The covenants, conditions and restrictions referred to above do not include restrictions upon the sale or occupancy of said land on the basis of race, color or creed. The President, Mr. lViatney,, opened a discussion of the business of the meeting, that is, the dedication of the streets of the Association to the City of Huntington Beach, by stating that at at n present the Association is paying taxes on its streets when .other -subdivisions are required so to do. He introduced Mr. Jim Nannoy, President of .-Huntington Continental Townhouse Association, No. l" . and Mr. Norman Ale.-Kander, Past President of Huntington Continental Townhouse Association, No. 1, who have been confronted with the same problem. Mr. Alexander, who has done extensive research in this matter, presented statistics to show that they have paid 3300 per year per acre, with 12 houses per acre. Single housing developments which have L houses per acre pay 'q`R500 to '41�1700- Further statistics show ,i,-2, 000. for street cleaning: $1,� 00 for street lightin and ,�2 500 for future ture reserve street maintenance-- a total of 8,,F1,30- �'per year that other citizens do not pay. These statistics are pertinent since they parallel tax burdens assumed by Huntington Continental Townhouse Association, No. 2 and Association No. 3. By offering to dedicate the streets to the City of Huntington Beach, the financial load would be lessened; it would also make possible retaining a low Association maintenance fee, Dave Morris,, Lot -#,268, presented the following resolution: MOVE that the Board of Directors be authorized to submit to the City of Huntington Beach, California a petition to offer on behalf of the Huntington Continental Town H ouse Association Number Two to dedicate the streets of tract 5062., includingT all street Lighting and fixtures comprising 32 street light standards and - ,Seconded by John Vlard, Lot #139, P _' VOTED: By marking of ballots. Voted, It was moved by Dave Morris and seconded by Jean Dimond to open the meeting for further business. Voted. Jerry Matney announced that the site immediately to the north of the Townhouses had been set aside for the erection of the John B. Bushard Elementary School in the Fountain Valley School District. There is a five-acre parcel of land which is to be offered to the City of Huntington Beach on a lease basis for use as a park site. Mr. Matney also, presented prelimimary plans, drainin up by the Architectural Committee and approved by -the Board of Directors., for the proposed Clubhouse for the Association. A report of the Architectural Committee setting forth Plot Plan Information, Floor Plan Information, and Generza Information, was read to the Association members. A copy of the report is attached to the minutes, It was the consensus of the meeting that the Board of Directors work with the Architectural Cbmmittee in finalizing the Clubhouse plans, Moved by Roland Roux, and seconded by Frieda 'LWard, that the preliminary plans for the Clubhouse be accepted, By a show of hands the motion was carried, witli two dissenting votes. The Townhouse Association holds in fee title or in permanent easement the substandard streets and rights-of-way, and they are set aside and maintained by the Townhouse Association for the use, enjoyment and convenience of the owners of the units . I believe the City maintenance of sub-standard streets , which were created for the sold purpose and comfort of a few, for their egress and ingress to private recreational and common areas is not in the best interests of the entire city. But, if by democratic process the substandard streets are accepted by the City, I respectfully request the following stipulation be made: That the cost to the City of improving the sub- standard streets to proper City street standards , to prevent them from becoming a public nuisance, be assessed on a rorated basis against the properties (units within the two Townhouse Associations, and that this assessment shall be- come a tax lien on said properties . Their reasons for this action are to request the City Council to relieve them of • what they feel is an unfair tax burden that is not required of other citizens. ilur property taxes per acre are approximately S.'4000.00 annually since are have 12 homes per acre , while eurxounding single housing developments having 4 houses per acre range from $1500 to $1700 annually per acre. . Therefore , per acre we pay almost twice the taxes of others in our area . including Glen gar which has homes vpl.ued up to $25,000. Now, in addition to these high taxes, we are required to pay, each year, approximately $2.000 .4 ' for street sweeping, $1400 for street lighting, $3006" for taxes 4m. o%.w atr"" and Sty t4 a reserve fund for future street main- tenance , for a total of $6400 for services other citizens receive free . Our citizens do not object to paying their just share of taxes , but they do object to and feel that thin extra tax burden is not fair and equitabje . We request that the Council relieve us of this unfair burden by accepting our streets as city property. Now gentlemen, we are not trying to give the city a white elephant . Our streets are of standard construction the same as other streets in Huntington Beach . This was verified with the builder and the City Engineer ' s Office . All streets have concrete curbs and gutters ; all curbing has been painted as suggested by the City Engineer ' s office . `mere are no faulry streets or gutters and no minor repairs or maintenance is anticipated for these streets for at least 5, and possibly 10 years . All street signs are installed and in excellent condition . Approved street signs were installed at a cost of. $35 each. As to the legality of the actual dedication, I can see no obstacles. In fact, the City of Huntington Beach is a chartered city and, as such, we have the right- and privilege either to accept a dedication or not. 2. As to whether or not this should be done is a matter of policy to be _determined. by the City Council. 3. In that respect, the City would probably be responsi- ble for all street maintenance and lighting. / 4. This responsibility and acceptance is tempered somewhat by the fact that the subdividers have implied certain things to the purchasers of the units, which are not true. 5- It is my suggestion that if there is an acceptance of this dedication, in all future condominium developments, the city de- mand a dedication of the streets. ORANGE COUNTY ASSOCIATED C of C: Secretary Gallienne notified the Board of Directors that following a meeting today of the Orange County Chambers of Commerce Ma nagers, it was decided to call a meeting with the Orange County Associated Chambers of Commerce_ officials along with Presidents, Ma nagers and Delegates of each chamber . of commerce in Orange County so that they may be advised as to the proposed $1139000.00 budget and the intent of the proposed development program that is listed to cost $679500.00 of which $229600.00 is budgeted to pay professional money raisers that would bring the total Orange County Associated Chambers of Commerce budget up to $113,000,00 showing in detail a $75600.00 item for salaries alone. , HUNTINGTON CONTINENTAL: Chamber of Commerce member Jim De Guelle addressed the I board of directors with reference to the proposal of the Huntington Continental condominim who have requested the City Council to take their private roadways and make them public streets. Mr. De Guelle pointed out that the Huntington Continental streets were substandard in width and that purchasers in the condominiumt; development knew the roadways were private when they bought their apartments. He said the whole inception of this condominim when first introduced to Huntington Beach were actual- ly walled in private operations and he said this unfair 'tax burden would be saddled on the other citizens of the community. Mr. De Guelle charged that people living in the condominim.have their own private recreational areas which would not be offered to the rest of the citizens of the community. Mr. De Guelle said that he had talked to several city officials whd likewise had expressed opposition to this acceptance of private roadways at the last City Council session. Director Roger Slates, Chairman of the Planning and Zoning Committee of the chamber of commerce said . purchasers in the condominim had been shown the California State Real Estate Com- missioner's statement specifying that streets were private and were to be maintained by the home owners. Chairman Slates said that the Huntington Beach -Realty Board I will also fight the proposed plan : and that city councilmen are scheduled to debate the private street issue at their next meeting April 5. It was brought out that f most heads of city departments had opposed the taking over of said streets. After a full discussion of the matter, the directors voiced their interest and suggested that we oppose this proposal and send our reasons for such to the City Council for their perusal. Motion by Director Slates seconded by Director Kiser that the chamber of commerce go on reeord in opposition to acceptance by the city of the Huntington Continental private roads as public streets and the motion carried unanimously. BETTER BUSINESS BUREAU: A letter from Jerry Marks of the Linbrook Hardware Co. ask- ing that the chamber of commerce appoint two representatives to meet with him to set up a Bettetter Business Bureau was tabled by motion of Director Forney seconded by Director Peterson and the motion carried. Motion carried. HUNTINGTON CONTINENTAL - OFFER OF DEDICATIONS ACCEPTED 7ne Clerk presented a letter from R. F. Neuman, Attorney for Hunting- ton Continental Townhouse Association - Unit #1 and Unit //2, request- ing that the City accept offers of dedication of streets in both units. The Clerk read a letter from Roger D. Slates protesting the acceptance by the City of the offer of dedications of private streets in the Huntington Continental Townhouse units. Mr, Norman Alexander, 19832 Berkshire Lane, City, addressed the Council and requested Council to accept their offer. Mr. Jim DeGuelle, 1011 California, City, addressed the Council and protested the acceptance by the City of private streets in con- dominium areas. Jerry Madney, 19846 Leighton Lane, City, defended condominium prop- erty owners, and requested assistance for the property owners through 1 acceptance of the Huntington Continental streets by the City. i Mr. John Mangano, 5661 Clark Drive, City, addressed the Council and protested the acceptance of private streets, as it would set a precedent in such cases. R. J. Neuman, City, Attorney for the Petitioners, addressed the Council and stated that all citizens are entitled to the same benefits for taxes paid, and requested that the petition be granted. 1 ! i I l 243 Page ,/Z - Minutes, June 4, 1.963 Gerald Lance, President of the Huntington Beach Board of Realtors, addressed the Council and requested denial of the petition and stated that if any inequity existed,; it should be handled through tax control. John Knapp, 10191 Pua Drive, City, addressed the Council and re- quested the Council to reconsider the acceptance of the offer of dedications. Assistant City Attorney George Shi.bata addressed the Council rela- tive to his statement on the legality of acceptance made at a previous meeting, and questioned Mr. Neuman regarding the By-Laws of their organization. Following further discussion on the matter, a motion was made by Welch, seconded by Gisler, to accept the offer of dedications for streets, curbs end lighting equipment for general public use, sub- ject to receipt by the City Attorney of certification of the vote of the Associations concerned, and proof that right-.of-way can be delivered to the City free of any and all encumberances. Motion carried. Mr. Norman Alexander addressed the Council and expressed appreciation on behalf of the residents of the Huntington Continental Townhouse Association Units. BODNER DISMISSAL - NOTICE OF DEMAND The Clerk presented a Notice of Demand for findings and recommenda- tions in the dismissal of Douglas J. Bodner from the City Fire Department, from .Jack. F. Austin, Attorney for Mr. Bodner, requesting that he be furnished in writing the findings and recommendations of the Council. On motion by Lambert, seconded by Welch, Council received the Notice of Demand from Jack F. Austin, Attorney for Douglas Bodner9 and directed the Clerk to forward a certified copy of the minute action of May 21, 1965, to Mr. Austin. Motion carried. SOLICITATION - SERVICES FOR THE BLIND �On motion by Lambert, seconded by Gisler, Council granted permission to the Services for the Blind to place cannisters in places of business within the City to raise funds. Motion carried. SB 997 - GAS TAX FUNDS - SAN JU.AN CAPISTRANO The Clerk presented a request from the City of San Juan Capistrano for adoption of a Resolution opposing SB-997 which would permit the use of Gas Tax Funds or .License Fee Funds for purposes other than the benefit of motor vehicles The Director of Public Works explained that SB-997 would apply to the Greater Los Angeles area only, due to the existing Rapid Transit problem. On motion by Welch, seconded by Gisler, the letter from the City of San Juan Capistrano relating to SB-997, was received and ordered filed. Motion carried.
