Statement of Issue:
The Department of Public Works has required Huntington Executive Park to grant an
Irrevocable Offer of Dedication-Street Easement for a future right turn pocket located at
16168 Beach Boulevard.
Fundinq Source:
There is no cost involved in the recommended action.
Recommended Action:
Instruct the City Clerk to have the "Irrevocable Offer of Dedication-Street Easement"
(attached) from Huntington Executive Park recorded with the Orange County Recorders
Office.
Alternative Action(s):
Deny the recommended action.

MEETING DATE: April 7, 1997 DEPARTMENT ID NUMBER: PW96-081
Analysis:
The Zoning Administrator, on January 17, 1996, approved Conditional Use Permit No. 95-99
granting approval to construct a new 14,820 square foot building to replace an existing
12,000 square foot building located at 16168 Beach Boulevard. Condition No. 6(c) states:
"For_purposes of a future "right turn only lane," the developer shall execute an irrevocable
offer to dedicate a strip of land 12 feet wide along Beach Boulevard. The irrevocable offer of
dedication shall become effective on February 19, 1999, with the termination of the El Torrito
lease. This document shall be recorded with the Orange County Recorders Office."
As this is an irrevocable offer to dedicate, the recordation of the "Irrevocable Offer of
Dedication-Street Easement" does not constitute acceptance of the dedication. The offer of
dedication remains open and can be accepted by City Council at any future date. In addition,
the City of Huntington Beach and its successors or assigns shall incur no liability with respect to
the offer of dedication, and shall not assume any responsibility for the offered parcel of land or
any improvements thereon or therein until the offer of dedication has been accepted by
appropriate action ("resolution of acceptance") of the City Council.
On or before the effective date of acceptance (February 19, 1999), a "resolution of
acceptance" shall be approved by Council action. and filed in the office of the county
recorder. Upon recordation of the "resolution of acceptance", the dedication shall be
deemed complete.
Environmental Status:
This recommended action to accept the irrevocable offer of dedication is a ministerial act,
and is exempt from the requirements of the California Environmental Quality Act, pursuant to
State CEQA Guidelines, Cal. Admin. Code, Title 14, Chapter 3, Section 15268 (b).

This is to certify that the interest in real property conveyed by the deed dated
August 28, 1996, from Huntington Executive Park, A California Limited
Partnership and Huntington Capital Corporation, Its General Partner to the
CITY OF HUNTINGTON BEACH is hereby accepted by the undersigned officer
or agent on behalf of the City Council of the City of Huntington Beach, pursuant
to the authority conferred by Resolution No. 3537 of the City Council of the City
of Huntington Beach adopted on August 7, 1972, and the grantee consents to
the recordation thereof by its duly authorized officer.

It is understood and agreed that the CITY of HUNTINGTON BEACH and its successors or assigns shall incur no liability with respect to
such offer of dedication, and shall not assume any responsibility for the offered parcel of land or any improvements thereon or therein until
such offer has been accepted by appropriate action of the City Council. The proposed improvements, including revisions
to the existing parking and relocation: of the existing monument sign, are shown on Exhibit "C"
(Plot Plan) attached hereto.
The dedication of the property will reduce the existing parking at Huntington Executive
Park. For purposes of approving uses and building square footages at Huntington Executive
Park, the City of Huntington Beach shall continue to include in its calculations the number
of parking spaces existing before being lost by this dedication.
In the event the CITY of HUNTINGTON BEAC
H,or its successors and assigns,on behalf of the public,should determine that the use of
said property or any portion thereof is no longer needed,the rights herein given shall terminate as to those portions not needed and revert to
the undersigned owner or its successors or assigns.
The provisions hereof shall inure to the benefit of and be binding upon heirs, successors, assigns, and personal representatives of the
respective parties hereto.
