Dear Mr. Findley:
This letter is in response to your telephone inquiry of
August 3.0, 1974, regarding reimbursement for a sewer main
built in Beach Boulevard in 1964.
Please be advised that Section 3545 of the Huntington
Beach Ordinance Code states, ."Notwithstanding any other pro
visions of this Ordinance the payment of .refunds shall be
governed as follows: (a) refunds shall be payable for a period
of five (5) years only from date of applicant' s application for
sewers" . Such application having been made by-Jones and Jones
in 1964' the five year period has expired and further refunds
cannot be made.

Gentlemen:
It is recommended that funds in the amount of $507.84
be transferred from the sewer fund account and that reim-
bursement be made to Jones & Jones, Attorneys, as was
previously agreed for their construction of off-site sewer
across Beach Boulevard. Sewer fees of $180.00 from
Huntington Valley Mortuary and $327.84 from Der Wiener-
schnitzel International, which are served .by this off-site
sewer, have been collected. The remaining balance due on
this reimbursement will be $3,315.16.

this letter.
As you can see, the bid of Nottingham is entire reversed
from the other bids as to its segregation of costs with
reference to the line under the boulevard as compared to
the lateral . The other three bids are within a couple
of hundred dollars or so on the lateral required but vary
on the line under Beach Blvd . , Scott Bros . bid being
considerably cheaper. It would appear that the lowest and
most responsible bidder is Scott Bros. Construction, but
since this is a matter of interest to the City, in that we
will be claiming immediate reimbursement for the cost of
the line, under Beach Blvd.' and that the property owners will
eventually be reimbursing the City for a part of the cost of-
the lateral, I would .like to have the City' s approval before
finally accepting the Scott Bros. bid .

Gentleman:
We wish to apply for soaae form of relief from a situation that
is affecting ou= ia�ra�nt of a one acre lot between Talbert
and sterling Avanuoa on Beach Boulevard. Our present plains are
to construct a first-class office building for legal offices
consisting of ap zoKinately 6300 feet. The plans are presently
out for bld and are to be returned the eeld of this month.
The pribles is is a sewer tonne ation. Attached are three
Exhibits "A", "8", and "C", together with three smaller pages
breaking down construction costs and tbomselvss labelled to tie
In with the large RKWbits. The parcel an which we propose to
build an office building is Identified by diagonal lines, and
is Parcel 2 with l".91 feet of frontage as compared with 751.20
ftontap of all the parcels Involved, 1 through 6, the frontage
an Parool 6 -bring computed along Talbert Avenue.
The sewer line IS across Beach Boulevard at this point.. The
psoporty Routh of us is tied into the midway City Sanitary
District aeons Sterling Avenue. The property north on the other
sad• of Talbert has no need for sewerage facilities and the
property at our east is a school ground. Therefore, there to no
need for not any use for a line extending dawn Beach on the 6"t
side of the street except to serve these six parcels. It is
possible for our parcel, along with Pascal No* ' I to tie in with
the Midway City Sanitary District line and this solution is shown
in Sshabit "A". How"mr, this would appear to be highly uneconomical
since then the Jack under Beach Boulevard °would only serve the four
remaining parcels, which could not, because of their elevation
Problems, drain into the Midway City sanitary District sewer.
M blbit "B", assuming a Jack is brought across at Talbert, wound
drain all parcels satisfactorily, but would cost $IS.02 per front
foot for the six parcels involved, and the Iii a down Talbert would

Beach Boulevard at about the middle of the sic parcels involved
appears to be the most economical and it appears to being dove
the cost of the front foot of the parcels involved to $13.43, of
which the cost of jacking under beach Boulevard awuunts to $8.6S
per front foot.
It is cry understanding that for a property owner an the vent side
of Beach the only ewer cost would be the $300.00' per aare annexa-
tion fee and that the property to the east oa Beach is paying in
its general tax rate a pro rata most of that sewer. it appears to
be bas icaal ly unfair for the property owners in these six parcels
to pay such a high penalty for a sower connection and still be
subject to the city's general tonneso nail that it would not be asking
too aauch of the city to themselves finance the crass-oves undo;
Beach Boulevard and leave the psopesty owners with the bux4sn of
paying the normal annexation fee and the cost of the sows lines
required once this arose-*vex utdes Beach is made,, beating in Mind
that they are still by this netbod paying their answwation f o ,and
