Staff has re-- evaluated the need for a detailed specific plan for this area and has determined that such a plan would be premature at this time. ANALYSIS : On December 71 .1981 .the City Council ado'p+;ed Resolution No . 5053 (in conjunction with Lund Use Eleinent Amendment No. 62-1) which -stated, among other things, t:.hat. "The existing' Medium Density Residential designation on the 97. 0 , acre area bounded by Goldenwest Street, GarfirlId Avenue, Huntington Street and Clay Avenue: be ,.regained and that staff be directed to prepare a specific plan for said area" . The intent of the specific plan was to delineate appropriate uses for the area on ,r .r RCA March 7, 1983 ` Page 2 a block by block basis while addressing the issues of compatibility wit existing oil operations, consolidation of tl cess and concerns . Staff indicated that work on the aspecificeplan could other planas soon as previous planning commitments had been completed including the Downtown and Ellis - Goldenwest Specific Plans. Staff has re-evaluated the need for a detailed specific plan for the Garfield - Goldenwest area: and has determined that such a plan would be premature at this time . There are a numbe*: of that may have an impact on the Garfield - Goldenwestr area vwh.ich&ues should be resolved before work o» specific development standards is under- taken. The major issues are as follows: I . The future alignment of Gothard Street south of Ellis Aven' tie has not been finalized and may have a substantial impact on circulation and land use in the Garfield - Goldenwest area. - staff is considering alternative alignments for Gothard Street andcwillntly bring these alternatives to thr. Planning Commission during the next amendment to the Circulation Plan of Arterial Streets and Highways . 2. The City is considering including the eastern portion o,`. . the Garfield - Goldenwest area into a Gothard Corridor Redevelopment Project Area for which a redevelopment plan would be prepared , 3. The City Council recently approved a redesignation and rezoning Of a portion of "'he site to Industrial to acUommodate a request by the Carrbro Manufacturing Plant to expand their operations; a specific plan would not be needed for this industrial portion. 4 . The property owners in the Garfield - Goldenwest area have not indicated that they want the City to prerare a specific plan for their properties. In short, there are a number of significant unresolved issues that ma have an impact on the Garfield - Goldenwest area which should be re- Y solved before additional Planning efforts are undertaken for the area . Staff will continue to monitor any City actions that may impact future land uses in the Garfield -- Goldenwest area and to evaluate what special planning efforts by the City, if arty , will be necessary to Insure compatible and coordinated development . Jimenez, developer, in order to reaolve the claim of excessive costs involving an industrial development on the south side of Talbert Avenue approximately 1 ,230 feet west of Beach Blvd. At 9 : 00 A.M. The policy was applied in varying degrees for a short time following its adoption . However , with Prop 13 and the general feeling of the public toward governmental expenditures, it would appear reasonable for the present City Council to reconsider this policy at this time. Baker, Attorney at Law, in which he has requested to address the City Council on the matter of street improvements along his client' s weal-,er•ly property line at Talbert Avenue and Redondo Circle. Events as set forth by Mr. Baker in his letter are ccrrect. This department has no explanation of why , the planned alignment1, 1.or Redondo Circle was missed on the originally approved `AR 76-5_9 . Mr. Kovacs , the property owner, - svbsevuently revise] his plan and resubmitted it -for approval , and at that time it was' discovered that .• the original approval had not taken the street alignment into con-sideration. There has been much delay because of this prior over- sight and, as stated by Mr. Baker, the majority of the street is required to be dedicated from his client 's property. The street alignment and improvement will directly benefit the City 's holdings to the south of the subject industrial development. Because of that beneficial, effect to,•the value of the City-owned:property, as well as the delay a'nd expense caused by the prior oversight and the majority dedication required from this property, the Department of Pavelopment Services in our reviews with the representatives of the applicant haR�recommencled that he pursue with the City Council some. possihz le rellei f from the street improvements as currently required. In our meetings with the *A property owner subsequent to his filing his revised plans , he inquired whether the City would pay for any of his additional costs required for ultimate development . At that time, the staff informed Mr. Kovacs i, of the policy previously adopted by the City Council to assist where ever feasible in offsite improvements for industrial and commiarcial development within the City. Pursuant to that policy, Mr . Baker ' s letter is before you for review. We do not feel that the City Council ' s concurrence for participation for a portion of the offsite improvements for this development would be setting a precedent , as the Council on a number of occasions has agreed to street improvements where dedication has been granted by a property owner. The existing portion of Redondo Circle was cony tructed with participation by the City , as well as a number of additional streets where Public Works could arrange for street improvements in exchange for dedication of right-of-way. RECOMMENDATION: In view of the above-mentioned fact: , the Department of Development Services recommends that the City Council pursue one of the following suggested actions : 1 . Approve in concept the participation with the property owner cor partial reimbursement for the street improvements as required by the Board of Zoning Adjustments on Administrative Review 79-57 , and request the developer to submit to the Department of Public Works calculations on quantities and costs for these additional street. improvements . 2. Approve in concept the costs of street improvements for the north/south leg of Redondo Circle as required by the Board of Zoning Adjustments on Administrative Review 79-57 and require that that developer submit to the Department of Public Works quantities and coasts for such construction and grant reimbursement in exchange for the street right-of-way dedication . ALTERNATIVE ACTION : Reject the request to participate in the additional street improvements as required on this development pursuant to the Hoard of zoning Adjustments ' action or. No notice of the requirements of Specific Plan 73-1 as revised was given to my client and but for a decision to change contractors, permits would have been pulled and the project built . All without an), notice of or requirements for street improvements on the proposed Redondo Circle . When the owner made application in AR 79-57 to modify the Site Plan in preparac.ion for actual corls;truetion, the City for the first time notified the owner that Specific: Plan 73-1 would have an effect on his proposed development. Subsequent facts reveal that statement to be the major understatement of the year. The proposed street will take approximately 3/4 of its width from my client 's property and because the westerly property is already developed only approximately 1/4 of the width will come from that property. That fact alone is a major disproportioning of the burden of improvement in that obviously my client would be faced with upwards of 3/4 of the cost of the street . Since at the time the westerly property was developed no provision for the street was contemplated , the westerly property owner was not required to bond or guarantee for street improvements . In addition , our preliminary engineering studies indicate that the adjacent property owner has constructed a block wall which encroaches on the City ' s proposed right of way and that the wall ' s footing are as much as 3-1/2 feet higher than the top of the proposed curb of the west side of the street , indicating an excessive change in grade from the property as it now stand: and the elevation of the finished street. Further, the City ' s Public Works Department has indicated a n". d for storm drainage facilities down this street but are unable at this time to provide the details of their prijected needs or any specific engineering requirements . My client is now in a position where he must proceed with all speed to develop or the project will become economically infeasible. We have already obtained a conditional exception t-o deal with the encroachment prob;ems created by the sudden awareness of the proposed street. Sewer Fund , Water Fund , Drainage Fund and an Economic Development Administration ' Grant of $1759000 . Because of the possibility of industrial davelopment in the I.usk Ind►istrial Park , it has bern suggested that the City Imcnedint4ly Icro- ceed with a project to complete the street work on Springdale Street , Graham Street , 8oisa Avenue and McFadden Avenue adjacent to the vacant industrial property . The cost would be approximately $348 , 972 and can • be financed with Gas Tax Funds . This project will not jeopardize .any project plan for the next 12 months. Baker, attorney at Law, in which he has requested to address the City Council on the matter of street improvements along his client's westerly property line at Talbert Avenue and Redondo Circle . Events as set forth by Mr. Baker in his letter are correct. This department has no explanation of why the planned alignment for Redondo Circle was missed on the originally approved AR 70-59. Mr. Kovacs, the property owner, subsequently revised his plan and resubmitted it for approval, and at that time it was discovered that the original approval had not taken the street alignment into con.- sideration. There has been much delay because of this prior over- sight and , as stated by Mr. Baker , the majority of t:he street is required to be dedicated from his client' s property. The street alignment and improvement will directly benefit tho city's holdings to the south of the subject industrial development. Because of that beneficial effect to the value of the City-owned property, as well as the delay and expensd caused by the prior overnight and the majority dedication required from this property, the Deps.rtment of Development Services in our raviews with the representatf,ves of the applicant has recamended that he pursue with the City Council some possible relief from the street improvements as currently required. (As aside issue , when it was determined that the street was required to be dedicated and improved additional grading was necessary upon Mr. Kovacs' property because of street grade. No notice of the requirements of Specific Plan 73--1 as, revised was (riven to my client and but for a decision to change con�Xactors , permits would have been pulled and the project built. All without any 'notice of or requirements for street improves*nts on the proposed Redondo Circle. When the oviner made application in AR 79-57 to modify the Site Plan in preparation for actual construction t the City for the first time notified the owner that specific Plan 7 3-1 would have an effect on his proposed development. Subsequent Facts reveal that statement to be the major understatement of the year. The proposed street will take approximately 3/4 of its width from my client 's property and because the westerly property is already developed only approximately 1/4 of the width will come froin that property. That fact alone is a ma or disproportionind of the burden of improvement in that obviously my client would be faced with upwards of 3/4 of the cost of the street. Since at the time the westerly property was developed no provision for the street was contemplated , the westerly property owner. was not �'-'. required to bond or guarantee for street improvements . In addition , our preliminary engineering studies indicate that the: adjacent property owner has constructed a block wall which en6roa ches on the City' s proposed right of way and that the wall ' s footing are as much as 3-1/2 feet higher than the top of the proposed curb of the west side of the street , indictating an excessLve change in grade from the property as it now stands and the elevation of the finished street. Further, the City ' s Public Works tbepartment has indicated a need for storm drainage facilities down this street but are unable at this time to provide the details of their projected needs or any specific engineering requirements . , My client is now in a position where he must prc..tieed with all speed to develop or the project will become economically infeasible . We have already obtained a conditional exception to deal with the encroachment problems created by the sudden awareness of the proptrre+d street. The City Council has reprioritized Gas Tax Projects to establish ,a project oft the aforementioned property. Said project will. provide for the following : 1 . Encginuerinc - They Project will include !:reparation of plans to construct street improvements on Springdale Street, McFadden Avenue , and Graham Street . 2 . Street Improvements - The Project: will }provide for construction of ,I i l street improvements as required by the improvement plans , for .Springdale Street, Mcf'aciden Avenue , and Graham Street. Sidewalks will not be included as a part of this construction on the east side of Graham and the north side of McFadden , but will be worked out as a requirement development of the property abutting the two streets . Sinco this is ai Master Planned Project, the coat of the drainage facility will. be applied as credit f toward payment of drainage tees . The City will not require installation of a wester line on Springdale Street . The developer of the property west of and contiguous to Springdale Street will be permitted to "hot trap" as necessary the existing 36" line in Springdale Street at the time the property is developed. It will be the respf)nsibility of the developer to provide fire hydrants (approximately ! ) on Graham Street as required by the Fire Department. There is no requirement nor is there a need for the Huntington Beach Industrial. Park to install an identification monument or to provide a separate landscape area at the northwest corner of Springdale Street ' and McFadden Avenue to identify the industrial park . Huntington Beach Industrial Park will be respr,nsibte for processing the various parcel maps, tentative parcel maps , r,reparation of storm drain: plans and installation of master storm drains. Additionally , Huntington Beach Industrial Park will bb responsible for all fees and assessments normally charged by the city for Industrial development. It should be clearly understood by all parties that the reprioritizing of the Gas Tax Project to move this project up higher on the priority list: was done to enhance the desirability of this site for the Weiser Lack Company . Should the Weiser Lock transaction with the Huntington ©each Industrial Park not be fulfilled , the improvements outlined herein will be subject to further review which may postpone such improvements .
