Statement of Ima, ReoomnwxWtion, Analysis, Funding Source, Altern"Ive Actions, Attachments: STATEMENT OF ISSUE: Transmitted for your consideration is Precise Plan of Street Align- ment No. 80-1, a precise plan for private streets over exist-ing easements in order to provide access to interior. _properties %ith a minimum acceptable right-of-way width. RECO&JENDATION: The Planning Commission and Planning Staff recommends that, the City Council approve Prelcise Plan of Street Alignment No. 80-1 and adopt the attached resolution. ANALYSIS : APPLICANT: City of Huntington Beach LOCATION: North of Pearce Street and west of Green Street REQUEST: A precise plan of ,-rivate streets over existing easements to provide access to interior properties. PLANNINGC=1SSI0N ACTION ON APRIL 74 1981 : ON MOTION BY HAU ER AND SECOND, BY WINCHELL, PRECI15E PLAN OF STREET ALIGNMENT NO. 80-1 WAS APPROVED AND RECOMMENDED FOR APPROVAL TO THE CITY COUNCIL WITH THE FOLLOWING VOTE: AYES: Bannister, Kenefick, Winchell, Sauer NOES: Schumacher ABSENT: Porter ABSTAIN: None The Commission further. stated that a condition be added to' ' the resolution that if parcel 38, consisting of lots 106 through 110, of Tract 184, is developed as a single parcel, as prasently`, con-, sreaented under ownership, the proposed private street whichiwould presently , s parcel be terminated at, the eastern, edge of the parcel. these lots, ,, however, -split and. sold separately, then the proposed private street would terminate as presently depicted. Page Two DISCUSSION: In November, 1980, the Planning Commission reviewed Precise Plan of Street Alignment No. 80-1 . This proposal presented three alternative street alignments into the subject property . Each of these street alignments utilized a standard, or close ' to standard street section. After eonsidera►:,te review, the Planning Commission concurred that none of the thm. alternatives provided access to all of these properties within this general area and with the extra wide street section, a number of properties were completely consumed by the proposed street. Therefore, the Commission r,icommended that the staff explore different alternatives related to the access problem for this area. The ,staff has reviewed a number of alternatives and has determined that since .all of the properties are served by private easements, the most realistic approach would be to identify these private easements and require a minimum right-of-way that the Fire Department, Police Department, and Department of Public Works can find acceptable as an alternative solution to a public street for this area . At the present time, there are three recorded private easements providing access to . `ach of .:he parcels within this general area . These private Oasements are presently 20 feet wide. The staff is recommmending that these easements be increased to a minimum street section as defined in the Department. of Public Works standard street sections for private streets, which is 33 feet. The staff is also recommending that at the time of development for any of these parcels within the subject area , street improvements be made on these private streets and also all of the maintenance on i:hese streets be provided by each of the adjacent property owners taking access from these roadways , There are several areas where the full 33 feet cannot be achieved because of existing development, however, the staff feels that in these areas, such as the new four-plex development- south of Hideaway Circle, the private street section can be reduced in that particular area and then widened again to the 33 feet beyond that point . Both the staff and the Planning Commission feel that this is a reasonable aolu'Idon for so?.ving a potential problem for future development within this area . The proposed 33 foot wide private street will provide two - 12 ft. travel lanes required by the Fire Department and will allow an 8 foot parking lane on one side of the street. New streets will be improved and maintained by each of the property owners adjacent to that portion of this street . Cede Amendment No. 81-3 in conjunction with Precise Plan of Street Alignment 84-1 will allow for the identification of private streets on the sectional district maps, the requirement for futiire develnp- ment to comply with a sotba`ck as established for that district and require improvements of private streets to minimum City standards. The adoption of the attached resolution will enable these private streets to be identified on the appropriate sectional district map. 1 Page Three ENVTRONMENML STATUS: Pursuant to Section 15105 of the California Environmental Quality Act, the identification of these private easements to 'private streets is categorIca?.ly exempt . ALTERNATIVZ CTION: The Citv Council may consider an alternative method for providing a minimurr. and acceptable street width to provide access to the interior properties of this general area . Bellavia who was conducting private meetings in the above subject , with the property owners - in the past. Mainly to consolidate the land by selling out to a develpoer . Since this plan never materialized , b cause I was the only one who was willing to sell . Now there is a new plan to enlarge the present easement to a private roadways . We like to make this initial explana.-tion . We want to express our opposition for such a plant A . Our property has two easements - one in the Southo other in the North side . Taking away 32' -- 36 ' on each side. from our 9B ' lot would shrink to a 26 ' strip of land . We already was denied to buill around the existing Community Water Well on the South side - 251 * 5 ' a 30 ' would already not buildable . Trerefore we wasted a complete plan wich was revised 5 times, but rejected in the variance commitee . Appr . cost last $ 4 .500. Now we have a new smaller plan under Plan Check . We hired Shell Homes Co . with a $ 68 .500. -- contract to get City approval . We paid out a other appr. $ 3,800. -- to complete the plans . This new 38 ' wide building plan will be Jeopardized according to this new demand . We already has a street improvement plan approved . B . We feel we singled out to carry all burdens to benefit the older homes located west behind of our property . 1 . We are forced to do all Street Improvement on Green St 981 ♦ plus curbs and gaters and pavements . All has to be dedicated to City . 2. We now restricted to a much smaller building . Cost and hardship. 3 . Build and maintain two privet roadways appr . 78 ' long. C . We understand the need of the roadways , but when the- City govern our privet property we like to see some help to solve the problem by spreding the cost of such a improvements beatween all othtero . 1-• Willing to sell all or part of our property , or 2. Give up one of the easement wi',Lh the Community Wells or 3. Spread the coast of the Street Improvements and roadways .
