BEARDSLEY, PE, DI� OF PUBLIC WOR SUBJECT: Adopt Resolution Approving Grant Funding Agreement for the Irby Park Runoff Treatment Project and Appropriate Matching Funds S tatement of Issue,Funding Source,Recommended Action,Alternative Action(s),Analysis,Environmental Status,Attachment(s) Statement of Issue: The City of Huntington Beach applied for and received a $1,875,000 competitive Proposition 40 Grant from the State of California for a project that will divert and treat urban runoff at the Irby Park site. A resolution approving the Agreement and authorizing a City representative to sign related documents is required. Funding Source: 1. The State will award $1,875,000 for the Irby Park Runoff Treatment project. Grant funds and offsetting revenue will be appropriated to the project account. 2. A 25% grant match amount totaling $625,000 is required. Anticipated grant funds for the city match are not available at this time. An appropriation of $155,000 from the General Fund undesignated reserve is requested for FY 2006/07. The balance of $470,000 in construction funds will be required in FY 2007/08. s. Funds will be appropriated to Water Quality Grants, Irby Park Runoff Treatment, Drainage Improvements, 89288006.82500. Recommended Action: Motion to: 1. Adopt Resolution No. 2 0 0 6-7 8 , A Resolution of the City Council of the City of Huntington Beach Approving the Proposition 40 Nonpoint Source Pollution Control Grant Agreement with the State of California for the Irby Park Runoff Treatment Project. 2. Appropriate $155,000 from the General Fund reserve to the project account. 3. Appropriate $1,875,000 to the project account, and increase estimated revenues by $1,875,000 to the Water Quality Grant Fund from the State of California, 89200892.46160. Alternative Action(s): Deny approval of the resolution. This action will result in the forfeiture of $1,875,000 Proposition 40 grant funds for the Irby Park Runoff Treatment Project. REQUEST FOR CITY COUNCIL ACTION MEETING DATE: 12/18/2006 (DEPARTMENT ID NUMBER: PW 06-070 Analysis: The Irby Park Runoff Treatment project will divert up to 800,000 gallons per day of polluted dry weather urban runoff from the East Garden Grove Wintersburg Channel (EGGWC) and local drainage areas through pre-treatment devices, into a city-owned 7-acre parcel for natural treatment provided by an engineered wetland and enhanced infiltration system. This project will provide multiple benefits to the region, including the protection of receiving waters, enhancement of local flood retention capacity during wet weather, groundwater recharge, habitat value, aesthetic value and education opportunities. The EGGWC is a County-controlled, regional channel that drains up to 7 million gallons per day of urban runoff from a 22 square-mile watershed extending as far northeast as the cities of Orange and Anaheim. The channel discharges into the lower Bolsa Chica wetlands, Huntington Harbour, Anaheim Bay and, ultimately, the Pacific Ocean. The State Water Quality Control Board has designated Huntington Harbour and Anaheim Bay as 303(d) listed impaired waterbodies due to urban runoff,storm sewers and unknown sources, which means that the City is subject to 'impending enforcement action to help facilitate abatement measures. The project will divert urban runoff from the local drainage area and channel into a treatment area to remove pollutants and prevent them from impacting receiving waters. The goal of the project is not to route the treated runoff back into the receiving waters but, instead, to completely utilize it for beneficial uses in the Irby Park area. The proposed project's primary treatment technology is the use of a Natural Treatment System (NTS), also referred to as a constructed wetland. A NTS is an area that receives a constant water source with vegetated coverage and pool areas of varying depths. Beneficial uses may consist of groundwater recharge, passive recreation and new wetlands areas. The Irby Park Runoff Treatment project will need to comply with the California Environmental Quality Act (CEQA) and a negative declaration will be requested. Project components may include a channel diversion structure, pump station, control system, conveyance piping, pretreatment, NTS, groundwater recharge enhancements and an educational exhibit. The NTS design will consist of permanent, shallow ponds that support the growth of emergent wetland plants as well as deeper open water areas. The final site design may include modifications to reflect the change in wetland treatment science. The intent of the design will be to incorporate native grasses, shrubs and trees to create a natural environment. Enhancements will likely be limited to a'perimeter walking trail and other passive uses. It must be emphasized that this project is still in the conceptual phase and, once funding is received, a consultant will be hired to refine and develop plans using the most current and successful treatment technology. Ongoing maintenance costs will be determined upon completion of the design phase. The City of Huntington Beach will provide 100% of the match required for this grant. It is anticipated that the source for the match will be the Federal Water Resources Development Act Bill currently waiting approval in Congress. Other possible sources include various EPA and state funding opportunities. If grants are received, the General Fund would be reimbursed for incurred expenses. Funding must be in place by the end of the calendar year to secure the $1,875,000 grant. Fiscal Impact Statement: Per Council action, a new appropriation must meet one of the following three criteria: 1. It is an unanticipated emergency, 2. It is required to implement labor negotiations, or 3. It is a new expense that is offset by related new revenues. This new appropriation meets criteria# 1, an unanticipated emergency because (1) it needs to be approved prior to the end of the calendar year 2006 and (2) the anticipated matching Federal funds that were envisioned when the grant was submitted have been delayed in Congress. Public Works Commission Action: Not required. Environmental Status All required environmental analysis and compliance for this project will be accomplished upon design completion and construction authorization.
