RECOW41KNDATION Adopt the ordinance amending the Huntington Beach Municipal Code by adding Section 13.36.170 to Chapter 13.36 prohibiting docking of any vessel without consent of owner. ANALYSIS Chapter 13.36 of the Huntington Beach Municipal Code does not contain any restriction prohibiting a boater from docking his vessel at any pier or slip without the consent of 'the owner/agent in charge of said location. The lack of such an ordinance prohibits the County Harbor Patrol from removing an unauthorized vessel even when the rightful owner is being inconvenienced. This ordinance, which is similar to that utilized by the city of Newport Beach, would alleviate this problem. The County Harbor Patrol has advised us that when the ordinance is in effect, they will remove any unauthorized user in any dock or slip in Huntington Harbour providing that the owner files a written_ request on a standard form provided by the county. Said ordinance will also negate the use of considerable staff time presently being spent assisting Huntington Harbour homeowners in their efforts to remove unauthorized vessels from their private moorings. FUNDING SOURCE None ALTERNATIVE ACTIONS Maintain present sections and do not prohibit the docking of vessels without the consent of the owner. RECOMMENDATION: Approve plans and specifications and authorize the County of Orange to advertise for bids for the dredging of Huntington Harbour. ANALYSIS: The County has completed design plans and received permits for a $1.5 million project to dredge the Main Channel of Huntington Harbour from the Anaheim Bay bridge to Warner Avenue. On November, 1986 the City Council adopted a Resolution authorizing the County's Harbours, Beaches and Parks District to act as agents for the City to dredge Christiana Bay as part of the project. FUNDING SOURCE: The City Council included $20,000 in the 1987-88 budget in Account Number 343390 to cover the City's share of this project. ALTERNATIVE ACTION: Do not approve the plans and specifications and delete the City-funded portion of the project. TO CITY COUNCIL FROM JACK L SUBJECT Report on Meeting with State Lands DATE September 13 , 1984 Commission Staff As you recall, at our meeting of August 13 , 1984 , the City Council ,directed me to send letters to members of the State Lands Commission opposing the leasing of State land in the Main Channel and the Bolsa Chica Channel at the end of Countess Drive to anyone but Mola. Development and/or the City- for the purposes of constructing public and private boat slips. Those letters were sent. Also, at the direction of the City Council, I met with Claire Dedrick, Executive Officer of the State Lands Commission, and members of her staff in Sacramento on August 30th. Also in atten- dance were Paul Cook, Peter von Elten and Dick Harlow representing Mola. For your information,: the results of the meeting were as follows; 1. The State Lands Commission wants boat slips constructed in'.the Main Channel and the- Bolsa Chica Channel on sub- merged land they own in. order to increase boating facilities for the public. 2. The Commission has directed the staff to solicit proposals from parties interested in constructing these boat slips and operating a public marina. 3 . Commission staff strongly prefers. that the City lease their land for this purpose rather than private enterprise. 4 . Commission staff will recommend that the slips to bo constructed in the Main Channel be designated for use for the owners of the homes that Mola will build- only if the slips to be constructed in the Bolsa Chica Channel are made available to the general public. Staff has prepared the attached proposal which provides for the following: 1. The leasing of State lands in the Bolsa Chica Channel to develop and operate a 53 boat slip public marina by the City. 2. The leasing of State lands in the Main Channel with a sub-lease to the Portofino Cove Boatowners Association for the purpose of developing a 38 boat slip marina by Mola Development Corporation, and operation of this marina by the Boatowners Association. 3. The pierhead line for Tract 5481, lots 130 to 150 inclus -ve, and Tract 8040, lot 56 is requested to be relocated to 60 fee-.._ from the bulkhead. Recommendation: Adopt the at-:ached resolution to establish the pierhead line at 60 feet from the bulkhead for Tract 5481 and 8040, all in the Huntington Harbour Main Channel . Analysis : Pursuant to Section 13 . 32 . 020 of the Municipal Code, the pierhead line is established by City Council Action. "Pierhead Line" means the line -between the bulkhead and the waterway, which line separates the area open for navigation from the area extend- ing outward from the bulkhead in which the mooring and docking of vessels is permitted. The major portion of the wharfage area for Tract 8040 was approved to a 60 foot pierhead line by Resolution #5197 . The property owner for Lot 56 is requesting the 60 foot pierhead line to accommodate the large boat recently purchased. The pierhead line extension for Tract 5481 is consistant with city policy. Tracts 6675, 8040, 9168, 9335, 10004 and 11716 have pierhead. lines located at 60 feet from their bulkheads . Funding: No expenditure of funds is involved in the recommended action. The recommended action is hereby ' requested for Council approval. Recommendation: Adopt the attached resolution establishing the pierhead line per Exhibit "B" , Analysis: Pursuant to Section 13. 32 . 020 of the Municipal Code, the pierhead line is established by City Council Resolution. "Pierhead Line" means the line between the bulkhead and the waterway, which line separates the area open for navigation from the area extending outward from the bulkhead in which the mooring and docking of vessels is permitted. . The exact distance from the bulkhead to the pierhead line shall be determined by the City Council. The establishment of the pierhead line has been coordinated with the Army Corps of Engineers. . Exhibit A, B, and C are in substantial accordance with their authorization dated March 10 , 1971. Exhibit "A" indicates a pierhead line along the outer edges of the existing dock and would result in the elimination of four (4) side-tie moorings on the extremities of the docks. The action would establish a navigable channel width of 70 . 3 feet between pierhead lines. The marina proprietor would be penalized by this action. Exhibit "B" proposes a pierhead line along the outer edges of the existing docks at the narrow section of the navigable channel and 13 . feet from the outer edges of the docks, in the wide part of the channel. This action would allow the marina to maintain two (2) side-tie mooring and eliminate two. The minimum navigable channel width would be 70 . 3 feet. Exhibit "C" indicates a pierhead line that has been suggested by the marina owner. The pierhead line is proposed approximately parallel to the lot line of Lot "C" . The minimum channel width is 57 . 3 feet, and the maximum would maintain a width of 85 .00 feet. Gangways attached to an existing bulkhead leading directly to the Portofino Cove development will be constructed. Dock boxes will be included with each berth. These berths will he subleased to the Portofino Cove Boatowners Association, the members of which will own residential units in the Portofino Cove Development Tract Number 11716. . Construction of Phase I will be the responsibility of Nbla Development Corporation, with a contractor of their choice. Operation and maintenance of Phase I will be the responsibility of the Portofino Cove Boatowners Association, a corporation established in conjunction with Tract Number 11716. PHASE 1I - .A 100 space parking lot will he developed on land owned by Nola Development Corporation, the City, and the State. This parking lot will serve guests of the Portofino Cove development, visitors to the Ci.ty's Seabridge .Park, _and ,boatowners and guests of the public. marina to be developed as Phase III in the Bolsa a ica Channel . This parking lot shall include restroan5 and showers available only to boatowners in the public marina, Phase 11I; Storage space for marina operation supplies; a trash enclosure; public utilities including electrical , water, sewer, storm drain, and telephone; landscaping, and overhead lighting. Phase II will he developed by the City and Mola Development Corporation in conjunction with the attached Reciprocal Parking Agr.eanent. The contractor_ will be chosen by Mola and 'the City. PHASE III - 53 boat slips will be .constructed in the Bolsa Chica Channel and will be mmde available to the general public on a first cane-first serve basis. Construction will include; the extension of the existing bulkhead in the Bolsa Chica Channel ; necessary dredging; a gangway leading to the public parking lot, Phase 11; and 53 boat slips ranging in length from 50 feet to .25 feet. The contractor will be chosen by the City based on bidding procedures for governmental agencies in accordance to California law. PROPOSER'S MEITIOD OF OPERATION Phase I will be subleased to the Portofino Cove Boatowner's Association and wi11. be operaaed and maintained by that Association in accordance with subleasing terms established by the City as well as leasing terms established i 1 for the City by the State. The City will regularly inspect Phase I to assure compliance by the Association. i Phase II' and III will be operated and maintained by the City. Operation will consist of distributing and collecting keys to' the restrobms for .boatowners, and assuring that the parking lot is meeting all the needs for which it was developed including the visitors at . Seabridge Park. Maintenance will consist . of monthly parking lot cleaning, weekly landscape maintenance and regular irrigation and daily restroan cleaning and maintenance, trash bins will be collected by contract with Rainbow Disposal Company. The City will bill. all boat renters on a monthly basis and deposit all revenues in a special trust fund to be used for debt service, and .payment of operation and maintenance expenses. PROPOSER'S EXPERIENCE STATfMEW I � The City does not currently operate a public marina as proposed. However, the City does operate a 2,000 space parking lot and municipal beach and pier in the downtown section of the City. This operation includes concession Teases, overnight carrying facilities and . lifeguard services. Maintenance at this facility, includes the parking lot, landscaping and restrooms. The City also owns and maintains boat docks adjacent to the Warner Fire Station and Huntington Harbour Yacht Club .as well as guest docks on Trinidad. Island and the Seagate development. Operation of those facilities .is the responsibility of the City's Cotrmunity Services Department, Melvin Bo%Mn, Director. Maintenance is the responsibility of the Public Works .Departrr'nt, .Paul Cook, Director. PRDPOSID NEI M OF FINANCING DEVELOPNU F i Phase I will be financed by Mola Development Corporation through a loan from their own lender . Phase II will be financed by lVbla Development Corporation through a loan from their own lender. .. In. return for development of the. . State's upland parcel, Nbla will be credited with payment of parks and recreation fees, normally due to the City pursuant to the attached Reciprocal. Parking Agreement . Phase III will be financed by the City through a loan from the California Department. of Boating and Waterways. EXPERIENCE STATEVENr OF PROPOSER'S AIIC H I TDCT I If the City's proposal is accepted by the State, the City will send requests for proposals to architects qualified in marina design for Phase III . In accordance with California law for governmental agencies, the City will select the architect who most fully meets the city's needs. You will note that while most of the text of each document is identical, there are some very significant differences. My concern is that the County has shifted the emphasis from preservation of coastal resources to mitigation of development impacts. For example, the first paragraph of the Coastal Commission's text states an entrance will be allowed if it is found "that it will have no significant adverse impact on sand supply." The County's version states it will be approved if it is found "that it will have no significant unmitigable adverse impact on sand supply." Similar changes occur throughout the text. We must not allow any circumstances to exist which could lead to the total erosion of the beach, as has happened in Oceanside. This area has many similarities to Oceanside in terms of location and tidal movement, and severe erosion problems already exist here, as we all know. It is imperative that existing erosion not be exacerbated by development of navigable entrances into the Bolsa Chica. Recommendation: I strongly recommend that all references in the Orange County Land Use Plan to a navigable ocean entrance be taken verbatim from the California Coastal Commission's final revised modifications and findings of November 29, 1984. RECOMMENDATION: Adopt the attached resolution establishing pierhead line at 60 feet from the bulkhead. ANALYSIS: Pursuant to Section -13.32.020 of the Municipal Code, the pierhead line is established by City Council resolution. "Pierhead. line" means the line between the bulkhead and the waterway, which line separates the area open for navigation frown the area extending outward from the bulkhead in which the mooring and docking of vessels is permitted. The exact distance from the bulkhead to-the pierhead line shall. be determined by the City Council. The establishment of-pierhead line has been coordinated with the Army Corps of Engineers. The clear channel width in the Main Channel is sufficient for navigation. To quote from "Huntington Harbor, the Planning Process" prepared by Moffat Nichol Engin- eering, "Comparative statistics show the great superiority of Huntington Harbour over the Southern California residential marinas in the liberal provision of clear channel widths for boat navigation." Reducing clear channel width in the Main Channel from 310' to 300' will not affect boat traffic. The primary obstructions are existing at Peter's Landing and the Pacific Coast Highway bridge, each with a clearance of 210 feet. At the March 18, 1985 Council meeting, Resolution 5503 was continued for more information. The information is contained in memo dated March 18, 1985 to Jeri Chenelle from Les Evans, City Engineer. April 1, 1985,Council Resolution 5503 was continued as a result of March 20, 1985 letter from Trinidad .Island Homeowners Association. Their letter indicated the City would not extend pierhead line without Homeowners Association agreement. April 10, 1985,- the Honorable Mayor Bailey, Councilman Kelly, the Demler family, and Mr. Hibbard of the Public Works Dept. met to discuss the pierhead line at Trinidad Island. During the meeting, a letter dated April 8, 1985 from the Trinidad Island Homeowners Association was presented. Line In response to Mayor Bailey's concerns, we have developed the following information: 1. What is the minimum width criteria for a channel? Doug D'Arnall contacted Lt. Harry Gage of the Orange County. Sheriff's Department and was advised that he- knew of no such requirements. A subsequent phone call to the Department of Boating and Waterways in Sacramento revealed that there were in fact, no such laws on the books: Doug. was advised that the State of California did publish a guideline for the design of marinas. - In this guideline , 'no specific dimensions are listed for the width of any channel including a main channel - in a marina. The guideline simply states that when a harbor. . is designed and pierhead lines established, reasonable access should be provided for navigation. For example, if you are going to have vessels in. the harbor up to 100 ' in length, you would at least want a 150 ' access so the vessel could make a comfortable turn around. In the case of the main channel in Huntington Harbour which,- is 410 ' wide, a pierhead ". line of 60 ' would not appear to be unreasonable. The fact remains that since there are no specif-ic laws. or guidelines that dictate the required width of a harbor, the Council is free to establish any pierhead line . that. they deem to be in the City's best interest. If you need more detailed .information, Doug has - requested that the' State send us a copy of the guideline. 2 . What are the environmental requirements? The environmental concerns where addressed in the Environ mental Impact Report (EIR 74-6) Tentative Tract 8636 and Townhouse Study Plan for Tract 8718 . The EIR states : "Both tract proposals will include docking facilities. Thus additional boats will be introduced .to the. harbor with the project. It is estimated that 2.08 docks can be built in the channels adjacent to the project Memo to Jeri Chene. Quanti- fication of the boating impacts of the project on water quality of the area around the project is not possible based on the absence of -applicable research data to construct a water quality model. However, - it is important . . to keep in mind that, although the total pollutant load will increase within the harbor, the-pollutants will be distributed through an increased water volume. This is due to the fact that the completion of Long- Channel will increase the water volume. Consequently, the average concentrations may not increase significantly. " The report does not list mitigation measures for increased boat traffic, and the resolution, #5503 does not increase boat traffic. 3. What is State involvement? None. RECOMMENDATION Authorize the transfer of $10,000 from the unappropriated fund balance into Account No. 343441 (Maint . , Harbor) for the purchase of a "SEA CURTAIN" Debris Barrier. ANALYSIS Containing the enormous amount of debris that flows into the Huntington Harbour waterway from the flood control channels has long been a problem. Kepner Plastics Fabricators , Inc . has developed a debris containment device that has been used quite successfully by the City of Long Beach. This device could be utilized in Huntington Harbour adjacent to the Edinger and Warner bridges with equal success . It is recommended to purchase one unit and install it at the Warner Avenue site on a trial basis . If, during next winter ' s rain, the barrier proves to be effective, a second unit will be purchased for the flood control channel below the Edinger bridge . This control procedure has been reviewed by the Public Works Director who is agreeable to the trial program. The early request on this item is to provide suffi- cient time to receive the product and apply for and obtain the necessary permits for installation. FUNDING SOURCE Unappropriated General Fund. ALTERNATIVE ACTIONS 1 . Request matching funds from the county to assist in this project ; 2 . Request county to provide and maintain the barrier; 3 . Yet, in spite of all a'ffi-ratative action indicated by the State and -the -public: hearings on environmental questions required by the State Water Quality Control Board, action by the City_ Council in rejecting Negative Declaration No. 84-32 stopped all further .action .on the project. You -interrupted a process- which _was. routine and contained in it all the safeguards to . the environment over ;which Councih members expressed concern. Ther.e .were expressions on .the part .of some Council members that the project was too costly. Those members should be advised that the project is being planned, we are told, in strict accordance with technical guide lines laid clown by the granting agency, State Department of Boating and Waterways. And it is noted . further, the funds used for this project belong to the boaters who will benefit, for it derives .from fuel -taxes alr..eady paid by these boaters. As you already know, this entire project will be . paid for by the Boating and Waterways -Revolving Fund which accrues at the rate of approximately 25 million dollars eac'.: year. The plan also shows two handicapped parking stalls where a restroom facility could be constructed as an alternative. Initial estimates indicate that approximately 8,000 cubic yards of material will have to be dredged out of the main channel for the creation of the facility. Other services for the ramp will include electrical and water service. However, no buildings, other than a possible restroom, will be constructed. The City is requesting State participation in the form of a grant to fund the facility. An itemized cost estimate for the project is provided further on in the text. A section of drawings including (1) a location map, (2) a project site map, and (3) a project layout map with a legal description also follow. 4. PROPOSED USES Anticipated boating uses for vessels launched from the proposed facility include fishing, water-skiing, cruising and sailing. At present, no restrictions on the vessels are now anticipated. 5. IMPACT ON EXISTING FACILITIES The boat ownership and economic characteristics of the project area indicate both a high present and future_demand for launching facilities. The median income for the Huntington Beach area is over $25,000 per year, and the large number of boats in the area reflects a major interest in boating as a recreational activity. A survey of the usage of existing launching facilities was conducted, and a public hearing on the subject was scheduled for the City Council meeting of June 18, 1984. At that meeting the Council approved Resolution No. 5397 requesting a grant for the development of this project. 6. SURROUNDING AREA The proposed Warner Avenue Boat Launching Facility is located in the main Harbor Channel of Huntington Harbor within the City of Huntington Beach. Huntington Beach is situated along the southern coastal region of Orange County, just south of the Los Angeles County line. It lies about 35 miles southeast of central Los Angeles and 95 miles northwest of San Diego. This coastal location provides Huntington Beach with a pleasant climate year-round. The prevailing westerly and southwesterly winds from the Pacific Ocean, with a mean hourly speed of 10 to 15 miles per hour, help maintain pleasant weather all year long. Area rainfall averages just under 12 inches annually, with an average temperature of 62 degrees. Existing boating facilities include three private marinas (Huntington Harbor Bay and Racquet Club, Peter's Landing, Davenport Marina), a public marina (Sunset Acquatic Center), and a public launching facility. The pleasant climate provides for a year-round boating season in all types of uses. Although the area is primarily residential, some light industry is present. A large . industrial park is located in the northwestern section of the City near the proposed launching facility. The immediate area also contains a sizable boat building, . supplying and repairing industry. 2. PROJECT SITE The proposed site is now undeveloped. It lies within "Huntington Harbour," a water oriented residential community served by several navigational channels. The launching facility will be at the southeast end of the main channel, with the harbor to the northeast and ocean-access to the northwest through Anaheim Bay. Road access to the site is provided by Warner Avenue, a fully improved four lane primary arterial highway. The project area can be reached by traveling west on Warner to within five hundred feet of its termis into Pacific Coast Highway. At present there is one other boat launching facility in the harbor. It is located directly across the main channel from the proposed site adjacent to the Warner Avenue Fire Station. However, the existing facility is of limited recreational value because of its small size and restrictive parking. 3. PROPOSED PROJECT The proposed project is the development of a 30' boat launching ramp and facility at the southeastern end of the main Harbor Channel. The launching facility will include landscaping and parking.. Provision for a restroom could also be made. Construction at the site would include 350' of rip rap slope, 765' of concrete curb and 25,425 sq. ft. of paving. The ramp will be adjoined on the east by a 6' floating dock. The project as proposed could result in the permanent loss of intertidal and subtidal marine habitat and resources. We are , at this . time , unable to ascertain the extent of impacts, if any, to marine resources and habitats because insufficient information is provided with the Negative Declaration. We contacted Messrs. H. Zelefsky and L. Evans of the City of Huntington Beach to determine the extent of habitat and resource gains and losses . We were informed that the dredging of 8, 000 cubic yards from the main channel was necessary to maintain the original design depth of the channel. The material is to be used to grade and level the existing area. The rip rap slope would extend from the finished grade to the bottom of the channel approximately at minus ten feet mean lower low water (MLLW) . However, Mr. Evans was unable to determine the amount of cut and fill and the area of intertidal mudflat, if any, which would be lost. He stated that no detailed plans for the project had been prepared and that present plans were conceptual at this. time and were prepared to be submitted for a project-funding request. We stated to the applicant that our acceptance of a Negative Declaration for the proposed project, at this time, would be inappropriate because there was insufficient information available to determine that the project as proposed would have no impacts to marine habitats- and resources . We also stated that if the project were designed so that gains and losses of marine habitats and resources were balanced or adequately mitigated, a Negative Declaration would be acceptable . The time table for the $370 , 000 grant for this project is that funds would be available, if all State approvals are received, in Sept. 1985. After that time, the City would hire an architect to design the project and prepare final plans and specifications. Construction would begin in July, 1986 and the facility would be open for operation by July 1987 . The extraordinary time frame is to obtain approvals for dredging and disposal of same. 2. The approximately 8 ,000 cubic yards of material to be dredged for this facility represents about 6. 5% of the total that needs to be dredged from the Main Channel. However , this project would alleviate an existing navigation hazard directly in front of the Huntington Harbour Yacht Club where considerable boating activity takes place, especially by youth learning to sail. 3 . The California Department of Boating and Waterway provides funds for grants or loans for new or improved boating facilities such as launch facilities or marinas. They will pay for dredg- ing if it is incidental to the facility being developed. They cannot provide funds if they are to be used for maintenance dredging. 4 . This facility, if developed, may be removed for widening of the Main Channel to accommodate boating from Huntington Harbour to the Bolsa Chica area if a full navigable channel is developed . However, that development is at least 10 years away and, probably, much longer. In the meantime , this facility could be used by the boatowners in the area. 5 . Funding in an estimated amount of $33,000 is needed for the work. RECOMMENDATION: Authorize the expenditure of $33,000 from the unappropriated General.Fund_balance, & authorize this maintenance reconstruction to be bid through the Purchasing Department. ANALYSIS: The subject public docks are located easterly of the Huntington Harbour Yacht Club and are comprised of a "U" shaped main dock and a smaller make-up dock. These facilities were constructed pursuant to an agreement between the City and the County of Orange, dated June 6, 1978 and amended on July 31, 1979, utilizing County Revenue Sharing Funds. The covenants provide that the City maintain the facility for public use. In September of 1984, subsequent to 84-85 budget adoption, it was brought to the attention of Public Works that the dock decking had been broken up due to wave actions caused by excessive speeds of boat turnings in the Harbor Channel . However, salt air corrosion of the reinforcing in the normally thin concrete units may have also been a contributing factor. The Fire Station Dock was also damaged at about the same time, however, it was much less costly, and the repairs have been completed. The specifications provide for bidding new. concrete deck or an alternative of lumber, and will effect the installation of one additional support/guide pile. FUNDING SOURCE: Unappropriated General Funds(Account A301) are proposed for this project. ALTERNATIVE ACTIONS: Do not approve the project, however, City failure to maintain the public facility will effect non-compliance with the agreement. General Description: The work, hereinafter described, consists in general of the removal and disposal of the decking on the public docking facility located north of Warner Avenue and east of Pacific Coast Highway, the protection in place of existing piling, the installation of one pile, the salvage and reuse of existing concrete encapsulated floatation units, the salvage and reinstallation of existing gangways, and the reconstruction of a new decking in the same configuration and of similar nominal dimensions as the original . II. Salvage. Items: . The following existing items shall be salvaged and reused or reinstalled in the reconstruction. A. Three concrete pilings. Contractor to install a fiberglass cap on one pile. B. Two gangways, to be reinstalled after completion of the new decking. C. Rollers, brackets , and guides for the existing piling. Contractor to reinstall with new galvanized angle iron supports and bolts; and to furnish and install equivalent assemblies. for the new pile location. D. All floatation units. Rollers and guides shall be equal to or better than those indicated on the plan dated 12-19-77. IV. Shop Drawings and Phasing Submittals: The successful bidder shall be'required to submit Shop Drawings with dimensioned plan views, sections,. and details for the new installations proposed in his'quotation. All supports, blocking, -and connections must be clearly indicated. Blocking and spacers shall securely confine the floatation units in such a manner that the distances between floats remain constant. Should the design and/or calculations of the success- ful bidder dictate additional .floats, new floats shall be furnished and -2- IV. Lights, buoys, or other satisfactory markings shall be provided to provide for night indicators of their locations to prevent boating accidents. Openings in the hand- ' rails shall be secured after removal of the gangways in order to pre- vent pedestrian passage beyond the bulkhead. VII. Consideration of Alternates: The intention of these specifications is to -provide sufficient guide- lines for the submittal of bids for either a concrete or lumber deck. The considerations for acceptability as the final selection will be based on the bid together with the number of years guarantee of materials and workmanship and anticipated maintenance costs, for a life cycle type review. -3- VIII. Standard Specifications: Except•as hereinafter provided, the provisions of the 1979 Edition . of the "Standard Specifications for Public Works Construction" (Green .Book) published by Building News. Inc. , 3055 Overland Avenue, Los Angeles, California 90034, and all amendments thereto, adopted by the Joint Cooperative Committee of Southern California District and Associated Contractors of California; hereinafter referred to as Standard Specifications, are adopted as- the "Standard Specifications" for this project and shall be considered .as a part of these Special Provisions. IX. Design Criteria: A. Sufficient floatation shall be provided to support a live load of 20 lbs, per square foot of deck area, with a freeboard of' not less than 10 inches. With no live load, the freeboard shall be between 15 inches and 18 inches, with a maximum variation of 1". B. Pontoons shall be located within the structure so as. to be capable of supporting a 400 lb. point load moving in any area on a float without excessive rolling or tilting of the dock. C. For purposes of calculating dead loads:, the unit weight of lumber shall be taken at 35 lbs. per cubic foot. D. The floating dock system shall be designed to withstand a uniformly distributed wind load of 15 p.s.f. acting on the above water profile of a berthed craft and floating docks. X. Materials: A. Proprietary manufacturers and stock numbers where used in these specifications shall be understood to be those listed for the original construction, and "or approved equal " shall apply in all cases. y . -4- X. To secure pontoon positions shall be a minimum of 1 - 4 X 6 across each end. D. Lumber Treatment: ' All lumber for the construction of the floating dock shall be pressure treated per AWPA Specification C2-74, or current revision, to prevent dry rot. No incising. All field cuts and bored holes to receive a brush coat of concentrated preservative. E. Plywood: Plywood when used as a- deck surface on knees, dock ends, and utility through cover, etc. shall be Grade A-B exterior with a medium density overlay. Duriply, Harborite or equal . F. Bumper Stripping: Bumper stripping shall be white or off-white, extruded vinyl plastic, ethylene propylene, neoprene or other synthetic rubber, compounded to resist salt water, ozone and sunlight. Stripping shall be installed around total perimeters of the docks. -5- X. Materials, Cont. G. Corner Bumpers: ' Corner bumpers shall be #CF 4 X 8-by Newman & Bennetts, Inc. , or #4311 by Docker Marine: Three bumpers shall be installed on each corner. H. Bumper. Nails: All corner bumpers and bumper .stripping shall be secured to the fender lumber with 1 1/4" hot dip galvanized, domestic roofing . nails at 6" O.C. staggered top and bottom. The deck surface of knees, dock ends that are plywood, utility through cover, and the entire deck surface for a lumber alternate shall be painted with a marine primer and two coats of battleship grey non-slip coating. For both alternates, the existing gangways shall be.repainted as above. -6- X. Materials, Cont. L. Pontoons (if additional are required) , and Deck Units for Concrete Alternate: Pontoons shall be. a manufactured product comprised of expanded polystyrene foam cores and lightweight concrete surfaces. 1. Lightweight concrete shall have a maximum dry unit weight of 115 lbs. per cubic foot. The minimum compressive strength shall be 3000 psi at 28 days. 2. Pontoons shall be cast in forms with smooth, true surfaces. Forms shall have a tolerance of plus or minus 1/8" in all directions and shall be cleaned and oiled before each casting. 3: Concrete shall be placed in forms in such a manner as to prevent any segregation of the concrete- mix and shall be vibrated bothinternally and externally to insure a dense, smooth finish. The placement of the concrete shall be such that no cold joint exists in any part of the finished product. 4. The concrete shall be reinforced by the proper placement of appropriate welded wire fabric and. reinforcing rod as shown on the contractors plans. A1-1 reinforcing bars, rods, and wire fabric, shall be hot dip galvanized. 5. The float deck surface shall be trowel finished with a steel trowel- and a light broom finished applied. The. surface shall be sprayed with an acceptable curing compound immediately after finishing. The remainder of the float shall be sprayed immediately after form stripping. -7- X. Materials, Cont. M. Foam• The expanded polystyrene foam core shall be planed and held in true position with .a permissible tolerance of not more 1/8" from dimensions shown on the drawings. Vibration of the concrete. shall be maintained to insure a bond between the foam core and concrete surface. 1. My concern is that the County has : shifted the emphasis from preservation of coastal resources to mitigation of development i - impacts. For example, the first paragraph pf the Coastal Commission's text states an . entrance will be allowed if it is found "that it will have no significant adverse impact on sand Supply:' The County's version states it' will be-approved if it is .found "that it will have no significant unmitigable adverse impact on sand supply." Similar changes occur throughout the:text. We must not allow any circumstances to exist which could lead to the total erosion of thej beach, as has happened in Oceanside. This, area has many similarities to Oceanside inl terms of location and tidal movement, and severe erosion problems already exist here, as; we all know. It is 'imperative that existing erosion not be exacerbated by development of navigable entrances into the Bolsa Chica. Recommendation: I strongly recommend that further planning of Bolsa Chica be delayed until the Army Corps of': Engineers has sufficient hydrological _ data to. determine whether such navigable' entrances can be constructed without damage to Bolsa Chica State Beach and Huntington' Beach. The project would also include 356 feet of rip rap slope, .a six-foot floating dock and the dredging of about 8,000 cubic yards of material from the main channel for the creation of the facility. The project as proposed could result in the permanent loss of intertidal and subtidal marine habitat and resources. We are, at' this time , unable to ascertain the extent of impacts, if any, to marine resources and habitats because insufficient information is provided with the Negative. Declaration. We contacted Messrs. H. Zelefsky and L. Evans of the City of Huntington Beach to determine the extent of habitat and resource gains and losses . We were informed that the dredging of 8,000 cubic yards from the main channel was necessary to maintain the . original design depth of the channel. The material is to be used to grade and level the existing area. The rip rap slope would extend from the .finished grade to the bottom of the channel approximately at minus ten feet mean lower low water (MLLW) . However, Mr. Evans was unable to determine the amount of cut and fill and the area of intertidal mudflat, if any, which would be lost. He stated that no detailed plans for the project had been prepared and that- present plans were conceptual at this- time and were prepared to be submitted for a project-funding request. we stated to the applicant that our acceptance of a Negative Declaration for the proposed project, at this time, would be inappropriate because there was insufficient information available to determine that the project as proposed would have no impacts to marine habitats and resources. We also stated that if the project were designed so that gains and losses of marine habitats and resources were balanced or adequately mitigated, a Negative Declaration would be acceptable . City Council policy needs to be determined if the City should enter into an ongoing waterway cost sharing maintenance agreement with the County of Orange. RECOMMENDATION Authorize the City Administrator to negotiate with the County of Orange to dredge the main channel and Christiana Bay within Huntington Harbour and enter into an ongoing waterway cleaning agreement for Huntington Harbour. ANALYSIS In July 1982, the City entered into a cost sharing agreement with the County to conduct a harbor depth survey. The survey was completed in October 1984, at a cost .to the City of $20,500. The survey indicated that only the main channel and Christiana Bay were in need of dredging. The County has indicated they will pay for the cost of dredging the main channel (see attached cost, map and schedule). The City would pay for Cnristiana Bay inasmuch as the bay is within the City jurisdiction. The main channel is. under ownership by State tidelands. The side and finger channel are under the jurisdiction of the City. The County is agreeable to apply to the State and Federal agencies for a dredging permit on behalf of the City. . The County estimates that it will take approximately three years to obtain a dredging permit. The City cost for dredging and bioassay investigation will be about $17,000. Funds will be budgeted in FY 88. In September 1982, the City entered into a matching funds agreement with the County to maintain the cleaning of the harbor waterways within Huntington Harbour (see attached map - slash lines indicate maintained area). Tile annual cost agreement with our outside contractor is $42,000 ($21,000 paid by City). The original agreement was to be for a one-year period with the idea that the City would investigate funding sources more associated to the direct uses. Funding sources have been investigated but have not materialized. The County has indicated that they are willing to enter into an ongoing agreement to provide matching funds for this purpose once the City commits to this ongoing program. Yearly costs are estimated to increase from five to ten percent annually. FUNDING SOURCE General Fund. The exact distance from the bulkhead to the pierhead line shall be determined by the City Council. The 40' pierhead line was established for this tract which was consistant with City policy. at that time. The wharfage areas were planned for 30' to 35' long boats. The 60' is necessary to accommodate the 40' range boats which predominate in this area. The establishment of pierhead line has been coordinated with the Army Corps of Engineers. The clear channel width in the main channel is sufficient for navigation. Lots 8, 9, 25 'through 28, '55 and 56 are not recommended for pierhead line relocation. Lots 8, 9, 55 and 56 are sufficient in size to accommodate the average large size vessel. A relocated pierhead line for lots 25 through 28 would interfere with boat traffic utilizing Lot '.Cl Marina. To quote from "Huntington Harbor, the Planning Process" prepared by Moffat Nichol Engineering, "Cbrrparative statistics show the great superiority of Huntington Harbor over the Southern California residential marinas in the liberal provision of clear channel widths for boat navigation". Reducing clear channel width in the main channel froi;� 320' to 280' will not affect boat traffic. The primary obstructions are existing at Peter's Landing, and the Pacific Coast Highway Bridge, each with a clearance of 210 feet. Recommendation: Request .the County Board of Supervisors to share equally the cost of survey control in Huntington Harbour. Authorize an equity transfer of $20, 500 from the Capital Outlay Fund to the General Fund. as the City' s share of the cost of setting survey control and performing an accurate survey. . Analysis: On May 12, 1981, the City .of Huntington Beach and the Orange County Harbors, Beaches and Parks District amended their existing agreement to provide for Environmental Management Agency assisting the City in . performing condition surveys within Huntington. Harbour. waterways. The surveys were conducted in order to determine the extent of shoaling and to develop a maintenance plan for keeping the main channel free of navigational hazards. During the survey, it was noted that there was a lack of permanent survey control along the main channel and the work was done by fathometer on an approximation basis. As a result of the initial survey, it was determined that much of the main channel is less than the required 10 feet of depth. The survey team has recommended that some type of permanent survey control be established along the main channel in order that more exact cross- sections can be made and repeated on an. annual or bi-annual basis with some accuracy. The cost of establishing permanent control is estimated at� $33,000. After initial survey control is 'set, the main channel can be cross-sectioned at a cost of about $8,000. RECOMMENDATION: Adopt the attached resolution establishing pierhead lines which provide a wharfage width of 60 feet in ' the Bolsa Chica Channel. ANALYSIS: A pierhead line is the line between a bulkhead wall and. a waterway which separates the area for navigation from the area for the mooring. and docking of vessels. Pursuant to Section 13.32. 02'0 of the Municipal Code, the pierhead line is established by. the City Council by resolution. The requested 60_ feet width for wharfage area. in the..Bolsa Chica Channel is consistent with .present City policy. The establishment of the pierhead line has been coordinated with the Army Corps .of Engineers. The center clear channel width- in the Bolsa Chica Channel is sufficient for navigation.
