Statement of Issue, Recommendation, Analysis, FundiN.:�g Soi;rce, Alternative Actions: STATEMENT OF ISSUE: Based upon new, information submitted to the City Council at your February 20 , 1979 meeting, the Council directed that Precise Plan of Street Align- ment No. 70-4 be rescheduled for Council review. RECOMMENDATION : The Planning Commission and staff recommend that the City Council approve the revocation of Precise Plan of Street Alignment No. 70-4 by the adoption of the attached ordinance. ANALYSIS : The December B , 1978 Request for Council Action (attached herewith) contains the analysis on the revocation of PPSA 70--4 , which brings the width of Atlanta Avenue into consistency with the Circulation Element of the General Plan . The Council, had originally requested that this item appear on the March 4 , 1979 agendas however, the Clerk was unable to schedule the , public hea.ing for that meeting and the staff deferred the Item and scheduled a new public heArin'g for your March 19 , 1979 meeting to allow you the opportunity to review the new information prior -t:o a final determination. Since approximately July 1977 Varlderwood Corp- oration has been attempting to have the above-referenced Precise Pldn of Street Alignment revoked by your City so chat it could undertake to develop seven single family lots located between the Southern Pacific Railroad right of, way, Atlanta Avenue and Alabama Street ( 101 through 113 Alabama Street) . The lots in question are outlined on thu Precise Plan of Street Alignment which is attached hereto as Exhibit A. After being on the Planning Commission l;yenda a total of 17 times , the Huntington Deach Planting Commission did , on November 7 , 19781 vote to recom:,nend that the City Council approve the revocation of Precise Plan of Street Alignment No . 70- 4 . At your City Council meeting of December .16 , 1.978 , your Honorable body considered the revocation and deterniined to continue the matter until some further decision regarding the intersection of Atlanta Avenue and lake Street was reached. The result of your action on that occasion is to continue in existence the above referenced Precise Plan which has since 19711 prevented development on the subject lots. Since your Honorable body .amended the Circulation Element of the Huntington ©each General. Plan in December of ' Aonorable Mayor and embers of City Council ' February 61 1979 v r page 8 e two 1978 to reduce the width of Atlanta Avenue , the present Precise Plan of Street Alignment is .inconsistent with the adapted Circulation Element of your ei*nneral Pan. Further, in all of the discussions before the;,,Planning Commission and in the Staff presentation to the City Council on December 18, it was indicated by the City' s Staff that whatever the final decision regarding the intersection of Atlanta Avenue and Lake Street was going to be , that 'portion of the Precise Plan of Street Alignment No. 70-4 which Impacted on the seven lots outlined in Exhibit A to this letter would not be needed therefor and that the portion of roan over said, lots was not being considered for construction under a� of the alternatives available to the City. My client now finds itself in a position where it is being denied its right to develop seven single family homes in accordance with the zoning ordinances of the City of. Mintinn_ t:on Beach on the lots in question , solely by virtue of the existence of the above-referenced Precise Plan of Street Alignment, whir.,h Plan Is legally inappropriate in that it is .inconsistent with the Circulation 'Element of your General Plan , and is pracL.ically unimportant, as inconsistent with, any reasonably likely future course of action' ' that the City of Ztuntingt:on Beech may undertake . After reviewing the file in this matter in depth and discussing :he matter with your Planning Staff and Legal Staff, I must assume that the members of the City Council who voted to continuc the quostlon of the revocation of this Precise Plan, rather than acting on it , did so without being aware of all of the above-mentioned facts. I am writing this letter so that the City Council may, at its earliest convenience, act to revoke this antiquated and legally inadequate Precise Plan of Street Alignment and allow my client to build on the property in question in 'compliance with your zoning ordinances . ' Such an action is not only proper and appropriate, cis a result of your prior action regarding the amendment to the General Plan , but I believe legally, essential in order that the City 'not deny my client the right to develop its property. Alignment No. 70--4 as it is precise planned as a major arterial at 120 foot width which is inconsistent with recent ,amendment to the Circulation Element, which designates Atlanta Avenue as a prituiry arterial of 100 foot width. Also, to remove the Orange/Wal.nut couplet as an intertie with Atlanta, which has been inconsistent: since the adoption of the General Plan in 1976 . RECOMMENDATION: The Planning Connission and the staff recommend that the City Council approve the revocation of Precise Plan of Street Alignment No. 70-4 by the adoption of the attached ordinance . ANALYSIS: On November 6 , 1978, the City Counc,il Approved by general Plan Amendment , No. 78--2 a reduction in the status of Atlanta Avenue from a major arterial highway tri a primary arterial highway. Because of the adoption of this amendment and prior amendments to the Circulation Element which eliminated the Atlanta/Orange two-way couplet , it is necessary to repeal Precise. These alternatives have been reviewed with the Planning Commission from time to time during the year, with a final determination on an alignment being made by the Commission at your August 1 , 1978 meeting . Attached herewith -= s a chronological listinq of the events that have transpired durinq the past year and a half in regard to this precise plan. The revocation is necessary to imp lemeri t the General Plan Amersiiment to the Circulation Element which repealed the one-way couplet use of Orange and olive Avenues, adopted by the City in 1976. On September 6 , 1978 the Planniaq Commission instructed the staff to incorporate a reduction in the ultimata right--of-way width of Atlanta into the General Plan Amendment 78-2 ; this amendment is pending before the City Council at its November 6 meeting. There- fore, the staff will update the Commission at your November 7 meeting on the Counc.i l ' s inction on the amendment . The Planning Commission also instructed the staff to table all actions on the precise plan for Atlanta/bake until such time as the Circulation Plan had been amended . Therefore this repealinq of . PPSA 70-4 , which was acted on by the City Council on December 7 , 1970, will now allow the properties to the north to develop ' pursti- ant to the 'Circulation Element at a 100 foot width for Atlanta in lieu o the prior width of 120 foot , major arterial designation. A vote was taken on the motion as amended, which carried as follows : AYES: Thomas , MacAll :ster, Sieberte Pattinson NOES: Bailey,, Mandic ABSENT: None PUBLIC HEARING - PPSA 70-4 - DEFERRED PENDING ALTERNATIVE PLANS Mayor Pattinson announced that this was the day and hour set for a public hearing to consider repealing Ordinance No. 1633 which would revoke PPSA 010-4,the,.align- ments of Atlanta Avenue from 1265 feet west of Beach Evr:le�,airs to Lake Street; (2) Lake Street between Orange Avenue and Pacific CV4t Highway and; (3) Olive Avenue between Lake Street to 135 feet west of Secora Street. The City Clerk informed Council that ail legal req.)irements for notification, publi- cation and posting had been w.t and that no protests, either oral or written, had been received. The Acting Planning Director informed Council that he had received numerous calls an this matter.
