That the real property hereinafter described and shown on District Map 38 (Sectional District Map 34-5-11) marked Exhibit A attached hereto and incorporated herein and the real property described and shown on District Map 3 (Sectional District Map 3-6-11) marked Exhibit B also attached hereto and incorporated herein is amended to include Precise Plan of Street Alignment No . 91-1 of the City of Huntington Beach: 1 To establish the precise centerline alignment of Garfield Avenue between Edwards Street and Goldenwest Street, in the City of Huntington Beach, County of Orange, State of California, through section 34, township 5 south, range 11 west, and section 2 and 3 , township 6 south, range 11 west, San Bernardino base and meridian, all as shown on the maps recorded in book 51, pages 13 and 14 of miscellaneous maps, records of Orange County, California, which is more particularly described as : beginning at the centerline point of intersection for Garfield Avenue and Edwards Street, as shown on the map recorded in book 92, pages 19 through 28 inclusive of records of surveys, records of said Orange County, said point being the south quarter corner of said section 34 ; thence south 89042 ' 05" east 2639 . 70 feet along the south line of the southeast quarter of said section 34 , to the southeast corner thereof, said corner being the centerline point of intersection of said Garfield Avenue and Goldenwest Street . The Holly Seacliff General Plan Amendment approved on January 8, 199.0, maintained this classification and alignment as part of the overall circulation policies of the Holly-Seacliff area plan. Subsequent to the adoption of the Holly-Seacliff General Plan policies, the City entered into a development agreement with Pacific Coast Homes and Garfield partners for development of the Holly-Seacliff area. The development agreement entered into on November 5, 1990, required, in part, that arterial improvements be provided in four phases based on the Holly-Seacliff general plan circulation policies and certified EIR 89-1. The development agreement calls for the developer to dedicate, design and improve all arterials indicated by the development agreement as well as pay for the cost of any necessary property acquisition. The agreement requires precise plans of alignment to be submitted within 120 days of the effective date of the development agreement, with improvement plans to be submitted within one year of precise plans of alignment approval . The precise plan of street alignment of Garfield Avenue between Edwards and Goldenwest Streets is part of the required Phase 1 improvements . Adoption of the precise plan of alignment is not only required by the development agreement but is necessary to allow the City to obtain additional right-of-way through condemnation proceedings . The property to be obtained is located north of Garfield Avenue approximately 300 feet east of Edwards Street and is currently owned by Michael W. Blasgen. The alignment of Garfield Avenue between Edwards and Goldenwest Streets will follow the existing centerline and increase the right-of-way width from 60 feet to 110 feet, transitioning to 116 feet at the Goldenwest intersection. The street improvement plans for this section of Garfield Avenue have already been approved by Public Works based upon the proposed alignment and construction has been initiated. The precise plan of street alignment of Garfield Avenue between Edwards and Goldenwest Street -is consistent with the Master Plan of Arterials for Orange County, the Holly-Seacliff general circulation policies and the Holly-Seacliff Development Agreement No. 91-1. ENVIRONMENTAL STATUS: EIR NO. 89-1 was certified by City Council on January 8, 1990 for the Holly-Seacliff General Plan Amendment . The Development Agreement calls for phased arterial improvements requiring the timely processing of precise plans of street alignment, street improvement plans, property acquisition and right-of-way construction. The proposed alignment of Garfield Avenue between Edwards and Goldenwest Streets will follow the existing centerline and increase the right-of-way from 60 feet to 110 feet, transitioning to 116 feet at the Goldenwest intersection. The proposed improvements are as indicated on Exhibit 3 . The street improvement plans for the proposed alignment have already been approved by Public Works and construction initiated. Discussion The City must obtain additional right-of-way for the proposed alignment . The property to be obtained is located north of Garfield Avenue approximately 300 feet east of Edwards Street and is currently owned by Michael W. Blasgen (attached exhibit 5) . In order to enter into condemnation proceedings , the City must formally adopt the Precise Plan of Alignment . The adoption of this alignment will allow completion of right-of-way acquisition necessary to insure the street improvements (Holly-Seacliff Phase I Improvements) on Garfield Avenue, Edwards Street and Seapoint Street are completed on schedule. Currently the underground utility relocation and grading work required for the Phase I Improvements is in progress. Southern California Edison is relocating power poles, the City water line by-passes are being installed and fuel oil and gas transmission lines are being relocated. In addition, a portion of the grading work necessary to support these utility relocations is being done. However, the surface street improvements cannot be finished until the City acquires all necessary right-of-way. In order for the City to proceed with the right-of-way acquisition, a PPSA for Garfield must be adopted. We have been working with various City Departments to have the Garfield Avenue, Edwards Street and Seapoint Street improvements available for public access by March 1, 1992. In order to meet this expedited schedule, all necessary right-of-way must be acquired and therefore this PPSA adopted.
