A RESOLUTION OF THE CITY COUNCIL. OF THE CITY
OF HUNTINGTON BEACH AUTHORIZING THE EXPENDITURE
OF MONEY FROM THE SEWER FUND.
WHEREAS, the City Council of the city of Huntington Beach has adopted
a budget for the fiscal year 1970-71 by Ordinance No. 1585, and
WHEREAS, Section 5 of said Ordinance No. 1585 provides the procedure
for authorizing expenditures from the several Special Funds mentioned in
said Section 5, and
WHEREAS, the Director of Public Works and the City Administrator have
recommended an expenditure, and
WHEREAS, the City Council hereby approves said recommendations,
BE IT THEREFORE RESOLVED that an expenditure in the amount of. Five Thousand
One Hundred Fifty and 34/100 dollars ($5, 150.34) is hereby authorized to be
made from the Sewer Fund. Fund payable to United States Post Office Department
for work performed per Reimbursement Agreement No. 70-S2.
PASSED AND ADOPTED this 15th day of March , 1971.

to as facilities, and said facilities have been constructed in conformity
with the plans and specifications approved by the Director of Public Works

Dear Mr. Harlow:
This will acknowledge your letter of December 1, 1970 to Richard J.
Winter at Los Angeles, concerning the post office building on
Warner Avenue in Huntington Beach.
Prior to the time the waiver was granted concerning the wall along
the west property line of the postal property, it had appeared the
wall in question would be very expensive because of the difference
in elevations of the post office site and that adjoining it on the
west. We had also assumed that once the property to. the west was
developed for either commercial or residential use, it would have
to be filled and brought up to a level acceptable to the City and
the Flood Control District. This would tend to reduce the cost of
the wall.
Can you advise whether or not filling of the property to the west
has been accomplished, or is contemplated in the near future?
The General Counsel for the Post Office Department in considering
the question of responsibility for this wall has ruled that it is
not the responsibility of the Post Office Department, but that of
Pete King Corporation, owner of the building, or Ray Beem, sub-
divider of the land. We, too, will bring it to the attention of
.the Pete King organization, with whom we have our basic contract.

Re: Huntington Beach Proposed Postal Facility on Warner Avenue West
of Golden West.Street
Gentlemen:
Attached is our application for-CONDITIONAL EXCEPTION (VARIANCE)
for subject property. There are several items of importance which should
be brought to light in your review of this application.
The post office property is zoned C-2.. The adjacent property to the West
is zoned R-A which allows both Residential and Agricultural use. The
property to the West is currently being used for_Agricultural purposes.
In addition, this R-A property is considerably lower than the Post Office
site (4' to 61), .Warner.Avenue (3' to 5'), the top of the Flood Control
Channel on the North (5' to 91), -the street abutting the property at its
West property line (3'"to 51). .Constructing a wall separating the post
office site from the adjacent R-A property, with the R-A property remain-
ing at its present elevation, would necessitate that the separation wall
also serve as a structural retaining wall due to the extreme difference
of elevation of the two sites. The retaining wall would have to be designed
with a concrete piling foundation in order for it to meet the structural
requirements imposed by the difference in site elevation. We have
designed and estimated this wall. The resultant construction costs for
approximately 500 lineal feet of wall is in excess of $29, 000.00. This
is certainly a very prohibitive price for a wall whose function is area
separation.
If the adjoining R-A property is to be developed, land fill would be re-
quired to raise this.property sufficiently to meet the normal water shed
requirements. Raising this site would allow any required separation
wall to be built on standard spread footings.
The construction of the Post Office and the proposed plan for a shopping
center on the property adjacent to the Post Office,. East, certainly allows
consideration that the R-A property adjoining the Post Office Property on
the-West possibly being rezoned for commercial use.
In view of the above, we herewith request that a variance be granted
allowing us to proceed with the occupancy of the commercial Post Office
site waiving the requirement for the area separation wall. We will agree
that if at some future date the R-A property is developed for residentia:_1

use, we will at that time (prior to occupancy of the site) construct the
area separation wall if necessary to meet zoning requirements providing,
the requirements at that time do not exceed the zoning requirements for
the wall as set forth in the City Ordinances as of this date, and further,
if the development of the property adjoining the Post Office on the West
is developed for commercial use, this waiver will become permanent ;
thereby absolving us of any responsibility to place an area separation wall.

The United States Post Office Department constructed
the subject sewer main. Fees in the amount of $5,150.34 have
been collected from developers who have connected to this
line and said .sum is refundable to the developer per the
conditions of the agreement. The balance remdning on this
agreement will be $5,847.42.
Enclosed is a resolution requesting that the sum be
reimbursed, the check be made payable to United States Post
Office Department and the check be returned to this for
transmittal.

of Golden West entailed building an offsite sewer main which will
serve the intervening properties. The cost has been established
as $12.78/front foot and this agreement provides for this reimburse-
ment.
It is recommended that this agreement be approved, and that
the Mayor and City Clerk be authorized to execute it.

Dear Mr. Lovejoy:
In accordance with your request, we return the original and one
copy, executed, of the reimbursement agreement for offsite sewer
main incident to construction of the post office building at
Huntington Beach, California. The agreement is in accordance
with the understanding we had while the building was under con-
struction and when the sewer was installed in the street.
It is our understanding that approximately one-half of the
adjoining property has been developed and probably has already
connected to the sewer main. It would be -our expection, there-
fore, that approximately half of the refundable amount would be
available to us in the near future. The remainder, of course,
would await development of the property still to be improved.
With return of an executed copy of the document, we would like
to have a breakdown of the $12,219.85 which forms the basis of
the agreement.

REIMBURSEMENT AGREEMENT FOR
OFFSITE SEWER MAIN
THIS AGREEMENT entered into by and between the CITY OF HUNTINGTON BEACH,
a municipal corporation, hereinafter for convenience referred to as "City",
and Post Office Department, hereinafter for convenience referred to as
"Builder".
WHEREAS, Builder, pursuant to agreement with City has, at his own cost
and expense, constructed offsite sewer main, hereinafter referred to as
facilities, and said facilities have been constructed in conformity with
the plans and specifications approved by the Director of Public Works of' -
City, and have .been dedicated to City, and City desires to reimburse.Builder
for a portion of the cost of the construction of said facilities as provided
by the ordinance code,
NOW, THEREFORE, in consideration of the premises and agreements herein
contained, the parties hereto agree as follows:,
Builder has constructed, at a total cost of $12,219.85 a sewer main and
appurtenances to serve the Postal Facility and adjacent properties. (See
Exhibit. �A" attached hereto and made a part hereof for a. map of the area
served) "and has dedicated said facilities to City.
The refund to be paid to.Builder under this agreement is as follows:
Total job cost of facilities $12,219.85
Times 90% per Chapter 35, Huntington Beach Code
Net Refundable $10,997.86
Connection Fee of adjacent properties to be on a front foot basis,
offsite distance of 860.34 feet = •12.78/foot.

No refund shall be made by City to Builder until the Director of Public
Works shall certify in writing, to the Finance Director that Builder is
entitled to a refund by reason of connection having been made to facilities
in accordance with the Huntington Beach Ordinance Code, and that City has
received the fee for such connection.
City shall not be liable for payment .of refund by reason of its failure
to collect or receive- from any person or entity the connection fee. . However,
City agrees from an administrative, legislative or quasi judicial procedure
to protect the interest of developers, either individuals or entities, who
have previously constructed similar facilities, by the collecting fees, either
prior to or concurrent with the development, or any property served by the
facility constructed under this agreement. If a developer who develops property
served by the facility constructed by Builder is required as a condition-of .
development to construct additional facilities,. City may allow said developer
credit toward the per acreage fee consistent with this said agreement; and no
fees shall be due Builder by reason of such construction City further agrees
to furnish a copy of this agreement to the developer of any properties served
by the facilities described herein..
In:. the event City does not require a developer to deposit the connection
fee with be City prior to or concurrent with development, City will provide
an agreement with said developer that said developer is obligated, not only
to the City, but to Builder, and to developers who have previously contributed
to the cost of construction of facilities constructed hereunder to deposit
said fee with City; said agreement will further provide that in the event
that. it becomes necessary to institute legal .proceedings, either by. the City
or by Builder or developers, who have previously contributed to the cost of
such facilities, to enforce the rights of the parties thereunder, that the
prevailing party shall be entitled to reasonable attorney fees; provided,
however, that the City shall not be required to pay the attorney fees for any
of the parties.

It is understood that the City is not required to institute legal
proceedings to protect the interest of the Builder, but may do so.

Gentlemen:
We are rapidly approaching the completion of the referenced project, and
would like a final determination by the City as to the responsibility for
the construction of the property line fence between our property and the
Post Office.
On November 1, 1967, the Pete King Corporation was granted a temporary
waiver from the City allowing them to defer construction of their wall
until the R-3 property west of the Post Office was developed.
Now that we are developing the subject property, we believe that Pete
King Corporation has the prime responsibility to complete the construction
of the wall. 1
In the event the latter defaults on their obligation, we are prepared to
complete the construction of the wall in order to receive final acceptance
of our project from the City.
However, we are enlisting the aide of your department to require one of the
parties connected with the Post Office property to honor their commitment.

THIS AGREEMENT. entered into by and .between� the CITY OF HUNTINGTON BEACH,
a municipal corporation, hereinafter for convenience referred to as "City",
and Post Office Department, hereinafter for convenience referred to as
"Builder".
WHEREAS, Builder, pursuant to agreement wi�h City has, at his own cost
and expense, constructed offsite sewer main, hereinafter referred to as
facilities, and said facilities have been constructed in conformity with
the plans and specifications approved by the Director of Public Works of
City, and have been dedicated to City, and City desiresto reimburse Builder
for a portion of the cost of the construction of said facilities as provided
by the ordinance code,
NOW, THEREFORE, in consideration of the premises and agreements herein
contained, the parties hereto agree as follows:
Builder has constructed, at a total cost ok $12,219.85 a sewer main and
appurtenances to serve the Postal Facility and adjacent properties. (See
Exhibit "A" attached hereto and made a part hereof for a map of the area
served) and has dedicated said facilities to City.

City shall not be liable for payment of refund by reason of its failure
to collect or receive from any person or entity the connection fee. However,
City agrees from -an administrative, legislative or quasi judicial procedure
to protect the interest of developers, either individuals or entities, who
have previously constructed similar facilities, by the collecting fees, either
prior to or concurrent with the development, or any property served by the
facility constructed under this agreement. If a developer who develops property
served by the facility constructed by Builder is required as a condition of
development to construct additional facilities City may allow said developer

credit toward the per acreage fee consistent with this said agreement; and no
fees shall be due Builder by reason of such construction City further agrees

the Pust Office Department in connection with the development of
the postal facility approximately two and a half years ago, speci-

In connection with this, we understand that the property between
the post office site and Golden West has been sold and is currently
being developed as a shopping center. Apparently a connection will
be made to the sewer line during the early part of next month.

Dear Mr. Robinson:
Reference is made to a letter to you dated September 13, 1967
regarding reimbursable cost of .the offsite sewer main necessary to
serve the subject facility. Please be advised that cost for compac-
tion test of backfill will also be allowed as a. reimbursable item.
However, (a) the City must approve the test lab (we understand
Advanced Foundation Engineering is doin the onsite work and they
are an acceptable soils engineering firm); (b) only cost for passing
test will be allowed; (c) since the engineer will probably need
additional test for his certification should failures occur, we
will have to negotiate the final amount to be allowed. It is
expected that the cost should be in the vicinity of $250.00.
