STATEMENT OF ISSUE:
Transmitted for the City Counci l ' s action is a request to reactivate
Precise Plan of. Street Alignment 81-1 , which was tabled by the
City Coun^11 on July 6 , 1961 .
RECOMMENDAT ION£: '
. The Department of Development Services in recommending that the City
Council reactivate Precise Plan of. Street AlignmQ:!� 81-1 , a precise
street alignment on the 12-acre parcel of land located on the south
side of Yalbert. Avenue approximately 450 feet west of Beach Boulevard
it is ifurthzr recommended that this item be referred back to the
Planning Commission for revision prior to the City Cotinci 1 's taking

Request: To establish a private looping street which would
provide access to the 12 acres south of Talbert ,
west Of Beach .
Giscussirn : At: the July 6 , 1981 City Council meeting, the Council
tabled Precise Plan of Street Alignment No . 81--1 .
This precise plan, which provided a looping .n'treet
for access to the 12-Acre parcel of land located
on the south side of Talbert west of Beach ;boulevard ,
was recommended for approval by the Planning Commis-
sion at its June 2, 1901 meeting .
Since the Council ' aB action on this precise plan , the Departments' of
Development Services, ,has met on numerous occasions with a number, of

discussl n- and review of a number of alternatives , the property
owners . and City staff have identified several alternatives which
would provide better access to the subject property and resolve
a number of problems in the general area .
Therefore, the staff is recommending that the Council reactivate
Precise PLan of Street Alignment 81-1 and refer it tuck to the
Planning Commission for a new public hearing and report hack to the
City Council prior, to any additional Council action.

The City Council may consider not reactivatinq Precise Plan of

PUBLIC HEARING - PRECISE PLAN OF STREET ALIGNMENT 81 -1 - TALBERT/BEACH - TABLED
The Mayor announced that this was the day and hour set for a public gearing to
consider Precise Plan of Street Alignment No. 91-1 , a request to align a private
street for the purpose of providing access to the twelve acre site located on
the south side of Talbert Avenue, approximately 450 feet west of Beach Boulevard.
The City Clerk announced that all legal requirements for notification, publi-
cation and posting had been met, and that she had received no communications or
written protests to the matter.
The Director of Development Services presented a report on the matter,
The Mayor declared the hearing open.

George Wood stated that he had his attorney draw up documents regarding the
matter; however, he did not know if Council had received them yet. stated
that he would be granting access , not receiving it. He presented maps to staff.
There being no one further present to speak on the matter and there being no,
protests filed , either oral or written, the hearing war closed by the Mayor.
On motion by Pattinson, second Thomas , Council tabled consideration of Precise

ment 81-1 , a precise plan to align a 40-foot wide street providing
access to the 11 . 81 acre site located on the south side of Talbert
Avenue approximately 450 feet west of Reach Boulevard.
RECOMMENDATION:
The Planning Commission rCcolamend" that the City
Council approve Precise Flan of Street Alignment 81--1 and adopt the
attached resolution .
ANALYSIS :
Applicant: City of Huntington Beach
Location: South side of Talbert. Avenue approxinately
450 feet west of Beach Boulevard
Request: To precise plan the alignment of a 40-Moot wide
private street which will provide access to the
11 . 81 acres of land located on the south side of
Talbert Avenue approximately 450 feet west of
Beach Boulevard . This precise plan will not pro-
vide access to each parcel in this general area;
however each of the major parcels will be provided
access via this private strer�-t .

DISCUSSION:
In July of 1980 , the Planning Commission approved Zone Change 80-9,
a request to change the zoning on an 11. 81 acre parcel of land
located on the south side of Talbert Avenue a pprt1ximately 450 feet
west of beach Boulevard . This zone change was from "Q"R-1 to
"Q" R-2-PD. This "Q" R-2-PD zoning was approved with four specific
conditions :
1 . A single development plan be approved for the entire 11 . 81
acre parcel .
2 . Access to the entire: site be limited to two (2) points of
ingress-egress from Talbert Avenue .
3 . A 10-foot pedestvian easement be provided from Talbert to the
adjacent park site along the south property line.
4 . A 25--foot setback be established between the future residential
units on tho subject site and the adjacent industrial along
the west pr-,)perty line.
One of the property owners of this site had worked with a number of
the other prop:rty owners in order to prepare a development plan
4' for the entire site; hnwclver ,, because of the large number of property
owners involved with this land it became a very difficult task for
one of the landowners to get concurrence from the remaining land-
owners for a single development plan for the entire site. The property
'r owner then requested the Planning Commission to alter Condition No. l
to allow for either a specific plan or a precise plan of street
' alignment to satisfy some of the concerns the Commission had at the
i time it required the single development plan . The Planning Commission
,t concurred with this request and the landowner prepared a precise
plan for a major access street .into the 11 . 81 acre site which could be
incorporated into future developemnt plans as each of the major property
owners pursued a development on each of the major parcels .
in reviewing this proposal with the Department of Public Works, ,
it had been indicated that this streets remain as a private street
for the sole purpose of providing access to each of the major parcels
within the overall 11 . 81 acre site. Some concern was expressed as
to. the location of the two paints of ingress and egress for the pro-
posed street; however, these issues have been resolved and the
Department of Public Works agrees with the locations.
The Planning staff has identified several concerns related to the
street which can be resolved through proper conditioning of future
tract mapA on the subject property . These issues include: 1) a
continuous maintenance agreement for the proposed street, whibh will
require all, property owners to ahare in the maintenance of the
overall street; 2) a long-term access agreement wh'lch would allow
all of the property owners the right of this private ,street for

access to and from their properties; 3 ) adequato utilities be
constructed under th�L, first segment of the street to accommodate
development of the overall 11 . 81 acres.
After reviewing the proposed private street alignment, the Planning
Commission concurred with the approach and approved Precise Plan
of Street Alignment 81-1 and recommended adoption by the City Council .
ENVIRONMENTAL S:'ATUS:
Since the overall site was addressed for environmental effects as a
result of Zone Change 80-9 and the overall project of approximately
175 units , including utilities and street circulation, were dis-
cussed as a part of Environmental Impact Report 79-5 which was certi-
fied by the Planning Commission and the City Council , no additional
environmental assessment was required . Each segment of this private
street will be addressed as part of the circulation for each phase
that is developed under a separate tract map.
FUNDING SOURCE: Not applicable.
ALTERNATIVE ACTIONS:
1 . The City Council may consider denying Precise Plan of Street Align-
ment 81-1 . This a--tion would preclude development from occurring
on the subject property until all of the property owners could concur
on an overall development plan for the entire site.
2 . The City Council may Consider, after closing the public hearing ,
withholding action on the adoption of Resolution No. until all
property owners have filed with the City agreements for maintenance
of subject private street in accordance with their pro rats share,
as well as non-revocable agreements to allow cross reciprocal ease-
ments to all other property owners within the area for Ingress/egress
purposes.

1 .0 RECOMMENDED ACTION:
The staff is recommending that the Planning Commission apl, .. ove Precise
Plan of Street Alignment No. 81-1 as presented, a proposal to pre-
cisely plan a private street south of Talbert F.venue and west of
Beach noulevard.
2. 0 GENERAL INFORMATION:
In July of 1980, the Planning Commission approved Zone Change No. 80-9 .
This was a change of zone on the 11. 18 acres of land located on the
south side of Talbert Avenue, approximately 450 feet west of Beach
Boulevard from Q-RI to Q-R2-PD. One of the conditions placed on this
zone change was that a single development plan be approved for the
entire 11 .18 acre parcel . One of the major property owners of this
site has been working with the other owners in order to prepare a
development plan for the entire 11 . 81 acre site, however, because of
the large number of property owners involved with this land, it has
become very difficult to achieve approval of all of the land owners .
Therefore, Mr . Woods of Woodt,ree Development, one of the major
property owners, addressed the Commission earlier this year requesting
that an alternative to this condition be provided in order for him to
Ue able to develop his four acres of land. At that time the Planning
Commission indicated that either a specific plan or precise plan of
street alignment be prepared which would provide access to all of the
property owners and allow for the harmonious development of the property.
The property owner was required to provide all of the necessary in-
formation for this precise plan of street alignment.
As required, the propertyowner has submitted all of the information
outlining a 40 ft. private street providing access to the four major
parcels comprising this 12-acre site. Attached is an exhibit of the
proposed street alignment and a legal description of said street .
In reviewing this proposal with the Department of Public Works, It has
been indicated that this street remain as a private street For the sole
purpose of providing access to the subject property. Some concern was
expressed as to the location of the two points of ingress and egress
for the proposed street, however, those issues have been resolved.

,rho Planning Staff teas several concerns related to the stt•eet which
can be resolved through proper conditioning of suture tract maps on
the subject property . These issues include:
1 . A continuous maintenance agreement for the proposed street which
will require all property owners to share in the mai.n:enance of
the entire street.
2. A long--term access agreement which would allow c,.101 of the property
owners the right of this private street or accesa to and from
their property .
3 . Adequate facili%":ies be constructed under the first segment of the
street which will provide adequate facilities to accommodate
ultimate development of the overall 11 . 81 acres.
The staff concurs that these three major issues can be properly resolved
at the time each of the major parcels is proposed for development . Through
proper conditioning of each of the tentative tracts required for the
development of this property, these major issues can be resolved .
The staff feels that this is a reasonable solution for solviny a potential
problem for future development within this area. The 40-foot street con. -
plies with the minimum requirements set forth by the Fire Department and
under the new provisions of the Ordinance Code for private streets. The
street has also been designed to accommodate 50 foot wide entrances at
each of the two points of ingress and egress.

WHEREAS, pursuant to the Planning and Zoning Law, na,•ticu-
larly Calirornia Government Code section 65500, the Planning
Commission of the City of Huntington Beach , after notice duly
given, held a public hearing on Juno 2, 1981 to consider Precise
Plan No. 81-1 to provide a forty (40) foot private atreet to be
privately developed and maintained as access to real property
generally located on the south side or Talbert Avenue , approxi-
mately 450 feet west of Beach Boulevard ; and
On July 6 , 1981 , after notice duly given, hearing was held
