Hopkins, PE, Director of Public Works SUBJECT: Adopt and authorize recordation of Resolution No. 2018-18 ordering the Summary Vacation of the excess Right-of-Way Easement located at the Southwest Corner of Indianapolis Avenue and Florida Street Statement of Issue: The property owner at 630 Indianapolis Avenue requests that the City adopt a Resolution to summarily vacate a portion of excess right-of-way along the frontage of his property at the southwest corner of Indianapolis Avenue and Florida Street pursuant to California Streets and Highways Code Section 8334(a). Financial Impact: No funding is required for this action. Recommended Action: A) Adopt Resolution No. 2018-18, "A Resolution of the City Council of the City of Huntington Beach Ordering the Summary Vacation of the Excess Right-of-Way Easement Located at the Southwest Corner of Indianapolis Avenue and Florida Street"; and, B) Instruct the City Clerk to record Resolution No. 2018-18 and the attached exhibits with the Orange County Recorder. Alternative Action(s): Deny the recommended action. Analysis: On April 17, 1979, an easement for street and public utilities was dedicated to the City of Huntington Beach by the property owner located at 630 Indianapolis Avenue. This easement provided the City with an additional 10 feet of street right-of-way along the property's Indianapolis Avenue frontage, (increasing the half-street right-of-way width to 40 feet) as well as a 32-foot radius along the southwest corner at the intersection of Indianapolis Avenue and Florida Street. This street easement was initially intended for the expected future widening of Indianapolis Avenue. To date, no street construction has occurred or been approved to widen this segment of Indianapolis Avenue. The portion of the easement that the City is requested to summarily vacate is located within the property owner's yard and is not needed for the purpose of any public utility, pedestrian or vehicular access. The General Plan currently designates this segment of Indianapolis Avenue as a "Collector Street," which has a maximum required half-street right-of-way width of 30 feet. Item 3. - I HB -122- Dept. ID Pw 18-002 Page 2 of 2 Meeting Date:4/2/2018 Upon vacation of this portion of the easement, the rights to the underlying land would revert to the underlying fee owner of the property, and the resulting right-of-way width (30 feet) would be then consistent with the General Plan. On January 23, 2018, the City of Huntington Beach Planning Commission adopted Resolution No. 1702 approving General Plan Conformance No. 17-005 to process a Summary Street Vacation of the public right-of-way easement located at the southwest corner of Indianapolis Avenue and Florida Street. Unlike the General Street Vacation process, the Summary Street Vacation process does not have public noticing requirements, nor does it require a separate public hearing prior to the Council taking action. After adoption, the resolution shall be recorded with the Orange County Recorder to affect the street vacation. Environmental Status: The General Plan Conformance review was categorically exempt pursuant to City Council Resolution No. 4501, Class 5, which supplements the California Environmental Quality Act because the request is a minor easement vacation. NOW, THEREFORE,the City Council of the City of Huntington Beach does hereby, resolve as follows: 1. Pursuant to Division 9, Part 3, Chapter 4 of the California Streets and Highways Code, commencing with Section 8334(a), the City Council of the City of Huntington Beach hereby orders the vacation of the excess Indianapolis Avenue right-of-way easement located at the southwest corner of Indianapolis Avenue and Florida Street. 2. The right-of-way easement hereby vacated is more particularly described in the Legal Description and plat attached hereto as Exhibits "A" and"B" respectively, which exhibits are incorporated by this reference as though fully set forth herein. The City Council does hereby confirm that the easement herein vacated is excess right- of-way and is not required for street or highway purposes.
