Wilson, City Manager PREPARED BY: Janeen Laudenback, Director of Community Services Stephanie Beverage, Director of Library Services SUBJECT: Adopt Resolution Nos. 2014-15 and 2014-16 amending Fee Resolutions 2009-33 and 2009-31 for facility rentals recreation services, and user fees Statement of Issue: City facilities are often used for City-Sponsored or Co-Sponsored events. Fees and charges for these types of events have historically been waived. The purpose of these resolutions is to formalize these past practices and correct some minor discrepancies. Financial Impact: Not applicable Recommended Action: A) Adopt Resolution 2014-15, "A Resolution of the City Council of the City of Huntington Beach Amending Resolution No. 2009-33 Which Established a Citywide Schedule for Charges for Facility Rentals and Recreation Services and Repealed Resolution No. 2007-60 and All Supplemental Resolutions Thereto (Supplemental Fee Resolution No. 5);" and, B) Adopt Resolution 2014-16, "A Resolution of the City Council of the City of Huntington Beach Amending Resolution No. 2009-31 Which Established a Citywide User Fee Schedule and Repealed Resolution No. 2007-58 and All Supplemental Resolutions Thereto (Supplemental Fee Resolution No. 5)." Alternative Action(s): Do not adopt Resolutions 2014-15 or 2014-16 and direct staff accordingly. Analysis: City facilities are often used for City-Sponsored or Co-Sponsored events. Fees and charges for these types of events have historically been waived since these events are joint efforts between the City and other city affiliated organizations. The adoption of these resolutions will provide the authority for the City Manager or his/her designee to waive the fees in consultation with the City Attorney. In addition, some charges that were inadvertently not included in the prior resolutions, including charges for advertising in the SANDS Community Services Guide, have been included. Originally a pilot program, the advertising program is now developed enough to include in the "charges for facility rentals and recreation services" schedule. Additionally, certain 4th of July charges have been HB -97- Item 8. - I Dept. ID CS 14-007 Page 2 of 2 Meeting Date:4/7/2014 added for administrative purposes only and reflect no increases. Finally, some outdated and obsolete fees included for both Community Services and Library Services have been removed. Again, these edits are only for administrative purposes and reflect no increases. With regards to the "User Fee" Resolution, certain clerical edits have been made to move some fees previously included on the "user fee" schedule to "charges for facility rentals and recreation services" schedule. (SUPPLEMENTAL FEE RESOLUTION NO. 5) WHEREAS, on June 15, 2009, Resolution No. 2009-33 was adopted, establishing a Citywide fee for public access and use of certain City property; and The City Council desires to amend the Community Services Department Facility Rentals and Recreational Service Charges schedule to include advertising charges for the SANDS Community Services Guide, the inclusion of 4th of July event program charges, as well as other minor and clerical adjustments, as set forth in Exhibit A attached hereto and incorporated herein by this reference; and The City Council desires to amend the Library Services Department Facility Rental, Equipment Use and Related Fees and Charges schedule to include new charges for the programming wing of the Main Street Branch Library, as well as other minor adjustments related to out-dated charges as set forth in Exhibit B attached hereto and incorporated herein by this reference; and In addition to the above, charges for programs or events that are sponsored or co- sponsored by the City of Huntington Beach or for unanticipated events or programs not specifically addressed or included in Exhibits A or B may be waived by the City Manager or his/her designee in consultation with the City Attorney. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Huntington Beach that the new charges set forth in Exhibits "A" and"B" and adopted by this Resolution shall be effective immediately following the adoption of this Resolution, and continue thereafter.
