Hopkins, PE, Director of Public Works SUBJECT: Adopt Resolution No. 2012-75 approving the submittal of a Grant Application to Orange County Transportation Authority (OCTA) Tier 2 Program for the Adams Avenue Frontage Median Retrofit Project Statement of Issue: Adoption of a resolution is required to approve the submittal of a project for the grant application to the Orange County Transportation Authority (OCTA) for funding under the Environmental Cleanup, Tier 2 Grant Program under Orange County Local Transportation Ordinance No. 3. Financial Impact: No funding is required for this action. However, if the grant application is approved by OCTA, the City will be responsible for a minimum of 50% in local matching funds. A separate City Council action will be required at that time. Recommended Action: Motion to: Adopt Resolution No. 2012-75, "A Resolution of the City Council of the City of Huntington Beach Authorizing an Application for Funds for the Environmental Cleanup, Tier 2 Grant Program Under Orange County Local Transportation Ordinance No. 3 for the Adams Avenue Frontage Median Retrofit Project." Alternative Action(s): Deny approval of the project in the Resolution and forego eligibility to receive grant funds from OCTA. Item 17. - 1 xB -496- REQUEST FOR COUNCIL ACTION MEETING DATE: 11/5/2012 DEPARTMENT ID NUMBER: PW 12-064 Analysis: In July 2012, the Orange County Transportation Authority (OCTA) announced a call for projects for the Environmental Cleanup, Tier 2 Grant Program under Orange County Local Transportation Ordinance No. 3. This program is regional and competitive. As a condition of eligibility, the City is required to adopt a resolution approving the submittal of applications for grant funding. In general, the resolution declares the City's desire to implement the submitted project, as well as an affirmation to follow the Comprehensive Transportation Funding Program (CTFP) procedures, should funding be approved and allocated. At the August 20, 2012, City Council Study Session, staff requested City Council to consider the Adams Avenue Frontage Median Retrofit Project as a potential project for the OCTA Tier II Grant Opportunities. City Council approved the Adams Avenue Frontage Median Project and staff submitted the grant application to OCTA for consideration. The grant amount requested was $408,000 with a local match amount of $272,000. The City will be responsible for a minimum local match of 50% of the project costs. The matching funds may be provided by cash contributions and/or in-kind services. In-kind services can include salaries and benefits for employees who work directly on the project. In-kind services for operation and maintenance of the project cannot be pledged as a match. Public Works Commission Action: Not Required Environmental Status: Not applicable. Adams Avenue Frontage Median Retrofit Project Map Produced on W116012 R r S gym_ 10, 200 4W One inch equals -feet, \ x : Hs -499- Item 17. - 4 ATTAC H M E N T #2 RESOLUTION NO. 2012-75 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING AN APPLICATION FOR FUNDS FOR THE ENVIRONMENTAL CLEANUP, TIER 2 GRANT PROGRAM UNDER ORANGE COUNTY LOCAL TRANSPORTATION ORDINANCE NO. 3 FOR THE ADAMS AVENUE FRONTAGE MEDIAN RETROFIT PROJECT WHEREAS, Orange County Local Transportation Ordinance No. 3, dated July 24, 2006, and is known and cited as the Renewed Measure M Transportation Ordinance and Investment Plan makes funds available through the Environmental Cleanup Program to help protect Orange County beaches and waterways from transportation-generated pollution(urban runoff) and improve overall water quality; and The Environmental Cleanup, Tier 2 Grant Program consists of funding regional, potentially multi jurisdictional, capital-intensive projects such as constructed wetlands, detention/infiltration basins and bio-swales which mitigate pollutants including litter and debris, heavy metals, organic chemicals, sediment, and nutrients; and OCTA has established the procedures and criteria for reviewing proposals; and City of Huntington Beach possesses authority to nominate water quality improvement projects that have a transportation pollution nexus to finance and construct the proposed project; and By formal action the City of Huntington Beach authorizes the nomination of the Adams Avenue Frontage Median Retrofit Project, including all understanding and assurances contained therein, and authorizes the person identified as the official representative of the City of Huntington Beach to act in connection with the nomination and to provide such additional information as may be required; and The City of Huntington Beach will maintain and operate the equipment acquired and installed; and The City of Huntington Beach will give OCTA's representatives access to and the right to examine all records, books, papers or documents related to the funded Tier 2 Grant Project; and The City of Huntington Beach will cause work on the project to be commenced within a reasonable time after receipt of notification from OCTA and that the project will be carried to completion with reasonable diligence; and 12-3520/85608.doc 1 Resolution No. 2012-75 The City of Huntington Beach will comply where applicable with provisions of the California Environmental Quality Act, the National Environmental Policy Act,the American with Disabilities Act, and any other federal, state, and/or local laws, rules and/or regulations, NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: The City.Council of the City of Huntington Beach hereby authorizes Travis Hopkins, Director of Public Works, as the official representative of the City of Huntington Beach to apply for and accept funds for the Environmental Cleanup, Tier 2 Grant Program for the Adams Avenue Frontage Median Retrofit Project. BE IT FURTHER RESOLVED that the City of Huntington Beach, agrees to fund its share of the project costs and any additional costs over the identified programmed amount.
