Henricksen City Administrator Huntington Beach, California Dear John: As per your inquiry regarding the City of Orange's trash and rubbish contract, we have had such a contract for the past four years. Our contract calls for daily pick-up in the commer- cial or business area and weekly pick-up in the residential areas. We pay a flat fee of 65 cents per water meter for all areas. The program works fine and we are getting less complaints than when we were doing our own pick-up. We still pick up garbage with our own forces. Mainly, because we had the necessary equipment to do this work. The City has a sanitation charge of $1.00 per housing unit per month. This revenue covers all the expense of trash and garbage pick-up, sweeping the streets and main- tenance on our sewer system. We figure the savings by this contract amounts to about $20,000 per year. I believe you will find that most Orange County Cities have similar contracts, including Santa Ana and Anaheim. We are very happy with our system and would not con- sider changing. The-City.of Anaheim has used the services of a contractor for the collection and disposal of rubbishfor the entire City since April, 1955. Prior to that time, the commercial area was serviced by a contractor and the City crews and 'equipment serviced the residential area. A comprehensive study was made as . to the comparative costs.' and merits. of' each service and our findings favored the contractual idea by a considerable margin of. sevings, but with some re— servations as to merit. We accepted bids and true to our findings, the.'c.ost was about 75% 'of existing costs. After contracting with the "lowest" bidder, we found that this was, the first mistake and lived with a 'miserable situation for about two years. However, for the past year we -have experienced, what I believe to be,: the finest trash and garbage service that any municipality could ask for. The City pays a flat monthly fee of $15,500.00 for residential trash and city—wide garbage service to the Jaycox 'Disposal Company and $3,000.00 per. - month for all commercial -trash service to Anaheim Disposal Company. We find that the present contract, having been recently renewed for three years, is 25% lower in cost than if we were to handle the same. services with City equipment and personnel. ,v A word of warning; John, don!t pick the lowest bidder, pick the most respon— sible. (a) The City shall pay to the contractor for trash and garbage collection and disposal in the areas annexed subsequent to August 1st, 1957 - $ 1.40 per unit per month. (b) For trash and rubbish collection and disposal in the area of the City as it existed prior to August 1, 1957 - $ 1.14 per unit per month. (Note Garbage collection and dis oral has been under contract in this area since City was established. The cost to the City for the collection of garbage and trash will be .paid from the General Fund as it has always been. No one residing in the City will be charged for the service and which has never been done. The City forces are only collecting trash and rubbish in the area (4,5 sq. miles) which existed prior to the annexations subsequent to August 1, 1957. That Company is hereby given the right and privilege for a period of five (5) years , commencing October 10, 1962 and ending October 9th , 1967, of collecting, removing and dis.. posing of trash, rubbish and garbage as defined in Chapter 32 of the Huntington Beach Ordinance Code, within the City of Hunting- ton Beach, as the boundaries now exist, or may hereafter be alter- ed, and the disposal of such refuse at any company dump or trans- fer station dump unless otherwise provided for. 3. That Company shall cause to be collected, removed and disposed of , all garbage and trash from the cans and recept- acles within the above defined area where trash and garbage has been placed, in accordance with Chapter 32 of the Huntington Beach Ordinance Code, or as it may be amended. 4. Company shall at all times during the term of this agreement keep and maintain, in good operating order, sufflo- lent trucks and other equipment to properly and adequately ser- vice the area covered by this Agreement. 5. Company shall maintain miminum schedules for collect. ion as follows Residential and Non-Commercial: Garbage - Two times per week Trash - Two times per week 2. Commercial Establishments: Garbage - Daily,excluding Sunday Trash - Daily,excluding Sunday 6. That as referred to herein, in addition to the de- scription of rubbish and trash, as set forth in Chapter 32 of the Huntington Beach Ordinance Code, °trash' , for the purpose of this agreement is defined as waste paper, cans, bottles, glass, metal, grass, trimmings of all kinds and all types of debris gen- erally referred to as "trash and rubbish". For the purpose of this agreement, trash will not need to be tied in bundles and the use of 55 gallon oil drums as receptacles for trash will be permitted. 7. That the word, "garbage" , as used, and whenever used In this agreement, shall mean and be construed to mean, all vege« table and animal refuse which may be placed in cans or receptacles placed in or along the sides of any public alley in the City of Huntington Beach, or at any other convenient place provided there for, or as may be designated by the Health Department of the City of Huntington Beach. In the event that any public alley shall be impassable due to any reason whatsoever and such garbage cans are placed in parkways adjacent to the streets fronting on said property, that during such times as said alleys may be impassable, the collection of said garbage shall be made from said parkways bar Company. 8. That all work done hereunder by the Company shall be done in such method and manner so as to conform with the provis. ions of Chapter 32 of the Huntington Beach Ordinance Code as the same now provides , or may be amended to provide, and Company fur.. then agrees that in the disposal and handling of such trash and garbage, they will comply with all City and County ordinances and 3. State regulations pertaining thereto. 9. Company agrees that upon removing garbage from recept- acles it will replace said receptacles and replace the covers therewith; that it will not allow or cause any garbage to spill, while handling the same, upon any public street or private prop. erty and will use proper care in the handling of said receptacles so as not to destroy or damage the same more than is reasonably necessary under proper handling of the same. 10. City shall pay to the Company for services rendered, under the terms of this Agreement, each calendar month, as fol- lows : First 19100 units - $1.60 per unit per month Next 400 units - 1.55 per unit per month Next 500 units - 1.s0 per unit per month Next 500 units - 1. 5 per unit per month All Over 20500 units - 1.40 per unit per month For the purpose of this agreement, one unit shall be con- sidered as a single house, apartment or a small business estabe lishment, as provided in Chapter 32 of the Huntington Beach Or- dinance Code, or as it may be amended. 11. The company, or any partner, shall not sell, assign, or transfer this Agreement, or any interest therein, without first obtaining the consent of the Huntington Beach City Counoil. Until the adoption of any ordinance by the City Counoilj the Company may sell or otherwise dispose of garbage and salvage materials after the same has been collected. 4. 12. Company shall, at all times, during the life of this Agreement, keep on file with the City of Huntington Beach, a bond in the sum of $20,000.00 to the effect that Company will faithfully perform its contract and comply with all of the ordi- nances of the City relating to the care, control, collection and disposal of garbage, refuse, filth and trash. 13. Company agrees that for the purpose of transporting any garbage under this contract, it will provide, maintain and use at all times mentioned herein, trucks suitable in size, which trucks shall be equipped with a metal body and be provided with a cover which shall sufficiently and amply cover the contents of said trucks, and said covers shall be so arranged at all times while said trucks are upon the public highways , alleys or any public places, so as to corer any filled portion of said trucks and shall be so arranged and kept that during actual collections of garbage there shall be a sufficient opening for placing said garbage in said trucks , but that no more of the garbage in said trucks shall be uncovered than shall be necessary for such purpose, and at any time while transporting garbage upon the public streets while not actually collecting garbage from receptacles, the entire contents of said trucks shall be covered. 14. Company shall report monthly the number of units in each area served by Company during the month and the amount paid to Company shall be based upon the number of units in the area served by Company. City reserves the right to make actual counts from time to time, of the units served by Company and Company agrees to co-operate with the authorized personnel of City in counting the units. 5. Company shall, at all times during the term of this Agreement, abide by all rules, regulations and statutes of the State of California respecting the employment of labor under this contract, and shall keep in full force and effect adequate Workmens' Compensation on its employees. 16D' Company shall keep in full force and effect during the life of this agreement, a policy of public liability and prop. erty damage insurance, in such amounts as shall be deemed satis. factory to the City Council, and in which policy the City shall be named as an additional assured and Company shall furnish City written evidence of said. poliey or policies. 17. City reserves the right to cancel this agreement upon thirty (30) days written notice to the Company in the event that Company shall be in default in any of the terms, covenants and conditions as set forth in this Agreement, or in the event that Company shall fail to comply and abide by all of the require- ments and provisions of Chapter 32 of the Huntington Beach Ordi- nance Code, as the same now exists, or may hereafter be amended. Upon such default, the City shall have the exclusive right to rent and operate any or all trucks, trailers, tractors, bulldozers and other equipment used by the Company in the performance of the work specified in this Agreement. Such rental shall be upon a reasonable basis until other arrangements can be made by the City and tke rental of garbage or refuse trucks shall be at the rate of $25.00 per day.
