Hopkins, PE, Director of Public Works SUBJECT: Adopt Resolution No. 2016-56 repealing Resolution No. 2016-17 and authorizing the City to apply for a Grant Application under the Orange County Transportation Authority (OCTA) Ordinance No. 3 for the Huntington Harbour Marina Trash Skimmers Trash Removal Project Statement of Issue: The Orange County Transportation Authority (OCTA) revised the model resolution in the 2016 OCTA CTFP Guidelines which therefore requires Resolution 2016-17 as adopted by City Council on April 4, 2016 to be repealed. Financial Impact: The revised resolution includes language that requires the City to provide matching funds if the grant is awarded by OCTA. Matching funds in the amount of $12,186 are included in the proposed FY 16-17 Capital Improvement Program under the General Fund (10040314.82000). Recommended Action: A. Adopt Resolution No. 2016-56, "A Resolution of the City Council of the City of Huntington Beach Authorizing an Application for funds under the Environmental Cleanup, Tier 1 Grant Program under Orange County Transportation Ordinance �No. 3 for the Huntington Harbour Marina Trash Skimmers Trash Removal Project;" and, B. Repeal Resolution No. 2016-17, "A Resolution of the City Council of the City of Huntington Beach Authorizing an Application for Grant Funds for the Environmental Cleanup Tier 1 Grant Program Under the Orange County Transportation Authority Environmental Cleanup Program." Alternative Action(s): Do not adopt the revised Resolution 2016-56, do not repeal Resolution 2016-17, and direct staff how to proceed. Analysis: OCTA has requested the City of Huntington Beach revise the previously submitted Resolution No. 2016-17 as adopted by City Council on April 4, 2016. The revision to the adopted resolution includes language for the City to provide matching funds for the Huntington Harbour Marina Trash Skimmers Trash Removal Project grant application. The City is providing matching funds in the amount of $12,186 as included in the proposed FY 16-17 Capital Improvement Program, and Item 10. - 1 HB -102- Dept. ID PW 2016-051 Page 2 of 2 Meeting Date: 8/15/2016 therefore the revision of this Resolution is considered a minor clean-up for the purpose of receiving the OCTA funding. HB -103- Item 10. - 2 RESOLUTION NO. 2016-56 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING AN APPLICATION FOR FUNDS FOR THE ENVIRONMENTAL CLEANUP, TIER 1 GRANT PROGRAM UNDER THE ORANGE COUNTY TRANSPORTATION AUTHORITY ORDINANCE NO. 3 FOR THE HUNTINGTON HARBOUR MARINA TRASH SKIMMERS TRASH REMOVAL PROJECT WHEREAS, Orange County Local Transportation Ordinance No. 3, dated July 24, 2006, known and cited as the Renewed Measure M Transportation Ordinance and Investment Plan, snakes funds available through the Environmental Cleanup Program to help protect Orange County beaches and waterways from transportation generated pollution (urban runoff) and improve overall water quality; and The Environmental Cleanup, Tier 1 Grant Program consists of fielding purchases and installation of catch basins with Best Management Practices, such as screens, filters, inserts, and other "street -scale" low flow diversion projects; and The Orange County Transportation Authority ("OCTA") has established the procedures and criteria for reviewing proposals; and The City of Huntington Beach has the authority to nominate water quality improvement projects that have a transportation pollution nexus to finance and construct the proposed project, NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: 1. The City Council authorizes the nomination of Huntington Harbour Marina Trash Skimmers Trash Removal Project ("Project'), including all understanding and assurances contained therein, and authorizes the person identified below as the official representative of the City of Huntington Beach to act in connection with the nomination and to provide such additional information as may be required. 2. The City of Huntington Beach will maintain and operate the equipment acquired and installed. 3. The City of Huntington Beach will give OCTA'S representatives access to and the right to examine all records, books, papers or documents related to the funded Tier 1 Grant Proj ect. 4. The City of Huntington Beach will cause work on the Project to be commenced within a reasonable time after receipt of notification from OCTA and that the Project will be carried to completion within reasonable diligence. The City of Huntington Beach will comply where applicable with provisions of the California Environmental Quality Act, the National Environmental Policy Act, the Americans with Disabilities Act, and any other federal, state, and/or local laws, rules and/or regulations. 6. The City of Huntington Beach must include all projects funded by Net Revenues in the seven-year Capital Improvement Program as part of the Renewed Measure M Ordinance eligibility requirement. 7. The City of Huntington Beach authorizes a formal amendment to the seven-year Capital Improvement Program to add projects approved for funding upon approval from the OCTA Board of Directors. 8. The City of Huntington Beach will provide matching funds for the Project as required by the Orange County Comprehensive Transportation Funding Programs Guidelines. 9. The City of Huntington Beach hereby authorizes Travis K. Hopkins as the official representative of the City of Huntington Beach to accept funds for the Environmental Cleanup, Tier 1 Grant Program for the Project. 10. The City of Huntington Beach agrees to fund its share of the project costs and any additional costs over the identified programmed amount. 11. Resolution 2016-17 and all other Resolutions in conflict herewith are hereby repealed.
