Dear Senator Speier,
The City of Huntington Beach, where I reside, has recently received a
very'large sum of State money for repairing the streets in the city.
$375,000 is attached to my street, Brush. Drive, an extremely long
street, with 42. beautiful healthy trees, that they plan on removing.
The problem is that we don't want this 'project and we don't want our
trees removed. The city policy is that 75% of the home owners must
want the project. There are at least 26 % or more who do not want the
project.
So why the controversy? 11 years ago, a resident fraudulently
circulated a petition around the street to put us on a project list.
Now we can't get ourselves off of the .list! 9 renters signed that ..
petition which was for homeowners only, and it was misrepresented
during the circulation. Removing the renters alone, invalidates it.
Try as we may, for almost a year, we can't get off of that list. So
that is why I am,writing to you.
Another frustrating fact is that the street doesn't 'need ,the projectl
Brush Drive has the flattest sidewalks in the neighborhood and doesn't
flood when it rains. There are streets all over the city in dire need
of this project with sidewalks buckling up 4+ inches, The city has a ,
waiting list of over 100 streets for this project. The sad thing is
that they do not -go by need, but rather by who is next on the list!
And we are #4. No other streets in the neighborhood are up for the
project. Our street, being almost 1 mile long is taking up 2 streets
worth of money.
We desperately need to keep our urban forest on Brush Drive because we
are surrounded by several very large streets, a freeway, shopping
centers, car dealerships, strip malls, etc. and have no park or green
space for miles. The street will become hot, noisy, ugly, etc. and our
real estate values will go down. They plan on replacing the trees with
these very small crepe myrtle saplings that are bushes trimmed into .
trees which •loose all their leaves for 6 months out of the year.
Is there any way you or the State can direct them to use the money
based on need, rather than on other criteria. This money needs to be
put to the best use. Can't it be used to repair larger streets with
potholes .and other problems, and streets in dire need?

Dear City Council Members:
There is a project slated for my street to remove ALL the trees (except 12 small Crepe Myrtles) in order
to refurbish the gutters and sidewalks. I have circulated a petition for homeowners to sign if they do not
want the trees cut down for this project. The Dept under Jim Jones informed me that if 1 get 75% of the
homeowners to sign the new petition, they will not cant'out the project. So'far 64% of the homeowners
have signed the new petition. It is difficult to get 75% and this percentage is extremely high. Could you
tell me where in the city laws that a petition requires 75% to pass?
There are 50 units affected by this project and 43 trees will be cut down. Brush Drive is an extremely
long street. Most of the sidewalks are relatively flat and the street does not flood even when it down-
pours. The original petition, circulated 10 years ago, which put vs on the project list, has many serious
problems, which I will list below:
* Renters signed it.
* The statement describing the purpose of the petition is only on the 1 st page (with 6 signatures).
* Page 2 and 3 contain no statement as to what one is signing for. They contain signatures only.
*.The person who originally circulated it admitted to me that he didn't know that all the trees would be
taken out. He thought it was just to refurbish gutters and sidewalks.
* Many who signed it did not know that all the trees would be taken out and thought it was just for
refurbishing gutters and sidewalks.
* There are only 8 valid signatures left after eliminating all those who no longer own homes on Brush
Dr. and those who have signed the new petition.
* 10 years ago, if 26% did not want this project, it was not put on the list. Why is it 75% now? Shouldn't
this petition be invalid?
This street is in a neighborhood with no park for miles. It is boxed in by the 405 Frwy, Beach Blvd.,
Warner St., Newland Ave., Heil St., automobile dealerships, the Target Shopping Center, strip malls and
the Huntington Center. It is extremely devastating for use to loose what little greenery, oxygen, shade
and we have. The homes are small, not outstanding, and don't have the "curb appeal" to look good
without our trees. In other words, it will look ugly for a long time until the new ones mature in 10 - 15
years. We do not have Fichus or Pines, but a variety of trees (Palms, Chinese Elms, Pepper trees,
_ Carrotwoods& Crepe Myrtles).
I have already been to 3 meetings with Jim Jones and his dept and want your input. (The meetings
were BLT,Town Hall & one w/the HB Tree Society.) We have already been told that there will be no
compromises or alternatives. It is all or nothing. There is a definite unwillingness to work with the will of
the people. There is a large section of the street that could be worked on without cutting down all the
trees, because they have already been removed, but there is a refusal to even consider it. The street
begins and ends in several places and one of those sections could be worked on without as much
impact to us. This would not be considered also. Our street in far better shape than many of the streets
in our neighborhood, yet it is slated now for this project (#4 on the list). The majority do not want the
trees cut down and have signed the new petition. Even the ones who haven't signed did not want ALL
the trees cut down, but had some small issue of their own and wouldn't sign. (Some were afraid to sign
anything, some didn't like the tree pods, etc.) Since the majority want to keep the trees and will forgo
the project altogether, what are we to do?There will be many unhappy people on this street if our trees
get cut down. There are so many other streets begging to have this work done with lifted up sidewalks,
flooding and giant pools of water standing in the street. Many people told me that they would be happy
if there were speed bumps put in instead.

Huntington Beach City Council:
am writing this note in regards to the planned removal of trees, curbs and sidewalks on Brush Drive, mostly the
removal and replacement of the trees along this street. The majority of the homeowners on this street would prefer that
this plan be canceled. We have a petition signed with approximately 64% of the residents against the removal of these
trees. I understand that a few of the resident came to the city council meeting this past Monday (11/21/05) to try to get
this stopped. I unfortunately could not make the meeting, but felt writing you may help the effort to stop this tree
removal.
Theresa Chaque has been the organizing this effort on our street, but has been stuck at 64% of
owners signing the.petition to stop the removal. It is our understanding the 75% is needed, but
where does that figure come from? The original petition may have had 75%, but in a court of law it
would be thrown out as it has signatures of renters, people that no longer live and the street, plus
the format of the petition is invalid as only 6 signature are on the sheet that states what the petition
is that they are signing.
l signed the original petition, but it was presented to me as ONLY replacing the curbs, nothing about
removing all our beautiful trees.
The curbs and sidewalks on this street, for a 45+ year old street, are in excellent shape for their
age. This is a waste of the City of Huntington Beach's tax dollar and I know we do not have a
surplus. There are plenty of other streets, even ones in this track that are much more in need of
repair.
We are open to compromises, but in meetings with Jim Jones, Maintenance Operations Manager, it
has been all or nothing. There must be some common ground. I would appreciate,anything you can
do to stop this unneeded repairtfixing of the curbs, tree replacement along Brush Drive.

Dear Council Members,
We are completely against the removal of the trees on Brush Dr.in order to fix
the small amount of necessary repairs.I had my sidewalk repaired 9 years ago,they are
still in perfect shape,and no future damaged from the trees has occurred.I find it almost
criminal that-you would even consider spending millions on repair for a street that could
use a few spot repairs when the next street over(Bryant)looks like a war zone.
Sidewalks on Bryant are at a 30-degree angle and ducks are swimming in the street after
a small drizzle._How selfish are the people who signed to Brush repaired when so many
other streets need the repairs much worst.
One other point I would like to bring up is that the people I spoke with that signed the
petition to have the repairs made thought they were signing to have the entire
neighborhood repaired.The people who were obtaining the signatures completely misled
the residents on Brush Dr.Two of my neighbors said they would never had signed the
petition if they knew it was only Brush Dr.that would get the repairs. I believe that a
register letter(with no pressure from neighbors)is the only way to let people know the
real truth.
Instead of making a decision to spend millions of taxpayers dollars bases on signatures of.
people who were misled.Let's do the right thing with our money,do the patch repairs on
Brush and use the additional funds on streets that need it the most.Why don't one of
you take 20 minutes and drive down Brush and the other streets in the neighborhood
and you will clearly agree that this is a waste of taxpayers money.

My husband Ross Erick and I own our home at 8342 Brush Drive in Huntington Beach. We have lived here
since August 1998. Before that we lived around the corner on Tripp Circle for six and a half years. I have lived
in Huntington Beach since l was four years old. We have bought four new cars here on Beach Boulevard. We
care very deeply about our city.
1 am confused and upset by the letter we received today from James Jones ("Street Improvements - MSC-
430"). The letter is dated January 24th and states that you recently approved a construction contract for our
neighborhood.
A letter dated January,13th from Robert Beardsley to our neighbor, Theresa Chaque, who has worked very
hard trying'to help us save our trees, states that Mr. Beardsley is "preparing to bring this matter to the City
Council for contract award in February."
Ms. Chaque was previously informed that the issue was put on hold until further notice. She has been trying to
contact more neighbors and clearly trusted the City that she had a little more time to wait for them to respond.
Are we to assume that today's letter is the "further notice"? Is it a "done deal"? If we wish to express
ourselves at the City Council meeting on February 6th, will our efforts be futile? it,looks like things were done
behind our backs, behind closed doors, and without notice. At this point, it seems that someone working for the
'City has been dishonest.
1 believe that most Huntington Beach representatives are sincere in their efforts to make our city even better;
however, pushing ahead with this project at this time is wrong for our neighborhood. I find it hard to simply
trust that every possible avenue has been explored.
Perhaps you do care about the environment and will help us find a way to save our dozens of beautiful trees,
while still protecting the City from potential liability due to uneven sidewalks and other problems. There must be
away. Please help.

l am writing as a resident of Huntington Beach with.property that sides along Brush Drive. As I understand, the trees in
that area are slated to ALL be removed based on a request from local residents 10 years ago!
While I realize there is a long wait for projects'of this sort, I can't believe there is any logic behind the process of
following the requests of persons from that long ago. If the requirements of the city say that 75% of residents must agree.
before trees are removed- and there is THAT LONG of a span before action is taken, then that same percentage (75%)
should be required to continue with the project. How about common sense.
Regardless of all the ecological reasons why they should not be removed- let's try some common sense in what
the CURRENT residents want in.this neighborhood. If the only concern is that the city has to take care of gutters and
curbs- seems like paving the entire city and getting rid of all plant growth would make that much easier! I don't think that
is a logical reason for removing the trees, either.
Based on a letter received from Mr. Beardsley to Ms. Chaque, a resident with concerns, in relation to this
removal- he made it sound like the residents in the area weren't concerned about it Just because many people don't
have the time to go to meetings- doesn't mean they aren't concerned about the issues. And- it was stated that he would
'have to conclude that the level of support of the neighborhood is at least equivalent to that of the original petition:' If that
were the case- then there would still be 75% of residents asking for removal- not 36% which is what is currently.

I know that I received notice of what would be required for the tree removal that was happening (was NOT
stated as any kind of option- but a statement of fact)- does not exactly constitute notification with an expectation of
response. 1 am not that involved in the politics of these events- I am a single mother with two young children. It does
NOT mean I am not concerned, merely that I lack the,time to follow up at numerous meetings.
r Why is it that unless numerous people show up at a meeting, take many hours.of their time, and get 5 minutes
to make their point- then it must be that they agree with your edicts? Personally, I have never felt that I have had any
option in what the city decides to do. As this is being written- the streets have already been marked and the worker told
me that the contract had already been awarded. Based on that information- I can't imagine Mr. Beardsley was waiting to
see if anyone would have objection.
I'm sorry if this sounds rambling- I am just trying to find a way to express my frustration with a system that
seems so far from logical. I work for the federal government- so I understand there are always processes in the way
things happen. It still makes no sense that something decided 10 years ago can override what.is wanted today. Either the
removal process,is expedited ( I understand issues with that)- or there is a process to ensure after a certain number of
years- when the time comes for action- there is the same desire for the project to take place. The current process
basically looks like what the residents want was never a factor- it's all about the city and what makes their workload
easier.
I also would bet that if it was in the Harbour area- the resident voices would be heard and respected more than
they are from this neighborhood.

City Council direction at the May 15, 2006 meeting was that the petition .list submitted
that evening, subject to one name (the owner at 8112 Brush Drive) being removed, would be
verified by staff and, thus, would determine whether the project would proceed or be
further subjected to a certified mail ballot. The petition information at that time
indicated that"39 of the 50 homeowners (781) supported the full improvement project.
Staff determined that two properties petitioning in support of the project (81'52 .Brush
.Drive and .16601 Newland Street) wer& signed by residents who are not the legal owners.
While the owners of these two addresses subsequently'submitted affidavits in support of
the project, accepting this late information would be inconsistent with Council's
direction. Therefore, the final support for the project is 37 homeowners, or 74%, which
fails- to meet the required 75

I have not been able to talk with you directly.

:entire street's curbs. and gutters shall be subject to replacement and residents will be

the occupants of the two residences in queston.to represent the legal owners, much less '
whether they are related to the,`owners. However, my staff is attempting to contact the
owner at 8152 Brush Drive as well as the occupant, to :dete,rmine whether there is any
mitigating information that would change my conclu'sion: ..

The mail survey will be prepared by me and my staff and will be a neutral, brief
description of the proposed project. There will be two selections, from which the
.,property owner will have to .choose one ("yes" or "no,') . I appreciate the offers I
received to help compose and circulate the survey; however, that will not be necessary and
I will not be inserting any of the information that was suggested. I. Cannot state for
certain how we will proceed once the results of .the mail survey are received. The Counci,

I need 'to respond to your email regarding our having only 74% of the homeowners sign the
petition. . The signer at 8'152 Brush has 'permission from his mother, the. homeowner, .to sigh
on her behalf for all things' concerning the house. In addition, we immediately'got her
signed petition faxed to us. That alone gives' us the required percentage.
The owner at 16601 Newland has lived there for many years and also makes• the decisions for
her son who lives in Texas. However, we got his signature the same'day' we` got the call
from Mr. Jones. -
Who will draft the letter? How will it be •phrased? If you have to send a letter, would you
consider saying the city is scheduled to do this unless 26% say no? We have worked so hard
to get this done by the city, standards that I think it would only be fair to put the
burden on the other side to get 'their "no" votes cast against this project. If they. .can
get' the required .26o to refuse this, so be it.
One homeowner that I _know of refused• to, give us his address, but signed for the rental
house he owns on our street. He will never get your letter because he does not live where
the public record says he does. Others are away, ones owned.by a trust in LA and never
responds,- etc. This would be an unfair, untested process and just forces ,,our neighborhood
to have more dissension. You cannot want that.

you to know that I am not engaging any .of these residents directly; rather, ',I am

that she has offered here. The survey instrument will be very neutral and will .offer two

Thank you and your staff for all' of your efforts. I'
wish I could•meet you as I have never met you!
A poll by registered mail is the fairest option under
the circumstances. In order to keep it fair, I am
asking for an insert to be placed in the registered
letter which will cover the effects of. losing the
trees on the street and the results of= having. the
funds go to this street instead of others more
deserving:, This would be "the other side" of the
issue: I am sure the ballot will cover all the facts
about having the project, but all the facts about not
having the project need to be- given also.
I am willing to donate my services to type this and
supply it to you with changes to it as needed, in -a
timely fashion, with your approval. I worked in the
graphics, field for 20 years and have -enough experience
and am quite capable of putting something together
very quickly.
Some of. the issues and results caused from this
project are: ,
An Increase. in Temperature on the street for several
years

neighborhood is encased by miles of large urban
development, (405 frwy; Beach Blvd. , Warner St. , large
shopping centers, etc. ) and has no park or open space,'
the increase -in heat may be significant.
A Decrease in Real Estate Values.

1011 diameter trunk is worth $1, 729 and a 3011 diameter
'trunk, . $15,554.
A Decrease in Air Quality.
Once again, . because the street and neighborhood is
surrounded by a freeway., highway, busy .streets and
shopping centers, the exhaust emitted by the trucks;
cars, traffic °etc. is substantial. The loss of 42
mature trees and .the air filtering capabilities from
them,, could make the--street at times unfit for our

Loss of Beauty and Shade.
This needs little explanation. Anyone can see how
beautiful these big trees are and how reli.eving .the
shade is to walk in.
Brush Drive will use the funds that could be used on 2
other normal length streets and acheived this through
questionable means.
The, original 1995 petition did not have the required
75% signatures. Because the street is extremely long,
it will take more funds to redo a street that is not
"in great need of it. Spot repairs and alternative
methods of street repair can be more cost efficient
and work,perfectly. well on a street such as Brush
Drive without cutting down our trees. Please visit
8941- Nightingale Ave. , Fountain Valley (near
Magnolia/Ellis) to see perfect results of a spot
repair.

to one name (the owner at 8112 Brush Drive) being
removed; would be verified by staff and, 'thus, would

should not have its' trees cut down. The sidewalks in front of our house seemed to be in good shape and I don't see any.
