OF A PORTION OF CORAL CAY LANE NORTH OF
DLUFNATER LANE
MIEREAS, on May 18, 1992. the City Council of the City of
Ifuntington Beach duly adopted Resolution No. 6304 declaring its
intention to vacaLe a portion of Coral Coy Lane North of
Bluewater Lane, and referring to maps and plans on file in the
office of the City Clerk for particulars as to the proposed
vacation; and
Said resolution fixed the time and place of June 15. 1992,
at the hour of 7:00 p.m., or as soon thereafter as the matter
could be heard, in Lhe Council Chambers in the Civic Center,
for hearing all persons interested in or objecting to the ,
proposed vacation, which time was not less than fifteen (15)
a
days from the passage of this resolution. Notices of vacation
were posted conspicuously along the street section proposed for
vacation, and such notices were posted not more than three
• htindred (300) feet apart and at least three (3) were posted.
On June 15, 1992, at the hour of 7:00 p.m., in the Council
Chambers in the Civic Center, the City Council of the City of
Huntington Beach slid convene for the purpose of hearing all
persons interested in or objecting to the proposed vacation of j
a portion of Coral Coy Lane north of Bluewater Lane, at which
time no acceptable objection was matte to said vacation, and
evidence was presented showing that said easement Is not

necessary for present or prospective public use and is not
suitable for use or development as bicycle paths or routes .
NOW, THEREFORE, the City Council of the City of Huntington
Beach, pursuant to Division 9, Part 3 , Chapter 3 of the
California Streets and Hiahways Code, commencing with section
8320, does resolve that an easement for public street purposes
over a portion of Coral Cay Lane north of Bluewater Lane, is
not necessary for present or prospective public use, and is not
suitable for use or development as bicycle paths or routes, and
it is hereby
ORDERED that the easement for public street purposes over a
portion of Coral Cay Lane is hereby vacated; and that the
section so vacated is more particularly described as follows :
Legal Description: :
That portion of Coral Cay Lane in the City
of Huntington Beach, County of Orange, State
of California, being a portion of Tract 8040,
recorded in Book 350, Pages 27 to 37
inclusive, of Miscellaneous Maps of said
County, more particularly described as
follows :
Beginning at the most Westerly corner of Lot
"E" of said Tract, thence N46 37 ' 26"E along
the Southeasterly Right of Way line of said
Coral Cay Lane 25. 00 feet to the True Point
of Beginning, thence N46 37 ' 26"E along said
Right of Way line 15 .00 feet to the
Southeasterly corner of the terminus of the
Public Right of Way line of said Coral Cay
Lane, thence N43 22 ' 34"W 100.00 feet to the

The City hereby reserves and excepts a permanent easement
and right at any time or from time to time to construct ,
maintain, operate, replace, remove and renew storm drains,
sanitary sewers, water mains and appurtenant structures in,
upon, over and across that portion of Ash Street containing for
public street purposes the easement proposed to be vacated, and
pursuant to any existing franchises or renewals thereof, or
otherwise to construct, maintain, operate, replace, remove,
renew and enlarge lines of pipe, conduits, cables, wires,
poles, and other convenient structures, equipment and fixtures
for the operation of gas pipelines, telegraphic and telephone
lines, railroad lines, and for the transportation or
distribution of electric energy, petroleum and its -products,
ammonia, water, and incidental purposes, including access and
the right to keep the property free from flammable materials,
wood growth, and otherwise protect same from all hazards in,
upon and over the easement for public street purposes proposed
to be vacated on Coral Cay Lane.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH ORDERING THE VACATION

WHEREAS, on May 18, 1992, the City Council of the City of
Huntington Beach duly adopted Resolution No . . 6384 declaring its `

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH PROVIDING. NOTICE OF
INTENTION TO VACATE AN EASEMENT FOR PUBLIC STREET
PURPOSES OVER A PORTION OF CORAL CAY LANE
NORTH OF BLUEWATER LANE
WHEREAS, the City of Huntington Beach owns an easement for
public street and right of way purposes over the real property
generally described as a portion of Coral Cay Lane north of
Bluewater Lane in the City of Huntington Beach; and
The City Council proposes to vacate said easement; and
On January 7, 1992, a public meeting was held before the
Planning Commission, at which time it was determined, pursuant
to California Government Code Section 65402, that the proposed
vacation of the easement described herein conformed to the
City' s General Plan,
NOW, THEREFORE, the City Council of the City of Huntington
Beach does hereby resolve as follows :
1. Pursuant to Division 9, Part 3, Chapter 2 of the
California Streets and Highways Code, commencing with Section
8320, the City Council of the City of Huntington Beach hereby
declares its intention to vacate an easement over a portion of
Coral Cay Lane, north of Bluewater Lane more particularly
described as follows :

Huntington Beach, County of Orange, State of
California, being a portion of Tract 8040, recorded
in Book 350, Pages 27 to 37 inclusive, of
Miscellaneous Maps of said County, more particularly

hour of 7: 00 p.m. , or as soon thereafter as the matter may be
heard in Council Chambers in the Civic Center, as the time and
place for hearing all persons interested in or objecting to the
proposed vacation, which time is not less than fifteen (15) days
from the passage of this resolution.
4 . The City Clerk is directed to cause a copy of this
resolution to be published in a weekly newspaper, published and
circulated in Huntington Beach for at least two successive weeks
prior to the time set herein for the public hearing.

5 . The Director of Public Works is directed to post, or
cause to be posted, notices of vacation conspicuously along the
easement proposed to be vacated at least two weeks before the
date of the hearing. The notices shall be posted no more than
300 feet apart, but at least three notices shall be posted. The
notices shall state the day, hour, and place of the hearing, and
shall refer to the adoption of this resolution of intention, and
shall include a map or plan showing the location of the portion
of the easement proposed to be vacated.

the 18th day of May 199 2 .

The Coral Cay Homeowners Association has requested the vacation of a fifteen (15) foot
strip at the north end of Coral Cay Lane above Blue Water Lane.
RECOMMENDATION:
Adopt the attached resolution ordering the vacation of said easement.
ANALYSIS:
On May 18, 1992, the City Council adopted Resolution No. 6384 declaring the intention to
vacate a segment of Coral Cay Lane and setting the required public hearing date for June
15, 1992. Final Council action, after the public hearing, is required to complete the
vacation process.
When this request was first made there was opposition from the adjacent Sea Harbour
Homeowners Association (SHHA). The Director of Public Works has since received
correspondence from the SHHA stating that they now support the proposed vacation as
beneficial to both associations.

public hearing for June Y, 1992.

ANALYSIS:
The Coral Cay homeowners have requested the vacation of a fifteen foot strip of Coral
Cay Lane which would allow them to modify the entrance to their complex. The request
has gone through the review process and all affected departments have found it acceptable.
On January 22, 1992, the Planning Commission found the proposed vacation to be in
conformance with the City's General Plan. This will be a complete vacation in that no
easements will be preserved.

'WHEREAS, the City of Huntington Beach owns an easement for
public -street and right of way purposes over the real property
generally described as a portion of Coral Cay Lane north of
Bluewater Lane in the City of Huntington Beach;• and
The City. Council proposes to vacate said easement; and
On January 7, 1992', a .public meeting was held before the
Planning Commission, at which time it was determined, pursuant '
to California Government Code Section 65402, that .the proposed
vacation of the easement described herein conformed'to the
City's General Plan,
NOW; THEREFORE, the City Council of the City of Huntington
Beach does hereby resolve as follows:

Honorable Mayor and City Council :
The residents of Coral Cay respectfully request the vacation of a
fifteen foot strip of Coral Cay Lane to enable us to rebuild and
relocate our gate house. The benefits to this request are:
* To improve the aesthetics of the gate house by adding
landscaping and a roof structure to protect the guard, residents
and guests from adverse weather conditions.
* To upgrade the gate house and to meet all current city codes
and standards.
* To protect the safety of all Coral Cay and Sea Harbour guests
and residents by moving the gate house to improve traffic
conditions and adding a stop sign on private property at no cost
to the city.
* To put this parcel of property on the tax rolls and enhance
property values in the surrounding area with an eventual
corresponding increase in taxes.
* There is no cost to the city and the request has gone through
the review process and all affected departments have found it
acceptable.
* We have all discretionary permits for the building and have
verbal plan approval pending the vacation of the property.
* We met with Sea Harbour HOA, the adjacent property owner, and
Jim Otterson, city traffic engineer, and all agree that the plan
submitted will improve traffic and safety concerns.
Attached are letters and drawings pertaining to this resolution.

At the request of the Coral Cay Homeowner's Association I have made a field review of the
proposed guardhouse relocation and its effects on traffic flow into and out of the development.
It is my opinion that relocation of the guardhouse will significantly improve traffic conditions
on Coral Cay Lane near Bluewater Lane. Relocation of the guardhouse will allow northbound
traffic entering Coral Cay Lane from Bluewater Lane to see the automatic gate opening and
closing, thus allowing the motorist. on Bluewater Lane to see vehicles approaching Bluewater
Lane. The present guardhouse location completely obstructs the view of the gate for northbound
traffic on Bluewater Lane. Traffic Engineering supports the relocation of the existing
guardhouse to the new location in the proposed vacation area of Coral Cay Lane. It is important
to note that the Coral Cay Homeowner's Association agreed to install a STOP sign for motorists
entering Coral Cay Lane from the development.

On March 16, 1992, the City Council adopted Resolution No. 6355 declaring the intention
to vacate the easement in question and setting the required public hearing for April 6,
1992. Final Council approval, after the public hearing, is required to complete the process.

STATEMENT OF ISSUE:
The adjacent homeowners have requested a vacation of fifteen feet of street right—of—way
on Coral Cay Lane north of Bluewater Lane.
RECOMMENDATION:
Adopt the attached resolution of intent to vacate said easement and schedule the required
public hearing for April 6, 1992.
ANALYSIS:
The Coral Cay homeowners have requested the vacation of a fifteen foot strip of Coral
Cay Lane which would allow them to modify the entrance to their complex. The request
has gone through the review process and all affected departments have found it acceptable.
On January 22, 1992, the Planning Commission found the proposed vacation to be in
conformance with the City's General Plan. This will be a complete vacation in that no
easements will be preserved.
FUNDING SOURCE•
None. No funds necessary.
ALTERNATIVE ACTION:
Deny the request and retain the easement.

INTENTION TO VACATE ANEASEMENT FOR PUBLIC STREET
PURPOSES OVER A PORTION OF CORAL CAY LANE
NORTH OF BLUEWATER LANE
WHEREAS, the City of Huntington Beach owns an easement for
public street and right of way purposes over the real property
generally described as a portion of Coral Cay Lane north of
Bluewater Lane in the City of Huntington Beach; and
The City Council proposes to vacate said easement; and
On January 7, 1992, a - public meeting was held before the
Planning Commission, at which time it was determined, pursuant
to California Government Code Section 65402, that the proposed
vacation of the easement described herein conformed to the
City' s General Plan,
NOW, THEREFORE, the City Council. of the City of Huntington
Beach does hereby resolve as follows:
1. Pursuant to Division 9, Part 3, Chapter 2 of the
California Streets and Highways Code, commencing with Section
8320, the City Council of the City of Huntington Beach hereby
declares its intention to vacate an easement over a portion of
Coral Cay Lane, north of Bluewater Lane more particularly
described as follows :

said Tract, thence N46 37' 26"E along the
Southeasterly Right of Way line of said Coral Cay

hour of 7: 00 p.m. , or as soon thereafter as the matter may be
heard in Council Chambers in the Civic Center, as the time and
place for hearing all persons interested in or objecting to the
proposed vacation, which time is not less than fifteen (15) days
from the passage of this resolution.
4 . The City Clerk is directed to cause a copy of this
resolution to be published in a weekly newspaper, published and
circulated in Huntington Beach for at least two successive weeks
prior to the time set herein for the public hearing .

5. The Director of Public Works is directed to post, or
cause to be posted, notices of vacation conspicuously along the
easement proposed to be, vacated at least two weeks before the
date of the hearing. The notices shall be posted no more than
300 feet apart, but at least three notices shall be posted. The
notices shall state the day, hour, and place of the hearing, and
shall refer to the adoption of this resolution of intention, and
shall include a map or plan showing the location of the portion
of the easement proposed to be vacated.

WHEREAS, the City of Huntington Beach owns an easement for
public street and right of way purposes over the real property gener-

Lane in the City of Huntington Beach; and
The City Council proposes to vacate said easement; and
On January 7, 1992, a public meeting was held before the
Planning Commission, at which time it was determined, pursuant to
California Government Code Section 65402, that the proposed
vacation of the easement ascribed herein conformed to the City's
General Plan,

CORAL CAY LANE
Coral Cay homeowners have requested a street vacation of fifteen feet of street
right-of-way on Coral Cay Lane. The matter was scheduled for public hearing on April 6,
1992. The request went through the review process by City departments and was found
acceptable. However, adjacent Sea Harbour homeowners have raised various concerns
relating to traffic impacts resulting from the proposed relocation of a guard house at the
entrance to Coral Cay Lane.
Staff has recommended to discontinue the public hearing until all matters and concerns
relating to the relocation have been settled.

2. The City Clerk is directed to maintain on file in the
office of the City Clerk maps or plans showing the particulars
of the proposed vacation, and reference is hereby .made to such
maps and plans for particulars as to said proposed vacation.
3. The City Council does hereby fix June 15, 1992, at the
hour of 7:00 p.m., or as soon thereafter as the matter may be
heard in .Council Chambers in the Civic Center, as the time and
place for hearing all persons interested in or objecting to the
proposed vacation, which time is not less than fifteen (15) days
from the passage of this resolution.
4. The City Clerk is directed to cause a copy of this

resolution to be published in a weekly newspaper, published and
circulated in Huntington Beach for at least two successive weeks
prior to the time set herein for the public hearing.
5. The Director of Public Works is directed to post, or
cause to be posted, notices' of vacation conspicuously along the
easement proposed to be vacated at least two weeks before the
date of the hearing. The notices shall be posted no more than

300 feet apart, but at least three notices shall be posted. The
notices shall state the day, hour, and place of the hearing, and i
shall refer to the adoption of this resolution of intention, and
shall include a map or plan showing the location of the portion
of the easement proposed to be vacated.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on
the 18th day of May 199 2 .
