Recommendation, Analysis, Funding Source.Alternative Actions: STATEMENT OF ISSUE: Precise Plati of Street Alignment No. 78-3 is a proposal to establish the southerly extension of a north/south street located between Gotthard Street and the Pacific Electric Railroad right-of-way (Burke Street) and to connect this street with an east/west intertie (Hermann Way) to Gothard Street. The proposed alignment is rnflective. of streets that have been previously approved upon Tentative Tract 10446X. rhese streets and the extension of Burke Street northerly would serve as ` .access to the industrially zoned property east of Gvthard Street and south of tteil Avenue. RECOMMENDED ACTION: Adopt Precise Plan of Street Alignment No. 78-3 by Resolution (attached) . DISCUSSION: The proposed precise plan of street alignment was reviewed in con- junction-'with the two subdivision maps encompassing the entire in- duatrially zoned acreage, at the southwest cgrner of Gothard Street and Heil 5t Av enue'. The proposal was initiated to insure that. I t 10 &” Page 2 ' Since the "X" map procedure was used upon the subject property, the stuff recommends adoption of the street alignment by resolution rather than by ordinance . This is suggested because the precise lot corfiguratie)ns have not been established within the tract . Therefore, minor modifications to the exact placement of the street may be necessary, thereby allowing for an amendment by resolution rather than lengthy ordinance procedures . ENVIRONMENTAL STATUS: The proposed precise: plan of street alignment reflects the street configuration of the proposed tentative map on the property which did receive environmental assessment. The precise plan is therefore exempt from further environmental review. FUNDING SOURCE : Construction of the streets would be at the expense of the developer. ALTERNATIVE. " . 0 GENERAL INFORMATION: The subject items were continued from the July 5 , 1978 regular Planning . , Commission meeting to allow the staff time to investigate concerns raised in the following areas : (a) Impacts Gf truck traffic on Heil Avenue resulting from the opening of a north/south street (Burke Street) intersecting with Heil Avenue. (b) Safety of Burke Street/Heil Avenue intersection in terms of adequate sight distance from the raised elevation in Heil Avenue east of the project site . (c) Safety of Burke Street/Heil Avenue intersection upon Heil Avenue bicycle traffic. These concerns were the principal issues resulting from the Planning is Commission ' s discussion and oral comments received during the public hearing from Howard Subnick, a resident in the abutting residential tract to the east of the project area. The. staff has since met with Mr. Subnick and discussed the nature of the project proposal as well as discussing his concerns in more detail . The staff requested the developer to employ a traffic engineering con- sultant to address those concerns as previouisly noted. Emphasis was placed upon developing measures which could possibly be employed to mitigate potential traffic problems. Since ;' this report was not tom- pl.eted prior to distribution of the Planning" Commission agenda information , the staff will report on the findings of the study and state their recom- mended action the night of the Planning Commission meeting. (C) Adopt Resolution No . 122.4 approval of Precise Plan of Street Align- ment No . 18-3 . 2. 0 GENERAL INFORMATION: Tentative Tract Nos. 10447 and 10446-X have been filed in conjunction for the purpose of coordinating improvement plans for the entire area of indu9Grially zoned land southeast of Gothard Street and Heil Avenue. Tentative Tract Map No . 10447 is a 19 ].ot subdivision designed to convey a previously approved building site into separate ownerships ., Admini- strative Review No. 78-49, approved by the Board of zoning Adjustments on May 31 , 1978 , entitled the development of 164 ,899 square teet of industrial building area among 20 buildings. Most of the developrsents upon the property would share reciprocal easements for vehicular ingress and egress . Tentative Tract No . 10446-X establishes a street configuration serving a ,,, . 16 acre parcel of land as well as linking the two maps with access to Heil Avenue and Gothard Street. Precise Plan of Street Alignment No . 78-3 reflects the intended design of the industrial streets depicted upon Tentative , Map Non . 10446X and 10447 . The staff initiated the precise plan to insure than an acceptable intertying sitceet design is achieved whether or not the property en- compassed within Tentative Tract No. 10446-X is developed at this time. 3 . 0 SUMMARY OF ISSUES : The following issues are raised as a result of the project proposals : (A) Sewer capacity to accommodate the projects . (B) Timing of construction of interior streets . Otter issues of concern addressed by the staff and Subdivision 6saittese have since been solved by revised designs or through the institution of appropriate conditions of approval . 4 . 0 ENVIRONMENTAL :STATUS : ` F 4. 1 Tentative Tract No . 10447: � Negative Declaration No.. 78-32 4a'*_ •daptrd by" the Board of Loninq Adjust-— ments on April 5, 1978 . Therefore, a determination was made that no further environmental documents were necessary. Since the proposed subdivision only divides the preapproved development into lotsp the tentative map is dee.ned to be exempt from further environ mental review . 4 . 2 Tentativc Tract No. 10446-X: Negative Declaration No. 78--55 was posted on May 25, 1978 and as of the 10 day posting,"period of. , .'rune 5, 1978 , no comments were received. A com- munication from the Ersv rt n ^,tal Council dated June 5 , 1977 was received registerincy opposition to dividing the induatrtal acreage into smaller lots. Section 7 .0 of the staff report addresses the concern. Based on this premise and previous' environmental documents , the precive plan is exemp% fror further environ- mental review. 5.0 PRESENT LAND USE, ZONING, AND GENERA,t: PLAN DESIGNATION : The subject properties are presently vacant and zoned Ml Light Industrial. The General Plan designation for the property is Light Industrial . There- fore, the subject property is in compliance with the General Plan and zoning . Consequently, this issue was not a major Item of discussion. Further flow line measurements by the Department of Public Works revealed that previous measurements of sewers in the area were not accurate because of what is believed to be a settled manhole. Based upon a re-examination of the Neil. Avenue Sewer, average and peak flow volumes do not currant con- struction of the relief sewer at this time. The relief sewer must however be eventually =mtructed in view of t-he anticipated txtild-out under -existing zoning desig= nations in the area. A ca m nication frrm the Department of Public Works addresses this ism*. 6 . 2 Timing of Construction of Interior Streets : The interior street shown on Tentative Tract No. 10447 will be constructed immediately to serve the developments which have already been approved and is under construction. The developer of Tentative Tract No. 10446X anticipates a probable develop- ment schedule of proceeding six months after occupancy of thn tenants of buildings within Tentative Tract No . 10447 . Since the two tracts will not necessarily develop concurrently , a temporary means . pf;`,insurinqq through access from Steil Avenue to Gothard Street has been r'e"qusired . 1F 44-foot wide east-west ingress and egress easement (the -equivalent of 2 travel and 2 parking lanes-) between Burke Street and Gothard Street at the cotman property linos of, the two tentative tracts would' be provided-to carry traffic through during this interim period . ~' The terminus of "Burke Street" would be barracaded during this period of time. Precise Plan of Street Alignment 78-3 would set a street pattern for the eventual build-out of the property south of Tentative Tract .'No. 10447. The "X ,Map" process is a means in which the street configuratton.;among other planned improvements is set, on the tentative map but lot confiqu-- rations are established later through the parcel map process . :his procest - provides flexibility to the. developer where desired parcel con- figarationsare unknown at this time and eliminates the need to submit parcel maps, adjusting lot lines later. This treatment was acceptable to the Subdivision .Committee . The Comittee also reviewed the access points of the development�,in significant detail. The Traffic, Engineer hais' since addressed ieveiml questions regarding these access points and concurs in the developerh approach . Minutes of the Subdivision Committee meeting are excerpted for the Planning Comission ' s information . 7 . 0 ADDITIONA►L INFORMATION: The Environmental Council' s cotm� ' oniration- of Juice 5 , 1978 (attached) recommends denial of Tentative Tract No . 10446-X . , Their recoiWendation is based on the need to ,provide ,large parcel single user sites rather than smaller lot subdivisions . TT 10447/TT 1044fi-X/NA 78- SO/PPSA 78-3 Page Five While large lot industrial subdivisions are encouraged, the zoning ordinance currently allows for the division of land Into 10,000 square foot sites in the H1 zone . This minimum lot area must therefore be considered acceptable untJ61 the City Council enacts code changes . If the Planning Commission wishes to consider a code :.hange, the staff recommends that such a position be reported to the City Council for direction and priority. 8 . 0 RECOMENOAT ION: The Subdivision Committee recommends approval of Tentative Tract 10447 , 10446-X, and Precise Plan of Street Alignment No . 78-3 based upon the following findings and subject to the following suggested conditions of approval: FINDINGS : TENTATIVE TRACT NO. 10447 : 1 . The General Plan has set forth provisi.ona for this type of land use as well as setting forth cbjectivei for development of industrial land . 2 . The property was previously studied for this intensity of land use at the time the zoning was applied to the subject property. 3 . The lot size, depth, frontage , street widths, and all other. design and %mprovements features; of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifications on file with the City as well as in compliance with State Map Acts and supplementary City Subdivision Ordinances . TENTATIVE TRACT NO. 10445-X : 1. The General Plat has set forth provisions for this type of land use as well as netting forth objectives for development of industrial land. 3 . The property was previously studied for this intensity of land use at the time the zoning was applied to the subject property. ' 3 . Sewer and water laterals shall be bored if Installed after completion of the street surface. 3. Drainage for the proposed subdivision shall be approved by the Department of Public Works prior to the recordation of a final map. This system shall be designed to provide for siltation and erosion control both during and after construction of the project. 4 . All conditions of approval of Administrative Review No. 78-49 shall" be applicable to this subdivision . 6 . In General Plan Amendment 77-1 Miscellaneous items , 2 .4 . 1 - 2 . 4 .2 it states that one of the main advantages to the property in this area is that it is in large parcels under single ownership and therefore able to attract quality industrial uses. nurirn) the controversial public hearings on GPI 77-1 , staff repeatedly argued that small lot size and divided ownership were not conducive to attracting quality industry and therefore those properties should be rezoned to residential use . This property is one of the prime industrial location's in the City, with compatible surrounding land uses , excellent freeway and arterial access, topography flat, no drainage problems , single ownership and large parcel size. While no project is being proposed at this time, dividing the land into t:po parcels could lead to split ownership, piecemeal or lesser quality develop- meht, etc. and severely limit the options available and/or ruin opportunities for future quality industry to locate here . Dividing this property would appear to be in conflict with previous Planning Commission and City Council intentions and actions toward retaining quality industrial sites north of Slater Avenue. Heil Avenue Access : • The access points on Heil Avenue were reviewed , and Mr . Eadie said that the Planning Department would recommend closure of the westerly drive in order to keep industrial traffic out of the residential area to the east as much as possible. Mr. Burke objected; noting that he needs the drive for access , flexibility, add circula- tion and suggested making it right turn in, right turn out only. It was pointed out that right turn our would funnel truck traffic directly easterly. Other treatments were discussed, including posting, left-turn only, and entrance only. It was the consensus of the Committee ard' staff that the Traffic Engineer should consider the problem of this drive in more detail and retort to the full Commission . Vehicular access rights can be conditioned to be subject to .the approval of the Department of Public Works, but if the Coeais- rsion is inclined to approve leaving the drive in Dave: Eadie suggested that ;t not be restricted except for right in, right out only, because of the difficulty of enforcing other weans of control.
