La Belle, Director, Co ni y Development Subject: PRECISE PLAN OF STREET ALIGNMENT NO. 87-2 Statement of Issue, Recommendation,Analysis, Funding Source, Alternative_ tions, Attachments: o�veo, a,Y C_�.__ C�L STATEMENT OF ISSUE• Transmitted for your consideration is Precise Plan of Street Alignment No. 87-2 to replace Precise Plan of Street Alignment No. 74-3 . Precise Plan of Street Alignment No. 87-2 is a proposal to extend Redondo Circle from its existing easterly terminus to the existing southerly terminus of Kovacs Street. RECOMMENDATION'' i Staff recommends that the City Council adopt Precise Plan of Street Alignment No. 87-2 . The Planning Commission will review the -proposed Precise Plan on September 1, 1987. The Planning Commission' s recommendation and comments will be presented at the September 8, 1987 City Council meeting. ANALYSIS• The original alignment of Redondo' Circle, as shown on. the 1973 Taylor and Beach Specific Plan, began at a point 600 feet to the east of the railroad right-of-way, and extended southward from Talbert Avenue 660 feet to a cul-de-sac. Precise Plan of Street " Alignment No . 74-3 was adopted by the City Council (Ordinance 1951) on December 16, 1974 . This action moved Redondo Circle 310 feet to the west of the original alignment and curved it eastward to the original cul-de-sac location -(see attached Precise Plan of Street Alignment No. 74-3) . On February 21, 1978, the City Council adopted Resolution No. 4590, amending the Taylor and Beach Specific Plan and extending Redondo Circle 330 feet to the east to intersect a proposed north/south street (Kovacs Street) . (See attached Amendment to Taylor and Beach Specific Plan. ) The purpose of the connecting loop system was to serve industrial properties that were then undeveloped. PIO 4/81 The proposed new street alignment will also form a connecting loop system, but will realign Redondo so that it extends northeasterly from its existing terminus to the existing terminus of Kovacs Street . This conceptual alignment was approved by the Planning Commission on July 7, 1987, with their approval of the conceptual site plan for Boureston Development (Administrative Review No. 87-15, Use Permit No. 87-34 and Negative Declaration No . 87-9) . Boureston has developed a detailed site plan which incorporates that portion of the street alignment located on their site. The detailed site plan and associated variances were approved by the Planning Commission on July 21, 1987 (Conditional Exception (Variance) No. 87-61) . Precise Plan of Street Alignment No. 87-2 will impact properties to the north and to the west of Boureston' s site. To the north, a triangular piece of property approximately 1, 700 square feet in area will be required for right-of-way purposes . The property owner has submitted conceptual development plans to the City for an auto center, and is working with staff to incorporate the proposed right-of-way into the project. To the west, there is an existing industrial building which will also be affected by the proposed Precise Plan. Approximately 716 square feet of land will be required for right-of-way purposes, and the new alignment will create a 7-1/2 foot building setback (includes 5 ' public utilities easement) from the existing structure to the curb line. Although the required building setback is 15 ' (10 ' + 5 ' public utilities easement) per the Ordinance Code, the Planning Commission may issue a Certificate of Conformance for the building so that any future development of the site will not be adversely impacted by the City' s actions . The 7-1/2 foot setback will allow for intensified landscaping. A total of 24 spaces are currently required for the 12, 000 square foot building on the site, with 27 spaces provided. One on-site parking space will be eliminated by the proposed alignment, leaving a total of 26 spaces . The current property owner has expressed support for the connection of Redondo Circle and Kovacs Street because it will increase the visibility of his business and will reduce the incidence of vandalism, grafitti, and loitering associated with the existing dead-end situation on Redondo Circle. Circulation around the building will not be affected since a driveway to the rear of the building will be replaced on the realigned Redondo Circle. ENVIRONMENTAL STATUS: The subject proposal is covered by Negative Declaration No. 87-9, which was approved by the Planning Commission on July 7, 1987. The Negative Declaration also covered Administrative Review No. 87-15, Use Permit No. 87-34 and Conditional Exception (Variance) No. 87-61, a request to permit a 125, 000 square foot industrial building for Boureston Development. RCA - 9/8/87 -2- (8971d) The primary environmental concerns identified with regard to the Precise Plan of Street Alignment were traffic circulation, air quality, and cumulative impacts. Staff analyzed those impacts in conjunction with the Boureston Development project and concluded that there will be no significant adverse impacts on the environment. FUNDING SOURCE• Not applicable. ALTERNATIVE ACTION: The City Council may choose to: 1. Deny Precise Plan of Street Alignment No. 87-2 and retain the existing Precise Plan of Street Alignment. 2 . But, once again I would like to voice::my dissapproval of the current high density and street realignment proposal of the downtown redevelopment project. It appears to me that the current project with the multi story high rise hotels, the Seaside Village, the Main Street Mall, the street realignment etc is geared toward the visitors only. The residential community will be at a great disadvantage. Some residents will lose their property altogether, and certainly will..-not see the full value of it when purchased by a developer or the City. Some will lose footage due to the street realignment. Historical buildings will be torn down. Others will be impacted with traffic and parking problems. I feel the project .needs further study to include the needs of-the residential community in these plans also. Some of the areas that need further study are: street realignment, location of traffic lights and stop signs to control traffic, bus routes, parking structure locations, possibility of 1 way streets versus street widening, location of entrances & exits to parking structures I feel the density of this development is to large to be self supporting year round. As a long time resident it does not require any great study to know that a high density commercial does not have the market potential in downtown Huntington Beach. The past evidence is Sea Cliff Village and. the: Huntington Inn. It does not have the traffic patterns or easy access to freeways to support high density commercial. My understanding, recently, is that the 'Old Civic Center Site, property would be developed first in the old town area with commercial and residential. If that doesn't prove market- able then something else would be done with the property on the other side of Main Street. I don't like living across the street from the experiment. Also, I understand, that Main Street would be closed at the 5th/6th street intersection which would impact 6th street' with more traffic and have a negative effect on commercial property in the 1, 2, and 300 blocks of Main Street. l/" October 5, 1986 Page 2 I have been attending the City Council meetings and the Planning Commission meetings to keep informed on this project. I feel the Planning Commission is exercising a much needed caution lest the residents will have to live with whatever white elephants are created by a hasty decision. More time is needed t- consider the impact this redevelopment project will have on the whole city. I urge you to exercise the same caution. The new alignment will ultimately require 10 feet of additional right-of-way on each side of the street from Sixth Street to Lake Street and will feature a 12 foot unraised median and 10 foot parkways . (B) Deleted (The deletion of this item is explained on page three of this report. ) (C) Sixth Street between Pacific Coast Highway and Orange Avenue is being precise planned to implement the Circulation Element redesignation from local street (75 feet) to primary arterial (100 feet ) . The new precise alignment, however , will feature a reduced width of 80 feet which will include a 12 foot median and ten foot parkways. (D) Sixth Street between Orange Avenue and Lake Street will be connected with Fifth Street at the intersection with Main Street. Though the Circulation Element identifies Sixth Street north of Orange Avenue as a secondary arterial (80 feet ) it has been determined that a reduced width would satisfy the estimated demand, therefore, a right-of-way which varies from 77. 5 feet at the intersection of Sixth Street and Orange Avenue to 80 feet at the intersection of Fifth Street and Main Street is proposed. Most of the connection would be executed through vacant land previously occupied by old City Hall . (E) Orange Avenue between Sixth Street and Third Street -is being precise planned to implement the Circulation Element redesignation from local street (75 feet ) to primary arterial (100 feet ) . The new precise alignment, however, will feature a reduced width of 80 feet which will include a 12 foot median and ten foot parkways . Appropriate traffic control channelization and devices will need to be incorporated into the design at the intersection of Orange Avenue and Sixth Street to limit and discourage vehicular travel from the downtown northwestward on Orange Avenue into the townlot area .. Wording to this effect has been included in Section 5 of the attached ordinance. (F) Lake Street between Atlanta Avenue and Pacific Coast Highway is being precise planned to implement the Circulation Element designation of a primary arterial (100 feet) . Lake Street is presently developed at a 75 foot width . This alignment of Lake Street amends Precise Plan of Street Alignment No. 84-2 which was adopted October 15, 1984 . That plan established the precise alignment of the Atlanta/Orange intersection and also the take for right-of-way for Lake evenly on both sides of the street. This amendment to that alignment retains the precise alignment of Atlanta/Orange, but adjusts the right-of-way take on Lake Street entirely from the vacant property on the east side of the street. RCA - 10/6/86 -2- (6308d ) i Precise Plan of Street Alignment No. 86-1 has undergone considerable review and revision since its first public hearing before the Planning Commission on July 22, 1986 . The first revision was for the deletion of Area B (Walnut Avenue between Lake Street and Beach Boulevard) from the Precise Plan so that staff could work with the property owners and assess alternative alignments . The Planning Commission and staff were in agreement that this area be deleted from the precise plan. Staff also prepared street cross sections to indicate how the arterials may be constructed to minimize impact on existing structures . The maps (which are attached to the adopting ordinance ) .depict the existing street sections, interim sections which will work until adjacent property recycles, and ultimate sections which depict how the arterials will look after all of the property recycles. The Walnut Avenue interim section proposes ten feet to be taken only on the southwest side in conjunction with proposed redevelopment projects . No dedication will be taken from the northeast side until property recycles . The Orange and Sixth Street interim sections propose all improvements to be made within the existing right-of-way with only 2.5 feet of dedication to be acquired as property recycles . Also included is a conceptual rendering of how the intersection of Walnut Avenue and Sixth Street may be treated if the Worthy house is retained in its present location rather than relocated. The rendering shows Walnut Avenue taking a 10 foot jog to the northeast onto property occupied by an oil well in order to retain the Worthy house at its present location. The Planning Commission recommended approval of the Precise Plan of Street Alignment with the condition that the renderings of interim street sections and the Walnut/Sixth Street intersection be included as exhibits in the adopting ordinance. That recommendation has been incorporated into the attached ordinance for adoption. ENVIRONMENTAL STATUS: The environmental impact of the proposed alignments was previously assessed at the time of Circulation Element Amendment No. 84-1 . Negative Declaration No. 84-14 was adopted by the City Council on June 4, 1984. Environmental Impact Report 82-2 previously analyzed the downtown arterials in conjunction with the Downtown Specific Plan . No additional environmental assessment is .necessary. ALTERNATIVE ACTIONS: The City Council may deny Precise Plan of Street Alignment No. 86-1 . Such action would prevent the City from implementing the adopted arterial status of the streets covered by the Precise Plan and would require that the City reassess its plans for the Downtown area. D4 Yes [ ] New Policy or.Exception Statement of Issue, Recommendation,Analysis, Funding Source,Alternative Ac ` s, Attachments: STATEMENT OF ISSUE: At the City Council meeting of March 17, 1986 the Council considered Negative Declaration No. 85-72/Precise Plan of Street Alignment No. 85-2 (Gothard Street). Council continued this item and requested staff to provide additional information regarding costs, financing, participating agencies and funding for the project in ten to fifteen years. RECOMMENDATION: Staff recommends that the City Council approve Precise Plan of Street Alignment No. 85-2 by adopting the attached Resolution and Ordinance after certifying Negative Declaration No. 85-72 and authorize staff to plan for the purchase of needed right-of-way and obtain needed easements for the realignment of Gothard Street between McFadden Avenue and Center Drive. ANALYSIS: The purpose of this report and analysis is to provide Council with new information not provided in the report that was presented *to Council at the March 17, 1986 Council meeting. Attached is a copy of a. letter from Cal Trans District Director Donald L. Watson to Assemblyman Frizzelle. Mr. Watson stated in the letter that Cal Trans has no objections to the Huntington Beach proposal of extending Gothard Street either by utilizing the railroad opening under the freeway or by constructing a new overcrossing providing all Cal Trans standards are met. A meeting was held with the Westminster Deputy City Administrator, Planning Director, and Public Works Director. Attached is a letter from Westminster dated April 1, 1986. The letter states among other things that the Westminster Council has referred the Gothard-Hoover connection to their Traffic Commission for study. As of this writing the Traffic Commission has not begun to study this matter because of other priorities. The letter also noted that although the Gothard-Hoover connection is shown on the Westminster General Plan it is not on the Official Street and Highway Map of the City of Westminster. In order to have the Gothard-Hoover extension eligible for grant funds administered by OCTC the County's Master Plan of Arterial P10 5/85 RH 86-33 May 9, 1986 Page Two Highways (MPAH) needs to be amended. In order to apply for an MPAH amendment both Westminster and the City of Huntington Beach need to amend their Circulation/Official Street and Highway Map to show the connection between Hoover and Gothard and a possible interchange. Our Public Works Director received a letter from the Orange County Transportation Commission dated April 18, 1986 which is attached to this report. The four key points suggested by OCTC for consideration by the City of Huntington Beach are: 1. The need for an amendment to the County's Master Plan of Arterial Highways (MPAH) and the Circulation Elements of the cities of Huntington Beach and Westminster - Currently, the County's MPAH does not show a connection between Gothard Street and Hoover Street or an interchange with the San Diego Freeway. Jerry Bennet or Bob Peterson from the County should be contacted regarding an amendment. 2. A financial plan for designing and constructing the improvements - A plan addressing the funding sources for the project should be prepared. It is assumed that local funding (public/private) would be the primary source. 3. The role of Cal Trans and the Federal Highway Administration (FHWA) on the project - Cal Trans and FHWA are responsible for approving any connections to the interstate system. Their involvement early in the process is important. 4. An agreement with the City of Westminster - The Gothard/Hoover Street interchange affects both the City of Westminster and Huntington Beach. Concurrence on the proposed project is essential to its success. Staff would like Council to know that potential on and off ramp connections to I-405 would be a long range proposition. Financing the Gothard Street realignment, extension of Hoover and addition of an on and off ramp can be obtained from tax increment which can be combined with possible funding with from Gas Tax, FAU, and AHFP. Conservative estimates of tax increment over the life of the project show an estimated net of $19 million available for projects, after all existing obligations have been subtracted. Cost estimates in 1986 are provided for. preliminary planning purposes. There are numerous issues that could impact the costs involved. Some of these issues are configuration and location of an on/off ramp, configuration of a roadway to go over or under the freeway, future railroad plans, future plans of Southern California Edison relative to transmission lines and towers and the increased traffic flow on Beach Boulevard and Goldenwest. RH 86-33 May 9, 1986 Page Three Cost of Gothard Realignmerit South of McFadden The cost of right-of-way for the Gothard realignment south of McFadden is estimated at $480,000. Construction of the actual roadway, which is not necessary at this time . and may occur anytime over the next several years, is estimated to cost $540,000. The total cost is estimated at $1,020,000. If building is allowed to occur, an additional $500,000 is estimated for acquisition bringing the total cost of the project to $1,520,000. Cost of Gothard-Hoover Extension North of McFadden to Bolsa The estimated cost of the right-of-way is $2,080,000 and this right-of-way would be from the railroad and Edison Company. Right-of-way is not needed from Land School, which is in the Westminster School District. Appropriate environmental mitigation measures would also be implemented to eliminate possible negative impacts to the school and residential area. In the future, when construction of this portion of roadway takes place the cost is estimated at $800,000. In terms of the improvements such as on and off ramps that may be constructed in the future staff's analysis is that projected tax increment from the project as well as additional transportation funding sources will place these improvements well within the economic ability of the City/Agency to fund. FUNDING SOURCE: The funding source for the Gothard realignment south of McFadden will be from the Huntington Center Commercial District Redevelopment Project and from transportation grant sources that this project would qualify for. ALTERNATIVE ACTIONS: An alternative action would be not to approve the negative declaration/precise street alignment. Because of the size, configuration, shape and lack of unique topographic features of the subject property, there does not appear to be exceptional or extraordinary circumstances or conditions applicable to the land, buildings or premises involved which do not apply generally to property of class of uses in the same district. The parcel is similar in size and shape with other parcels in the subdivision and is relatively flat. 2. Exceptional circumstances do not apply that deprive the subject property of privileges enjoyed by other properties in the same zone classification because it is a typical 60 by 100 foot R1 zoned lot. 3. Since the subject property can be fully developed within regular esta- blished setbacks, such a conditional exception is not necessary for the preservation and enjoyment of substantial property rights. 4. Granting of Conditional Eception No. 85-93 would constitute a grant of special privilege inconsistent with limitations upon properties in the vicinity. 5. Conditional Exception No. 81-49 was approved by the Planning Commission in 1982 and is still effective which and permits an addition to encroach 2 feet into the required 10 foot setback. The proposed alignment would move the current centerline of Gothard Street easterly approx- imately 250 feet and align that portion of Gothard Street, south of McFadden Avenue to Center Drive. The Deputy City Clerk announced chat all legal requirements for notification, publication and posting had been met, and that she had received no communica- tions or written protests to the matter. Councilwoman Bailey stated that because of a possible conflict of interest she would abstain from discussion or voting on the issue. The Director. of Development Services stated that a letter had been distributed to Council dated March 13, 1986 from Kent V. Gale, Projects Engineer, Southern Pacific Transportation Company, objecting to the placement of Gothard Street within the existing railroad underpass structure under the San Diego Freeway. Stephen Chase, attorney representing Southern Pacific Transportation Company, stated that they had no plans to abandon the rail line involved in the pro- ject. He stated that the railroad has a pending lease that has been consider- ably delayed and suggested that if the Council approved the realignment of Gothard Street the City should be prepared to purchase the property immedi- ately. Orrin Burge addressed Council and explained he wanted to build a mini-ware- house in the area and was opposed to the realignment of Gothard Street. He questioned information the City had received and the cost effectiveness of the, project. Ron Pattinson, representing the Pacific Coast Corporation which has the lease- hold interest on the property in question with the railroad, stated that a 1984 study of Huntington Center and the realignment of Gothard Street indi- cated that such realignment was feasible only if the railroad line was removed. He stated he did not believe the realignment would be cost effective. Bob Getzfrid, a resident of Westminster, said he lived on the first street north o Gothard Street, and was concerned about traffic coming from Vermont Street, and the loss of the traffic light at Vermont Street if Gothard - is realigned. He was also concerned about future truck traffic on Gothard Street He suggested that his tract be annexed into the City of Huntington Beach. There being no one present to speak further on the matter and there being no further protests filed, either oral or written, the hearing was closed by the Mayor. You requested I write concerning any information I might have on the area between Bolsa and McFadden Avenues adjacent to the Southern Pacific Railroad right-of-way just south of where Hoover Street dead-ends at Bolsa Avenue. As I informed you at the meeting, I have very little information concerning this area. Besides meeting with you, I have met with Orin Berge, Ronald Pattinson and two rep- resentatives from Southern Pacific, Kent Gale and R. A. Schuffenhauer. They were interested in determining if the City of Westminster was intending to extend Hoover Street to McFadden Avenue. I could only tell them what I told you, that the West- minster City Council directed staff to bring the issue to the Traffic Commission, which I did (see attached excerpt from minutes), that we were under-staffed with a limited budget which curtails our capabilities for traffic studies, that it was not an area of high priority in this department wherein it could only be studied as time permits., and that our City Council had heard from concerned residents in the housing tract objecting to any extension of Hoover Street. In addition, we discussed the General Plan and the Streets and Highway Map. Below are the comments of Don Vestal which discuss the General Plan and the most recent zone change on the property. The Circulation Element of the General Plan has shown Hoover Street extending south from Bolsa Avenue to McFadden Avenue since the General Plan was originally adopted in 1965. Hoover Street is designated as a "secondary highway" by the General Plan.. The Official Street and Highway Map has never shown Hoover Street extending south of Bolsa Avenue. Pursuant to Section 17.48.05ON of the Westminster Municipal Code, the, Official Street and Highway Map is the legal basis for requiring street dedications and improvements as a condition of a development approval . On November 13, 1984, the City Council approved Zone Change R-426 which rezoned 1 .17 acres of the Southern Pacific Transportation Company's property extending north from McFadden Avenue to the southerly boundary of the San Diego Freeway right-of-way from PF "Public Facility" to CM-PD "Commercial-Industrial--Planned Development. " The property is a 100-foot-wide strip located between the Southern California Edison right-of-way on the west and the railroad line on the east. To date no application has been submitted for development of this property; however, given the existing status of the property, we will process such an application if it is submitted. The need for an amendment to the County' s Master Plan of Arterial Highways (MPAH) and the Circulation Elements of the cities of Huntington Beach and Westminster - Currently, the County's MPAH does not show a connection between Gothard Street and Hoover Street or an interchange with the San Diego Freeway. Of course, the Board must take a position against such crippling invasion to the educational program and services to our children. It appears that the proposed realignment and extension of Gothard Street- and subsequent connection to Hoover Street would require a substantial portion of the Land School campus. The Gothard-Hoover extension north of McFacden is in the City of Westminster and is under evaluation by the City of Westminster Traffic Commission. Our traffic evaluations and those of the Orange County Transportation Commission conclude that the escalation of traffic volumes on Beach Boulevard and Goldenwest Street would in future years require the need for another north/south street such as the Gothard-Hoover extension. Although actual construction of a new roadway would most likely be years in the future, prior planning is important to ensure that all alternatives are considered and that all interested agencies, groups, and individuals have the opportunity for input. MINORITY REPORT: Commissioner ' s Winchell , Schumacher and Rowe believe the City Council should approve this alignment and take the following information into consideration before making a decision on the precise plan of street alignment: 1 . Precise Plan of Street Alignment No . 85-2 connecting Gothard to Hoover Street will be the first step toward alleviating future traffic problems on Beach Boulevard by providing an alternative route to southern Huntington Beach. . 2 . Precise Plan of Street Alignment 85-2 should be implemented to address the circulation problems identified by the Huntington Center Redevelopment Plan . 3. From an economic viewpoint , it is more cost effective to precise plan Gothard Street at this time, and purchase the property while it is still vacant . The price for property will increase if structures are constructed on right-of-way parcels . STAFF RECOMMENDATION: Staff recommends that the City Council approve Precise Plan of Street Alignment No. 85-2 by adopting the attached Resolution and Ordinance after certifying Negative Declaration No . 85-72 . ANALYSIS: APPLICANT: City of Huntington Beach LOCATION: Gothard Street between McFadden Avenue and Center Drive REQUEST: Realignment of Gothard Street south of McFadden Avenue moving the centerline eastward approximately 250 feet for the portion of Gothard which extends 500 feet south of McFadden Avenue . DISCUSSION: Gothard Street, between Center Drive and McFadden Avenue, is within the boundaries of the Huntington Center Commercial District Redevelopment Plan . One of the proposed improvements for the infrastructure includes "Realignment of Gothard Street and extension to Bolsa Avenue to connect with Hoover Street and the construction of an on and off-ramp on the I-405 freeway at Gothard. RCA - 3/17/86 -2- (4339d ) Precise Plan of Street Alignment No. 85-2 is intended as an initial , step toward resolving the circulation problems identified by the Redevelopment Plan . . The realignment- of Gothard Street, coupled with the connection of Gothard Street to Hoover Street will provide for another transportation corridor to South Huntington Beach . This would serve to reduce the number of vehicles on Beach Boulevard . The Orange County Transportation Commission Beach Boulevard Super Street Project would greatly benefit from such a connection. The Orange County Transportation Commission has indicated support of the Gothard/Hoover connection because of the transportation benefits to the region. Gothard is a four lane secondary arterial with an 80 foot right-of-way having traffic counts estimated at 16 ,000 vehicle trips per day. The realignment of Gothard Street would require the purchasing of approximately 48 ,000 square feet (80 ' x 6001 ) with a resulting vacation at some future. date of the same area (former Gothard Street ) . During the review by the Planning Commission of the Precise Plan of Street Alignment, they expressed concern regarding the fact that there is currently an application which has been filed with the Board of Zoning Adjustments . The application is to develop a mini-warehouse facility in the area where the Gothard Street realignment is being considered . The applicant is leasing the property from the Southern Pacific Railroad . Staff has indicated to the lessee of the property that temporary portable structures or open storage for RV' s and boats to the North end of their proposed development would be an acceptable interim use of the property. The permanent mini-warehouse facility could then be constructed at the South end of the property. Such a compromise would afford the lessee the use and enjoyment of his property without significantly increasing the cost to the City in the event the property is acquired for the realignment of Gothard Street . The Planning Commission directed Staff to contact the City of Westminister , Westminister School District, and Southern California Edison to determine their position on the City 's proposal for realignment . Attached for the Council review are the letters that were received from these agencies . It should also be noted that the City of Westminister has agreed in concept- to participate in future studies which would align Gothard Street to Hoover Street . Westminister 's Circulation Element does show Hoover Street connecting with Gothard Street south of McFadden Avenue . Their circulation map also depicts Gothard Street in the City of Huntington Beach as Hoover Street. Staff also surveyed the users of the. Southern Pacific Freight Line along Gothard Street to ascertain their dependency on rail service . We have attached the results of that survey for the City Council 's review. RCA - 3/17/86 -3- (4339d ) ENVIRONMENTAL STATUS: Pursuant to the environmental regulations i.n effect at- this time, the Department of Development Services posted Negative Declaration No . 85-72 for ten days and no comments either verbal of written were received . The staff in its initial study of the project has recommended- that a negative declaration be issued for the Precise Plan of Street Alignment No. 85-2. Prior to any action on the Precise Plan of Street Alignment , it is necessary for the City Council to certify Negative Declaration No. 85-72 . Gothard Street is a four lane secondary arterial with a 80 foot right-of-way with current traffic counts estimated at 16 ,600 vehicle trips per day. The staff is introducing the Precise Plan at this time in response to Southern Pacific Railroad 's plan to lease a portion of its property for development . The lessee of the property has indicated to City staff a desire to develop the entire parcel adjacent to the realignment which would conflict with the -City 's future plans for Gothard Street . Staff has indicated to the lessee that temporary structures at the north end of the railroad property (see attachments ) would be acceptable , with permanent structures at the southern portion . It should also be noted that the Southern Pacific Railroad has indicated to staff that their branch line south of I-405 is a potential candidate for retirement . The realignment of Gothard Street would require the purchasing of approximately 48 , 000 square feet ( 80 feet x 600 feet ) with a resulting vascationing of the same area (former Gothard Street ) . Staff has been in contact with the City of Westminister to ascertain their concerns with regard to the ..subject matter . Their staff supports the Precise Plan as proposed, however they did mention no formal City Council position has been reached. Staff should also point out that the realignment of Gothard Street may result in the modification of a traffic signal serving Vermont Street in the City of Westminister . 9 .0 RECOMMENDATION: Staff recommends that the Planning Commission approve Precise Plan of Street Alignment No . 85-2/Negative Declaration No . 85-72 and recommend adoption to the City Council . The proposed crossing of our right-of-way requires a considerable amount of our property to be used for street purposes. This surface use will preclude any future use of this property for our operating needs , i.e. towers, poles, or other types of electrical facilities we might need. This right-of-way is a vital part of our transmission system and cannot be jeopardized in any way. We would like to meet and discuss the merits of the Gothard Realignment, so we may be able respond in a more effective manner to the proposal. PC Minutes - 2/19/86 -3- (4290d) The Huntington Center Redevelopment Project Area Manager sent out letters to the agencies identified by the Planning. Commission . Additionally, the Department of Public Works revised the legal description for the Precise Plan of Street Alignment so that Gothard Street does not cross the railroad right-of-way but is aligned adjacent to a line five (5 ) feet westerly to the line of the right-of-way. The staff 's position is to maintain 40 feet clearance adjacent to the railroad right of way in order to accommodate future light rail . THE PUBLIC HEARING WAS OPENED Letter from Southern Pacific Transportation Company, owner and operator of the railroad line located south of the San Diego Freeway known as the Stanton Branch , was read into the records ; confirming that they had no intention of abandoning rail operations over the . said right-of-way. Ron Pattinson spoke in opposition to the realignment . He feels that it is not economically feasible or responsible to the citizens of Huntington Beach . He feels the citizens of Westminister would be impacted tremendously by this project . Stephen Chase, attorney for Southern- Pacific Transportation Company, spoke in opposition to the realignment . He feels that his client has been delayed enough already by this proposal . If the City is interested in acquiring the property they should do it now. Bill Compton, Area Manager from the Southern California Edison Company, was not sure what the impact might- be in terms of the realignment . There are two towers involved with the realignment on the northern side of McFadden that would be entailed . The transmission corridor is there to maintain their transmission lines . It is a vital link to their total electrical transmission system and they are concerned about losing any more property in that area . Would like to see a more precise plan than what has been offered to date to insure that it doesn ' t have the kind of impact that it appears to have to the operation . Commissioner Erskine asked Mr . Compton if he had to make a decision today regarding the realignment, what would it be. Mr . Compton replied that there would be major costs that would have to be borne by the relocation agency (millions of dollars to relocate towers ) . He would not say absolutely no, but it would take a considerable amount of planning to accommodate the realignment . Orin G. Berge, spoke in opposition to the realignment . The project is decades late in being proposed and -it would be too costly to the City to align a street that will eventually dead-end at Garden Grove Boulevard . It will also be a costly, expensive impact on the surrounding environment . PC Minutes - 2/19/86 -4- (4290d ) There were no other persons to speak for or against the project and the Public Hearing was closed. Les Evans responded to some of the questions of the Commissioners . He stated that the width of the alignment right-of-way was 80 feet . The main problems would be getting under the freeway bridge. Even though there is a 115 foot span, the railroad is in the middle of the span . If the span needs to be widened or the underpass reworked, the City would be faced with spending millions of dollars . The only place that they would consider narrowing would be the underpass . It would be cheaper to acquire the property bare, today, then to wait until something else is built . " Relocation of the transmission towers would not be necessary. The right-of-way would be crossed but would not take up that much room. There would be no adverse impact to our circulation by realigning Gothard, it ' would not make it any better or any worse, according to Mr . Evans . The road can be built from Center to McFadden for about one half million dollars . There would be about $100 ,000 in signal modifications . A total of approximately $700 ,000 (not including acquisition of the Edison right-of-way) would be the cost, he added. Cal Trans has been contacted and they have indicated that it is feasible that on/off ramps. on Gothard would help with traffic problems . This area of Gothard handles about 16 ,000 vehicles per day and it could handle 40 ,000 vehicles per day . The on/off ramps are very possible. Commissioner Porter asked how the City proposed to spend money outside of the City limits or redevelopment area since the majority of the expense is not in the construction in the street but to the modification to the overpass and rail alignment . He felt that two actions were in order . First to approve the negative declaration and then to table the alignment proposal until such time that the City of Westminister and the City of Huntington Beach can reach some decision of what they plan to do. Staff recommended that an action of denial be considered, since they would like to get this proposal up to the City Council so that acquisition of property for the right-of-way could be started. Commissioner Rowe stated that if we were going to Gothard as a means of alleviating traffic problems , it is far more desirable to do it now while it is vacant land instead of increasing the cost when we might have to remove buildings or structures . An investment now can turn out to be wise in terms .of preparing the ways for the future when it might be well more costly. He felt that serious consideration should be given to the precise alignment of Gothard as recommended. Previously, the Planning Commissioners received a copy of a report entitled, "The Bolsa Chica Linear Regional Park Boundary Study" prepared by the Orange County Environmental Management Agency. This document set forth the goals and objectives of the linear park and inventoried each of the twelve parcels of land which will eventually become the linear park . The County did not have a precise boundary for parcels 2, 4 and 5, owned by the Huntington Beach Company . After meeting with representatives of the Huntington Beach Company, touring the site and analyzing topographic maps , staff developed a "Conceptual Boundary" for the linear park . Factors which influenced the location of the proposed conceptual boundary included o Adequate width of the park on top of the bluff to accommodate a minimum of two recreational trails ( 4% grade for trails desired) o Buffer areas surrounding each oil operation o Inclusion of areas which offer scenic vista points which overlooking the Bolsa Chica o Inclusion of large, relatively flat areas which may be suitable for parking or staging facilities o Adequate setbacks from the bluff faces The'. linear park , as proposed by staff, encompasses approximately 120 acres of land . Green NOES: Councilmen: Thoma�; NOT VOTING : Bailey ABSENT: Councilmen: MacAllister J � City Cleri: and ex-officic C'_eri: of the City Council of the City of Huntington. beach, California R ORDINANCE NO. 2827 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING DISTRICT MAP 15 TO INCLUDE PRECISE PLAN OF STREET ALIGNMENT NO. 85-2 TO REALIGN GOTHARD STREET SOUTH OF MCFADDEN AVENUE WHEREAS, pursuant to the Planning and Zoning Law, particularly California Government code sections 65453 et seq. , the Planning Commission of the City of Huntington Beach,,after notice duly given, held a public hearing on December 17, 1985 to consider Precise Plan of Street Alignment No. 85-2 to move that portion of the existing centerline of Gothard Street, extending six hundred ( 600) feet south of McFadden Avenue, approximately 250 feet; and On MArrh 17 , 1Q96 1986, after notice duly given, hearing was held before this Council, and the matter having been considered, the Council finds that said Precise Plan of Street Alignment No. 85-2 is reasonably necessary to the orderly and efficient flow of traffic, for the preservation of the health and safety of the inhabitants of the city, and for the orderly development of the community. ,a. NOW, THEREFORE, the City Council of the City of Huntington Beach does resolve as follows: SECTION 1. That the real property hereinafter described and shown on the map marked Exhibit A, attached hereto, incorporated herein and by this reference, is hereby designated and adopted as Precise Plan of Street Alignment No. 85-2 of the City of Huntington Beach: Beginning at the southwest corner of Parcel 1, as shown on a map recorded in Book 169, pages 45 and 46, Parcel Maps, said corner being the beginning of a curve concave southeasterly and having a radius of 500.00 feet; thence northerly and easterly along said curve through a central angle of 45000 ' 00" . An arc - distance of 392 .70 feet to a point on a tangent line; thence north 44020 '07" , east 271. 52 feet along said tangent line to a point on a tangent curve,- said curve being concave to the northwest and having a radius of 895.00 feet; thence easterly and northerly along said curve through a central angle of 44059' 42" , an arc distance of 702 .85 feet to a point on a tangent line; thence north 0039 ' 35" west 140.34 feet along said tangent line to the point of termination. SECTION 2 . District Map No. 15 (Sectional District Map 14-5-11) is hereby amended to show the realignment of that portion of the existing centerline of Gothard Street, extending six (600) feet south of McFadden Avenue, by moving such centerline approximately 250 feet.
