SUBJECT: Authorize appropriation of funds for the Bella Terra Pedestrian Crossing Project
Statement of Issue:
The City received $250,000 in development funds for the proposed Bella Terra Pedestrian
Crossing. Funds received by the City are deposited as revenue. A separate Council Action is
required to appropriate the funds to an expenditure account.
Financial Impact:
None. Any unspent funds will be returned to the developer. Any City funds required to fund the
project would be submitted as part of the annual budget process or by separate Council Action.
Recommended Action:
A) Authorize appropriation of $100,000 to Infrastructure Fund expenditure account
31490001.82800 for the Bella Terra Pedestrian Crossing Project; and,
B) Authorize the Finance Director to appropriate additional funds in the future, as needed, up to a
total of funds received from the developer(s), to fund the Bella Terra Pedestrian Crossing Project.
Alternative Action(s):
Do not authorize the appropriation and instruct staff on how to proceed.
Analysis:
As part of the ongoing development of Bella Terra/Costco and Boardwalk, a pedestrian crossing
linking the two developments is proposed in order to provide a more convenient and pedestrian -
friendly connection between the two developments. The connection requires crossing the existing
railroad tracks and channel. The recommended connection would involve a small bridge over the
flood control channel and an at -grade crossing of the railroad tracks.
Gaining approvals for an at -grade railroad crossing from both the railroad and the Public Utilities
Commission (PUC) is likely to be challenging and involve significant studies and reviews. Final
approval by the PUC is not a certainty, but staff believes there is reason to be optimistic that such a
crossing has the potential to be approved given the current use of the tracks. Staff does not believe
that a full, grade -separated crossing of the railroad tracks is financially feasible and is not
recommended.

Boardwalk's development agreement calls for a deposit of $250,000 to help fund the planning,
design, permits and construction of the project. This payment was recently received and deposited
into the Infrastructure Fund as a holding account. Pursuant to the terms of their Development
Agreement, an additional $250,000 from DJM Capital is also required after permits for the PPI have
been approved by the City, following approval by the railroad and PUC. In addition to the initial
$100,000 appropriation requested, staff is seeking authorization to appropriate additional funds, as
required, to fund the project up to the total funds received from the developers.
Environmental Status:
Any environmental review of the project would come in later phases prior to construction.
