SUBJECT: DEAWAY CIRCLE
At the September , ouncil meeting, the Council requested
some additional information regarding Hideaway Circle and a petition
for the application of the State of .California Vehicle Code, Section
21107, Enforcement of a Private Street. This private, 20-foot access
easement is located west of Green Street approximately 170 feet south
of the centerline of Neely Circle.. The applicant indicated to the
Council that prior to the issuance of building permits he had been ad-
vised -that the Fire Department requested assurance that Hideaway Circle
would remain free of vehicle parking; therefore, he requested the
Council approve the Police Department' s enforcement of "no parking" on
this private street.
Prior to the Council approving this request, the Department of Develop-
ment Services was directed to provide some additional information
regarding this matter. All of the records at hand indicate that no
dedication of Hideaway Circle has ever been made to the City and the
only document ever recorded on this 20-foot access easement was- the
original access easement recorded when the original tract, 184 , was re-
corded with the County.
The request for enforcement of "no parking" came from a property owner
who- would like to develop five contiguous lots located at the southwest
end of Hideaway Circel. This private easement would be the only means
of access to the proposed project. The minimum private street width for
planned residential developments within the City is 24 feet; this allows
2 12-foot, side by side travel lanes. Because of the existing construc-
tion both on the north and south sides of Hideaway Circle, it would be
impossible to provide a clear 24-foot wide travel lane to the subject
property. Therefore, the Department of Development Services is recom-
mending that the Council deny this petition for the application of
California Vehicle Code Section 21107 and further recommends that Council
place a building moratorium on the properties located south of Hideaway
Circle and north of Pearce Avenue and direct the Department of Development
Services to develop a precise plan of street alignment for this area,
which would alleviate the possibility of similar situations occurring in
the future. Two additional private access ways similar to Hideaway
Circle exist between Hideaway Circle and Pearce Avenue.

STATEMENT OF ISSUE
A request from James E. Neal & Joseph N. Shaffer for enforcement of the
provisions of the California Vehicle Code on their privately owned
un-dedicated street pursuant to authority of Section 22107. 7 (a) CVC.
RECOMMENDED ACTION
Deny the requested resolution.
ANALYSIS
At the present time there exists or is under construction within the
City of Huntington Beach, 74 private development tracts consisting of
approximately 7, 900 individual units that will house an estimated 18, 000 .
persons . Additionally., there are plans for 12. .private developments of '
500 to 600 units on file with the city in various planning stages . Each
of-these developments .are laced with networks of private , un-dedicated
roadways. Whereas the police department is obligated to provide each of
these developments with routine police services , none of them require
the police to respond to traffic en-forcemen t probelms with the single
exception of the Villa Pacific ,Condominium development.. This tract' s
petition was accepted approximately Rine (9) years ago by the. city
and approved by the ,police department under a - different set of budgetary
conditions . As the police department' s manpower problems and budget
limitations developed over the intervening years it became the policy
of the department to routinely disapprove similar requests of' other
.private developments . This policy has been endorsed by the City
Administrator and City Councils . A reversal of this policy at this :
time could conceivably result in a deluge of requests from .other privately
owned tracts which, at the worst , would be equilivant to the department
having to absorb the additional traffic related calls- for-service of
an 18 ,000 population community. At best , if only a small percentage

of the private developments sought such police service it would result
in a diversion of manpower and an obvious reduction in the level of
services to the community at large. Until such time as budgetary
problems are overcome and the council is able to resolve the
Police Department 's manpower shortages , it must continue to be the
policy of the Police Department to disapprove all such requests from
private property owners .
ALTERNATIVE :
1 . Approve the resolution and appropriate the necessary funds for
increased police personnel .
2 . Approve the resolution and accept a generally reduced level of
police service to the community at large .
S. Deny the resolution and recommend the property owners post
the private street in accordance with Section 22658- a CVC ,
permitting removal of vehicles from private property by the
owner or person in lawful possession.

ON A PRIVATE ROADWAY
This memorandum is in accordance with your request regarding the James E. Neal
property. Mr. Neal has asked that the street known as Hideout Circle be
designated by resolution so that the Vehicle Code may be enforced.
In effect his request is to satisfy fire department requirements. The
department in effect does not recognize any street other than those having a
minimum width of 40 feet as accessible for fire fighting purposes. The 40-foot
street allows for parking on both sides and a minimum of two, 12-foot travel
lanes in each direction. The Neal property is unique in that they cannot
provide that type of street width or access and still have a buildable lot. We
will accept a 24-foot private roadway if the owner can guarantee that no one
will park there. This guarantee comes about in a couple of ways:- 1) they
design the road so that parking is impossible and 2) post it with adequate
signs indicating no parking. The problem with the Neal property is that he is
willing to do that, but the Vehicle Code cannot be enforced on private
property. Even though the code calls out no parking in a fire lane, the
California Vehicle Code pre-empts our local Fire Code.
In order to have enforcement on private property, the owners must submit a
petition indicating their interest to do so and under California Vehicle Code,
Section 21107.7 a city is permitted to accept the enforcement responsibility by
resolution.
Mr. Neal has complied with all of our requests including an agreement to fire
sprinkler the structure and post no parking signs per our specifications on the
street. As far as the city adopting by resolution any specific area, we are
neutral on that point and in the case of Mr. Neal 's property, we feel that would
be a solution to his problem. If he is not permitted to do that, then he
probably will not be able to build the building that he intends to build.
In closing we agree with the Police Department in that we do not like the
scatter gun approach to designating certain areas enforceable under the 21107.7
section. We feel a more appropriate method is to pursue getting the State law
changed or get an Attorney General 's ruling indicating that the city can develop
such an ordinance and that it will be enforceable uniformly throughout the
city. The Police Department has indicated they will be willing to take on the
parking control problem and we certainly would like to see it. Everyone
recognizes that there would be an increase in personnel ; however, it is also
felt that the cost of the personnel would be offsett by fines imposed for
violators.

Dear Sir:
Regarding your letter of May 20, 1980 addressed to the Mayor
and City Council of Huntington Beach wherein you request a
resolution be passed allowing the Police Department to enforce
no parking requirements in your proposed apartment building
project, I must inform you of the following:
California Vehicle Code Section 21107 . 7 states that a city
may resolve to enforce the vehicle code, which would include
no parking restrictions,, only if a majority of the owners of
such private roadways request same via a petition. Upon
enactment of the resolution, the vehicle code may be enforced - -
provided appropriate signs are erected at the entrances to
these private roadways. The signs must state that the road is
subject to the provisions of the vehicle code and must be readily
legible from a distance of 100 feet during daylight hours.
If you are successful in obtaining the aforementioned petition
signed by a majority of your owners, I feel obligated to advise
you that due to manpower limitations, the Police Department
will oppose the adoption of such a resolution.

Parking Regulations for a Private
Street
Honorable Mayor and Members of the Council :
Sunset-Orange Partnership intends to construct a three unit
apartment building on property owned by the Partnership
which is legally described as Lots 85, 86 , 87 , 88 , 89 of
Tract No. 184 in the C�tp—of-H-rrtington Beach, which will
also be known as 2 Hideout Cle.
Prior to issuance o-a-building permit, we have been advised
that the Fire Department will require assurance that Hideout
Circle will remain free of vehicle street parking enabling
Fire Department access. Being that Hideout Circle is a pri-
vate street involving several owners, some of which are out
of state residents, it is not reasonably feasible to provide
adequate assurance to the Fire Department that the "no park-
ing" requirement can be enforced without the assistance of
the City Police Department. Therefore, we request the City
Council to affect a resolution allowing the City Police De-
partment to enforce the "no parking" requirement.
As no further action can be taken in our development plan
until this matter is satisfactorily resolved, your prompt
attention will be greatly appreciated.

The undersigned, representing.a majority of those property owners
having a twenty (20) foot access easement over that certain private roadway
(alley) known as Hideout Circle, Huntington Beach, California, by their
signatures hereon REQUEST AND PETITION the following:
That the City Council prepare and pass a Resolution
allowing the Police Department of the City of Huntington
Beach to enforce the fire access lane "No Parking" re-
quirements along the above referenced roadway pursuant to
Section 21107.7 of the California Vehicle Code.
The reason for the petition is as follows:
--The-pro -owner of-record-of -Assessor's-parcel numbers-- ----�—�-
178-201-28, 29, 30 and 31, which encompasses lots 85 through 89 in Tract
184, as recorded in Book-12, Page. 27 of Miscellaneous Maps in the office
of the Orange County Recorder, has received approval of Conditional Ex-
ception Number 80-4 subject to certain conditions which provide that,
(a) the entire alley from Green Street to the west end of
Lot 85 shall be designated a fire land and kept ccinpletely clear of any
parking;
(b) if fire access lane "No Parking" enforcement provisions
along the private alley cannot be worked out to Fire Department specifio
cations, or any alternative fire protection devices provided, the applica-
tion shall become null and void;
(c) the attached conceptual plot plan shall be the approved lay-
out showing access via the twenty (20) foot alley.

Regarding your letter of May 20, 1980 addressed to the Mayor
and City Council of Huntington Beach wherein you request a
resolution be passed allowing the Police Department to enforce
no parking requirements in your proposed apartment building
project, I must inform you of the following:
California Vehicle Code Section 21107 . 7 states that a city
' may resolve to enforce the vehicle code, which would include
no parking restrictions, only if a majority of the owners of
` such private roadways request same via a petition. Upon
enactment of the resolution, the vehicle code may be enforced
{ provided appropriate signs are erected at -the entrances to
these private roadways. The signs must state that the road is
subject to the .provisions of the vehicle code and must be readily
legible from a distance of 100 feet during daylight hours.
If you are successful in obtaining the aforementioned petition
signed by a majority of your owners, I feel obligated to advise
you that due to manpower limitations, the Police Department
will oppose the adoption of such a resolution.
