The precise alignment of a 25 ft. north/south local street between Adams Ave. and Shipley St. Said street will be located approximately 118 ft. east of 17th St. PLANNING COMMISSION ACTION: ON MOTION BY BOYLE AND SECOND BY FINLEY PRECISE PLAN OF STREET ALIGNMENT NO. 76-8 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Finley, Gibson, Newman, Boyle NOES: None ABSENT: Parkinson, Slates, Shea PLANNING COMMISSION RECOMMENDATION: The Planning Commission recommends approval of Precise Plan of Street Alignment No. 76-8. SUMMARY ANALYSIS: Precise Plan of Street Alignment No. 76-8 is a proposal to cul-de-sac the northerly end of Shipley Street at the intersection of 17th Street, the precise alignment of a 20 foot north/south alley between Adams Avenue and 17th Street and the precise alignment of a 25 foot north/ south local street between Adams Avenue and Shipley Street. These proposed alignments are the results of an anticipated single family residential development on the surrounding properties. The alignments were recommended by various city staff representatives in order to effectuate the following: Page Two PPA 76-8 1. Elimination of overflow parking onto the present alignment of Shipley Street from the proposed City Community Park to the west of 17th Street. 2. Deorientation of the residential structures from 17th Street in order to improve aesthetics, attenuate noise levels, and increase privacy for the future residents. 3. Increase the alley right-of-way to 20 feet in order to imple- ment the City' s standard for residential alley right-of-way. 4. Elimination of driveways and intersections on 17th Street, an arterial highway, which will increase traffic flow and efficiency. Based on the foregoing findings, the staff recommended approval of Precise Plan of Alignment No. 76-8. ENVIRONMENTAL STATUS: The Planning Department determined that previously granted Negative Declaration No. 76-82 was sufficient for an environmental assess- ment of the proposed alignment and recommends approval by the City Council ADDITIONAL INFORMATION: On October 26, 1976, the City Council approved vacation of portions of Shipley .Street which is consistent with this Precise Plan. Said north/south alley will be parallel with and approximately 118 feet southeast of 17th Street. zs> PPA 76-8 Page Two 2 . 0 SURROUNDING LAND USE AND ZONING: ,Shipley Street is presently bounded by property zoned and designated on the General Plan for residential uses. The properties to the east of the proposed street alignment on the west side of Main Street are presently developed with single family homes on individual lots. Properties to the north and northwest are zoned R1-0 and proposed to be developed in the near future as a City Community Park. Properties to the southwest across Adams Avenue are . zoned RI-0 and mostly vacant - at this time with a church existing upon a portion of the property at the intersection of Main and Adams. 3 . 0 ENVIRONMENTAL STATUS: The environmental effects of this proposed modification to circu- lation with increased alley widths and a closure on Shiplev was analvzed in conjunction with a request for Negative Declaration 76-82 which had been filed in conjunction with Administrative Review 76-126 and Conditional Exception 76-44 to the Board of Zoning Adjustments in September of 1976 . In conjunction with the new environmental procedures, the request for Negative Declaration 76-82 was posted in the Office of the City Clerk on August 31=, 1976 and by September 28 no comments had been received as a result of the public posting. Subsequently, the Board of Zoning Adjustments granted Negative Declaration 76-82 at their public hearing held on the proposed 20 single family home development proposed by Family Home Builders, Inc. with the mitigation measures as recommended by the Environmental Resource Section of the Planning Department (see attached communication, to the Board of Zoning Adjust- ments dated September 8, 1976 on Negative Declaration 76-82) . 4. 0 ANALYSIS: This proposed cul-de-sac at the northerly end of Shipley Street was recommended by City staff in an early meeting with the proponent for the development of this area to eliminate overflow parking which might occur in the future from the City Community Park to the west of the proposed development. The staff also recommended that the developer pursue reorientation of the homes on those lots fronting 17th Street to eliminate pedestrian access to the homes from 17th, and allow the construction 'of a perimeter wall at that location with the typical landscape treatment to improve aesthetics and attenuate noise. The staff also felt that this reorientation of these homes would create a more desirable community identity, more privacy for the residents , and would in- crease traffic flow on 17th Street by eliminating lots that front on to arterial highway. PPA 76-8 Page Three The 25 ft. street section which is the intertie between Shipley and Adams is to allow for the reorientation of homes with proper addressing and mail deliveries as existing ordinance would not allow addressing or required open space as proposed upon the development plan with frontage on an alley. The purpose of the precise plan to increase the alley width between this development and those existing homes on Main Street is to increase the alley width to a standard 20 ft. and to allow dedi- cation of the total 5 ft. from the southwesterly portion of the alley as all properties to the east of this alley section are currently developed. It should also be noted, that wherever possible, it is the desire of the- City to eliminate intersections with arterial highways for increased efficiency of those arterial highways and in this situation, the developer was receptive to this closure and con- struction .and installation of landscaping. 5 . 0 RECOMMENDATION: The staff recommends adoption by Resolution No. 1183 Precise Plan of Street Alignment 76-8 based upon the findings that the proposed Precise Plan of Street Alignment will provide a more efficient and afe circulation system for this area. ��. The Department of Environmental Resources has granted. the above negative declaration, having found that the project will not have a substantial adverse effect upon the physical environment. No environmental impact report has been prepared. The findings are based upon staff review, public notice and review process , and the following recommendations : 1. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-1.1 , respectively. If no air conditioning is to be proposed, the insula- tion in ceilings and exterior walls shall be a minimum of R-1.3 and R-7 , respectively. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Natural gas and 220V electrical shall be stubbed in at the _location of clothes dryers , and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units . 4 . An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the project property. 5. All structures proposed for construction within this subdivision shall be constructed in compliance with the g-factors as indicated by the geologist's report. 6. Calculations for footings and structural members to withstand anti- cipated g-factors shall be submitted to the City for review. 7. with the planning proposals for modification of circulation in this area (especially dead-ending Main Street at Adams) , the traffic • ND 76-82 September 8, 1976 Page 2 impacts of such modification may require Adams Avenue to be wider where possible to accommodate the diverted traffic. 8. Any trees destroyed during the construction process should be replaced on a two-for-one basis and adequately spaced throughout the project area to the requirements as may be imposed by the Department of Public Works . 9 . The Planning Commission recommends approval of Precise Plan of Street Alignment No. 76-6D. SUMMARY ANALYSIS: Precise Plan of Street Alignment No. 76-6D was initiated in response to citizen complaints concerning the high speed traffic and parking problems on Park Street and Pine Street. The specific proposal is to provide the closure of Park Street and •Pine Street by constructing cul-de-sacs within the existing 60 feet of right-of-way. Approximately 40 square feet of additional right-of-way must be acquired from the adjacent parcels to allow the continuation of a 3 ft. wide sidewalk. y , Page 2 Three alleys adjacent to the affected residences between Utica Avenue and Springfield Street will also be designated one-way alleys with traffic flowing- north to prohibit their use by undesirable through traffic. The estimated cost of the necessary improvements is $12,000. Due to the receipt of few formal comments on the closures in the early stages of this project, one hundred forty-one questionnaires were mailed to the residents of. the two streets . Sixty-two (62) responses were received. Of those respondents favoring closure, 60 percent favored the cul-de-sac closures . Thirty-three (33) percent of the respondents opposed any type of closure. ADDITIONAL INFORMATION: Both the Police and Fire Department have reviewed the proposed closures. The Fire Department has requested that one additional fire hydrant be installed on Park Street and on Pine Street and that a drive-through for emergency vehicles only be provided at the end of each cul-de-sac. These concerns will be incorporated in the final engineering designs . The Police Department has indicated that they have no objection to the closures . ENVIRONMENTAL STATUS : Precise Plan of Street Alignment No. 76-6D was addressed as part of Final Environmental Impact Report No. 76-5 which was adopted by the City Council on December 6, 1976 . The closure of. these streets is part of the precise plans being developed. The Planning Commission has given consideration to the closure of these streets utilizing a service road. However, the. traffic analysis prepared by RGB Engineering . for the Environmental Impact Report on the Precise Plan proposals indicated that the existing and projected traffic levels were (the most recent traffic counts .indicate ADT is 170 on Park •Street and 280 on Pine Street) very low and should not require the construction of. a service road. Staff- presented this „ .` information at the January 25 , 1977 meeting . Due to the few formal comments received at _that time, staff felt it necessary to survey the residents of these two streets. One hundred forty-one questionnaires were mailed to property owners asking whether they. favored or opposed the proposed closure. If they favored closure they were asked. to indicate whether they favored a service road or cul-de-sac closures . Staff has received 62 responses: Of those respondents favoring closure, 37 or 60 percent favored cul-de-sacs while- only 4 respondents favored the service road concept. Twenty-one (21) or 33 percent of the respondents opposed the .closures. The benefits of implementing this precise plan proposal are: (1) Undesirable through traffic would be kept out of a residential area. (2) The cul-de-sac .closures can be constructed within the existing right-of-way. j (3) The closures will not adversely affect the overall circulation of the area. I The liabilities of implementing these precise plans are : (1) Those motorists desiring to enter Park or Pine Street from .the north will experience some inconvenience since they will have to enter these streets from Springfield Avenue. (2) Rolled curbs for large emergency vehicle access will be necessary.. A . (3) Three feet of right-of-way will be acquired from the property owners adjacent to the cul-de-sacs to allow the extension of sidewalks. � '. 3 . 0 ENVIRONMENTAL STATUS These precise plan proposals were addressed as part of Final Environ- mental Impact Report 76-5 which was . adopted in December, 1976 . APPENDIX A PRECISE PLAN OF STREET ALIGNMENTS 76-6A - E CIVIC CENTER/OLDTOWN AREA August 31, 1976 NOTE: To facilitate a concise presentation of staff' s recommendations on the complex issues involved in planning the street system in this area of Huntington Beach, no recommendations are contained in this document. The intent of this study is to discuss existing conditions, background information, alternative proposals and impacts. Staff' s recommendations on these Precise Plans of Street Alignment under consideration are contained in a summary staff report to which this document is an attachment. 1. 0 GENERAL INFORMATION Precise Plan of Street Alignment No. 76-6A through E consists of a number of proposals that are designed to address the circu- lation problems in the area generally bounded by Ellis and Adams Avenues, Goldenwest Street and Beach Boulevard. The following are the proposals to be. considered: (1) PPSA 76-6A: The extension of Lake Street from Mansion Avenue to Garfield Avenue. (2) PPSA 76-6B: The widening of Lake Street from Pacific Coast Highway to Mansion Avenue. (3) PPSA 76-6C: The realignment of Main Street from Mansion Avenue to Ellis Avenue. (4) PPSA 76-6D: The vacation of Main Street between Mansion Avenue and Garfield Avenue and closure of Main Street at G Seventeenth Street. { (5) PPSA 76-6E: The extension of Huntington Street to link N with Ellis Avenue. I i 1 i l 6 ff� -7- ' (3) Pacific Electric Railroad Right-of-Way: Since all of the alternative alignments described above include portions of the Pacific Electric Railroad right-of-way, the status of this right-of-way is of vital importance to the Lake Street Precise Plan. Historically, the railroad right-of-way has been identified as a potential mass transit corridor by the City and the Orange County Transit District. On February, 1971 , the Planning Commission indicated that the existing right-of- way south of Garfield Avenue and an additional 15 or 20 feet on each side should be reserved as a potential mass transit corridor. In March, 1974 , this corridor was included in the basic transit plan adopted by the Orange County Transit District. They are currently preparing an in-depth study of this corridor. Sources in the Transit District office, however, indicate that development of this corridor is very low priority and may be twenty years away. At the same time, the Southern Pacific Railroad, owners of the right-of-way, are attempting to abandon the line south of Garfield Avenue. An application for this purpose was submitted to the Public Utilities Commission in June and is currently in the midst of its six month review period. According to Mr. L. M. Brown of the Southern Pacific Land Company, the railroad' s real estate division, upon approval of the abandonment, they are obligated by the Railroad Act of 1974 to notify the City or Orange County Transit District. The rights-of-way must be freed for a period of time after abandonment, according to Mr. Brown, to allow the City and/or OCTD to negotiate a price and acquire the property if it is needed for transportation purposes. Mr. Brown also indicated that although no formal agreement exists, the railroad has in the past discussed with City and . Huntington Beach Company disposing of the right-of-way from Wichita Street to Atlanta Avenue in the following manner: (a) The eastern 20 feet will be quitclaimed to the City. (b) The westerly 20 feet will revert to the Huntington Beach Company. The Uuntington Beach Company as the major property owner affected by the abandonment has conducted a title search that indicates the following: (a) Garfield Avenue' to Wichita Avenue - The Huntington Beach Company currently has title to the right-of-way. The railroad has the right to use the right-of-way for rail- road purposes. An easement for street purposes granted Orange County in 1901 may exist (Note: The title company cannot Bete tus and wil not insure that 1 oes not exist. It is unclear whether this ease- ment passed on to the it u on cor oration. It would seem t a i may be necessary for the City to review the title search documents to determine if it has any existing rights to the right-of-way. ) /f 1 0o O— (b) Wichita Avenue to Pecan Avenue - Title to the western 20 feet belongs to the Huntington Beach Company subject to right-of-way for railroad purposes. The eastern 20 ___Laet_Pprobably belongs to the adjacent property owners with - the same conditions. (c) Pecan Avenue to Atlanta Avenue - The Southern Pacific Railroad has title to two of the parcels with reversionary rights belonging to the Huntington Beach Company. The Huntington Beach Company has title . to a -third parcel on the western side of the right-of-way. The eastern half of the right-of-way is probably owned by the adjacent property owners. If the. title search is correct, it would appear that the City has no existing rights to the railroad rights-of-way.. Even though the railroad will quit claim the eastern portion of the right-of-way to the City, the City will still have to purchase the title or easements to the right-of-way. Likewise any other right-of-way the City or OCTD would desire for a mass transit corridor must also be purchased. 2. 2 PRECISE PLAN OF STREET ALIGNMENT 76-6B LAKE STREET FROM PACIFIC COAST HIGHWAY TO MANSION AVE. On February 9 , 1976, the Huntington Beach Company filed Tentative Tract 9234 to be located at the northeast corner of Memphis Avenue and Lake Street. 'Review of this tract necessitated the expansion of the right-of-way to 106 feet. The Planning Commission has directed staff to incorporate this street section with the Lake Street plan. The additional right-of-way will be acquired from the eastern side of Lake Street. (See Figure 5 . ) This may impact development on the eastern side of Lake Street. since the lot depths will be reduced. An alley will be necessary to provide access to the subdivision since the access from a primary is limited. The end result is that thirty-six (36) feet will be removed from the developable site area leaving 96 foot lot depths. If the Pacific Electric Railroad right-of-way is not utilized as a mass transit corridor, the alley could be located in the western portion of the abandonment right-of-way increasing the size of the adjacent lots. If the transit corridor is retained at 40 feet, the parcels would still be developable, but dependent upon the type of transit system installed, there may be significant adverse impacts on the adjacent residences. If the transit corridor were to require additional right-of-way, the property between Lake Street and the right-of-way could be severely impacted and perhaps become undevelopable. 2. 3 PRECISE PLAN OF STREET ALIGNMENT 76-6C MAIN STREET REALIGNMENT To 'implement the recent amendments to the Master Plan of Arterial Streets and Highways, several changes have been proposed for Main Street. The Council therefore continued the hearing on Precise Plan of Street Alignment No. 76-4 to December 6, 1976, so as to allow these concerns to be analyzed by the staff. These concerns specifically involved a desire by Mr. Chislock that the proposed street be extended an additional 330 feet to the north. This request is necessary according to the representative in order to pro- vide local street access to a portion of the existing 48 unit complex. (Refer to "Exhibit "A" for a land use orientation. ) These units presently have access via an alley right-of-way which Mr. Chislock is desirous of upgrading to a local street status by this northerly extension. The staff has thoroughly analyzed this. request (which was in fact the original staff proposal) and concluded that extending the street an additional 330 feet was not practical because of the significant dif- ference in grade nor aesthetically desirable because the existing garages would front directly onto the street. (An analysis of the difference in grade can be made on "Exhibit B. " ) Therefore, the staff felt that the recommended alignment was the most logical, the most-- equitable in- terms of impact distribution, and the one. that provided the necessary- access to the problem parcels in the area. As counsel for several property owners immediately affected by the proposed alignment, I would like to recommend approval of the Plan as adopted by the Planning Commission. It does not appear that any other alternative of street alignment would be an efficient utilization of the area. It is my understanding that a public street running from Utica to Yorktown would create a difficult and costly engineering problem for all abutting land owners. Additionally, under another plan, the large lot at the northeast corner of Delaware and Utica owned by my clients would be responsible for retaining additional amounts of run-off water until the city storm drain system is operational. Alignment No. 76-4 will insure that all property owners in the vicinity have legal access and will not create another street which is not essential to the City Plan. This alignment was initiated by the Commission as the result of their approval action on Tentative Tract No. 8971 and their desire to insure a planned street system on the surrounding property. The proposal will provide a southerly extension of the street within this previously approved sub ___--_--_ division and then continue the street to the west in order to provide access to Huntington Avenue. (Refer to attached map. ) It should be noted by the City Council that when the effects of the previously approved Tentative Tract No. 8971 and Tentative Parcel Map No. 76-11 are combined, the great majority of the proposed street align- ment has already been accomplished. However, the precise plan will insure that the necessary knuckle radius area will be provided on that property presently owned by the State Department of Transportation. The environmental effects of the project were previously assessed at the time the Environmental Impact Report was processed for the Amendment to the Land Use Element as well as the environmental documents processed for Tentative Map 8971. The Environmental Resources Department has found that there are no significant changes in the approval of this precise plan that would necessitate additional environmental documents . Initiated by the Planning Department, it is intended that the proposed Dolores Street cul-de-sac would remedy a recognized traffic problem along Prairie Drive. Prairie Drive is an unimproved alley that connects with Dolores Street and extends westerly to Algonquin Street, and has been utilized as a short cut in and out of the area. In addition. to being a traffic problem, the continued use of Prairie with through access may generate a noise nuisance to existing and future residents within the immediate area. The proposal to cul-de-sac the north end of Dolores Street would eliminate the use of Prairie Drive as a through alley to Algonquin and would consequently minimize the traffic and circulation problems. The Department of Environmental Resources assessed the proposed Precise Plan of Street Alignment and found with certainty the project would not have a significant effect upon the environment (Notice of Exemption r attached) . In addition, the proposal will precise plan two north/south alleys, 20 ft. in width, and also located between Nashville and Oswego Streets approximately 153 ft. east of the center- line of Huntington Street and approximately 166 ft. west of the center- line of Delaware Street. (Please refer to the attached area maps. ) The proposed local street and two alleys were originally dedicated rights-of-way as a part of the T. J. Watson subdivision. NOTICE OF PUBLIC HEARING PRECISE PLAN OF STREET ALIGNMENT NO. 76.5 NOTICE IS HEREBY GIVEN that a pub- lic hearing will be held .by the City Council of the City of Huntington Beach, in the Council Chamber of the Civic Center, Huntington Beach, at the hour of 7:00 P.M., or as soon thereafter as possible, on Wednesday, the 6th day of October, 1976, for the purpose of con- sidering Precise Plan of Steet Alignment No. 76-5, a proposal initiated by the Planning Department, to precisely plan I a sixty (60) foot local street commencing from Nashville Avenue and continuing I northerly to Oswego Avenue, and to precise plan two al-legs commencing from Nashville Avenue and continuing north- erly to Oswego Avenue. One such alley will be located approximately 125 feet east of Huntington Street, and the other will be located approximately 125 feet west of Delaware Steet.
