California Environmental Quality Act (CEQA) Statement of Issue In 1992, the State enacted Public Resources Code 42010 This code provided for the establishment of Recycling Market Development Zones (RMDZ) across the State to incentivize local and regional demand for recyclable materials The RMDZ program is an economic development tool that helps create jobs, can increase the tax base, reduce the transportation costs of recycled materials, and reduce energy demands There are currently 36 RMDZs located throughout the State, none of which are located in Orange County This action will authorize an application to create a RMDZ for Orange County with the City as the Lead Agency Financial Impact There are no cost impacts to the City In passing a resolution to designate the City as an RMDZ and serve as the Lead Agency, the City will receive and administer Zone Incentive Funds Recommended Action Adopt Resolution No 2015-52, "A Resolution of the City Council of the City of Huntington Beach Authorizing an Application for the Designation of the City as a Recycling Market Development Zone, Authorizing the Receipt of Payments, Designation as the Lead Agency, and Exemption from the California Environmental Quality Act " Alternative Action(s) Do not approve the Resolution, thereby declining participating in the Orange County RMDZ Analysis The RMDZ is an economic development program that utilizes the growing supply of recyclable materials to fuel new businesses, expand existing ones, create jobs, and divert waste from landfills These programs foster businesses that manufacture products using secondary materials or that seek to partner with other companies who may want to use their discards, thereby creating a circular economy and enhancing the City's economic development potential A RMDZ is defined as a geographical area designated by CalRecycle dedicated to the development and support of businesses that utilize secondary feedstock in the manufacturing process CalRecycle funds and administers the RMDZ program utilizing landfill tipping fees This program is HB -481- Item 7. - I Dept ID AD-15-033 Page 2 of 3 Meeting Date 9/21/2015 offered at no-cost to participating cities Recycling based manufacturers located in RMDZs are eligible to apply for low-Interest loans, receive technical assistance, and free marketing of their products by the CalRecycle Materials Management and Local Assistance Division Any new business that wishes to relocate to the City of Huntington Beach will be subject to all existing land use designations and will have to go through the City's existing planning/building permitting process All new and existing businesses will be subject to existing pollution control ordinances/regulations The RMDZ loan program offers financing for recycling manufactures at the current rate of 4 0% Loans are for up to $2 million per-project, with up to 75% of a project financed Loans can be for new or existing companies Through research, City staff found that over 200 businesses, already in existence in the City, would qualify for RMDZ benefits One such interested business is Primal Elements This business designs and produces candles and soaps at their facility located off Gothard Street This family owned business sells their products at major retailers (Target, Ulta, etc), all over the world and is interested in expanding their operations to make a product called the Soap Keeper This product, made of 100% recycled plastic, keeps soap lasting longer Currently Primal Elements purchases this product from a retailer in China The owner seeks to manufacture this product at their facility in Huntington Beach Through the RMDZ the owner could expand his business by utilizing an RMDZ loan, receive technical assistance from CalRecycle, and purchase his plastic feedstock directly from Rainbow Disposal CalRecycle also offers financial assistance, product marketing through the Recycle Store, and if needed, permitting assistance with AQMD, the Regional Water Board, etc A business may be eligible for RMDZ benefits if their operations include any one of the following • Process that make products reusable again by repair, reconditioning, and/or washing, and • Manufacturing that makes recycled content products, and • Conversion technologies that convert waste to energy or fuel The proposed Orange County RMDZ (OC RMDZ) will consist of the cities of Huntington Beach, Garden Grove, Santa Ana, Stanton, Orange, and the County of Orange Based on the expertise of Huntington Beach Staff, the City seeks to lead the OC RMDA and will serve as the liaison between the State and the local zone participants Staff surveyed all 36 Zone Administrators throughout the State to assess the time needed to administer the RMDZ and all Administrators indicated that it was less than 5-10 hours per month and that the Administrator essentially serves as a conduit between the business community and CalRecycle As the Zone Administrator, the City of Huntington Beach will receive funds to cover advertising, outreach, trade shows, business tracking and marketing, and other qualifying projects RMDZ participation complements Staff resources as CalRecycle staff will work with City Staff to provide educational materials, business outreach, referrals, and loan assistance The goals of the RMDZ program are to encourage manufacturing with secondary materials in order to reduce waste, extend landfill capacity, divert materials away from the landfill, market reused and recycled content products, and to support the local economy The RMDZ program assists businesses that combine environmental innovation with economic growth The program encourages increased efficiencies in business processes, which can result in reduced use of water, energy, and waste along with decreases in air and water pollution The proposed zone will include a Commodity Exchange Marketplace where businesses can trade and/or sell discarded materials with other businesses located within the Zone, thereby creating a robust circular economy The City will also be able to leverage the RMDZ program for potential funding through Included in the City's annual AB 939 Compliance Report to the State, thereby enhancing the City's ability to comply with such State mandated programs With regard to the economic growth potential provided by the RMDZ, this program will further establish Orange County and the City of Huntington Beach as an innovative leader in new technologies, and will increase job growth in the manufacturing, energy, and environmental sectors The proposed OC RMDZ has received widespread support from the following agencies/organizations Orange County Business Council, Clean Tech OC, Association of California Cities-Orange County, Republic Services (dba Rainbow Environmental Services) Huntington Beach Chamber of Commerce, the County of Orange, the Cities of Garden Grove, Santa Ana, Stanton, and Orange Letters of support from the aforementioned agencies are attached The OC RMDZ will be a collaborative effort between the City and the local business community As the Zone gains traction within Orange County, the City can request that CalRecycle re-open the application so that it may be amended to include other interested Orange County cities Environmental Status This project is THE DESIGNATION OF THE CITY AS A RECYCLING MARKET DEVELOPMENT ZONE, AUTHORIZING THE RECEIPT OF PAYMENTS, DESIGNATION AS THE LEAD AGENCY, AND EXEMPTION FROM THE CALIFORNIA ENVIRONMENT QUALITY ACT WHEREAS, California Public Resources Code Section 42010 provides for the establishment of the Recycling Market Development Zone (RMDZ)program throughout the State which provides incentives to stimulate development of post-consumer and secondary materials markets for recyclables; and All California jurisdictions must meet a 50%reduction in landfill waste disposal as mandated by the California Integrated Waste Management Act; and The development of local markets for recycled materials would seduce the need to transport them out of the region in the future; and The cuiient and proposed waste management practices and conditions are favorable to the development of post-consumer and secondary waste materials markets; and The designation of a zone in the Cities of Huntington Beach, Orange, Garden Giove, Santa Ana, Stanton, and Unincorporated Orange County with the City of Huntington Beach as the lead agency dedicated to establishing, sustaining and expanding recycling-based manufacturing businesses, is essential for market development and to assist these jurisdictions in meeting the established landfill waste reduction goals, and The designation as an RMDZ is necessary to facilitate local and regional planning, coordination, and support existing new and existing recycling-based manufacturing businesses, as well as attract private sector recycling investments to the RMDZ, and RMDZ designation would make existing and new recycling-based manufacturing businesses located within the proposed zone eligible for the technical and financial incentives associated with the RMDZ program, and The City of Huntington Beach may receive RMDZ program related payments as authorized by Public Resources Code; and The California Legislature has defined environmental justice as "the fair treatment of people of all races, cultures, and incomes with respect to the development, adoption, implementation, and enforcement of environmental laws, regulations and policies" (Government Code section 65040.12(e)), and has directed the California Enviionmental Protection Agency to conduct its programs, policies, and activities that substantially affect human and low income populations of the State (Public Resources Code section 71110(a)); and The CalRecycle in its Strategic Plan, has adopted a goal to continuously integrate environmental justice concerns into all of the Department's programs and activities; and The Cities of Huntington Beach, Orange, Garden Grove, Santa Ana, Stanton, and the unincorporated areas of Orange County have agreed to submit an application to CalRecycle requesting designation as a RMDZ; and The City of Huntington Beach has agreed to act as Lead Agency for the proposed designation of the RMDZ; and In accordance with the California Environmental Quality Act(CEQA), the City of Huntington Beach finds that the designation of the RMDZ is exempt from CEQA; and The City of Huntington Beach on the basis of the entire record before it, finds that there is no substantial evidence that the requested designation as a RMDZ will have a significant effect on the environment; and The City of Huntington Beach will file a Notice of Exemption with the County of Orange Recorder and the California Office of Planning and Research and the Notice of Exemption from CEQA is available from the Lead Agency's custodian of records: (City Clerk's Office), NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: 1. I have made Huntington Beach my home for more than 21 years and have operated my business in Huntington Beach for almost 20. Today, on behalf of the Board of Directors of the HB Chamber of Commerce, it is my pleasure to enthusiastically endorse obtaining an RMDZ designation for Huntington Beach. This will provide us with a great economic development tool that utilizes the growing supply of recyclable material to fuel new business, expand existing ones, create jobs, and divert waste. Inclusion in an RMDZ fosters businesses that manufacture products using secondary materials or that seek to partner with companies who produce scrap and waste that may be viable feedstock for their manufacturing operations,thus diverting material from landfills. This type of program will help to stimulate the expansion of recycled content product manufacturers and will attract new businesses to our city. The city has already received strong indications from several companies that they would consider moving to HB should the city adopt the RMDZ. This will create new jobs for our residents, increase local revenues to the City and provide investment incentives for local businesses to expand and reinvest in Huntington Beach. Currently the City has 226 businesses that would qualify under the RMDZ loan program (information based on SIC codes that have been funded)—these businesses include Cambro, Melmat,Futures Fins, and Rainbow Disposal among others) Under the RMDZ program, companies would be eligible to receive low interest loans up to $2 million, technical assistance, free product marketing and ultimately recognition for their efforts by both the City and the County. This is economic development, workforce development, entrepreneurship and new clean technologies all wrapped up in one complete package that will be good for the community and good for the environment. Once again,the HB Chamber supports this effort and we urge the Council to do likewise.
