Recommendation: Approve the request made by the homeowners of Seacliff on the Greens for enforcement of vehicle code violations on their privately owned streets. Analysis: Traffic congestion has been experienced in some of the areas in which enforcement is requested creating a hazard to vehicles and pedestrians and obstructing access for emergency vehicles. Therefore, it has become necessary to prohibit parking. A written request for%adoption of such a resolution was received from the Board of Directors of the Seacliff on the Greens Community Association. COMMANDER Subject CVC ENFORCEMENT ON PRIVATE Date MARCH 27, 1992 STREETS The City Council has authorized the Police Department to enforce the Vehicle Code on the private streets. within the following private communities. BEACHWALK/HUNTINGTON SEACLIFF (17th and Palm) Resolution 4938. DEL WAY TOWNHOUSES (17th and Delaware) . Resolution 4998. HUNTINGTON VILLAGE LANE (Old World) Resolution 4809. LA CUESTA RACQUET CLUB (Delaware & Memphis) Resolution 4998. VILLA PACIFICA (Brookhurst) Resolution 3330 FERNHILL (Warner & Graham) Resolution 5654 At this time there is no mechanism in' place to allow us to accurately separate the numbers of parking and/or CVC violations ticketed in these private communities versus the balance of the city. However, Karen Peterson, Parking Control Supervisor, and Lt. Parker, Traffic Bureau Commander, have informed me that requests for enforcement of CVC violations rarely occur. They could only recall in the past few years once or twice being requested by the private communities to provide CVC enforcement. The overwhelming majority of their requests are for parking enforcement. Ms. Peterson's estimate for the number of parking tickets generated in these communities, compared to the total parking enforcement effort, comprises less than one percent. The vehicle Code Section 21107.7 (a) that regulates authority for enforcement on private streets reads ,in part . . . . Any city may declare that there are privately owned and maintained -roads as described in the resolution within the city that are not generally held open for use of the public for purposes of vehicular travel but, by reason of their proximity to or connection with highways, the interests of any residents residing along the roads and the motoring public will best be served by application of the provisions of this code to those roads. The Police Department supports this concept. The minimal impact enforcement requests from private complexes have on our ability to serve the general motoring public, far outweighs the benefits to the Department by being able to enforce the Vehicle Code within the community. This ability I1 4 Page Two CVC ENFORCEMENT ON PRIVATE STREETS March 27, 1992 allows us the probable cause to stop suspicious cars within these complexes and to generate selective enforcement in the complexes that occasionally become "short cuts" to the public highways. Certainly if a private community's request for enforcement is predicated solely on a need for citing speeding vehicles or other types of moving violations, we would suggest to them, as we did in the case of the Fernhill Complex, they install speed bumps. But as stated before, the vast majority of these infrequent requests for enforcement relate to parking problems which, in turn', cause little effort for us to enforce. The issues which have arisen are as follows: 1. I spoke with the attorney's office and determined that the request for legal services on the resolution was assigned to Bill Sage. He is -not in today, and I am told by secretarial staff . that the resolution is unlikely to be prepared by Monday''. agenda review. 2. Connie Brockway returned the RCA suggesting that a public hearing might be required and requesting that we get a legal opinion on this prior to placing it on the agenda. 3. Mr. Uberuaga has asked that the analysis of the RCA include the approximate projected cost for providing this enforcement. Given the nature and extent of the concerns, I thought it would simplest to pull the item temporarily so that we can resolve them. Please let me know if you have any questions or concerns. Thanks. Beachwalk Homeowner's Association has enjoyed excellent relationship with- the Huntington Beach City Council, the Huntington Beach Police and Fire Departments and administr- ative. offices and services. Cooperation by all parties has been outstanding in the past. OBJECTIVESs Beachwalk is seeking the protection of and enforcement of the California Vehicle Code. The same pro- tection now afforded perhaps 95% of the citizens of Huntington Beach. We are not petitioning for something new. The City Council. enacted a similar ordinance for Villa Pacific via Resolution No. 3370. We are not asking for, nor do we want, additional Police patrols or for parking monotoring. The proposed resolution would have minimal fiscal impact on the City, but will have a positive impact on 1500 concerned voters residing in Beachwalk. The Huntingbn Beach Police Department DOES NOW respond in a very timely manner, but the patrolmen are frustrated when they arrive. . .they are unable to do their job of enforcing the California Vehicle Code. By virtue of the power and authority in the Beachwalk C .C.&' R's (Covenants, Conditions and Restrictions) , we can and do actively monitor apparent violations by Homeowners and Beachwalk residents, BUT are powerless to protect lives and property from outside disturbing influences caused by violators of the California Vehicle Code. Wentworth City Clerk Page #9 - Council Minutes - 11/17/80 PUBLIC HEARING - COASTAL ELEMENT - OPENED AND CONTINUED TO 12/1/80 The Mayor announced that this was the day and hour set for a public hearing to consider the Coastal Element, a proposed addition to the General Plan which indicates the kinds, location and intensities of land uses in the City's coastal zone. The City Clerk announced that all legal requirements for publication and posting .had been met, and that she had received no communications or written protests to the matter. . The. Mayor stated that public input would be accepted at this meeting and on December 1 , and December 8, 1980. She stated that at this meeting the City Council would accept testimony only on that part of the coastal zone from Golden- west Street to the City' s northern boundary; the December lst hearing would cover the area from Beach Boulevard to the Santa Ana River; that December 8th would cover the downtown area and general comments on the coastal zone as a whole and further that final action on the Coastal Element would take place on December 15th. June Catalano, Senior Planner, gave background information regarding the coastal zone located between Goldenwest Street and the City's northern boundary. She presented viewgraphs depicting planning analysis in the area of concern. The Mayor declared the public hearing open. Jack Chalabian spoke regarding his piece of property that he had been trying to develop commercially and cited difficulties he had encountered. Peter Green, President of Amigos de Bolsa Chica, .suggested that Council accept the recommendation of the Citizens Advisory Committee as it relates to the Bolsa Chica. Ed Zschoche encouraged support of the Local Coastal Committee in this area. Council directed staff to study the matter of Jack Chalabian's property and bring it back to Council for further consideration. On motion by Pattinson, second MacAllister, Council continued the open public hearing to December 1 , 1980 by unanimous vote. Councilman Pattinson requested the City Clerk to prepare a tape for him of the meeting to be held December 1 , 1980. Oliver Roney stated that 90% of the speeders in that area were form outside of Beachwalk, that he believed a gate would be impractical due to traffic congestion and that if Council approved their petition, -the street signs' would be taken care of by their association. She stated that because her name was Langenbeck, she was beginning to feel embarrass- ment regarding the publicity surrounding the Park. She requested that Council get the park started and finished. Amy Yoshihara spoke regarding the farming on the Edison portion of the land. Arden Pratt displayed a wall map depicting homes and the proposed park. Trudy Witham spoke regarding development of the total eighteen acres of the park. Carol Caruthers requested that Council approve the design plan and authorize the landscape architectural firm to complete the working drawings and specifications. Lynne Bolding spoke regarding the dirt mound at the Pacific Mobile Park and requested Council s assistance in the matter. The Acting City Administrator gave a report on the matter and stated that the company should start moving the dirt Wednesday. Pat Dunn stated that he represented the builder and assured Council that barring wind or rain, removal of the dirt mound would commence Wednesday. Frank Pollack stated that he believed there should be some type of control over a developer that stored soil for future use. RESOLUTION N0. 4938 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DECLARING PRIVATELY-OWNED STREETS IN BEACHWALK/HUNTINGTON SEACLIFF TRACTS SUBJECT TO PROVISIONS OF STATE VEHICLE CODE WHEREAS, there has been filed with the City of Huntington Beach a petition , signed by a majority of owners of the roads in Beachwalk/Huntington Seacliff, Tracts 7155, 7473, 8003, 8224, 8247 and 8248, city of Huntington Beach, County of Orange, State of California, requesting this Council to declare the privately- owned streets in such tracts to be subject to provisions of the California Vehicle Code; and Pursuant to California Vehicle Code section 21107.7 , public hearing was had before this Council after ten day' s written no- tice duly given to all owners of such roads; and The City Council finds that those streets and roads within such Beach/Huntington Seacliff development, generally located between Palm Avenue on the south, Seventeenth Street on the east, Yorktown Avenue on the north, and Goldenwest Street on the west , are privately-owned and maintained and not generally open to the public for purposes of vehicular travel, but by reason of the proximity to and the connection with highways , the interests of residents residing along such roads and the motoring public will best be served by an application of the provisions of the California Vehicle Code to such roads; and The Beachwalk Homeowners' Association has agreed to purchase and install the signs required by California Vehicle Code sec- tion 21107.7 at no expense to the city, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that it finds and declares that the privately-owned and maintained roads in Beachwalk/Huntington CM: ahb 6/26/80 1 . Seacliff, Tracts 7155 , 7473, 8003, 8224, 8247 , and 8248, namely those streets and roads located within the Beachwalk/Huntington S eacliff development, are hereby subject to application of the provisions of the California Vehicle Code .
