RESOLUTION NO. 3423 A RESOLUTION OF THE CITY COUNCIL OF THE CITY .OF HUNTINGTON BEACH AUTHORIZING THE EXPENDITURE OF MONEY FROM THE SEWER FUND. WHEREAS, the City Council of the City of Huntington Beach has adopted a budget for the Fiscal Year 1971-72 by Ordinance No. 1651, and WHEREAS Section 5 of said Ordinance No. 1651 provides the procedure for authorizing expenditures from the several Special Funds mentioned in said Section 5, and WHEREAS, the Director of Public Works and the City Administrator have recommended an expenditure, and• WHEREAS, the City Council hereby approves said recommendations, BE IT THEREFORE RESOLVED that an expenditure in the amount of. The agreements for serer and water reimbursement referred to in the addendum agreement proposed by the Huntington Harbor Corporations were entered into by the City of Huntington Beach pursuant to author- ity specifically granted by the Huntington Beach Ordinance Code. We do not feel that the city can amend the two :agreements to provide for payment of the water contract out of funds collected from sewer connections or provide for payment of the contract from funds col- lected from water service connection for the following reasons: Section 1627 of the code is as follows: "Sewer Fund. There is hereby created a .fund to be known as the "Sewer Vun " and all funds received by the city for off-site sewer charges, connection and sewer fees from subdividers, and others, shall be deposited in such fund and shall be disbursed only for the use and purposes of con- struction of sewers, sewer laterals, connections, sewer maintenance and uses incidental thereto." Section 3545 of the code provides that refunds shall be made from subsequent development as set forth in Section 3532 which specifies the sewer connection rates. Such sections clearly prohibit the use of funds collected from sewer users for the payment of the water contract. Section 3449.1 provides in part: "All monies collected from fees and charges under Chapter 34 of the Huntington Beach Ordinance Code shall be deposited in the treasury of the city in the water fund." Section 3454(f) provides that the city shall not be liable for the payment of any refunds if the city should fail to collect the service connection fee for connecting into the main water line. Section 3545(f) has a similar provision for sewer fees. Section 3431 authorizes the city to collect service connection fees for the purpose of reimbursing the city its costs of the water system and future replacement and extensions of such system. These sections, without question, prohibit the city using water funds paid as service connection fees for any purpose except the construc- tion, repair and maintenance of the city water system. However, there is no reason why the general fund could not -be used if the city desires to pay Huntington Harbor off. IBM accounting data from Huntington Harbour Engineering and Construction Company. A summation of these construction costs follows. There are some -further charges still to be made; however, the engineering company assures me that the total cost will not be higher than the $655,000 figure referred to in the agreement. Wheeler City Engineer JRW:JKV:r J { i i 4W AGREEMENT THIS AGREEMEN T elated this �j7 ' day of , 1964, by and t` BETWEEN CITY, OF HLJNTTI1IGTON BEACH, a municipal corporation, hereinafter for convenience referred to as, CITY AND HUNTINGTON HARBOUR CORPORATION, a Delaware corporation, hereinafter called, CORPORATION W I T N E S S E T H: WHEREAS, Corporation is the owner of a large parcel of land located in City and is engaged in developing said property into a marina type development with approximately 641 acres of..land area proposed and with an extensive channel and waterway system; and WHEREAS, Corporation is in the process of dredging and filling said property and constructing improvements thereon and, in connection therewith, has filed with City tract Maps consisting of a portion of the property of Corporation; and WHEREAS; Corporation is .entitled to sewer and water service from City in accordance with established ordinances and regulations of City. ITI order'to serve paid property with se-wer and water, it is necessary to construct sewer main extensions and water main extensions as shown on Exhibit "A" attached hereto. The parties desire by this, agreement to provide for the install- ation and construction of said sewer-and water mains and, in accordance with applicable ordinances and regulations of City, to provide for the initial and ultimate financing with reference thereto. Number 106 1. . NOW THEREFORE, Corporation agreed to construct the sewer.and water mains as shown on .Exhibit "A" attached-hereto. Said sewer and water mains were built to a size and to the design and specifications of City. Corporation did advance; all costs in connection with said improvements and upon completion and acceptance by City ;will transfer title thereto to City. Said improvements were constructed in public right of ways and City hereby authorized Corporation to construct said improvements as shown on Exhibit "A" attached hereto. 111 ,e total construction cost of the sewer train extension Including the surer. pump stations is the rum of $385,736.94 and the construction cast of the water main installation is the gum of $262,466. 18, .both exclusive of engineering and inspection charges'. Actual construction costs were deter- mined upon completion of said projects and includes all labor, materials, engineering, and all other costs attributable to the construction of said projects. Under Section 3631 of the Huntington Beach Ordinance Code, Corporation is subject to a sanitation charge for each acre or fraction thereof of the land area developed and served by the sewer lines of City. 3y virtue of the undertaking of Corporation to construct the above referenced sewer lines, Corporation Is hereby credited with payment of said charge for 6.41 acres, the estimated area of land proposed to be developed and so served. In the event then this figure will be adjusted as between the parties based upon the ,acreage of land developed and served. In the event that any of the lands now owned by Corporation are later acquired by a public agency and so served and the acreage charge is warred by the City Council in whole or In pert, then Corporation shall be credited back with,the portion,so waived, The land area developed by Corporation and served by the water system of City is subject to a charge, pursuant to Section 3534 Sub Section "A" and 9R " of the Ordinance Code of City. In view of Corporation's commitments to install the, water mains above referenced, City hereby` credits Corporation with the payment of said acreage charge for 41 acres. In the event that more 2. or less land area is so developed and served by Corporation, then the amount of .such charge shall be adjusted as between the parties according to the true acreage so developed and served, In the event that any of the lands now owned by Corporation are later acquired by a public agency and the City Council waives in whole or in part said acreage charge, -then Corporation shall be credited back with the amount so waived. City agrees to,refund to Corporation the cost of the construction of said sewer main and appurtenances by paying to Corporation the sanitation acreage charge levied against the property of others and served by said sewer lines in accordance with the provisions of Section 3644 of the Ordinance Code of City, except that refunds shall be payable for a period of five (5) years_only commencing with the date of the last applicationJor sewer service by Corporation with respect to said 641 acres of land area. City agrees to refund to Corporation the cost of said water main extension and appurtenances by paying to Corporation the water service charge levied against the property of others and served by said water line in accordance with the provisions of Section 3556.2 of the Ordinance Code of City, ex cept that refunds shall be payable for a period of five (5) years only commencing with the-date of the last application for water service by Corporation with respect to said 641 acres of land area. It is mutually agreed that this contract shall extend to, and be binding,upon the successors and assigns of the respective parties hereto. HUNTINGTON shall exercise said option 23 within ninety (90) days after receipt by its Secretary of 24 written notice of such opportunity, or said option shall lapse of 25 its own terms and be of no further effect ; provided, however, that 26 during the five (5) year period following such notice, HUNTINGTON 27 shall have (1) the right of first refusal upon the sale of said 28 property at the fair market value thereof; or (ii) in the event 29 CITY wishes to lease such property on different terms than those j 30 offered to HUNTINGTON, HUNTINGTON shall have a ninety (90) days 31 ' opportunity to accept a lease on such different terms . 32 5.
