Iiartge City Administrator Subject Huntington Beach Union High Date January 28 , 1976 School District This is in reference to the meeting we had with Dr. Hess of the Huntington Beach Union High School District concerning several subjects involving the school and the City. Ocean View High School Site .A:. We have been conferring with District personnel for over a year and reached an agreement that the District would dedicate right of way for Gothard' Street if the City would install. the street. improvements. This is in 'conjunction with the EDA project. Secondly, the District will participate in the cost of the storm drain in Gothard Street adjacent to the school. It was previously anticipated that the District would pay drainage fees, but this proved to be unenforceable for the School District. Also at the Ocean View site, street improvements are to be constructed on Warner Avenue by the City in conjunction with modification of the traffic signal at Goldenwest Street. The District will pay for the improvements on. Goldenwest Street adjacent to the school site. . This work will .be performed as a part of the Warner job. The City cannot require' a school district to install street improve- ments because the District does not take out building permits from the local agencies. Huntington Beach High School We have reached agreement that the City will construct new curb and gutter and new pavement on Main Street in front of Huntington Beach High School if the District would pay for a new sidewalk. and street trees. This work is planned during the summer vacation time of 1976. All of the City cost in these projects will be from Gas Tax funds and from drainage fees. Formal agreement is not necessary at this time, however, I suggest this information be transmitted to the City Council. for an informal approval to proceed. We propose to pay for a 30" storm drain going south along Gothard and that the City build a storm drain on Gothard south of our property line. The City will let. a contract to install a storm drain system ' I in Gothard Street and along a portion of the south area of the school site in conjunction with the Gothard Street construction project. Advertisement for the project should commence in January or February 1976. The School- District will reimburse the City for the cost of that portion of the storm- drain which the District would have had to install if the City were not undertaking the Gothard Street project. The cost for the District's portion is estimated at $77,750.00. The estimate for the City' s portion is $122,250. 00. 2. Traffic warrants at the intersection of :•earner Avenue and Goldenwest- Street, and of Warner Avenue east of Goldenwest Street, 1! indicate that, improvemens are necessary to increase capacities. Improvements will consist of street widening out to and including curb and gutter from the. intersection approximately 1,000 feet easterly. Mork will also include: modification of the traffic signal. It was agreed that we would include in the contract Goldenwest Street widening from the intersection southerly 630 . feet, to be funded by the District. The District pu.t ' up $98; 995 . 80 and Security Fore $150 ,000 I for the project. The City then assigned a $650 .per acre fee in the tributary area. The agreement with the District ,,called for reimbursement by the City to Huntington Beach Union High School District from the per acre fees collected from subse- ,quent development. ' In lieu of paying the $650 per acre. fee on the 50. 08 acre Edison High School site, the District had the $32, 5.50 ''fee.s. subtracted from the gross reimbursable amount leaving a net rembursable ' amount of $66,443 . 0'8 . A similar j agreement was made for repayment to Security Fore. The district put up $98;99S. 80 and Security Fore $1S0,060 foir .the project. The City then assigned a $650 per acre .fee in the .tributery area. The agreement with the District called �6r, teimborsement .by the City to Huntington Beach Union ,High School District from the per acre fees collected from subse- quent development.. In lieu of paying the $650 per acre fee on the. 50.08 acre Edison High School site, the District had the $32,$501ees subtracted from the ross reimbursablelamount keaving 4':net reimbursable amount of 166,443. 08 . If additional users participate in drainage facilities in drainage area No. ?E %nd 7H in the future, the drainage fees they pay will be distributed to these individuals or entities, that have previously contributed to the cost of the pump station in proportion to the. cost borne by each .such individual or entity. -2- r 8. City shall not be liable for payment of refund by reason if its failure to collect or receive from any person or entity the drainage fee. However, City agrees from an administrative, legislative or quasi .judicial procedure to protect the interest.of School District either individuals or entities, who have previously constructed drainage facilities, by the collect- ing of the drainage fees, either prior to or concurrent with the approval of any final maps within the drainage area, if a developer, who is within the - drainage area, is required, as a condition to the 'approval of a tentative or ;i a final map to construct drainage facilities within the drainage area, City may allow said developer credit towards the per acreage fee consistent with ` this said agreement;• City further agrees to furnish a copy of this agreement to the developer of any properties in the drainage area. 9. In the event City must construct additional drainage facilities within this drainage area to allow further development within the area to proceed, City may use funds available from drainage fees collected within . Drainage Area No. 7E and 7H for construction of the additional drainage Al facilities prior to fulfilling the herein stated reimbursement.- L 10. It is understood that the City is not required to institute legal lu ;3 proceedings to protect the interest of the School District, but may do so. 11.
