A RESOLUTION OF THE CITY COUNCIL OF THE CITY i OF HUNTINGTON BEACH ESTABLISHING A PIERHEAD LINE IN THE DAVENPORT MARINA WHEREAS , the City of Huntington Beach desires to establish a pierhead line for the Davenport Marina; and Huntington Beach Municipal Code section 13 . 32 . 020 ( f ) provides that the distance from the bulkhead to the pierhead line shall be determined by the City Council ; and The City Council adopt the findings set forth on Exhibit "B" attached hereto and incorporated by reference herein . NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that there is hereby established a pierhead line in the Davenport Marina , also designated as Lot C of Tract 4880 ; that the establishment of said pierhead line conforms ±—�to - city policy; and the pierhead line and the property on which such pierhead line is established is described in Exhibit "B" , attached hereto and incorporated by reference herein . The Superior Court of Orange County in Case No . 46-75-77 , having concluded that the establishment of a pierhead line is a quasi-judicial function of the Council , the following findings or conclusions are found and concluded: 1 . The city is empowered to adopt pierhead lines to protect navigable channels from encroachment . 2 . Pursuant to Huntington Beach Municipal Code Section 13 .32 .020 , the City council of the City of Huntington beach has the power to establish pierhead lines by resolution . 3 . The Orange County superior Court in John J . Stanko v . City of Huntington Beach, case no . 46 75 77 , has mandated the city to set aside the pierhead line established by the City Council in ' Resolution No . 5523 , adopted June 3 , 1985 . 4 . Davenport Marina is located along the subject channel depicted on attached exhibits , and is improved -with various docks, slips , and gangways . 5 . The subject channel is a navigable waterway . A low bridge which crosses the channel to davenport Island prevents further navigation by vessels , except for small boats . A ninety foot width at the bridge is desirable for safe turning of vessels and navigation . 6 . A minimum channel width of seventy feet is necessary for navigation of vessels in the channel . 7 . Expansion of the existing marina further into the channel would impair navigation, create traffic and parking impacts, and be incompatible with the residential character of the neighborhood . 89 603306 "Exhibit "B" to Resolution 5801 October 30 , 1987 Page ( 2 ) 8 In the interest of the health , safety and welfare of the citizens of Huntington Beach , no additional boat docking facilities or end ties can be allowed outside the limits of the pierhead line as shown in Exhibit "B" . STATEMENT OF ISSUE: The Orange County Superior Court has ordered that Resolution No. 5523, adopted June 3, 19859 establishing a pierhead line in the Davenport Marina be set aside and a public hearing be held to reconsider the previous action. RECOMMENDATION: 1. Rescind Resolution No. 5523 which establishes a pierhead line for the Davenport Marina. 2. After holding a public hearing, adopt the attached resolution establishing a pierhead line per Exhibit "D". ANALYSIS: Pursuant to Section 13.32.020 of the Municipal Code, the pierhead line is established by City Council Resolution. "Pierhead Line" means the line between the bulkhead and the waterway, which line separates the.area open for navigation from the area extending outward from the bulkhead in which the mooring and docking of vessels is permitted. The exact distance from the bulkhead to the pierhead line shall be determined by the City Council. On June 3, 1985, the City Council adopted Resolution No. 5523 establishing a pierhead line for the Davenport Marina in accordance with the attached Exhibit "B". Exhibit "B" proposes a pierhead line along the outer edges of the existing docks at the narrow section of the navigable channel and 13 feet from the outer edges of the docks, in the wide part of the channel. This action would allow the marina to maintain two (2) end-tie moorings and eliminate two. The minimum navigable channel width would be 70 feet. On May 4, 1987, as the result of a lawsuit filed in 1985 by Dr. John Stanko, the owner of the Davenport Marina, the Orange County Superior Court found that the City should have held a noticed public hearing prior to adopting Resolution No. 5523 and that Dr. Stanko has a vested right to continue the use of all existing marina facilities that are lawfully permitted. The court ordered that Resolution No. 5523 be immediately set aside and that the City Council reconsider your previous action in light of the Court's findings of fact and conclusions of law and to take any further action specially enjoined upon you by law. The Court's Writ of Mandamus states that nothing in this writ shall limit or control in any way the discretion legally vested to the�_s City. PIO 5/85 Establish a Pierhead Line for Davenport Marina, Huntington Harbour September 10, 1987 Page 2 The judge who made the decision in this case seemed to feel that the owner should have the right to use all end ties which would be allowed per Exhibit "D". Therefore, staff is recommending that, after holding a formal public hearing, the City Council adopt the attached resolution establishing a pierhead line in accordance with Exhibit "D" which would allow a pierhead line legalizing all end ties to existing docks but no further expansion of the marina into the navigable channel. Other alternatives which were presented to the City Council on June 3, 1985 are also attached for consideration. Exhibit "A" indicates a pierhead line along the outer edges of the existing dock and would result in the elimination of four (4) end-tie moorings on the extremities of the docks. The action would establish a navigable channel width of 70 feet between pierhead lines. The marina proprietor would be penalized by this action. Exhibit licit indicates pierhead line that is approximately parallel to the lot line of Lot "C". The minimum channel width is 60 feet, and the maximum would maintain a width of 85 feet. The marina owner would be able to utilize the major portion of the Lot "C". This is the alternative that the marina owner is requesting. Staff is also presenting two other alternatives for consideration. Exhibit "E" is the pierhead line approved by the Corps of Engineers when the marina was originally proposed in 1964. Staff feels that this pierhead line encroaches into the channel so far that it inhibits navigation and turning at the Davenport bridge. Exhibit "F" is similar to Exhibit "D" except that it allows a 30 foot pierhead line parallel to the end of the marina parking lot. This would allow a ninety foot turning basin at the Davenport bridge. Staff does not recommend this alternative, however, because it allows further expansion of this commercial marina in a residential neighborhood. The marina owner has recently submitted plans requesting a permit to add docks to the marina which would extend outside the limits of Exhibit "D". The owner has not submitted a recent proposal for a pierhead line for the entire marina. Staff strongly feels that no modifications to the existing marina should be permitted until the City Council has established a pierhead line for the marina. FUNDING SOURCE: No expenditure of funds is involved in the recommended action. ALTERNATIVE ACTION: 1. Adopt Exhibits "A", licit, "E" or "F" pierhead line. 2. Readopt Exhibit "B" pierhead line. 3. Deny the recommendation for pierhead line at this time. Stanko, Marina Operator, by Latham & Watkins • • • • I INTRODUCTION The City Council of the City of Huntington Beach • has before it a proposal to establish a pierhead line for Davenport Marina in Huntington Harbour. The current proposal is the most recent in a series of attempts by the • City Council to deal with what apparently is perceived to be a problem regarding Davenport Marina. In October 1962, Huntington Harbour Corporation • (the "Corporation") dedicated the fee interest in the land underlying Davenport Marina to the City. This dedication and easement , a copy of which is attached as Appendix A, • reserved to the Corporation an assignable right to construct and operate a broad range of uses , including a marina. In May 1964, the City granted Conditional • Exception (Use Variance) No. 707 (the "Conditional Exception") to the Corporation for the construction of Davenport Marina and a parking lot . The Conditional • Exception authorized the construction of 91 slips on the Davenport Marina site; it contained no provision, condition or limitation requiring any work or construction with • respect to the marina or the marina parking lot to be performed within any specific time limit . A copy of the Conditional Exception is attached as Appendix B. • • • • In July 1964 the Corporation obtained from the United States Army Corps of Engineers and the City those permits necessary to authorize the construction of the • parking lot and Davenport Marina. Relying upon those permits, the Corporation constructed the marina parking lot, installed the necessary utilities , constructed the marina • bulkhead, installed an initial 17 boat slips, and began operating and using the marina and parking lot. In 1967 , the Corporation obtained a harbor permit from the City • authorizing the construction and installation of gangways and an additional 9 boat slips ; acting pursuant to those permits , the Corporation completed the additional construc- tion. In 1971 , an additional 48 boat slips were authorized for Davenport Marina by the Corps of Engineers • and the City of Huntington Beach, pursuant to Harbor Permit No. 518 . The Corporation then began construction of the additional 48 slips. In November 1972 , the City issued a • cease and desist order ordering the Corporation to stop work on Davenport Marina until an environmental impact report could be prepared and certified. The Corporation voluntar- ily deferred further action until the City had time to develop policies and procedures for environmental impact reports . • • 2 In January 1974, the Corporation formally requested the City to rescind the cease and desist order and allow completion of Davenport Marina. Prior to that time, the City Attorney had correctly ruled that neither state law nor City guidelines required preparation of an environmental impact report on the completion of the marina. Notwith- standing the City Attorney' s Opinion, on February 19 , 1974 , the City Council held a public hearing on the question of whether to revoke the Conditional Exception, and at the close of the hearing voted 4-2 in favor of revocation. The Corporation brought a mandate proceeding against the City in Orange County Superior Court, Huntington Harbour Corporation v. the City of Huntington Beach, Orange County Superior Court Case No. 211820 (1974) . The Court , Judge Mark A. Soden, presiding, found that the City had committed a prejudicial abuse of discretion in revoking the Conditional Exception. The Court issued a Judgment ordering a peremptory writ of mandamus , remanding the proceedings to the City Council and commanding the City Council to set aside its revocation. The City Complied. The Judgment appeared to have settled all questions between the parties . In 1975, Dr. Stanko purchased Davenport Marina from the Corporation. Dr. Stanko has operated Davenport Marina since that time. 3 • • The City Council has before it a renewed proposal to establish a pierhead line for Davenport Marina. The February 21, 1985 staff report with respect to this matter, • entitled "Request for City Council Action, " sets forth three possible pierhead line proposals , respectively identified as Exhibit "A, " Exhibit "B, " and Exhibit "C. " The staff report • recommends the adoption of a pierhead line pursuant to Exhibit "B. " Should the City Council follow the Staff report, Davenport Marina would lose several of its existing • side-tie moorings , despite the judicial determination that it has a vested right to complete build-out of the marina. To assist the City in its efforts to reach a • reasonable and responsible determination regarding establishment of a pierhead line for Davenport Marina, this position paper discusses some of the legal implications associated with the adoption of any of the staff' s proposals . Dr. Stanko ' s attorneys will be present at the hearing on the proposed pierhead line , should the City Council have any questions . II DAVENPORT MARINA HAS A VESTED RIGHT TO BUILD • OUT AND OPERATE ALL APPROVED FACILITIES. A. The City is contractually bound to permit the continued unimpeded operation and build-out of Davenport Marina. 4 • • The original dedication and reservation of easement by which the Corporation deeded the fee to the land underlying Davenport Marina to the City makes dedication of • the fee subject to reservation of an easement "upon and through the entirety of. . . [the marina site] " for the purpose of locating, constructing, maintaining, using, operating or • renting thereon, free of any rental charge by the City of Huntington Beach, docks , piers , wharves , slips , ramps , floats , landings and other mooring structures , and footings , • pilings and ancillary structures for bulkheads located on adjacent properties of the undersigned corporation, and dockhouses , club houses , marine fuel stations , restaurants , hotels and other structures or buildings of any nature or type for aquatic, recreational, fishing, boating, marina or harbor, and ancillary purposes of all kinds , whatsoever. . . . " This easement was expressly made severable and assignable. The inescapable conclusion to be drawn from the dedication and reservation of easement is that the Corporation or its successor in interest has never been required to procure a conditional exception from the City. The easement rights to construct Davenport Marina appear to be subject only to any applicable City building permit and similar requirements , with which the Corporation and Dr. Stanko have complied. 5 B. The Orange County Superior Court has determined that the Davenport Marina operator has a vested right to complete build-out of the Marina. Judge Soden' s Findings of Fact and Conclusions of Law in the Huntington Harbour case, together with the Judgment he entered in favor of the Corporation, establish that, in addition to its reserved easement rights to build a marina, the Corporation has a vested right to complete and operate Davenport Marina. A copy of the Court ' s Findings of Fact and Conclusions of Law is attached as Appendix C. A copy of the Court ' s Judgment is attached as Appendix D. The Huntington Harbour case is a conclusive determination of the marina operator' s entitlement to all slips originally authorized by the Conditional Exception, including those slips previously authorized but not yet constructed. See Appendix C, Conclusion of Law 3 (b) : "Huntington Harbour Corporation . . . has a vested right to complete the Davenport Marina. " (Emphasis added. ) C. Both the Corporation' s reserved easement rights and the vested rights under the Conditional Exception have transferred to Dr. Stanko . The marina easement contained in the City' s grant deed is expressly assignable and was transferred to Dr. Stanko when he purchased Davenport Marina. The Conditional Exception is a conditional use permit ("CUP") . It was 6 • • granted to the Corporation, Dr. Stanko ' s predecessor in interest, by the City in a quasi-adjudicative action, following a public hearing. Under California law, a CUP is • not a personal right of the owner of the property at the date the CUP is issued; instead, the CUP runs with the land and is available to any subsequent owner. Cohn v. Board of • Supervisors , 135 Cal. App. 2d 180 (1955) . Once an owner has acquired vested rights in a permit, those rights are protected to the same extent as if the use were a preexisting non-conforming use. Trans-Oceanic Oil Corp. v. Santa Barbara, 85 Cal. App. 2d 776 ( 1948) . The Huntington Harbour case conclusively determined ,that the marina' s CUP had become a vested right by reason of the developer ' s reliance upon issued permits and upon investments in construction. D. Current zoning may permit the present scale of marina operations . The original zoning for the Davenport Marina site • was single family residential. The present zoning, however, is CF-R. To the extent that the operation of the marina is a permitted use under the present community facilities zoning, the Conditional Exception would be voided and a present use permitted to continue as is . Because the Davenport Marina is a going concern which would then be protected under present zoning, this too would constitute a 7 • • vested right protectable by a court. Once again, this conclusion is supported by an Opinion of the City Attorney, a copy of which is attached as Appendix E (See Discussion of Question 2) . III IF THE CITY ATTEMPTS TO TAKE ACTION AGAINST THE • MARINA OPERATOR'S PROPERTY RIGHTS , HE WILL BE ENTITLED TO A WRIT OF MANDATE RESTRAINING THE CITY FROM ACTING, TOGETHER WITH MONEY DAMAGES. • A. The City can be restrained from acting. Should the City now attempt to establish a pierhead line that would eliminate any of Davenport Marina's • side ties , even assuming that it could lawfully establish such a pierhead line, Dr. Stanko would be entitled to a judicial writ of mandate prohibiting the City from • instituting any action to prevent him from using the side ties as part of his marina operations . Magruder v. Redwood, 203 Cal. 665 (1928) . Moreover, since the present use is • based upon the Marina' s earlier permits, as well as upon contract rights under the reserved easement, Dr. Stanko could enforce the Orange County Superior Court ' s prior • Judgment against the City. Trans-Oceanic , supra, 85 Cal. App . 2d at 795 . Indeed, should the City attempt to circumvent that Judgment , the City might be exposed to the • Court ' s contempt power. • 8 • B. If any slips were eliminated by City action, the City would be required to pay just compensation. The Fifth Amendment to the United States Constitution requires the City to pay "just compensation" when the City "takes" a person' s private property rights for public use. A "taking" can occur in two ways : either through formal condemnation (eminent domain) proceedings , or informally through a process known as "inverse condemnation, " which occurs when a government act or • regulation exceeds the government ' s power to regulate through the police power and frustrates the private property owner' s "reasonable investment-backed expectations" with respect to the property. Hamilton Bank of Johnson City v. Williamson County Regional Planning Commission, 729 F. 2d 402 (6th Cir. ) , cert. granted, 105 S .Ct. 80 (1984) (No. 84-4) . • In December 1975, following the entry of Judgment in the Huntington Harbour case, John J. O 'Connor, Deputy City Attorney, sent a memo to H. E. Hartge, the City' s Director of Public Works , answering the following question: "If the City Council was to establish a pierhead line for the Davenport Marina which resulted in the removal of • existing docking facilities , would the City be required to compensate the marina owner for this loss?" The Deputy City Attorney replied: "We respond in the affirmative. Establishment of a pierhead line by the City which would 9 • • require the removal of existing docking facilities as originally approved by the City, would clearly involve inverse condemnation in which the City would be required to • compensate the marina owner. Citation of authority is unnecessary, as this is basic law in California. " A copy of the Deputy City Attorney' s response is attached as Appendix • F. The present staff proposals are a repetition of proposals before the City Council in 1975 . Notwithstanding • any changes that may have occurred with respect to the California law of inverse condemnation since that date, federal courts are becoming increasingly active in • protecting a property owner 's rights under the Fifth Amendment to the United States Constitution. With the exception of the First Circuit, every federal court of • appeal that has decided the matter has determined that compensation in terms of money damages must be paid to a property owner for "takings" made through inverse condemnation by way of excessive government regulation. This monetary compensation may be either the full value of the property taken if the City ultimately punccases all of • the owner' s interest, or it may be damages for the period the invalid law or act was in effect before being overturned by the court . • • 10 • The Hamilton Bank case referred to above provides a particularly striking illustration. In 1973 , the Planning Commission of Williamson County, Tennessee approved a preliminary plat for a proposed cluster housing development covering 676 acres . The approved plat indicated that 736 dwelling units were to be permitted on the tract. • Lot lines , however, were only drawn for the first 469 units . Project development began, and between 1973 and 1979 the Planning Commission approved final plats for several • sections . The developer spent $3 , 000, 000 to $5 , 000,000 in improvements to the property during that time. In 1977 the zoning regulations were changed, but • the Planning Commission continued to apply the 1973 regulations to the project, since it had originally been approved under those earlier standards . That policy changed in 1979, when the Planning Commission decided to apply then- current regulations to future plats submitted by the developer. The developer, and Hamilton Bank, its successor in interest, submitted preliminary plats which included plans for developing the remaining undeveloped portion of the project by building 476 additional dwelling units , to bring .the development ' s total number of units at build-out to 688, substantially less than the 736 units authorized under the initial plat . Notwithstanding its prior approvals • and the fact that the completed project was going to have 11 significantly fewer homes than originally authorized, the Planning Commission denied the Plat. Hamilton Bank then brought an action in federal f court against the Williamson County Planning Commission under several theories of law, including inverse condemnation. The jury in the district court found that by disapproving Hamilton Bank's application to develop the balance of the property, the Planning Commission had frustrated the bank's reasonable, investment-backed expectations regarding the use of its property and that the Fifth Amendment required compensation to be paid to Hamilton Bank. The jury assessed damages against the Planning Commission in the amount of $350, 000 for the temporary taking of Hamilton Bank's property interest in the right to complete its development during the period between the time of the Planning Commission action and the date of trial . Hamilton Bank, supra, 729 F. 2d at 403-04 . The Sixth Circuit Court of Appeals , interpreting the • opinions in San Diego Gas & Electric Co. v. City of San Diego, 450 U.S. 621 ( 1981) , concluded that the United States Supreme Court will hold in the proper case that compensation 0 must be paid for temporary regulatory takings . 729 F. 2d at 409 . _.The Sixth Circuit ' s decision is presently being reviewed by the United States Supreme Court and a decision 41 is expected momentarily. 41 12 The Court of Appeals also noted that the federal taking claim could be maintained even in the absence of a vested right under state law to finish the development. i Id. , at 407. Of course , the Huntington Harbour decision states that the marina operator has just such a vested right to complete development of Davenport Marina. Thus , it appears that Dr. Stanko ' s right to compensation is significantly stronger than the developer' s right to compensation in Hamilton Bank. Nevertheless , the staff report states that "No expenditure of funds is involved in the recommended action." IV « ESTABLISHMENT OF ANY ONE OF THE PIERHEAD LINES DISCUSSED IN THE STAFF REPORT HAS OTHER TROUBLING LEGAL IMPLICATIONS. Although other legal implications will not be treated at length in this position paper, establishment of any of the pierhead lines discussed in the staff report suggests several additional legal problems that would be created for the City. Legislative acts are subject to judicial review to determine whether they are arbitrary and capricious . Arnel Development Co. v. City of Costa Mesa, 126 Cal. App. 3d 330, 337 (1981) . Similarly, any quasi-adjudicative action by the City Council, such as establishment of a pierhead line for Davenport Marina, must 13 meet an even stricter test . As set forth in Arnel, the essence of an arbitrary and capricious act is a legislative change of mind, in the absence of a "significant change in • circumstances . " Id. The City has previously appro ed 91 slips or Davenport Marina, including the side tie uld be lost 0Jr J1V4v — if one of the staff' s proposed pierhead lines were to be l)JC9--b adopted. Yet, the staff report makes no mention of any change in circumstances that would justify establishing a pierhead line contrary to earlier approvals . One would think that the City would consider whether the proposed pierhead lines further or retard the goals and policies set forth in the City' s General Plan and in the Coastal Element of the General Plan, which implements the California Coastal Act. The Coastal Element states that the "Coastal Act encourages increased recreational boating as a use of coastal waters . " Coastal Element , Section 2. 2. 8. The Coastal Element then notes that there is a • shortage of boating facilities in Huntington Beach. Id. The proposed Council action would remove existing berthing facilities in the face of a proclaimed shortage. Such an action would raise serious consistency problems, which -must be considered by the City Council . • 14 • V CONCLUSION The owner of Davenport Marina has a vested right to maintain all present facilities . There is no requirement that it be used exclusively for public purposes . "' • A reading of the forejoing (copy attached hereto as Exhibit I) t makes it abundantly clear that. the City of Huntington Beach In accepting, the dedication agreed to a broad and pervasive reservation of rights in the Huntington Harbour Corporation , and this reservation expressly permits the construction of a • marina as proposed by the Huntington Harbour Corporation . This is a reservation of a private proprietary easement , is legally valid, and was agreed to and accepted by the City under those terms and conditions . DISCUSSION OF QUESTION 2 : The property underlyng the waterway was zoned R1 at the time of dedication to the City , and has remained zoned R1 until several months ago when it was zoned to a community facilities • district . The law is well settled that a public entity is not hound by its zoning. Bail�Iv V. City of Los Angeles , ( 1956) 116 C . 2d 132 , Kubach Cu . v. McQuire 1926 ) 199 C . 21.5 ; 32 Ops . Calif. A.G . 143 ( 195 .) , California Zoning Practice , Section 859 , Page 355 . However, there is some authority which seems to indicate that even though a public entity is not bound by • zoning regulations , that a private developer desiring to con- struct a project on property owned by a public entity must comply r;ith existing zoning regulations . Wilsey & Co . V. San Bernardino , ( 1957 ) 155 C.A . 2d 145 . However, in the Wilsey case , the lease expressly provided that the structures would hive to comply, with local zoning regulations . In • the press evjt s1tuat.ion involving Davenport Marina, there was no express requiromer:t by the City in accepting the dedication that cons ruction of the marina or the other designated faci- lities cc.:,-.-ply .:i.th zor:ing regulations . Recreational areas are not further defined , how-ever, they would seer.; to encompass a boating recreational facility such as a •marina . Webster' s definition of "recrea- tional" is "equipped to provide diversion or amusements" . Boating is generally accepted as a recreational activity . r DISCUSSION ON QUESTION 4 : The fee to the property underlying the waterway is owned by the City , however, there has been an express reservation of private proprietary surface easements of the waterway for the purposes enumerated and set forth under the discussion of Question 1 , supra. These reservations expressly include the use of the surface for a marina. Therefore , use of the surface of the water for marina purposes is not use of public property but in fact use of private property under reservations of the private easement which has been expressly reserved by Huntington Harbour Corporation. DISCUSSION ON QUESTION 5 : It necessarily follows from our discussion of Question 4 that since the reservation of an easement for construction of a marina is private property rather than public property , that Huntington Harbour Corporation can restrict and limit use of the marina to residents of Huntington Harbour, if they are so disposed . Since the easement for construction of the marina remains private property, there would be no constitutional prohibition against restricting use of the marina to residents of Huntington Harbour. Of course , Huntington Harbour Corpora- Lion could not discrim-Inate against residents of Huntington Harbour on the basis of age , color, sex , etc . as provided under the Federal Civil. Right.
