Statement of Issue: A City Council resolution is necessary to apply for grant funds under
the California River Parkways Grant Program. Grant funds to be used to construct an
Americans with Disabilities Act (ADA) accessible ramp at Le Bard Park to the Santa Ana
River pathway.
Funding Source: Not applicable
Recommended Action: Motion to:
Adopt resolution No. 2008- 19 Approving the Application for Grant Funds Under the
California River Parkways Grant Program Under the Water Security, Clean Drinking Water,
Coastal and Beach Protection Act of 2002 (Proposition 50).
Alternative Action(s):
Do not adopt resolution for application for grant funds from the California River Parkways
Grant Program for ADA access ramp at Le Bard Park.

Analysis:
The city has an opportunity to apply for a grant from the California River Parkways Grant
Program to construct an ADA-accessible ramp at Le Bard Park to the Santa Ana River trail,
as part of the Le Bard Park, Phase II project. Phase II of the Le Bard Park Reconfiguration
Project, as approved by the City Council, includes expansion of turf and additional
landscaping and walkways to the proposed turf area.
Le Bard Park is an important element identified in the city's Santa Ana River Blue Ribbon
Committee Report, as approved by the City Council in February 2007. One of the objectives
of the Orange Coast River Park (OCRP) Master Plan is to provide ADA access, wherever
feasible.
The five-acre Le Bard Park site is adjacent to Le Bard School and the Santa Ana River. The
existing three acres of developed city park includes traditional neighborhood park amenities
and a public parking lot.
The project scope for this proposed grant funding would provide for reconstruction of an
existing, inadequate ramp structure to an ADA-accessible ramp which would address ADA
and safety issues. It would enable improved access to the Santa Ana River trail, as well as
to the existing pedestrian bridge.
Strategic Plan Goal: Land Use: Preserve the quality of our neighborhoods, maintain open
space.
Environmental Status: Necessary environmental review would be completed prior to any
improvements.

RESOLUTION NO. 2008-19
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH APPROVING THE APPLICATION
FOR GRANT FUNDS UNDER THE CALIFORNIA RIVER PARKWAYS
GRANT PROGRAM UNDER THE WATER SECURITY, CLEAN DRINKING WATER,
COASTAL AND BEACH PROTECTION ACT OF 2002 (Proposition 50)
WHEREAS, the Legislature and Governor of the State of California have provided Funds
for the program shown above; and
The Resources Agency has been delegated the responsibility for the administration of this
grant program, establishing necessary procedures; and
Said procedures established by the State Resources Agency require a resolution certifying
the approval of application(s)by the City of Huntington Beach's governing board before
submission of said application(s) to the State; and
The City of Huntington Beach, if selected, will enter into an agreement with the State of
California to carry out the Project,
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
resolve as follows:
1. To approve the filing of an application for the Le Bard Park Access Project; and
2. To certify that the City of Huntington Beach understands the assurances and
certification in the application; and
3. To certify that the City of Huntington Beach or title holder will have sufficient
funds to operate and maintain the Project(s)consistent with the land tenure requirements; or will
secure the resources to do so; and
4. To certify that it will comply with the provisions of Section 1771.8 of the State
Labor Code regarding payment of prevailing wages on Projects awarded Proposition 50 Funds;
and
5. To certify, if applicable, that the Project will comply with any laws and
regulations including, but not limited to, legal requirements for building codes, health and safety
codes,disabled access laws, and, that prior to commencement of construction, all applicable
permits will have been obtained; and
6. To appoint the Community Services Director, or designee, as agent to conduct all
negotiations, execute and submit all documents including, but not limited to applications,
agreements, payment requests and so on, which may be necessary for the completion of the
aforementioned Project(s).
