THIS PAGE ADDED TO PROVIDE ADEQUATE SPACE FOR RECORDING INFORMATION (Additional recording tee applies) RESOLUTION NO. 2 0 0 6-6 g A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH VACATING A PORTION OF THE PUBLIC STREET EASEMENT LOCATED ON BEACH BOULEVARD, SOUTH OF TAYLOR DRIVE WHEREAS, on April 3, 2006, the City Council awarded the construction contract for the Beach Boulevard Parkway Landscape Enhancement Project, CC-1229; and This Federally funded project will construct landscape and hardscape improvements along the east side of Beach Boulevard, between Taylor Avenue and Sterling Avenue; and Taylor Avenue was renamed Taylor Drive per City of Huntington Beach Resolution Number 1588, adopted May 21, 1962, and Taylor Avenue is commonly referred to as Taylor Drive; and As part of the project scope, full-height curb will be constructed to eliminate the frontage road"dead-end pockets" located at the northerly and southerly project limits; and A concrete driveway will be constructed near the southerly project limit in order to maintain the existing residential garage access at 8002 Taylor Drive; and Upon completion of Project CC-1229, the City-maintained public street easement within this southerly portion of the Beach Boulevard frontage road, where the concrete driveway will be constructed, will be unnecessary for present or prospective public use; and A public meeting was held before the Planning Commission on September 26 2006, at which time it was determined, pursuant to Government Code Section 65402, that the proposed vacation of a portion of the public street easement located on Beach Boulevard south of Taylor Drive, as shown on the Map of Huntington Beach, in the City of Huntington Beach, County of Orange, State of California, legally described in the attached Exhibit "A" and depicted on the map attached hereto as Exhibit"B", conformed to the City's General Plan; and Pursuant to Division 9, Part 3, Chapter 2 of the California Streets and Highways Code, commencing with Section 8320, on October 16, 2006 at a regularly scheduled public meeting, the City Council of the City of Huntington Beach commenced proceedings under.the Chapter for a vacation of the portion of the public street easement legally described in the attached Exhibit "A" and depicted in Exhibit"B", while reserving and excepting from the proposed vacation a permanent easement for public utility purposes over the southerly 10.00 feet of the above described land; and The City Clerk set November 20, 2006, at the hour of 6:00 p.m. or as soon thereafter as the matter may have been heard in the City Council Chambers, as the time and place for hearing all persons interested in or objecting to the proposed vacation; and A Notice of Public Hearing on the vacation was published for at least two successive weeks prior to the hearing in the Huntington Beach Independent. At least two weeks prior to the public hearing, at least three (3) Notices of Vacation were posted conspicuously along the portion of the alley right-of-way to be vacated not more than 300 (three hundred) feet apart; and 06-533/4694 1 On November 20, 2006, at the hour of 6:00 p.m. in the City Council Chambers, the City Council did convene for the purpose of hearing all persons interested in or objecting to the propo-s'o d vacation of the public street easement legally described in the attached Exhibit"A" and depicted on the attached Exhibit "B", at which time no acceptable objection was made to said vacation, and evidence was presented showing that the public street easement as described above is not necessary for present or prospective uses, NOW, THEREFORE, the City Council of the City of Huntington Beach pursuant to Division 9, Part 3, Chapter 2 of the California Streets and Highways Code, commencing with Section 8320,does hereby resolve as follows: 1. Based on all the evidence submitted, the public street easement legally described in Exhibit "A" and depicted in Exhibit "B" is unnecessary for present or prospective public use and it is hereby ordered vacated. 2. The City hereby reserves and excepts from the vacation a permanent easement for public utility purposes over the southerly 10.00 feet of the above described land. 3. The City Clerk shall cause a certified copy of this resolution of vacation to be recorded in the Orange County Recorder's Office. REQUEST FOR CITY COUNCIL ACTION MEETING DATE: 11/20/2006 DEPARTMENT ID NUMBER: PW 06-074 Analysis: On October 16, 2006, the City Council adopted Resolution No. 2006-66 declaring the City's intent to vacate a portion of the public street easement located on Beach Boulevard, south of Taylor Avenue. It should be noted that, subsequent to this City Council action, it was discovered that "Taylor Avenue" was renamed to "Taylor Drive" per City of Huntington Beach Resolution No. 1588, adopted May 21, 1962. A statement to this effect has been included in the attached resolution. This vacation is necessary due to the Beach Boulevard frontage road dead-end pocket being eliminated by the construction of the Beach Boulevard Parkway Landscape Enhancement Project, CC-1229. The southerly portion of the frontage road is used primarily as vehicular access to the private residential garage located at 8002 Taylor Drive. A concrete driveway will be constructed to preserve the vehicular access to this garage. Furthermore, the City will reserve a ten-foot wide easement to maintain existing public utility services in the area. After adoption, the resolution shall be recorded with the Orange County Recorder to affect the street vacation upon completion of the improvements associated with the City's landscape project, CC-1229. The City Engineer will notify the City Clerk with the notice of completion. Adopt Resolution No. 21,0 6 - to vacate the portion of Beach Boulevard adjacent to 8002 Taylor Avenue, as described on the attached legal description and sketch, Exhibits "A" and "B", respectively; and 2. Direct that a public hearing be held on November 20, 2006 for all persons interested in or objecting to the proposed street vacation. Alternative Action(s): Deny the recommended action. REWEST FOR CITY COUNCIL ACWN MEETING DATE: 10/16/2006 DEPARTMENT ID NUMBER: PW 06-065 Analysis: On April 3, 2006 the City Council awarded the construction contract for the Beach Boulevard Parkway Landscape Enhancement Project, CC-1229. This Federally funded project will construct landscape and hardscape improvements along the east side of Beach Boulevard between Sterling Avenue and Taylor Avenue. As part of the project scope, full-height curb will be constructed to eliminate the frontage road "dead-end pockets" located at the northerly and southerly project limits. A concrete driveway will be constructed near the southerly project limit to maintain the existing residential garage access at 8002 Taylor Avenue. Consequently, it is necessary to vacate this portion of the frontage road, as the newly constructed driveway will access a private residential garage. Although the City will reserve a ten-foot wide public utility easement in order to maintain existing utility services in the area, the proposed street vacation will result in the removal of the public street easement over this portion of the Beach Boulevard frontage road. On September 26, 2006 the Planning Commission approved General Plan Conformance No. 06-02 with a finding that the proposed street vacation conforms to the City's General Plan. Following Council approval of the Resolution of Intent, notice will be given of public hearing on November 20, 2006. On or before that date, the public has the opportunity to address the proposed action. At the November 20 meeting, a Resolution Ordering the Street Vacation will be recommended by staff for City Council approval. If approved, the Resolution will be recorded with the County of Orange and the street vacation will become effective. Environmental Status: The proposed project is categorically exempt pursuant to Class V: Alterations in Land Use Limitations, sub-section (a) Minor street, alley, and utility easement vacations, of Resolution No. 4501 adopted by the City of Huntington Beach on August 1, 1977. This resolution consists of the City's implementing procedures for the California Environmental Quality Act (CEQA) and establishes additional categorical exemptions, pursuant to 150619(c) of the Guidelines for Implementation of the California Environmental Quality Act. Attachment(s): City Clerk's Page Number No. Description 1 Resolution No. X6 -col A resolution of the City Council of the City of Huntington Beach Declaring Intent to Vacate a Portion of the Public Street Easement located on Beach Boulevard, South of Taylor Avenue 2 Vicinity Map 8002 Taylor Avenue -2- 9/28/2006 5:25 PM ATTACHMENT # 1 RESOLUTION NO. 2 0 0 6-6 6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DECLARING INTENT TO VACATE A PORTION OF THE PUBLIC STREET EASEMENT LOCATED ON BEACH BOULEVARD, SOUTH OF TAYLOR AVENUE WHEREAS, on April 3, 2006, the City Council awarded the construction contract for the Beach Boulevard Parkway Landscape Enhancement Project, CC-1229; and This Federally funded project will construct landscape and hardscape improvements along the east side of Beach Boulevard, between Taylor Avenue and Sterling Avenue; and As part of the project scope, full-height curbs will be constructed to eliminate the frontage road"dead-end pockets" located at the northerly and southerly project limits; and A concrete driveway will be constructed near the southerly project limit in order to maintain the existing residential garage access at 8002 Taylor Avenue, NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: SECTION 1. A public meeting was held before the Planning Commission on September 26, 2006. at which time it was determined, pursuant to Government Code Section 65402, that the proposed vacation of a portion of the public street easement located on Beach Boulevard south of Taylor Avenue, as shown on the Map of Huntington Beach, in the City of Huntington Beach, County of Orange, State of California, legally described in the attached Exhibit A and depicted on the map attached hereto as Exhibit B, conformed to the City's General Plan. SECTION 2. Pursuant to Division 9, Part 3, Chapter 2 of the California Streets and Highways Code, commencing with section 8320, the City Council of the City of Huntington. Beach hereby declares its intention to vacate a portion of the public street easement located on Beach Boulevard south of Taylor Avenue, as legally described in the attached Exhibit A and as depicted in the attached Exhibit B. The City hereby reserves and excepts from the vacation a permanent easement for public utility purposes over the southerly 10.00 feet of the above described land. SECTION 3. The City Clerk is directed to maintain on file in the office of the Citv Clerk maps or plans showing the particulars of the proposed vacation of the public easement located on Beach Boulevard south of Taylor Avenue, and reference is hereby made to such maps and plans for particulars as to said proposed vacation. SECTION 4. The City Council does hereby fix November 20, 2006, at the hour of 6:00 p.m. or as soon thereafter as the matter may have been heard in the City Council Chambers in the Civic Center, as the time and place for hearing all persons interested in or objecting to the 4696 0 Res . No4006-66 proposed vacation, which time is not less than fifteen (15) days from the passage of this resolution. SECTION 5. The City Clerk is directed to cause a copy of this resolution and its attachments to be published in a weekly newspaper, published and circulated in Huntington Beach for at least two successive weeks prior to the time set herein for the public hearing. SECTION 6. The Director of Public Works is directed to post, or cause to be posted, notices of vacation conspicuously along the easement proposed to be vacated at least two weeks before the date of the hearing. The notices shall be posted not more than 300 feet apart, but at least three notices shall be posted. The notices shall state the day, hour, and place of the hearing, and shall refer to the adoption of this resolution of intention, and shall describe the easement or shall include a map or plan showing the location of the easement proposed to be vacated.
