OF HUNTINGTON BEACH AUTHORIZING PAYMENT ON
REIMBURSEMENT AGREEMENT #70-D1

WHEREAS, the City Council of the City of Huntington Beach
adopted a budget for fiscal year 1976-1977 by. Resolution
No. 4270); and

Section 5 of said Resolution No. 4270 specifies the
procedure for authorizing expenditures from special funds ;
and
The Director of Finance and the City Administrator have
recommended an expenditure, and the City Council hereby ap-
proves said recommendation,.
NOW, THEREFORE., BE. IT RESOLVED by the City Council of
the City of Huntington Beach that payment on ;Reimbursement
Agreement #70-D1 in the sum of $15,007,9.3 from Drainage
District 6C Fund is hereby authorized to be made to Joseph
Holtz as full payment for storm drain built in conjunction
With Tract 6317 .

Attached please find revised expenditure and revenue estimates
prepared by the Public Works Department. Based upon these amounts
it appears that there is sufficient cash to make the requested
payment-.-
It should be noted that the expenditure requirements in the future
are tied to the development of the last parcel of land in the district.
Therefore, no negative cash flow is anticipated.as a result of these
expenditures.

Subject Drainage District 6C Fund Date December 27 , 1976
In order to provide sufficient funds in Drainage District 6C,
I will be requesting an ordinance change to increase the 6C fees
from $2,000 to $3,000 per acre. This will generate additional
drainage fees in the amount of $7 ,500 from the last parcel of land
to develop in 6C. It is also important to note that this depart-
ment has reviewed its estimate for the Master Planned storm drain
for Magnolia Street and now estimates the cost of these facilities
to be $35,000. 00 plus 10% for contingency.
Based on this new information and figures supplied by Art
DeLaLosa (see Art' s memo dated 12-14-76) , the financial posture of
the 6C fund is as follows :
Revenue to date $204,583 . 95
Expenditure to date 167 ,943.76
Current balance 36, 640. 19
Recommended payment on RA 70-Dl 19 ,007. 93
17 ,632. 26
Future revenue 22 ,500. 00
40 ,132 .26
Future storm drain expenditure 38,500. 00
Projected 6C surplus 1, 632 . 26
Please consider this information and notify this department
if we can proceed with City Council approval for final payment on

WHEREAS, the City Council of the City of Huntington Beach has
adopted a Budget for the Fiscal Year 1970-71 by Ordinance No. 1585, and
WHEREAS, Section 5 of said Ordinance No. 1585 provides the
procedure for authorizing expenditures from the several Special Funds
mentioned in said Section 5, and
WHEREAS; the Director of Public Works and the City Administrator
have recommended an expenditure, and
WHEREAS, the City Council hereby approves said recommendations,
BE IT THEREFORE RESOLVED that an expenditure in the amount of
`Pen Thousand Nine Hundred Fifty-Four and 39/100 dollars ($10,954.39) is

Subject Information Errors on Holtz Date December 8, 1976
Agreement (RA 70-D1 )
The information supplied by your department is apparently in error with regard
to fees applicable to the subject agreement. The attached memo reflects much
more than the originally allocated $580.00 per acre as being attributed to the
storm drain system. It thus results in a significant overstatement of fees
applicable to RA 70-D1 . Although there has been an increase in fees to $2,000
per acre, it is logical that the pump station still receives the greatest share
of the revenue paid in. This is due to the original relationship between pump
station and storm drain costs. It, therefore, does not follow that all of the in-
crease in fees received should be applied solely to the storm drain construction
costs. When the proper allocation has been made, on a rational basis of apportion-
ment, the true amounts applicable to the Holtz agreement will be ascertained.
Please note that the fact that the pump station has already been reimbursed is of
no consequence. This is because there is no evidence that funds received in the
past and paid to the pump station agreement were properly apportioned. (Therefore,
it is conceivable that other storm drain fees were paid to RA 145 in error) . Since
those amounts were received from other areas not served by RA 70-D1 , there would be
no credit due this agreement as a result of prior pump st tion payments.

Revenue and Expenditures
Accounting has completed the verification of revenue and expenditures relating
to Drainage District 6C. The attached schedules which were compiled by Public
Works have been completely documented with the exception of the expenditure dated
January, 1970 for $12,725.88 and the revenue entry dated August 20, 1965 for
$858.00. The impact of the expenditure is to increase the surplus and conversely
the revenue will decrease the surplus. Verification of these transactions in
earlier years is difficult due to the incompleteness of records.

BURSEMENT OF DRAINAGE FEE FROM DISTRICT 6C
WHEREAS, the City Council of the City of Huntington Beach
has adopted a budget for fiscal year 1974-1975 by Resolution
,• No. 3900; and
Section 5 of said Resolution No. 3900 specifies the
Procedure for authorizing expenditures from special funds;
and
The Director of Finance and the City Administrator have
recommended an expenditure; and
The City Council hereby approves said recommendation,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Huntington Beach that reimbursement from Drainage

Enclosed is a resolution requesting that sum be reim-
bursed, the check be made payable to Joseph L. Holtz, and
the check be returned to this office for transmittal.

REIMBURSEMENT AGREEMENT
THIS AGREEMENT entered by and between the CITY OF
HUNTINGTON BEACH, a. municipal corporation, hereinafter .called
CITY, and JOSEPH L. HOLTZ,, assignee of- Hampshire Land Company,
hereinafter called1DLTZ.,
W I T N E S S E T H:
WHEREAS, Hampshire Land Company has constructed storm
drain facilities in conjunction with the development of Tract
No. 6317 in the City of Huntington Beach, at its own. cost and
expense, and in conformity with the plans and specifications
approved by the Director of Public Works, and. in accordance with
the Huntington Beach Ordinance Code, the Master Plan Drainage
Study for Drainage Area No. 6C; and
Pursuant to ordinance, Hampshire Land Company is en-
titled to reimbursement of the costs and expenses of constructing
said drainage facilities; and
Said Hampshire Land Company has assigned-'-.to Joseph L.
Holtz its right to receive said reimbursement,
NOW, THEREFORE; in consideration. of the premises and
agreements herein contained, CITY and' JOSEPH L. HOLTZ do hereby
agree as follows :
1. The cost . of constructing the storm drain facilities
in conjunction with Tract 6.317 in Storm Drain Area No. 6 C,
and the amount to be paid to HOLTZ is Sixty-three Thousand Four
Hundred Ninety-nine and 43/100ths Dollars ($63,499 .43) .•
2 . Reimbursement to HOLTZ shall be made from drainage
fees collected from developers of other lands in Drainage Area
No. 6C at the rate of Thirteen Hundred Dollars ($1300 ..00) per
acre (see Exhibit "A" for area served) , provided that if said
other developers construct or participate in the construction of
additional drainage facilities in Area 6C, the drainage fees
due from such developers may be reduced .by the amount of the costs

of such construction.
. 3 . If subsequent developers construct or participate
in the construction of drainage facilities in Drainage Area
No.. 6C, the drainage fees collected thereafter will be distri-
buted to developers., individuals or entities that have previously
contributed to the cost of constructing drainage facilities, in
proportion to the costs borne by each such developer, individual
or entity.
4 . Reimbursement shall be made by the Finance Director
of CITY upon certification by the Director of Public Works as
the work progresses,. to the extent that funds are available from
drainage fees collected as hereinabove provided.
5 . CITY shall not be liable for .reimbursement by
. reason of CITY'S failure to collect or receive from any developer,
individual or entity any drainage fee . However, CITY agrees that
as an administrative , legislative or quasi ,judicial body, it 'will
protect the interest of developers who 'have previously constructed
drainage facilities by collecting the drainage fees, subject to
the limitation in Paragraph 3, either prior to or concurrent with
the approval of any final maps within the drainage area. CITY
further agrees to furnish a copy of this agreement to any sub-
sequent developer of properties in the drainage area.
6 . In the event CITY does not require a developer
within the drainage area to deposit the drainage fee with CITY,
subject to the limitation in Paragraph .3, CITY will provide in
an agreement with said developer that developer is obligated not
only to CITY but also to developer who has previously contributed
to the cost of construction of drainage facilities within
the drainage area. Said agreement .will further provide that in
the event it becomes necessary to institute legal proceedings
to enforce the rights of the parties thereunder, the prevailing
party shall be entitled to reasonable attorney's fees, provided,
however, that CITY shall not be required to pay the attorney s .
fees for any of the parties . it is understood that CITY is not

required to institute legal proceedings to protect the interests
of developer, but may do so.
7 . in the event CITY must construct additional drainage
facilities within this drainage area, CITY may use funds available ,
or be reimbursed from drainage fees collected within Drainage
Area No. 6C for construction of said additional drainage facilitis
prior to fulfilling this agreement .

Land Company, a California corporation, all his rights under
the agreement ("said agreement") between himself and JOSEPH
LEO HOLTZ set. forth in Exchange Excrow Instructions in Escrow
No. 875860 at First American Title Insurance and Trust Com-
pany, 421 North .Main Street , Santa Ana , California, and
Hampshire Land Company hereby assumes all obligations of
.Rubin ana agrees to execute all documents that Rubin is
obligated to execute under said agreement .

The undersigned hereby assigns to JOSEPH L. HOLTZ all rights
to reimbursement from the City of Huntington Beach from. connection
fees collected by the City for connections made to the sewer and
water facilities required .to be installed to the property described
on Schedule A attached hereto.
The .undersigned directs the City of Huntington Beach after
completion of the sewer and water facilities as hereinabove pro-
vided for and approval of the City of Huntington Beach to enter
into Reimbursement Agreement directly with Joseph L. Holtz as the
assignee of the undersigned. .
This assignment is binding on successors in interest of both
parties .
