Hartge I NOTE: Unless specifically mentioned, this bid does not include the construction of any structures, nor the performance of underground work, relocation, removal or installation of utilities, irrigation works, pipelines, ditching, etc. This company does not assume responsibility for damage to wiring, underground piping, sidewalks, ditching, etc. TERMS: Net cash payable within 10 days after completion, less 10% retention when applicable, progress billings payable by the tenth of following month. Retentions are payable within 30 days after acceptance of the work by the owner. When signed by the buyer and a representative of Riley Construction Company, this will constitute a firm contract between both parties hereto for all work described herein according to terms and conditions on both sides hereof. Quantities herein are estimated and amount of contract to be determined by actual measurement at the unit cost specified herein. Owner to pay for all engineering,soil testing, inspection fees and permits. 2. Any trees, irrigation lines, utility lines and/or other existing obstruction requiring removal for completion of the work herein, to be removed by owner or if by contractor on a cost plus basis. Manholes to be reset at owners expense. 3. Any deviation from the specifications or modifications of the terms of this contract, and any extra or incidental work shall be set forth in writing and signed by both parties thereto. Said work unless otherwise stated, to be done on a field cost basis. - 4. All agreements are subject to contingencies of manufacture, strikes, fires, embargoes, regulations by government, delays due to unavoidable breakdown, and to any other contingencies beyond our control. 5. The buyer agrees to furnish adequate plans, rights of way and access, and to establish satisfactory grades and stakes prior to the start of work. 6. Overdue accounts will be charged interest plus, collection costs and reasonable attorney fees. If at any time, in our opinion, the financial responsibility of the buyer becomes impaired or unsatisfactory, or payments are not made as scheduled, we reserve the right to stop work, demand payment of previous retentions, and require payment in advance on any future work. 7. This bid is subject to acceptance within 15 days of above date, and the contractor reserves the right to extend acceptance to a later date. 8.
