PUBLIC HEARING - PRECISE PLAN OF STREET ALIGVENT 81-1 - TALBERT/BEACH - TABLED
The Mayor announced that this was the day and hour set for a public hearing to
consider Precise Plan of Street Alignment No. 81-1 , a request to align a private
street for the purpose of providing access to the twelve acre site located on
the south side of Talbert Aveaue, approximately 450 feet west of Beach Boulevard,
The City Clerk announced that all legal requirements for notification, publi-
cation and posting had been met, and that she had received no connunications or
written protests to the matter.
The Director of Development Services presented a report on the matter.

west of IIeach- Boulevard. This Z6ne -change was from ='Q"R-1 to
R-2--PD: This "Q" R.2--PD zoning was- approved with four specific,
,. conditions:

acre .'parcel .
24" Access to the entire site be limited to two (2) points of
ingress-egress fron Talbert Avenue.
3. A .10-font pedestrian easement be provided from Talbert to the
adjacent park site along the south property line.
4 . A 25-foot setback be established between the future residential
units on the subject site and the adjacent industrial along
the west property line.
f` One of the property cwners of this site had worked with a number of
the other property owners in order to prepare a development plan
for the entire site; however, because or the large number of property
owners involved with this land it became a very difficult task for
one of the landowners to get concurrence from the remaining land--
owners for a single development plan for the entire site . The: property
owner then requested the Planning Commission to alter Condition No.l
to allow for either a specific plan or a precise plan of street
alignment to satisfy some of the concerns the C=mission had at the
time it required the single development plan. The Plannincj Contminsi.on

Since the overall site was addressed for environmental effects as a
result of Zone Change 80-9 and the ova.-all project of approximately
3.75 units, including utilities and street circulation, were dis-
cussed as a part of Enviroru-nental Impact Pteport 79-5 which was certi-
. fied b the Planning Commission and the City Council, no additional

environmental assessment was required. Each segment of this private
street will be addressed as part of the circulation for each phase
,that is developed under a separate tract map.

I. The City Council may consider denying Precise Plan of Street Align-
ment 81-1 . This action would preclude development from occurring
on . the subject property until all of the property owners could concur
on an overall. development plan for the entire site.
2: The City Council may consider, of closing the public hearing,
withholding action on the adoption of Resolution No. until all
property owners have filed with the City agrcem.:-rats for maintenance
of subject private street in accordance with their pro rats share,
as well as non-revocable agreements to allow cross reciprocal case-
ments, to all other- property ownern within the area for ; ngresslegresa
purposes.

'The `stat£ is recommending that the Planning Commission approve Precise ' .
Plan . of .Street Alignment No. 81-1 as presented, a proposal to pre-
ciselu plan` a private street south of Talbert Avenue and crest of
Beach. Boulevard .
2 0 GENERAL IIIFOR14ATION:
'- In July of 1980,. the Planning Commission approved Zone Change No. 80--9 .
This was 'a chance of zone on the 11 . 18 acres of land located on the
south side of Talbert Avenue, approximately 450 feet west of Beach
- ` Boulevard from Q-R1 to Q-R2-PD. One of the conditions placed on this
zone change was that a single development plan be approved for the
entire 11 .18 acre parcel . One of the major property owners of this
site has been working with the other owners in order to .prepare a
development plan for the entire 11 . 81 acre site, however, because of
the large number of Property owners involved with this land, it has
become very difficult to achieve approval of all of the land owners.
Therefore, Mr. Woods of Woodtree Development, one of the. major
property owners, addressed the Commission earlier thin year requesting
that an alternative to this con61t on be provided in order for hit" to
be able, to develop his four acres of land. At that time the Plante;ng
commission indicated that either a specific plan or precise plan of
street:, alignment be prerpared which would provide access to all of the
y"> property owners and allow for the harmonious development of the property.
The property owner was required to provide all of the necessary in--
formation for this ,precise flan of street alignment .

WHEREAS, pursuant to the Planning and Zoning Law, :particu;
