Statement of Issue: Should the City Council adopt a resolution to enable the City's Police
Department to enforce provisions of the California Vehicle Code on private streets in the
Greystone Keys Maintenance Association?
Funding Source: The associated cost to provide these services is expected to be nominal
and can be absorbed by the Police Department's annual operating budget. Enforcement on
these streets will be upon request.
Recommended Action: Motion to: Adopt Resolution NO.�Gb/—a✓ to enable the City's
Police Department to enforce provisions of the California Vehicle Code on private streets in
the Greystone Keys Maintenance Association.
Alternative Action(s): Do not support the adoption of a resolution or suggest another
course of action.
Analysis: On January 23, 2001, Trelane Sankhar, Community Association Manager with
Keystone Pacific Property Management, transmitted the petition of Greystone Keys
Maintenance Association requesting city enforcement of private streets. As shown in
Attachment 2, all members of their Board of Directors have signed this petition. In a
subsequent discussion, Ms. Sankhar advised us of the Board's desire for enforcement of
parking rules and regulations. Additionally, she advised us that the Greystone Keys

Maintenance Association owns all the private streets and the parking areas within their
community.
California Vehicle Code Section 21107.7 enables a city to apply the Code's provisions to
private streets by following the designated procedure. This section initially requires the filing
of a petition requesting this action, with this petition supported by a majority of the Board of
Directors responsible for the private streets. Next, the city holds a public hearing on the
request. Written notices are sent to the owners of the private streets and parking areas in
the development 10 days prior to the public hearing. After adoption of the resolution or
ordinance, appropriate signs and markings must be installed before enforcement may begin.
Greystone Keys is-located in the area between Ellis Avenue, Main Street, Gothard Street and
Delaware Street as shown on Attachment 3. Entry gates control access to these private
streets from the end of Sea Gate north of Promenade Parkway and there is an emergency
access from the end of Huntington Street north of Main Street.
Public Works Department and Police Department staff met on March 13 to discuss this
matter and have no objections to this request. Currently, there are several associations in
the City with private streets that have gone through this process. Following City Council
approval, staff has worked with these various associations to review their signing and
markings to ensure that they meet the prescribed standards. After appropriate signing and
marking is installed, enforcement is provided in response to specific requests on a case-by-
case basis. When called, Police Department officers enforce all provisions of the California
Vehicle Code, not just parking rules and regulations. Staff members from both departments
will assist Greystone Keys as may be necessary throughout this process.
The City Attorney's office has drafted the appropriate resolution for consideration by the City
Council. Public Works staff provided a notice of the public hearing to the Greystone Keys
Maintenance Association at least 10 days prior to the City Council public hearing.
Public Works Commission Review: The Public Works Commission unanimously approved
the recommended action at its regular meeting held March 21, 2001.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH AUTHORIZING THE HUNTINGTON BEACH
POLICE DEPARTMENT TO ENFORCE CALIFORNIA VEHICLE
CODE PROVISIONS ON PRIVATE STREETS IN THE
GREYSTONE KEYS CONDOMINIUM COMPLEX
WHEREAS, the Greystone Keys Maintenance Association (hereinafter"Greystone") has requested
assistance of the City of Huntington Beach to enforce provisions of the California Vehicle Code on the
private streets within the Greystone Condominium complex; and
The City Council finds that the streets in the.Greystone Complex are not generally held open for
public use,but by reason of their proximity to public streets, the interests of the residents and motoring
public will be best served by application of the California Vehicle Code to those streets; and
California Vehicle Code §21107.7 requires a petition signed by a majority of the owners be
submitted,requesting the City's assistance in enforcing the Vehicle Code; and
On January 23, 2001 Greystone transmitted its petition to the Public Works Commission which
approved said action; and
California Vehicle Code §21107 requires notice of the proposed enforcement be given to the owners
of the private streets, and notice has been given as required by Code; and
A duly noticed public hearing was held on 05-07-01
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that
it finds and declares that after the installation of appropriate signage and markings, the privately owned and
maintained roads in the Greystone Condominium Complex located between Ellis Avenue, Main Street,
Gothard Street and Delaware Streets are hereby subject to the application of the provisions of the California
Vehicle Code.

THIS PETITION OF GREYSTONE KEYS MAINTENANCE ASSOCIATION
REQUESTING CITY ENFORCEMENT OF PRIVATE STREETS ("Petition") is dated this 3`d
day of January, 2001.
WHEREAS, the Greystone Keys Maintenance Association ("Association") desires to
submit this Petition in order to request that the City of Huntington Beach, a municipal
corporation ("City"), by ordinance or resolution, find and declare that the privately owned and
maintained roads within the City and the interests of the residents residing along the roads and
the motoring public, by reason of their proximity to or connection with highways, will best be
served by application of California Vehicle Code (C.V.C) § 21107.7 to those roads.
NOW, THEREFORE, BE IT RESOLVED that this Petition was regularly introduced and
adopted by the Board at a duly notified regular meeting held on the 6th day of December 2000.
RESOLVED FURTHER, that the decision to file this Petition with the City was made by
a unanimous vote of the Board.
RESOLVED FURTHER, that in accordance with C.V.C. § 21107.7, the Association gave
the owners of the road or all owners in the Association development ten(10) days' prior written
notice of the decision to file this Petition with the City;

RESOLVED FURTHER, that the Association acknowledges and understands that
pursuant to C.V.C. § 21107.7, the City may impose reasonable conditions and may authorize the
Association to erect traffic signs, signals, markings, and devices which conform to the uniform
standards and specifications adopted by the Department of Transportation and/or City
regulations governing the same.
RESOLVED FURTHER, that the foregoing named persons are the officers of the
Association, duly elected or appointed, qualified and acting as such, and that the signatures set

IN THE GREYSTONE KEYS MAINTENANCE ASSOCIATION AREA
Notice is hereby given that a public hearing will be held by the City Council of
the City of Huntington Beach in the Council Chambers of the Civic Center,
Huntington Beach at the hour of 7:00 p.m., or as soon thereafter as possible on
Monday, the 7'" of May, 2001 for the purpose of considering adoption of a
resolution to enable the City's Police Department to enforce California Vehicle
Code Provisions on the private streets within the Greystone Keys Maintenance
Association Area, which is located in the vicinity of Main Street and Promenade
Parkway.
A complete report detailing this matter is available for review by the public at
City Hall, 2000 Main St. in the City Clerk's office between the hours of 8:00 a.m.
and 5:00 p.m. Monday through Friday. Interested persons may also contact the
