September 16, 2013 adopted Resolution No. 2013-50 — A Resolution of the City Council
of the City of Huntington Beach Ordering the Summary Vacation of That Certain Excess

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH
ORDERING THE SUMMARY VACATION OF THAT CERTAIN EXCESS RIGHT-OF-WAY
EASEMENT GENERALLY LOCATED EAST OF MAIN STREET AND SOUTH OF
SPRINGFIELD AVENUE (CHAPMAN, 1746 MAID
WHEREAS, the City Council of the City of Huntington Beach wishes to summarily
vacate an easement which is excess right-of-way and is not required for street or highway
purposes pursuant to California Streets and Highways Code Section 8334(a); and
On June 25, 2013, a public meeting was held before the Huntington Beach Planning
Commission at which time it was determined,pursuant to Government Code Section 65402, that
the proposed summary vacation of the excess public right-of-way easement described herein
conformed to the City's General Plan; and
Said right-of-way is comprised of a 48 square foot right-of-way easement located at the
northwestern comer of an existing residential parcel, east of Main Street, south of Springfield
Avenue.
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
resolve as follows:
1. Pursuant to Division 9, Part 3, Chapter 4 of the California Streets and Highways
Code, commencing with Section 8334(a), the City Council of the City of Huntington Beach
hereby orders the vacation of the excess Main Street right-of-way easement located east of Main
Street, south of Springfield Avenue.
2. The right-of-way easement hereby vacated was granted to the City of Huntington
Beach by that certain Easement Deed recorded on November 21, 2008 as Instrument No.
1

SUBJECT: Adopt Resolution No. 2013-50 and 2013-51 ordering the Summary Vacation of
certain excess public right-of-way Easements generally located East of Main
Street and South of Springfield Avenue (Chapman, 1746 Main), and East of
Main Street and North of Springfield Avenue (Cullum, 1802 Main)
Statement of Issue: Pursuant to Division 9, Part 3, Chapter 4 of the California Streets and
Highways Code, commencing with Section 8334(a), the Department of Public Works requests that
the City Council adopt a resolution ordering the Summary Vacation of excess right-of-way
easement at 1746 Main Street and at 1802 Main Street.
Financial Impact: No funding required for this action
Recommended Action:
A) Adopt Resolution No. 2013-50, "A Resolution of the City Council of the City of Huntington Beach
Ordering the Summary Vacation of that Certain Excess Public Right-of-Way Easement
Generally Located East of Main Street and South of Springfield Avenue (Chapman, 1746
Main);" and,
B) Adopt Resolution No. 2013-51, "A Resolution of the City Council of the City of Huntington Beach
Ordering the Summary Vacation of that Certain Excess Public Right-of-Way Easement
Generally Located East of Main Street and North of Springfield Avenue (Cullum, 1802 Main);"
and,
C) Direct the City Clerk to record Resolution No. 2013-50 and Resolution No. 2013-51 with the
Orange County Recorder.
Alternative Action(s): Deny the recommended action.
Analysis: Right-of-way easements on two small triangular shaped private properties at 1746 Main
Street and 1802 Main Street, both located behind the corner intersection of Main and Springfield,
were originally dedicated to the City of Huntington Beach for public use per Easement Deeds in the
Orange County Recorder's Office. Both areas are approximately 48 square feet and were
dedicated at no cost to the City. The easements are no longer needed by the City due to design
changes during the recent construction of the Main Street Rehabilitation Project, CC-1397 in 2012.
To remove the City's liability from these excess right-of-way easements and to allow the underlying
fee owners unencumbered use of the properties the Department of Public Works filed an application
with the City's Planning Department to initiate the vacation process. On June 25, 2013, the
Planning Commission adopted Resolution No. 1671 approving General Plan Conformance No. 13-

WHEREAS, the City Council of the City of Huntington Beach wishes to summarily
vacate an easement which is excess right-of-way and is not required for street or highway

On June 25, 2013, a public meeting was held before the Huntington Beach Planning
Commission at which time it was determined,pursuant to Government Code Section 65402, that
the proposed summary vacation of the excess public right-of-way easement described herein
conformed to the City's General Plan; and
