HomeMy WebLinkAboutUsed Oil Collection Center - Application for Grant Funds -Council/Agency Meeting Held _ Deferred/Continued to ,A proved ❑ Conditionally Approved ❑ Denied i C rk s Sig ature Council Meeting Date July 19 2010 Department ID Number FD10 010 CITY OF HUNTINGTON BEACH REQUEST FOR CITY COUNCIL ACTION SUBMITTED TO Honorable Mayor and City Council Members SUBMITTED BY Fred A Wilson City Administrator PREPARED BY Patrick McIntosh Fire Chief SUBJECT Adopt Resolution No 2010-51 to make application for Grant Funds from the State of California managed through the California Department of Resources Recycling and Recovery Used Oil Grant Program for the establishment of a Used Oil Collection Center, and authorize the Fire Chief to execute all ancillary documents on behalf of the City Statement of Issue The City Council is requested to adopt a resolution reauthorizing the establishment of a used oil collection program Financial Impact If approved funds up to $35 000 would be provided by the California Department of Resources Recycling and Recovery Used Oil Grant Program No matching or in -kind funds are required for this grant Recommended Action Motion to A) Adopt Resolution 2010-51 A Resolution of the City Council of the City of Huntington Beach to Make Application for Grant Funds for the Establishment of a Used Oil Recycling Program and B) Authorize the Fire Chief to execute all ancillary documents on behalf of the City without further approval of the City Council Alternative Action(s) Do not approve the attached resolution and direct staff to pursue an alternative strategy for the establishment of a used oil collection program _113® Item 10 a Page 1 REQUEST FOR COUNCIL ACTION MEETING DATE 7/19/2010 DEPARTMENT ID NUMBER FD 010 Analysis The City of Huntington Beach through the Fire Department has operated a grant -funded used oil recycling program for fifteen (15) years This program annually includes the collection of approximately 19 000 gallons of used oil and over 1 000 used oil filters Senate Bill 546 passed in 2009 mandates changes to the program Beginning in duly 2010 the changes include streamlining the program and giving local agencies greater flexibility based on local conditions to optimize overall collection The attached resolution (Attachment 1) reauthorizes City staff to submit grant applications, amendments to applications periodic reports and payment requests to the California Department of Resources Recycling and Recovery (CalRecycle) The grant funding period is through June 30 2015 At this time the City Council is requested to adoptttTe attached resolution and authorize the Fire Chief to execute all ancillary documents on behalf of the City without further approval of the City Council Environmental Status None Strategic Plan Goal Maintain and Enhance Public Safety Attachment(s) 1 Resolution No 2010 - 51 A Resolution of the City Council of the City of Huntington Beach to Make Application for Grant Funds for the Establishment of a Used Of/ Recvcllna Proaram Item 10 -Page 2 -120- RESOLUTION NO 2010-51 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH TO MAKE APPLICATION FOR GRANT FUNDS FOR THE ESTABLISHMENT OF A USED OIL RECYCLING PROGRAM WHEREAS, the people of the State of California have enacted the California Oil Recycling Enhancement Act that provides funds to cities and counties for establishing and maintaining a local used oil collection program that encourages recycling or appropriate disposal of used oil, and The California Integrated Waste Management Board has been delegated the responsibility for the administration of the program within the State, setting up necessary procedures governing application by cities and counties under the program, and The Act was modified in 2009 through enactment of SB 546 to modify and simplify program administration by, among other things, allowing more control by local jurisdictions authorized to carry out the Act establishment of an up -front grant payment program from the current reimbursement program and streamlining administrative tasks by authorizing an on-line application and reporting system, and The Department of Resources Recycling and Recovery ( CalRecycle') formerly known as the California Integrated Waste Management Board has been delegated the responsibility for the administration of the modified used oil recycling program within the State and has established the Used Oil Payment Program (OPP) to oversee and make payments to qualifying jurisdictions for the implementation of local used oil programs based on the modified program, and CalRecycle's procedures require among other things an applicant's governing body declare by resolution certain authorizations related to the administration of the new Used Oil Payment Program NOW THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows 1 Authorize the City's submittal of Used Oil Payment Program applications to CalRecycle for all available funds under the California Oil Recycling Enhancement Act and CalRecycle's Used Oil Payment Program for the period of July 1, 2010 through June 30 2015 08 1933 003/48672 1 Resolution No 2010-51 2 The City's Fire Chief or his designee is hereby authorized to execute all necessary applications, contracts, payment requests, agreements and amendments for the purpose of securing used oil recycling funds and to implement and carry out the purposes specified in the Used Oil Payment Program guidelines PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 19 th day of July , 2010 A.
