Hopkins, PE, Director of Public Works SUBJECT: Adopt Resolution of Intent No. 2012-30 calling for a Public Hearing on July 16, 2012 regarding the formation of the Edinger Avenue Utility Underground District Statement of Issue: Staff recommends for overhead utilities on Edinger Avenue between Gothard Street and Marjan Lane to be placed underground. Per Huntington Beach Municipal Code Section 17.64.090, a public hearing is required to ascertain if public necessity,'health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures within a designated area. The subject Resolution will provide for notification of a public hearing regarding the formation of the Edinger Avenue Utility Underground District. Financial Impact: No funds required for this action. Recommended Action: Motion to: Adopt Resolution No. 2012-30, "A Resolution of the City Council of the City of Huntington Beach Setting a Public Hearing to Determine Whether Public Necessity, Health, Safety or Welfare Require the Formation of an Underground Utility District on Edinger Avenue Between Gothard Street and Marjan Lane." (Per HBMC 17.64.100, affirmative vote of at least five (5) members of City Council is required) Alternative Action(s): Deny the recommended action and direct staff on how to proceed. HB -61- Item 8. - I REQUEST FOR COUNCIL ACTION MEETING DATE: 6/18/2012 DEPARTMENT ID NUMBER: PW12-025 Analysis: Currently, there are areas within the City where utility service is provided to residential and commercial customers by way of overhead wires from utility poles within the public right-of-way. It has been an ongoing goal of the City to have overhead wires and poles removed along the major arterial roadways of the City. The removal of overhead wires and poles improves the general appearance of the street and reduces the potential for accidents. The California Public Utilities Commission (PUC), has adopted a requirement that public utilities set aside funding for Underground Utility District infrastructure costs. This requirement is referred to as Rule 20 for Southern California Edison (SCE) infrastructure and Rule 40 for telecommunications infrastructure. Staff notes that all aerial wires are included in this District except the SCE 66 kilovolt (kV) electrical transmission wires, which are exempt from undergrounding by Municipal Code 17.64. SCE has accumulated a balance of approximately $2.7 million to be used for an undergrounding project in the City of Huntington Beach. The Huntington Beach Municipal Code Chapter 17.64, Undergrounding of Utilities, establishes a five member Underground Utilities Coordinating Committee, which includes the Director of Public Works, the Director of Planning, an appointee of the City Manager, a Southern California Edison representative, and a Verizon representative. This Committee's duties include providing priority recommendations to the City Council for their consideration and approval. The Committee meets on an as-needed basis, which is typically every 3 to 5 years as the accumulation of Rule 20 funds are available. Past Undergrounding Committee actions have identified, Beach Boulevard, Brookhurst Street and Edinger Avenue as top priority corridors. Since that time, the undergrounding of utilities along Beach Boulevard has been completed and undergrounding of utilities along Edinger Avenue from Beach Boulevard to Gothard Street was completed and funded by private development. Also, since that time, the City adopted the Beach/ Edinger Specific Plan in an effort to reinvigorate the Beach Boulevard and Edinger Avenue corridors. Given these subsequent events, the City's Underground Utility Committee met on February 9, 2012 and determined that Edinger Avenue from Gothard Street to Marjan Lane would be recommended to the City Council as the next prioritized Utility Underground Project to pursue. The cost of this project is estimated by SCE at approximately $2.4 million. The remaining underground project, Brookhurst Street, has a 2005 SCE rough order of magnitude cost of $4.8 million from Garfield Avenue to Adams Avenue. Using this as a basis, the entire length of Brookhurst, from Garfield Avenue to Pacific Coast Highway, would costs about $15 million. The Municipal Code requires that the Planning Commission review the formation of the District and determine its conformance with the City's General Plan. On April 24, 2012, the Planning Commission so acted and approved General Plan Conformance No. 12-001. As a prerequisite to the establishment of a District, two resolutions must be adopted by City Council. The first resolution calls for a public hearing to establish the District. The resolution sets July 16, 2012, at 6:00 p.m., as the date and time for the hearing of objections to the formation of the underground utility district. At the conclusion of the public hearing, a second resolution is adopted, which establishes the District. Item 8. - 2 HB -62- REQUEST FOR COUNCIL ACTION MEETING DATE: 611812012 DEPARTMENT ID NUMBER: PW12-025 Based on SCE's current construction backlog, it is anticipated that construction of the proposed Underground Utility District along Edinger Avenue will take place in 2016. The utility companies responsible for telephone (Verizon) and cable television (Time Warner) will prepare designs and allocate funding to concurrently place their aerial facilities underground based on the SCE plans and shall share in joint trenches were applicable at that time. As an option, the PUC allows agencies to "mortgage" their yearly allocation up to an additional five years in order to undertake a qualifying Rule 20A project sooner than they otherwise could. NOTICE IS HEREBY GIVEN that a public hearing will be held by the City Council of the City of Huntington Beach on 07/16/12 at the hour of 6:00 p.m. in the Council Chambers of the Civic Center, or as soon thereafter as the matter may be heard,to ascertain whether the public necessity,health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication,or similar associated service in the districts hereinabove described. SECTION 2. At such hearing all persons interested shall be given an opportunity to be heard. The City Clerk shall notify all affected property owners as shown on the last equalized assessment roll and utilities concerned of the time and place of such hearing by mailing a copy of this resolution to such property owners and utilities concerned at least ten (10) days prior to the date thereof. The areas proposed to be included in the district are shown on those certain maps entitled "Edinger Avenue Underground Utility District" which is on file in the Department of Public Works of the City of Huntington Beach.
