[ Yes [ ] New Policy or Exception Statement of Issue, Recommendation,Analysis, Funding Source,Alternative Actions,Attachments: STATEMENT OF ISSUE: The County of Orange has advanced the city $91,000 in OCUTT funds in order to finance preliminary engineering for the super streets project (CC-728). RECOMMENDATION: Accept the advance and modify the Fiscal 1988-89 Budget document to allow for the expenditure of these funds. ANALYSIS: When the Fiscal 1988-89 Budget was prepared, the engineering work for the Beach Boulevard "Super Street" project (CC-728) was not planned to begin until the next year (1989-90).' However, it is the desire of the county that we complete the design work this year. In order to achieve this goal, the County has advanced us the required funds. FUNDING SOURCE: Local Transportation Fund (LFT) funds disbursed under the OCUTT program. These funds have been deposited in Holding Account F 301 pending transfer intoeexpenditure Account 747280. [ ] Yes [ ] New Policy or Exception Statement of Issue, Recommendation,Analysis, Funding Source,Alternative Actions,Attachments: STATEMENT OF ISSUE: Attached are Invoices from Legal Counsel to the Beach Boulevard PAC and from the Chairperson of the Beach Boulevard PAC requesting reimbursement for expenses incurred which total $5,551.27. This exceeds the prior authorization of the City Council. RECOMMENDATION: 'Authorize payment of $1900.00 to the Beach Boulevard PAC as previously approved by City Council. ANALYSIS: In March, 1987 the City Council authorized a not-to-exceed amount of $1,000 for the provision of a "consultant" to the Beach Boulevard PAC. The Beach Boulevard PAC contracted with Sherry Passmore to provide these services and an Invoice was received and paid for these services which did not exceed the $1,000 authorized. On June 15, 1987 the City Council again authorized funds to be made available to the Beach Boulevard PAC on a reimbursement basis to procure Legal Counsel and other services connected with the Joint Public Hearing on the Proposed Beach Boulevard Project Area which was conducted on July 6, 1987. At that time the City Council authorized $1,200 for the procurement of legal counsel and $700 for the printing, postage, and distribution of an announcement of the Joint Public Hearing. The attached request from the Project Area Committee exceeds the previous authorization by $3,651.27. Attached are the Invoices from the firm selected by the PAC to provide legal counsel, a request from James A. Lane, Chairperson of the Beach Boulevard Project Area Committee requesting reimbursement of other out-of-pocket expenses, and copies of receipts therefore. FUNDING SOURCE: Any expenditure on the part of the City for the benefit of the Beach Boulevard PAC would become Redevelopment Agency debt. [ ] Yes [X] New Policy or Exception Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions, Attachments: STATEMENT OF ISSUE: In 1982, when survey areas were adopted for the Main Pier, Talbert/Beach, Yorktown/Lake and Oakview Redevelopment Project Areas, a survey area was also established for portions of the Beach Boulevard Corridor. Recent staff investigations- have resulted in a recommendation to proceed with adoption of a Redevelopment Project Area. RECOMMENDATION: 1. Approve the attached Action Plan for the Beach Boulevard Corridor and 2. Authorize staff to request qualifications and to negotiate and prepare a contract with a consultant firm to assist in the Redevelopment Plan Adoption Process. ANALYSIS: The attached Action Plan highlights the major tasks to be undertaken, and elements to be incorporated in a Redevelopment Plan Adoption Process for the Beach Boulevard Corridor. The major reasons for pursuing a plan adoption for this area are: 1. The few remaining vacant parcels along the corridor which will be of most significance to the enhancement of the corridor are rapidly being committed to private development. 2. Currently vacant or under utilized parcels within the corridor may represent key relocation resources that will facilitate the implementation of the Main Pier Redevelopment Plan. 3. The concern regarding enhanced traffic movement through the corridor may most effectively be addressed and the physical development characteristics and land uses within the corridor may most effectively be controlled through the Redevelopment Plan process. Another key concern in the recommendation to move forward with plan adoption at this time regards the enhancement of current auto dealerships and the potential to induce additional new dealerships to locate within the Beach Boulevard Corridor. do 3� P10/1/85 RH 85-35 July 23, 1985 Page Two Commencement of the Plan Adoption Process at this time, and communication of the potential benefits of this effort to current property and business owners within the corridor may forward these objectives and help assure retention of other desirable businesses. It is recommended that staff procure the assistance of a consultant firm to provide technical assistance and support during the Plan Adoption Process. It is anticipated that the state law governing the procedures through which redevelopment plans are adopted will be changed and it would be beneficial to adopt any new redevelopment project area prior to July 1, 1986. To prepare the documentation within this time frame, such consultant assistance will be required to augment staff capacity. It is proposed that the cost of such consultant services be a Community Development Block Grant or Redevelopment Agency expense. At the time a contract for such consultant services is presented to the Agency for its consideration, a recommendation regarding a funding source will also be identified. ALTERNATIVES: 1. Do not approve the Beach Boulevard Action Plan. This will pre-empt commencement of the Redevelopment Plan Adoption Process at this time. .2. - Refer the Action Plan back to staff with additional direction. _FUNDINGSOURCE: Community Development Block Grant Program Funds previously budgeted for Beach Boulevard/Gotha rd Corridor Studies (Acct. #894834). Review existing development standards within corridor and propose appropriate modifications. 2. Consideration of expansion of "Scenic Highway" designation from PCH northward to 405 freeway and/or institute Code Enforcement Program. 3. Initiate process through which Redevelopment Agency staff reviews and comments on all BZA and Planning Commission applications within corridor. 4. Review results of PBQ and D financial feasibility study of super street concept. 5. Establish Beach Boulevard Corridor as a high priority for underground utility district funds. 6. Solicit proposals and qualifications from consultant firms to conduct Redevelopment Project Area adoption process (with support from Agency staff). After staff review of qualifications, -request Agency approval of contract with consultant. Actions Through Plan Preparation and Adoption 1. Through the plan process, consideration should be given to amending the existing 'survey area boundaries to include all of the Beach Boulevard right-of-way and a generous set-back and to expand the survey area boundaries in some locations to increase the depth of parcels within the project area. 2. Use the inclusion of the complete Beach Boulevard right-of-way and set-back to implement the "super street" concept, traffic systems management, cross traffic flow, and to implement an urban design theme for the corridor. 3. Identify parcels that are relocation resources for activities within the Main-Pier Redevelopment Project Area; to assist in early start to projects within the Main-Pier Project Area. Identify any Agency acquisitions. 4. Assess conflicts in Agency's land use objectives within the corridor and reconcile through plan preparation (auto vs. office vs. commercial) and establishment of "high-rise nodes." 5. Determine feasibility of establishing an assessment district to finance various improvements. 6. Determine any financial relationship between Agency and County of Orange. 7. Commence preparation of Code Amendments necessary to implement "Redevelopment Plan." 8. Mola Development Corporation is the developer of a 375,000 square foot commercial complex at the southwest corner of the Warner-Beach intersection. As you are undoubtedly aware, Beach Blvd. is one of the major commercial streets in all of Orange County. It is our feeling that a Super Street concept could have a devastating impact on all of the businesses along that corridor, to include our commercial complex which is presently in construction. We view this "Super Street" project as a means for moving traffic from interior parts of the County to the beach with no concern for those businesses in between who have invested millions of dollars. It would appear that other methods could be found to move traffic from point A to point B and that other transporation systems might be a viable alternative . It is my understanding that the studies incident to the ultimate decision of the Super Streets will commence shortly. I have a serious interest in being included in any discussion relative to the ultimate decision and would welcome the opportunity to be,_._` included in a citizens advisory group. o FELR I ' \1 Mr . It is for this very reason the super street concept may be an appropriate solution to the traffic congestion that occurs every day on Beach Boulevard. Improvements such as traffic signal coordination, parking restrictions, bus turnouts, access consolidation, and grade separations (flyovers) at key intersections can improve traffic movement while maintaining the accessibility of Beach Boulevard businesses. Like the rest of Orange County, the Beach Boulevard area continues to grow. As population and employment densities increase, so does traffic congestion which makes it more and more difficult for people to reach the market areas along Beach Boulevard. The super street project will improve the accessibility of commercial complexes such as the Charter Centre. Finally, let me assure you that a flyover is only one alternative that will be considered in this study for improving the intersection of Warner Avenue and Beach Boulevard. The study will provide an opportunity to assess a number of options for improving this intersection. Mills: We have been property owners in Huntington Beach for ten years and conducted a car wash on the corner of Warner and Beach Boulevards for a goodly portion of those ten years . We recently sold the car wash business , but we continue as owners of the underlying land and as taxpayers of the City of Huntington Beach and the County of Orange. We received your letter of December 12 , 1985 , and feel compelled to respond. You indicate that overpasses , or "grade separations" , are proposed for Beach Boulevard at the Warner , La Palma , and Imperial Highway intersections . You did not mention that your department originally recommended a total of eight overpasses for Beach Boulevard , but that five of these overpasses are no longer being considered due to the objections of various municipalities along the route . We have no doubt that each of the five discarded overpasses had the same compelling reasons for their construction as your Commission has out forward for the one at Warner and Beach. We also have no doubt that the same compelling objections to the overpasses that existed in the other cities are here in Huntington Beach. You indicated that the "main adverse impacts" of the project "are primarily associated with disruption during construction" . [lot mentioned in your letter , but contained in previous Commission materials , was the estimate that the construction at [+?arner and Beach would take between 18 and 24 months to complete , and that the multimillions lost by affected businesses would take up to 20 years to recover . We venture to say that your statement that the adverse impact is restricted to the construction period is tragically shortsighted . We haven 't seen actual cost projections of the "Super Street" project . We do wonder if the City of Huntington Beach, the County of Orange , Caltrans , and _your own Commission have allocated sufficient dollars for the eminent domain/condemnation actions that are sure to be filed by the businesses that are not only ' adversely impacted ' during the construction period , but are actually driven out of business by the permanent rerouting of traffic. We do not want to obstruct the flow of progress , but we must object to this counter-productive proposal put forward by your commission that has such an adverse effect on our community. After reviewing the proposals, I am gravely concerned as to the negative effect this will have on businesses in the area of Warner and Beach. I feel the high cost to business and property owners in the area through loss of business, far outweighs the small benefit to commuters. I am particularly against the bridge over Warner. The time frame of 18-24 months for construction is almost certain financial death for the many small businesses in this area. The tenant who occupies the property I own feels he will be unable to stay in business for the construction period mentioned because of anticipated revenue drop.
