A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF A WATERLINE EASEMENT_ ON THE WEST SIDE OF NICHOLS STREET, SOUTH OF WARNER AVENUE WHEREAS, the City of Huntington Beach desires to vacate an easement for waterline purposes on the west side of Nichols Street, south of Warner Avenue, NOW, THEREFORE, :the City Council of the City of Huntington Beach does hereby."resolve as follows : 1. Pursuant to Division 9 , Part 3 , Chapter 4 of the California Streets. and Highways Code, commencing with Section 8333 , the City Council of the City of Huntington Beach hereby orders the vacation of a public service easement for waterline purposes located on the west side of Nichols Street, south of Warner Avenue. 2 . [ Yes [ ] New Policy or Exception i Statement of Issue, Recommendation,Analysis, Funding Source, Alternative Actions, Attachments STATEMENT OF ISSUE• The affected owner is requesting the vacation of an unneeded waterline easement located on the west side of Nichols Street, south of Warner Avenue. RECOMMENDATION: Adopt the attached resolution ordering a summary vacation of this easement. ANALYSIS- The Zoning Administrator, On July 22, 1992, approved the construction of a 100,000 square foot industrial building. The location of this building has resulted in a need to relocate a waterline and also the waterline easement. The easement and waterline were relocated and dedicated to the City. The old easement must now be vacated by Council action prior to construction of the building. FUNDING SOURCE: None. No funds necessary. ALTERNATIVE ACTION: Deny the request.
