Wilson, City Administrator PREPARED BY: Stanley Smalewitz, Director of Economic Development SUBJECT: Adopt Resolution No. 2010- 40 , "A Resolution of the City Council of the City of Huntington Beach Amending Resolution No. 2009-70 Entitled "A Resolution of The City of Huntington Beach Establishing a Citywide Schedule for Charges for Facility Rentals and Recreation Services and Repealing Resolution No. 2007-60 and All Supplemental Resolutions Thereto." (Supplemental Fee Resolution No. 4) Statement of Issue: Council is asked to adopt the Resolution setting the recommended parking fees for The Strand Parking Structure. The Strand parking fees were last adjusted in April 2009, at the opening of the development. Financial Impact: No funding is required. The Parking Structure is operated by CIM with all base parking revenues to the City and the parking above the City's base parking revenues to be shared between CIM and the City. Recommended Action: Motion to: Adopt Resolution Number 2010- 40 , "A Resolution of the City Council of the City of Huntington Beach Amending Resolution No. 2009 — 70 Entitled A Resolution of the City Council of the City of Huntington Beach Establishing a Citywide Schedule for Charges For Facility Rentals and Recreation Services and Repealing Resolution 2007-60 and all Supplemental Resolutions Thereto." (Supplemental Fee Resolution No. 4) Alternative Action(s): Do not adopt resolution and make revisions to the proposed to the parking rates. REQUEST FOR COUNCIL ACTION MEETING DATE: 6/7/2010 DEPARTMENT ID NUMBER: ED 10-22 Analysis: The Strand Parking Structure is owned by the City, but operated by CIM. The City and CIM entered into an Operating Agreement (signed in November 2008) for The Strand Public Parking Structure. The Strand Parking Structure now has over a year of operating experience and has become an established parking opportunity for the downtown tenants and visitors. At the May 17, 2010, City Council meeting, the yearly operating budget (expenditures and revenues) was approved. As part of the Operating Agreement, CIM has the ability to subunit recommendations regarding the various parking rates to be established for the City's review. CIM and their parking company, Standard Parking, provided information regarding their request for revised parking rates, as discussed below. The Strand Parking Structure provides public parking for the retail, restaurant and office tenants, the Downtown area, and overnight and valet parking for the Shorebreak Hotel. Due to the location and retail/hotel as part of the overall Strand project, rates are recommended to differ from the rate Structure from the City's parking structure. The Strand is also recommending that they be allowed to have rates that have both a "floor" and a "maximum" rate. The goal is to maximize transient and non-beach public access and turnover while providing adequate availability for hotel attendant parking and monthly tenant parking. Within the two seasonal rate structures, CIM would watch for persistent trends and make a rate correction, if warranted. For example, if the Structure is operating close to peak occupancy, then CIM would request the implementation of the maximum rate adjustment to increase revenue and/or assure maximum public use by promoting turnover. If occupancy and revenues are failing, then CIM would analyze the extent to which the rate may be affecting occupancy and analyze lowering rates to the "floor". CIM would be required to post changes to the rates and provide the notice to the City no less than five business days prior to making a rate change. Recommended fees are: Daily rates: Off Peak Season Peak Season (September 16 - May 14) (May 15 - September 15) $2 first 2 hours or less $2 first 2 hours or less $1 to $2/20 minutes thereafter $2 to $3/20 minutes thereafter $15 to $18 maximum daily rate $17 to $20 maximum daily rate A flat rate of $6 to $8 can be charged for evening parking after 8:00 p.m. The flat rate for major events/holidays will be $27 to $30 (based upon City holiday schedule at the Beach lots). The maximum daily rate will reset at 3:00 a.m., daily. The parking pass allows 24/7 access with in-out privileges. Business Hours Parking Pass: Business hours parking passes will be sold for $17.93 per month and will be available for use Monday through Friday, 7:00 a.m. to 9:00 p.m. Business hours parking passes are available to certain tenants of the 100 block of Main Street, pursuant to the Fourth Amendment to Owner Participation Agreement between the Redevelopment Agency and the Abdelmuti Development Company. (SUPPLEMENTAL FEE RESOLUTION NO. 4 } WHEREAS, on June 15, 2009, Resolution No. 2009-33 was adopted, establishing a Citywide fee for public access and use of certain City property; and The City Council desires to amend this fee schedule to address parking issues at various City- owned downtown parking locations as set forth in Exhibit "A" attached hereto and incorporated herein by this reference, NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Huntington Beach that the fees set forth in Exhibit "A" and adopted by this Resolution shall be effective immediately following the adoption of this Resolution, and continue thereafter. All other charges or fees set forth in Resolution No. 2009-33 shall remain in effect.
