HomeMy WebLinkAboutFY 2015-2016 Huntington Beach Auto Dealers Association Busin Dept ID ED 15-16 Page 1 of 2 Meeting Date 8/17/2015 CITY OF HUNTINGTON BEACH REQUEST FOR CITY COUNCIL ACTION F MEETING DATE: 8/17/2015 SUBMITTED TO: Honorable Mayor and City Council Members SUBMITTED BY: Fred A Wilson, City Manager PREPARED BY: Ken Domer, Assistant City Manager Kellee Fritzal, Deputy Director, Business Development SUBJECT: Public Hearing to consider adoption of Resolution No 2015-43 approving an Annual Assessment within the Huntington Beach Auto Dealers Association Business Improvement District (BID) for Fiscal Year 2015-2016 Statement of Issue On July 20, 2015, the City Council approved Resolution of Intention No 2015-34, to levy an assessment for the Huntington Beach Auto Dealers Association Business Improvement District and authorized the City Clerk to schedule a public hearing for August 17, 2015 The City Council is requested to conduct a public hearing and consider adopting a resolution to approve the annual assessment for Fiscal Year 2015-2016 Financial Impact Revenues and expenses are included in the 2015-2016 Huntington Beach Auto Dealers Association Business Improvement District Budget (Fund 701 $101,520) Recommended Action A) Conduct the Public Hearing, and, B) Adopt City Council Resolution No 2015-43, "A Resolution of the City Council of the City of Huntington Beach Approving an Annual Assessment Within the Huntington Beach Auto Dealers Association Business Improvement District for Fiscal Year 2015-2016 " Alternative Action(s) Do not approve the Resolution and modify elements of the Annual Report, such as the proposed assessments, activities and/or improvements to be funded Analysis At the request of the Auto Dealers Association, the City Council formed the Auto Dealers Association Business Improvement District (BID) in September 1992 to fund the Dealers' obligation to operate and maintain the electronic reader board sign located adjacent to the 405 Freeway and to fund other promotional activities that benefit the auto dealers Since that time, they established and continue to operate the "Boulevard of Cars Store" at Bella Terra, with an average of 750 people per month visiting the desk For Fiscal Year 2015-2016, the Auto Dealers BID anticipates an operating budget of $101,520 and has a cash reserve balance of $1,000 On June 12, 2015, the Auto Dealers BID Advisory Board approved its annual report and proposed 2015-2016 assessment schedule and budget No xB -3 3 7- Item 13. - 1 Dept ID ED 15-16 Page 2 of 2 Meeting Date 8/17/2015 changes have been made to the assessment amount per dealer, and there are a total of ten (110) dealers in the BID However, the budget for 2015-2016 reflects revenue for only nine (9) dealers, as Mitsubishi has closed Thus, no BID fee revenue will be derived from this dealer In order for the City to levy the BID assessment each fiscal year, the City Council must conduct a public hearing before adopting a resolution affirming the coming year's assessments On July 20, 2015, the City Council adopted Resolution 2015-34, affirming its intent to approve the proposed assessments for 2015-2016, and setting the public hearing for August 17, 2015 As required by the California Streets and Highways Code Section 36500 et seq , copies of the Resolution of Intention were mailed to each of the businesses to be assessed A Notice of Public Hearing and copy of the Resolution were published in the Huntington Beach Wave on August 3, 2015 During the public hearing, the City Council will hear all interested persons for or against levying the assessment Protests may be made verbally or in writing However, written protests must be filed with the City Clerk at, or before, the time set for this hearing and contain sufficient documentation to verify business ownership and validate the particular protest If written protests are received from the owners of the businesses in the proposed area that will pay 50% or more of the assessments, no further proceedings to approve the assessment can be taken for a period of one (1) year Environmental Status Not applicable Strategic Plan Goal Enhance economic development Attachment(s) 1 Resolution No 2015-43, "A Resolution of the City Council of the City of Huntington Beach Approving an Annual Assessment Within the Huntington Beach Auto Dealers Association Business Improvement District for Fiscal Year 2015-2016" Item 13. - 2 Hs -338- RESOLUTION NO 2015-43 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH APPROVING AN ANNUAL ASSESSMENT WITHIN THE HUNTINGTON BEACH AUTO DEALERS ASSOCIATION BUSINESS IMPROVEMENT DISTRICT FOR FISCAL YEAR 2015-2016 WHEREAS, the Parking and Business Improvement Aiea Law of 1989, codified at Streets and Highways Code § 36500 et seq (the "Act') authorizes cities to establish packing and business improvement areas for the purpose of imposing benefit assessments on businesses for certain purposes; and The City Council has formed a business improvement area, the Huntington Beach Auto Dealers Association Improvement District (the "District"), by the passage of Ordinance 3175 on September 8, 1992 The City is proposing to levy an assessment for fiscal year 2015-2016 pursuant to the process detailed in Streets and Highways Code §36500, et seq , and The District's Advisory Board has prepared and filed with the City Clerk a teport fol Fiscal Year 2014-2015, ("Annual Report") which sets forth the amount and basis of levying the assessment for Fiscal Year 2015-2016 On July 20 , 2015 the City Council adopted a tesolutron declaring its intention to levy an annual assessment for Fiscal Year 2015-2016 as pi oposed in the District's Annual Report NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve, determine and find as follows SECTION 1 The City Council hereby approves and adopts the Annual Report filed by the Advisory Board in the City Clerk's office attached hereto as Exhibit A and incorporated herein by this reference, which report includes a proposed budget for Fiscal Year 2015-2016 and a description of the improvements and activities to be provided for Fiscal Year 2015-2016 SECTION 2 The City Council of the City of Huntington Beach hereby authorizes a levy and collection of assessments within the District for fiscal year 2015-2016 as proposed in the Annual Report The levy is to apply to small businesses classified by the City of Huntington Beach License Code as Class A Retail Sales, (Al) Auto, New, Used, Parts, including new business of that classification located within the District in the amount of One Thousand Four Hundred Forty-Four Dollars ($1,440 00) per month as set forth on Exhibit B, and incorpotated herein by reference SECTION 3 The assessments collected shall be used to cover costs to operate, upgrade and maintain an electronic reader board located within the City of Huntington Beach west of the intersection of Beach Boulevard and Center Avenue and other promotional and advertising activities 15-4769/122040 1 Resolution No . 2015-43 SECTION 4 This resolution shall take effect on October 01 2015 PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 17 t h day of August , 2015 ayor REVIE D APPROVED: APPROVED FORM. I Dept ID ED 15-13 Page 2 of 2 Meeting Date 7/20/2015 pole banners placed along Beach Boulevard in 2014 promoting the "Shop Play Stay" program in Huntington Beach - On June 12, 2015, the Auto Dealers BID Advisory Board approved its Annual Report and the proposed 2015-2016 assessment schedule and budget No changes have been made to assessment amount per dealer and there are a total of ten (10) dealers in the Auto Dealers BID However, the Auto Dealers BID budget for 2015-2016 reflects revenue for only nine dealers, as Mitsubishi is anticipated to close by December 2015 thus, no BID fee revenue is anticipated from that dealer The Auto Dealers BID anticipates an operating budget of $101,520 and has a cash reserve balance of$1,000 As required by State law, a protest hearing must be held to provide the opportunity for any affected businesses to voice their protests or submit their protests in writing The Resolution of Intention sets this public protest hearing for August 17, 2015 At that time, the City Council will tally the percentage of assessments protested and will hear public comments on the renewal of the Auto Dealers BID If the protests total less than 50% of the total amount of money to be collected, the City Council can approve renewal of the Auto Dealers BID If written protests are received from affected business owners of 50% or more of assessments, no further proceedings to continue the Business Improvement District can be considered for one (1) year The City Council also has the option of reducing assessments or modifying the boundary area if public comments prompt adjustments Environmental Status Not applicable Strategic Plan Goal Enhance economic development Attachment(s) 1 Resolution 2015-34, "A Resolution of the City Council of the City of Huntington Beach Declaring the City's Intention to Levy an Annual Assessment Within the Huntington Beach Auto Dealers Association Business Improvement District for Fiscal Year 2015-2016," including Exhibit A — Auto Dealers BID Annual Report, and Exhibit B — Auto Dealers BID Member List Item 6. - 2 xB -100- RESOLUTION NO 2015-34 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DECLARING THE CITY'S INTENTION TO LEVY AN ANNUAL ASSESSMENT WITHIN THE HUNTINGTON BEACH AUTO DEALERS ASSOCIATION BUSINESS IMPROVEMENT DISTRICT FOR FISCAL YEAR 2015-2016 WHEREAS, the Parking and Business Improvement Area Law of 1989, codified at Streets and Highways Code § 36500, et seq (the "Act") authorizes cities to establish parking and business improvement areas for the purpose of imposing benefit assessments on businesses for certain purposes; and The City Council has formed a business improvement area, known as the Huntington Beach Auto Dealers Association Business Improvement District (the "District"), by the passage of Ordinance 3175 on September 8, 1992 The City is pioposing to levy an assessment for fiscal yeas 2015-2016 putsuant to the process detailed in Streets and Highways Code §36500, et seq ; and The District's Advisory Board has prepared and filed with the City Clerk a ieport for Fiscal Year 2014-2015, ("Annual Repoit") which sets forth the amount and basis of levying the assessment for Fiscal Year 2015-2016 NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve, determine and find as follows- SECTION 1 The City Council hereby approves the Annual Repoit filed by the Advisory Board in the City Clerk's office attached hereto as Exhibit A and incorporated herein by this reference, which includes a proposed budget for Fiscal Year 2015-2016 and a descr iption of the improvements and activities to be provided foi Fiscal Year 2015-2016 SECTION 2 The City Council hereby declares its intent to levy and Uollect assessn)e,its within the District for Fiscal Year 2015-2016 The levy is to apply to small businesses classified by the City of Huntington Beach License Code as Class A Retail Sales, (AI) Auto, New, Used, Parts, including new business of that classification located within the District as shown in Exhibit B in the amounts set forth therein, which exhibit is incorporated herein by this t efer ence -
