The billing for extra excavation, delivered to the Police
Pistol range, Is approved in the amount of $8187.60.
The billing for extra sidewalk and bate amounts to $133.35,
however, we have reached agreement with Johnsons Landscape to
deduct $58.35 t}r cover conduit work which was deleted. There-
fore, this approved extra amounts to

Re: Perry Park
Gentlemen:
We refer to the Reimbursement Agreement dated March 6, 1967, between
the City and our company. At the time of the Agreement, a tentative total
cost'and a tentative date of completion was estimated. Now that the plan
and specification preparation and the bidding process has been completed,
it is evident that the total cost figure and the completion date must be
modified as shown below.
The contract prices are:
$ 3,444.00 Rough Grading
22,370.52 Landscaping
& Irrigation System
$25,814.52 Total
The rough grading contract includes the transfer of approximately 2300
Cu.Yds, of excess dirt to the City Pistol Range. The amount of the land-
scaping and irrigation contract is based on quantities estimated by .the
Subcontractor and is subject to change as determined by field measurement
of quantities during construction.
It is anticipated that the total construction time needed to complete
both grading and landscaping phases will be approximately 55 calendar days.
Therefore, the estimated completion date will be on or before September 15,
1967 in lieu of the July 31, 1967 date noted in the Agreement.

Gentlemen:
The Robert H. Grant & Co. , Inc. , who -is developing the housing .
tract adjacent to Perry Park, has agreed-.to proceed with. first
phase construction of Perry Park according to plans and
specifications approved by the City Council. Reimbursement will
be from the City Parks Development Fund sometime after July 1, 1967 .
Authorization for the Mayor and Clerk to execute the agreement
should be .by minute action.

hereinafter referred to
as
"CITY"
AND
ROBERT H. GHANT & CONPANY,
Inc, hereinafter referred
to as
"BUIL- DER"
W I T N E S S E T H:
1. Builder has heretofore filed a letter of intent
with the Administrator of the City, for the construction of
Perry Park and thereafter and concurrently herewith, Builder
has entered into an agreement with the City relating to the per-
formance of the work necessary in the construction of said park.
2. Builder has agreed, at its own cost and expense, and
In reliance upon the terms and provisions hereof, to construct
and build perry park in conformity with the plans, specifications
and provisions heretofore approved by the Director of Public
Works of the City.
3. It is mutually intended by and between the parties
hereto that upon completion of construction of Perry park in con-
formity with the aiplicable plans and specifications, thlt said
park shall be dedicated by the Builder to the City and that the
Builder shall be entitled to a full cash refund for the cost of
construction of zaid park. It is estimated the. t the cost of the
construction and improvement of perry Park shall be approximately
259000.00.

NOW, THEAEF013E9 in consideration of the premises, the
parties hereto do mutually agree as follows:
a. Subject to the conditions hereinafter set forth and
upon ompletion of the construction of Perry Park pursuant to
the applicable plans, specifications and provisions to the set-
isfaction of the City and upon dedication of said park to the
City, Builder shall, on or before July 31, 1967, be entitled to
a full cash refund from the City in the amount of its costs for
the construction and improvement of Perry Park.
b. The construction and improvement of Perry Park shall
be deemed to have been completed at such time as the Director
of Public Works of the City shall certify, in writing, to the
Finance Director of the City, that Perry Park has been completed
in accordance with the applicable plans, specifications and
provisions.
c. The cost incurred by Builder in the construction
snd improvement of Perry Park shall be determined by a final
accounting made by Builder and the City.
d. In the event either of the parties hereto insti-
tutes suit to enforce the provisions hereof, then the success-
ful party in any such proceedings shall be entitled to recover,
In addition to its costs, reasonable attorneys# fees.
e. This Agreement, and each and all of the terms and
provisions contained herein, shall be binding upon and inure
to the benefit of- the respective heirs, successors, and assigns
of the parties hereto.

IN WITNESS WHEREOF, the City has caused its corporate
name and seal to be hereunto annexed by its officers, thereto
duly authorized, and said Company has hereunto set its hand as
of the day and year hereinabove first written.
