SUBJECT: Adopt Resolution No. 2014-30 ordering the Summary Vacation of portions of
several easements in the Brightwater Development due to the reconfiguration of
Ashville Drive
Statement of Issue:
Pursuant to Chapter 4 of the California Streets and Highways Code, the Public Works Department
requests that City Council adopt a Resolution to summarily vacate portions of easements in the
Brightwater Development affected by the proposed reconfiguration of Ashville Drive.
Financial Impact:
Not Applicable.
Recommended Action:
A) Adopt Resolution No. 2014-30, "A Resolution of the City Council of the City of Huntington Beach
Ordering the Summary Vacation of Portions of Several Easements Due to the Reconfiguration of
Ashville Drive" in the Brightwater Development; and,
B) Instruct the City Clerk to record said Resolution (and attachments) with the Orange County
Recorder.
Alternative Action(s):
Deny the recommended action. This would preclude the developer from processing a series of Lot
Line Adjustments necessary for the proposed reconfiguration of Ashville Drive.
Analysis: The Final Tract Map (FTM) for the Brightwater Development (Tract 17034, Attachments 1
and 4) shows Ashville Drive connecting to Hampton Lane, which extends into the adjacent
Sandover Tract (Tract 15734, Attachment 2). Sandover is a gated community. The developer also
intended for Brightwater to be a gated community. However, the California Coastal Commission
ruled that the Brightwater Development could not be gated. Connecting Ashville Drive (un-gated
community) to Hampton Lane (gated community) then became no longer desirable, since such a
connection would breach the security of the gated Sandover community.
The process of "disconnecting" Ashville Drive from Hampton Lane involves the reconfiguration of
Ashville Drive to end in a cul-de-sac. To accomplish this reconfiguration, certain lots along Ashville
Drive also then need to be reconfigured, through a series of mapping lot line adjustments (LLAs)
which would be processed by the developer through the County. These LLAs cannot be processed
until the affected underlying easements (for public utilities, pedestrian and emergency access) are
vacated by the City. Some of these easements (shown on Attachment 3) were originally dedicated

by the developer to the County of Orange and others were dedicated to the City, but all have since
been acquired by the City with the annexation of the Brightwater Development. It is important to
note the easements in question are "paper" easements only, and have not been used for roadway
or other purposes since their creation, which is the reason a summary vacation is appropriate at
this time.
The Public Works Department is requesting that City Council adopt a Resolution (Attachment 3) to
summarily vacate portions of the easements affected by the reconfiguring of Ashville Drive. Upon
completion of these easement vacations, the LLAs will be processed and new City easements over
the new street alignment and newly configured residential lots will be reestablished and recorded.
Public Works Commission Action:
Not required.
Environmental Status:
The proposed project is categorically exempt pursuant to Class V: Alterations in Land Use
Limitations, sub-section (a) minor street, alley and utility easement vacations, of Resolution No.
4501 of the City of Huntington Beach.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH ORDERING THE
SUMMARY VACATION OF PORTIONS OF SEVERAL EASEMENTS
DUE TO THE RECONFIGURING OF ASHVILLE DRIVE
WHEREAS, the City Council of the City of Huntington Beach wishes to summarily
vacate portions of several easements due to the reconfiguring of Ashville Drive,
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
resolve as follows:
1. Pursuant to Division 9, Part 3, Chapter 4 of the California Streets and Highways
Code, commencing with Section 8333, the City Council of the City of Huntington Beach hereby
orders the summary vacation of portions of several easements for various public purposes
generally located in the vicinity of Ashville Drive and more particularly described on Exhibits A
and B attached and incorporated herein by this reference.
2. The City Council does hereby confirm that the portions of the easements herein
vacated have been superseded by relocation and that there are no other public facilities located
within the portions of the easements.
3. The City Council hereby declares that from and after the date of the recordation of
this resolution that the portions of the easements herein identified shall no longer constitute
public service easements.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a
regular meeting thereof held on the 7th day of July , 2014.
