that they are relatively simple and processed over the counter with minimal staff time. Therefore, staff is recommending that this permit have no-fee involved. It would be similar to City Council's action last year adopting a no-fee permit for certain day care uses. • Reduce the fee by 50 percent for a Variance processed with a Conditional Use Permit. This would reduce the fee to $1,659 for applications to the Planning Commission and $1,175 for applications to the Zoning Administrator. Savings in staff time are realized when these applications are processed concurrently, as staff would only require analysis of the zoning requirements of one parcel for the two applications. Nonetheless, there are issues that are unique to each type of application that necessitate separate analysis and separate findings. However, the economy of scale realized by analyzing both applications concurrently would reduce the staff time when compared to processing two applications (either for separate properties, or for the same property but at a much later date). Likewise, fees for Coastal Development Permits were reduced by 50 percent in 2005 when processed with a Conditional Use Permit, Variance, or Entitlement Plan Amendment. • Reduce the fee by 50 percent for a Zoning Map Amendment processed with a General Plan Amendment. This would reduce the fee to $9,256 for a Zoning Map Amendment when processed in conjunction with a General Plan Amendment. Although each application requires unique analyses and findings, there are tasks for both that overlap, resulting in savings in staff time and resources that could be passed onto the customer. -3- 2/25/2008 2:47 PM REQUEST FOR CITY COUNCIL ACTION MEETING DATE: 3/3/2008 DEPARTMENT ID NUMBER: PL08-02 • Create an Environmental Assessment — Historic fee. This would apply to properties listed in the General Plan Historical and Cultural Resources Element or in the historic survey area. These assessments generally result in a Negative Declaration and do not require many of the additional studies such as traffic, sewer impact, biological, or many of the other CEQA items needed for other projects. This fee would be $3,484, which is 50 percent of the current Environmental Assessment fee. • Create a Zoning Letter— Simple. For zoning requests that require minimal staff time, zoning letter fees would be $77, the same as a Flood Verification Letter. More complex requests would still cost $143. • Create a Wireless Permit Application Fee. On September 17, 2007, the City Council adopted Zoning Text Amendment No. 06-08, which amended the zoning provisions relating to telecommunication facilities to require the submission of a Wireless Permit Application. Staff recommends amending the City's fee schedule to include a fee to recover the City's cost to review Wireless Permit Applications. As these applications require a specialized technical knowledge that staff does not have, and these applications occur too infrequently to hire additional staff for this purpose, staff is in the process of securing the services of an outside vendor. The fee would reimburse the City for the vendor's costs. • At the November 5, 2007, City Council meeting, the Council adopted Zoning Text Amendment 2007-003, which removed "Medicinal Marijuana Dispensary" as a permitted use in the City's Zoning & Subdivision Ordinance. Accordingly, City Staff recommends deleting all references to "Medicinal Marijuana Dispensaries" in the list of Administrative Permits — List 2 from the City's Fee Schedule. Working with the City Council, City Administrator's Office, community stakeholders, and other City Departments, the Planning Department has completed this assessment phase of the City's development review process and implemented several Department changes to improve customer service and make the development review and permitting process more efficient. The revised fee schedule is one of the results of the on-going effort to improve the development review process as directed in the Strategic Plan. Additional modifications could be recommended as part of the Citywide cost recovery program and fee schedule update, which will begin this year. Strategic Plan Goal: L-5 Improve the efficiency of the development review process. Reduced fees reflect efficiencies realized by internal Planning Department improvements. The PRM study determined that labor cost was an appropriate component of fees based on a fair distribution of all Citywide and departmental overhead costs as described in the 2005 study across all activities; and The City Council approved the PRM study in 2005, finding that fees for any service should include a cost component that can be directly or indirectly associated with the service; and In 2007 the City Council determined that the Consumer Price Index ("CPI") for the period of November 2005 to April 2007 had increased by 5.96%, and that the CPI Index was a reasonable calculation of the increased departmental overhead costs incurred by the City to provide City services; and On September 4, 2007, the City Council adopted Resolution No. 2007-58 establishing a user fee schedule for the City; and City Staff has determined that the preparation of Zoning Letters for certain simple zoning requests requires minimal staff time, as opposed to the preparation of Zoning Letters for more complex requests, although Resolution No. 2007-58 establishes the same fee for both requests; and City Staff has further determined that the creation of a "Zoning Letter — Simple" fee in the amount of seventy-seven dollars ($77) would accurately and reasonably reflect the City's decreased overhead costs in providing Zoning Letters that require fewer resources than the more complex Zoning Letters; and The City Council desires to update the existing fees charged to the public consistent with Staff s analysis, and impose fees that do not exceed the estimated reasonable cost of providing the service for which the fee is imposed; and The City Council has determined that the fee set forth in this Resolution is fair and reasonable, and necessary to offset the cost of programs and services being offered, 07-13 13/16001 1 Resolution No. 2008-17 NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: 1.
