Please be advised that Section 3545 of the Huntington Beach Ordinance Code states, ."Notwithstanding any other pro visions of this Ordinance the payment of .refunds shall be governed as follows: (a) refunds shall be payable for a period of five (5) years only from date of applicant' s application for sewers" . Such application having been made by-Jones and Jones in 1964' the five year period has expired and further refunds cannot be made. As you can see, the bid of Nottingham is entire reversed from the other bids as to its segregation of costs with reference to the line under the boulevard as compared to the lateral . The other three bids are within a couple of hundred dollars or so on the lateral required but vary on the line under Beach Blvd . , Scott Bros . bid being considerably cheaper. It would appear that the lowest and most responsible bidder is Scott Bros. Construction, but since this is a matter of interest to the City, in that we will be claiming immediate reimbursement for the cost of the line, under Beach Blvd.' and that the property owners will eventually be reimbursing the City for a part of the cost of- the lateral, I would .like to have the City' s approval before finally accepting the Scott Bros. bid . Our present plains are to construct a first-class office building for legal offices consisting of ap zoKinately 6300 feet. The parcel an which we propose to build an office building is Identified by diagonal lines, and is Parcel 2 with l".91 feet of frontage as compared with 751.20 ftontap of all the parcels Involved, 1 through 6, the frontage an Parool 6 -bring computed along Talbert Avenue. The sewer line IS across Beach Boulevard at this point.. The psoporty Routh of us is tied into the midway City Sanitary District aeons Sterling Avenue. The property north on the other sad• of Talbert has no need for sewerage facilities and the property at our east is a school ground. Therefore, there to no need for not any use for a line extending dawn Beach on the 6"t side of the street except to serve these six parcels. It is possible for our parcel, along with Pascal No* ' I to tie in with the Midway City Sanitary District line and this solution is shown in Sshabit "A". How"mr, this would appear to be highly uneconomical since then the Jack under Beach Boulevard °would only serve the four remaining parcels, which could not, because of their elevation Problems, drain into the Midway City sanitary District sewer.
